Hendrickson stated there was a Joint Powers Water Board meeting and inquired if the Board had
discussed water rates with staff. Nafstad replied that he has not received information on rates
although he knows the Board undergoes an annual comparison study each year.
B. Legal
1). Encroachment Agreement Allowing a Portion of Taco Bell’s Drive Through
Lane To Be Located In The City Street
Nafstad reported the item is a continuation of the Taco Bell CUP. This license agreement would
allow Border Foods Inc. to construct a drive through and place improvements in the right-of-way.
Conditions of the agreement require Border Foods Inc. to indemnify the City and if safety hazards
should occur, would require Border Foods Inc. to modify the drive through lane to correct the
hazards. He stated that encroachment agreements are fairly common. Brixius stated that the street
design is not changing in this design.
Motioned by Sorensen, seconded by Hudson, to approve the License Agreement with Border
Foods, Inc. Ayes: Hendrickson, Hudson, Olson, Sorensen, and Vetsch. Nays: None. Absent:
None. MOTION DECLARED CARRIED.
C. City Attorney Report

1). Accessory Buildings/Deed Covenants
Brixius reported that approved residential planned unit developments have a design standard in the
City Code that does not allow accessory buildings if they are prohibited in the development’s
covenants. This was put in place when the size and number of accessory buildings were integral to
plat design and appearance, such as in the Cedar Creek and Towne Lakes developments. He stated
that staff had to return an application for an accessory building because it was not allowed in that
addition’s covenants whereas another applicant had a similar request but did not have that restriction
within their addition’s covenants. This places an inequality among residences within the same
development, just different additions. He recommended that the City not act on development DRAFTAgenda Page 5

covenants and if Council feels those specific neighborhoods of Cedar Creek and Towne Lakes need
those restrictions, the ordinance be amended to specify those neighborhoods.
Hudson was in favor of repealing the language in the City Code. Olson stated that Towne Lakes has
an association that can address the covenant issues; however, it appears only Cedar Creek is
impacted as it has no associations within the development. Council directed staff to come back at a
future meeting with new Code language.
E. City Clerk
1). Set Canvass Board Meeting Date and Time
Acting Clerk Lannes stated they must hold the Canvass Board meeting within ten days after the
November 8, 2016 election. Staff suggests holding it prior to the November 14, 2016 Arena Board
meeting as they did two years ago.
Motioned by Vetsch, seconded by Hudson, to set the 2016 Canvass Board Meeting, for November
14, 2016. Ayes: Hendrickson, Hudson, Olson, Sorensen, and Vetsch. Nays: None. Absent:
None. MOTION DECLARED CARRIED.
Hudson stated they did not set a time for the meeting. Lannes suggested not specifying a time for
the meeting yet, as they do not yet know when the start time will be for the Arena Board meeting.
She stated they could set the time a later date.

1). City Administrator’s Update
Nafstad reported that staff is working on language for the shared fire agreement and would like to
bring that back to a workshop for the Council.
He reported that on September 22 & 23 Highway 241 will be closed and the detour route will be
CSAH’s 37 and 19. Vetsch inquired about the Main Avenue NE railroad crossing and Nafstad
replied that it is scheduled to be done this year.
Nafstad reported that City Hall receives a number of complaints about legal and illegal parking in
Towne Lakes. He stated that cars are parking for an excessive amount of time, illegal parking so
garbage containers cannot be emptied on pick up day, or parking on both sides of the street making it
difficult to pass through. He wanted to bring this to Council’s attention and stated they may want to
consider no overnight parking or limited time parking. In terms of illegal parking, the Code
references an administrative fine from the City which makes it difficult for Wright County to enforce DRAFTAgenda Page 6

although they do chalk tires (48 hour parking limit) and talk to the vehicle owners. Nafstad stated he
will be working with Sergeant Kunkel to monitor the situation.
Hendrickson reported that she received a request to install a dog waste receptacle on the trail by
CSAH 18. Nafstad replied that it would be Wright County right-of-way and he will look into it.

