CALL TO ORDER - PLEDGE OF ALLEGIANCE Mayor Hendrickson called the meeting to order at 7:00 p.m. 2. RECOGNITIONS – PRESENTATIONS – INTRODUCTIONS A. ABDO Presentation on Long Range Plan Kevin Knopik from Abdo, Eick & Meyers, LLP was at the meeting to present the long range plan. Knopik reviewed the assumptions identified and used for the plan as well as tax capacity, levy and projected taxes, bond debt, general and capital funds, and enterprise funds. Vetsch inquired about funding for the improvements for the wastewater treatment plant that are due in 2021. Nafstad stated they will need to bond for some of the project and currently they have started the required plan, but need discharge limits from the MPCA. He stated they may look at other options than the upgrade to the wastewater treatment plant. Sorensen inquired about the recycling fund balance. Lannes replied the fund will continue to grow over the next few years so they will have enough in the fund when the contract expires in 2021 to buy down any increases in fees if it occurs. 4. Second Amendment to Towne Lakes 6th Addition Developer’s Agreement Couri provided the history on the addition, stating that the development was fully platted but never built. Kilber Development Group currently owns the property as an investment group and is looking sell the property to a new owner. Couri stated that if they release the Letter of Credit for Kilber, they will need to require a new Letter of Credit from the new owner to ensure the improvements in the developer’s agreement are completed. Nafstad reported the new buyer is Henry Hanson with Onsite Solutions, Inc. based in Albertville. Couri explained there is only one other change to the developer’s agreement and that relates to dedication of right-of-way for construction of Large Avenue NE and agreement of the new owner to pay for half of the construction once Towne Lakes 7th Addition or Hunters Pass 3rd Addition are approved. Hansen stated he expects to close in September and was projecting full buildout in a three year time frame. He hopes to begin construction of a model home yet this fall. Motioned by Hudson, seconded by Sorensen, to approve the Second Amendment to Towne Lakes Planned Unit Development Agreement, Towne Lakes 6th Addition. Ayes: Hendrickson, Hudson, Sorensen, and Vetsch. Committee Updates (STMA Ice Arena, Planning, JPWB, Parks, Fire Board, FYCC, etc.) Hendrickson reported they have hired Eric Otte for the Manager position at the water treatment plant. 3). Parks Committee Notes of July 25, 2016 – No Action Needed Nafstad reported that the Committee is looking at new structures, greens, and walkways for Westwind Park. Hendrickson would like to see if park grants could be researched and pursued that could also address improvements at other City parks. B. Public Works/Engineering 1). Resurfacing of the Tennis Courts at Oakside Park Motioned by Vetsch, seconded by Sorensen, to approve resurfacing the tennis courts at Oakside Park, 10820 Kanter Court NE, for $12,450 and directing staff to contract for services with C&H Sport Surfaces. Ayes: Hendrickson, Hudson, Sorensen, and Vetsch. Nays: None. Absent: Olson. MOTION DECLARED CARRIED. 2). Main Avenue NE Railroad Crossing Nafstad stated that he had obtained quotes for the additional improvements to the Main Avenue NE railroad crossing. The improvements generally include sidewalk, street, curb, culvert replacement, and ditch grading. Quotes received range from $92,631 to $125,516. Sorensen was concerned with the increase in cost and felt the repair project is now much higher than was projected. Vetsch inquired if they could bid it out. Nafstad replied it would be difficult not knowing the Railway’s schedule. Vetsch stated that once it is completed, it would look much better and Nafstad stated it would be safer for pedestrians and better accommodate downtown activity. Motioned by Vetsch, seconded by Hudson, to direct staff to contract with Omann Bros. for the improvements associated with replacement of the Main Avenue NE railroad crossing in the amount of $92,631.61. Ordinance Amending the City Code Relating to Yard Waste Brixius reported staff has received several complaints of residents dumping yard waste near drainage easements and wetlands. Although staff has resolved the complaints through the nuisance code, staff is recommending that the code be amended to specifically and clearly prohibit this type of dumping. Nafstad stated that staff has been challenged on enforcement through the nuisance code, so they would like clear and concise language in the code to prohibit this activity. Tort Liability Insurance Renewal Lannes reported it is time to renew the City’s tort liability insurance. She stated there are several options when renewing tort liability: 1) City does not waive statutory limits, 2) City waives the statutory limits and does not have excess coverage, or 3) City waives the statutory limits and purchases extra coverage. She stated that the City has always done option three. She