Hendrickson called a short recess of the meeting at 7:34 p.m. Hendrickson reconvened the meeting
at 7:36 p.m.
11. BUDGET WORKSHOP
Lannes reported that at the first budget workshop, Council asked staff to come back with a budget
figure that included the three unfunded capital items (City Hall boilers, HVAC control, and
electronic sign). She stated the preliminary budget presented to the Council at that workshop was a
total levy increase of 2.58% and with the unfunded capital items included, the total levy increase
would go to 2.94%.
Sorensen inquired about the quality of the images on the new City sign. He felt the images were too
blurry and he expected a much clearer and sharper image. Nafstad stated they are still working on
training and part of the issue is the angle in which the sign appears up close; from further away, the
image appears much clearer.
Lannes reported the only other change was an increase of $2,000 in Local Government Aid, which
brought the total levy increase from 2.58% to 2.53%. She stated that the Council will need to
discuss including the unfunded items, possible increase of funding to the ice arena, etc.
Hudson stated the ice arena item is hard to determine at this point because the Arena Board still
needs to discuss the staffing issues and capital. Lannes explained that if ice arena operations do not
operate in the black, staff will have to seek additional funding from the three entities. She stated the
additional $15,000 Council had designated to the ice arena is going into future capital, such as DRAFTAgenda Page 7

replacement of the Zamboni machine. Olson inquired if they are funding operations at all and
Lannes replied they are not, but if there is a major purchase or repair needed, they would need to use
the capital funds or ask for funding from the entities. Nafstad clarified that a big portion of the ice
arena capital was used for the roof and Lannes informed Council that the capital is slowly being built
up.
Council inquired about using the General Fund Reserves from last year for the unfunded items.
Lannes explained that if you put in a small amount into the budget now and build for ten years, funds
will be in the budget when items need replacement; otherwise the budget will have a lot of one-time
costs that would make the levy go up and down. Council discussed options for using the General
Fund Reserves.
Olson asked staff if they foresee any large items that need funding in the next budget cycle that
Council should be preparing for. Lannes stated that it really depends on permit revenue and Nafstad
added that even though they have enough commercial and industrial land to still develop, they are
approaching buildout for residential homes. Lannes stated there will always be some form of
revenue from permits though.
Council directed staff to bring the 2.94% total levy increase for approval at the next meeting.

BACKGROUND: The City processes claims on a semi-monthly basis. The bills are approved
through their respective departments and administration and passed onto the City Council for
approval.
KEY ISSUES:

key issues will be presented in the claims listing document.
POLICY/PRACTICES CONSIDERATIONS: It is the City’s policy to review and approve
payables on a semi-monthly basis.
FINANCIAL CONSIDERATIONS: City staff has reviewed and recommends approval of
payments presented.
LEGAL CONSIDERATIONS: The Mayor and Council have the authority to approve all bills
pursuant to Minnesota State Law, which requires all bills to be paid in a timely manner,
generally within 30 days unless one party determines to dispute the billing.

WRIGHT COUNTY AND THE CITY OF ALBERTVILLE TO PURCHASE SALT FOR THE
2016-2017 SNOW AND ICE REMOVAL SEASON
RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider the
following:
MOTION TO: Approve the Memorandum of Understanding between Wright County and the City
of Albertville for the Purchase of Salt for the 2016-2017 Snow and Ice Removal Season at a cost of
$78.33 per ton, which is subject to fuel escalation.
BACKGROUND: Since 2006, the City of Albertville has purchased salt from Wright County.
Public Works loads the salt at the Wright County Maintenance Facility in Otsego on an as needed
basis. Reimbursement for the salt is based on the predetermined price per ton and the quantity
hauled.
KEY ISSUES:
• The County facility is nearby and convenient.
• Bulk purchasing allows for reduced material and shipping costs.
• The City has limited salt storage capabilities/facilities.
POLICY CONSIDERATIONS: It is City policy for Council to review and approve all service
and purchasing agreements.
FINANCIAL CONSIDERATIONS: The City annually budgets for ice control. The annual cost
of snow and ice removal is weather dependant and varies with each season. The unit price of the
salt for the 2016-2017 season is $78.33 per ton, plus fuel escalation if applicable. This is
approximately $4.00 less per ton than the previous season. Total annual cost is based on quantity of
salt used.
LEGAL CONSIDERATIONS: The Mayor and Council have the authority to approve purchasing
agreements for the City.