estimated the cost for the extra coverage to be approximately $2,500 this year and in previous years it was usually $500. Nafstad stated that the difference in costs from last year adds up to real dollars. Hudson stated that although it is nice to offer, he felt it was no longer a deal for them to continue. Both Sorensen and Vetsch agreed. Motioned by Hendrickson, seconded by Hudson, to not waive the City’s monetary limits on tort liability. Ayes: Hendrickson, Hudson, Sorensen, and Vetsch. Nays: None. City Administrator’s Update Nafstad reported that staff had a baseball users-group meeting regarding the field #3 lights and from the discussion staff learned the users would like to the fences moved. He stated the City Planner will be looking at possible reconfiguration of the fence lines and they will meet again with the group. Nafstad stated they should have the fences in a permanent place before installation of the ballfield lights. 9. RECESS Hendrickson called for a short recess of the meeting at 8:23 p.m. 11. BUDGET WORKSHOP Hendrickson reconvened the meeting at 8:29 p.m. and Hendrickson moved the meeting into the budget workshop. Lannes presented an overview of the budget planning process and budget/levy historical numbers. She presented a 2017 preliminary budget of $3,765,954, a 2.58% increase from 2016. She explained $1,878,480 was the operations levy, $971,429 was the capital levy, and $916,045 is the debt levy. She stated they have maintained the reserves at 50%, which is above the State minimum of 35%. Lannes reviewed several unfunded items that are not part of the budget that include: • Desired improvements such as parks, amenities, buildings • Future equipment replacement • Law enforcement coverage • Scanner • Brush Chipper • Professional Services Vetsch inquired about law enforcement coverage and noted that annual calls has again decreased. Both Hudson and Hendrickson felt the current coverage is what is keeping the crime/call volume down. Council was fine with the current level of coverage and Lannes suggested they continue to monitor the numbers. Hendrickson inquired if funding is available for State lobbying services. She would also like to see some funding for marketing the City. Sorensen stated they are currently funding $15,000 to the Ice Arena for depreciation and it is not covering it. Lannes stated that it would have to go to all three entities if there should be an increase. Lannes reported they have approximately $350,000 in general fund reserves this year that Council will need to designate. Sorensen inquired about the status of the street maintenance and improvement funds. Lannes stated they are behind in streets. Nafstad stated they should be funding approximatelytwo miles of road a year, but they are currently at a quarter of a mile per year. He stated they have tried to stay away Agenda Page 8 City Council Meeting Minutes Page 6 Regular Meeting of August 1, 2016 from assessments for street repairs. Sorensen felt they should use the general fund reserves for streets. Hendrickson asked staff to bring figures back that include the unfunded building maintenance items. Hudson would like to see a figure with all unfunded items included. Nafstad stated they want to keep the percentage low for 2017 as they still need to address water rates. 12. The Festival will be held on Sunday, October 9, 2016 and proceeds will be used to help fund the Parish Center’s operating costs. The hours of the event will be 10:30 a.m. to 5:00 p.m. In addition, the applicant has requested that Lander Avenue NE be blocked off between the Church and the Parish Center for safety reasons between the hours of 8:00 a.m. – 5:00 p.m. KEY ISSUES: • The Church of St. Albert has submitted the correct application and fee for a One-Day Temporary 3.2% Malt Liquor License. • Sale of the 3.2% malt liquor will occur on the grounds of the Parish Center. • This is an annual event for the Church and Parish Center. RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following motion: MOTION TO: Adopt Ordinance Number 2016-08 to amend Section 1000.24 of the Albertville Zoning Ordinance to “opt out” of State Statute 462.3593 Temporary Health Care Units. BACKGROUND: This spring the Legislature passed, and the Governor signed, a law to require municipalities to allow “temporary family health care dwellings” under MN Statutes Section 462.3593. The new law defines these dwellings and requires their accommodation, but includes an “opt-out” provision that permits municipalities to exempt themselves from the provisions. The new law becomes effective on September 1, 2016. Cities that have restrictions on RV storage and parking are not already exempt; the only opt-out is an explicit opt-out. KEY ISSUES: Apart from the issues raised by accessory dwellings, the temporary family health care dwelling addresses a separate aspect of this issue – mobile, detached “trailer” units that are hauled to the subject residential property, installed with connections to the electrical and plumbing services from the main house, and then detached and removed, theoretically, when their use is no longer needed. The statute also allows for one unit per lot without distinguishing between single family or multiple family properties (twinhome, townhome). The statute allows only one person to reside in the unit. POLICY CONSIDERATIONS: In accordance with State Law, public notice was published and a public hearing will be held by the Planning Commission at 7:00 p.m. on August 11, 2016. The Commission is expected to recommend that the City Council approve the zoning text amendment. FINANCIAL CONSIDERATIONS: There are no significant financial issues related to the zoning text amendment. The City shall be responsible for all costs associated with any enforcement related to the zoning text amendment. LEGAL CONSIDERATIONS: In accordance with Council procedures, the Mayor and Council have the authority to amend the City Zoning Regulations, which requires a majority vote of the City Council and becomes effective upon publication. This spring, the Legislature passed, and the Governor signed, a law purporting to require municipalities to allow “Temporary Family Health Care Dwellings” under MN Stat Section 462.3593. The new law defines these dwellings, requires their accommodation, but includes an “opt-out” provision that permits the municipality to exempt themselves from the provisions. Intent of the new law. The statute itself was, developed and put forward by a New Brighton firm that builds these units, called “Next Door Housing”. The statute includes an exemption for any municipality that already has an ordinance that allows temporary health care dwellings as a permitted use. Cities that have a prohibition on RV occupancy or other similar code are not immune to the law. Components of the Statute. The new law includes the following aspects: • Definitions of caregiver, person needing care, and “relative” providing care; • Specifies that the subject of the statute is a “mobile” residential dwelling; • Specifies that the unit must be built off-site; • Specifies that the unit is no more than 300 square feet, and has no permanent foundation; • That the unit is “universally” designed and meets accessibility standards; • That the unit access plumbing and electrical through the principal home, or “other comparable means”. • That the unit uses exterior materials compatible to “standard residential construction” and has an energy rating of R-15; • Is sized to be movable with a one-ton pickup truck; • Provides that such units will be permitted uses; Agenda Page 18 2 • Provides for an application and permitting process, including notice to “adjacent” property owners; • Provides that the unit must meet setbacks and floor area ratio requirements; • Provides that the unit is occupied by only one person; • Provides for one six-month permit term, and one additional six month term; • Provides for municipal inspection and a revocation process; • Provides for a maximum $100 fee for the initial permit, and $50 fee for the additional term extension; • Incorporates MN Stat Section 15.99 for permit review. • Provides for the opt-out ordinance as noted below. Opt-out provision. The new statute, as a part of MN Stat 462 is incorporated into the municipal planning and zoning regulations, and will become effective on September 1, 2016. The municipality will have to opt out of the regulation prior to that date to avoid its effect. Because this is a zoning regulation, any opt-out will need to be processed as an amendment to the zoning ordinance, requiring the typical hearing and ordinance adoption. The only opt-out is an explicit opt-out. Accessory dwelling units generally. The issue of accessory dwelling units for the purpose of providing living space for family members needing care has been widely discussed. The context for most of these discussions has been for attached units that constitute some form of second dwelling on single family parcels. There are various arguments, pro and con, for these units. Issues under the new law. Apart from the issues raised by accessory dwellings, the Temporary Family Health Care Dwelling addresses a separate aspect of this issue – mobile, detached “trailer” units that are hauled to the subject residential property, installed with connections to the electrical and plumbing services from the main house, and then detached and removed, theoretically, when their use is no longer needed. Interestingly, the statute provides for a single six-month period of installation, and the option for one additional six-month period. The statute also provides for an extensive process of permitting and locational regulations that would supersede a community’s normal review process. It is not clear how the statute might apply to somebody who wishes to apply for a third six-month period – it would appear that the statute prohibits that extension. The statute also allows for one unit per lot without distinguishing between single family or multiple family properties (twinhome, townhome). Statute allows only one person to reside in the unit. In the City of Albertville, some of the residential neighborhoods consist of small to mid-sized lots that raise question with regard to rear yard access and unit placement. Placement of a temporary health care unit are required to meet principal building setbacks this will be problematic on the smaller lots in the City. Agenda Page 19 3 Summary and Alternatives. 1. The municipality may choose to do nothing, and allow the statute to go into effect. In this case, all of the details of the law, including size, location, construction, delivery, timing, and process would be regulated by the statute. 2. The municipality may decide that it wishes to allow Temporary Family Health Care Dwellings, but prefer ordinance details more tuned to its specific requirements and zoning objectives. Examples of alternatives preferred by the municipality might be providing for site-built facilities, differences in size or materials, differences in location or screening requirements, the use of interim use permits or conditional use permits, or alternative notice requirements, just to name a few. In such a case, the municipality should take action to adopt an ordinance opting-out of the statute, and proceed to adopt its own regulations. It will be important that the municipality opt-out of the state law, or the statute may have the effect of pre-empting the preferred alternative. 3. The municipality may decide that only attached accessory units are suitable in their community. Again, the municipality will need to take specific action to adopt an opt-out ordinance to avoid the effect of MN Stat 462.3953 prior to September 1, 2016. 4. The municipality may decide that it does not favor accessory units. Instead, families which are considering providing health care to their family members can do so within the confines of a single family home. It may be necessary to add some definition to what constitutes a separate residential use (especially cooking and sanitation/plumbing facilities) to ensure that single family homes are not accidentally modified to create additional dwelling units on the property. Recommendation: While the city has a number of options for addressing this issue, Staff would strongly recommend that the city adopt the attached ordinance to opt-out of the state regulations to avoid land uses and performance standards issues that will occur with the application state standards on lots within Albertville. If the City believes that this housing option is needed within the city, the city will adopt its own regulations specific to the city and appropriate for our lot sizes and neighborhoods. The purpose of the workshop is to discuss financing 2017 and ultimately working towards a general budget consensus. The Preliminary Budget, presented on 8/1/15, proposes a total levy increase of $94,715 or 2.58%. This increase is generally due to increased capital reserves, law enforcement services, wage adjustments, and inflation. The Council will be asked to adopt a Preliminary Budget and Levy at the first meeting in September. Ice Arena: The Design Committee met Monday, August 8, and finalized an arena concept. The Arena Board accepted the Design Committee’s concept design recommendation. 2016 Elections Update: For the August 9 Primary Election, there were 161 voters that voted on Election Day and 16 that voted by absentee ballot. Filing for local seats continues until 5:00 p.m. on August 16. Main Avenue NE Entrance Sign: Color Sign and Optec have been working on the sign to resolve issues with the antennae and programming of the sign. 2016 Recycling Cleanup Stats: The numbers for cleanup day this past May are attached. By the numbers, it was another successful year for both cities. ENGINEERING/PUBLIC WORKS Ballfield Lighting: I will be meeting with the baseball groups on the 11th to discuss whether or not the outfield fence should be adjusted prior to installing the lights, which are scheduled to be installed this fall. Council Members From: Tina Lannes, Finance Director RE: Budget Workshop #2 – Capital Increase Requests August 10, 2016 As infrastructure is added and ages, additional maintenance is required. As discussed in the budget workshop on August 1, 2016, there are several key building mechanical items that will need to be replaced in the next ten years. Likely items include: City Hall boilers (3) HVAC Control City Electronic Sign For these three items, staff requested adding $15,000 to the budget starting in 2017, so when it is time to replace them the funds are available. The preliminary budget presented to Council on August 1, 2016 had a total levy increase of $94,715 or 2.58%. Council inquired as to the impact of adding the above three items to the budget. If funded, these items would be included under City Hall capital reserves. This change, plus a small increase of an estimated $1,500 in expected LGA revenue, brings the total levy increase to $107,996 or 2.94%. Agenda Page 47