SUBJECT: CONSENT – CITY CLERK – TEMPORARY OUTDOOR MUSIC PERMIT
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Approve a Major Temporary Outdoor Music Permit for the 152 Club, Inc. for
September 24, 2016 located at 5794 Main Avenue NE.
BACKGROUND: The City Council revised its Temporary Outdoor Music ordinance in 2013.
The revision more clearly defined the definitions of both a Major and Minor Temporary Outdoor
Music Permit and the requirements that must be met for each type of permit.
The applicant, Trish Holm of 152 Club, Inc., has applied for one (1) Major Temporary Outdoor
Music Permit for September 24, 2016. A Major Temporary Outdoor Music Permit must meet
the following requirements:
1. Any person, organization, and/or entity shall be limited to a maximum of two (2) major
permits per year. No commercial property shall host more than three (3) major events in
a calendar year.
2. The permit applicant must pay a permit fee as set by the City Council by resolution and
provide information and/or a plan(s) that demonstrates that the site event will comply
with the performance standards of this code.
3. The permit applicant must demonstrate that there will be adequate sanitary facilities for
the event.
4. The permit applicant must demonstrate that there will be adequate security and fencing to
control access to the event at the location of the outdoor musical performance.
5. The permit applicant must have sufficient off-street parking. The music event shall not
occupy required parking for the principal use of the site.
6. The major outdoor musical performance must not interfere with other commercial and
governmental activities or with the quiet enjoyment of residential property.
7. The stage, performers, speakers and amplifiers are located three hundred feet (300’) from
any residence located in a residential zoning district.
8. The stage, speakers, and amplifiers are arranged in a design and manner that does not
directly broadcast music at or toward a residence within three hundred feet (300’) of the
stage.
9. Major outdoor music events shall be allowed between May 15th and October 15th and the
live outdoor musical performance shall only occur on the dates and during the hours
designated by the City Council.
10. Major outdoor music events shall not perform beyond 12:00 midnight.
11. The volume of the outdoor musical performance must be reasonable. The permit holder
shall comply with all requests of the Sheriff’s Department to reduce volumes to mitigate
nuisance complaints.

12. Failure to abide by these standards or the receipt of nuisance complaints may be grounds
for denial of future major outdoor music permits for the property.
The applicant has previously held both Major and Minor Temporary Outdoor Music Permits and
is familiar with the requirements that must be met.
KEY ISSUES:
• The applicant has paid the appropriate fee.
• The applicant has submitted a site plan showing the location of speakers, fencing and
security, and has indicated adequate sanitary facilities as well as parking.
• The September 24, 2016 event is the applicant’s annual Oktoberfest Celebration and
music will be played from 3:00 p.m. – 7:00 p.m. and again from 8:00 p.m. – 11:59 p.m.
• The applicant has indicated they will abide by the noise requirements.
• Failure to abide by the standards or the receipt of nuisance complaints may be grounds
for denial of future Major Outdoor Music Permits.
POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the
authority to approve or deny any Temporary Outdoor Music Permit.
FINANCIAL CONSIDERATIONS: There is minimal financial revenue collected from the
applicant for the music permit.

SUBJECT: CONSENT - HUNTERS PASS ESTATES 2ND ADDITION - LETTER OF CREDIT
REDUCTION NO. 4
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider
approval of the following motion:
MOTION TO: Reduce Letter of Credit No. 2220 held as security for the Hunters Pass 2nd
development from $15,973 to no less than $9,273, conditioned on any outstanding balances
owed to the City being paid in full.
BACKGROUND: Nathan Jones of Tollberg Homes has requested a reduction to the letter of
credit held for the Hunters Pass 2nd Addition. The Letter of Credit is held as performance and
warranty security for the road improvements and various site improvements and is currently in
the amount of $15,973.
Assuming the Developer is current with all fees owed to the City and based on work completed
to date, it is recommended that Letter of Credit No. 2220 be reduced to no less than $9,273. The
reduced balance is believed to be sufficient surety and is consistent with the development
agreement.
KEY ISSUES:
• Current amount of LOC is $15,973 and it is recommended that it be reduced to $9,273.
• Recommendation is consistent with agreements and approvals.
POLICY CONSIDERATIONS: It is City policy to have all letter of credit reductions
approved by the City Council
FINANCIAL CONSIDERATIONS: There are no financial implications for this request
LEGAL CONSIDERATIONS: The City has the legal authority under the Development
Agreement to reduce the letter of credit upon completion of the required improvements or deny
requests for reduction if the required improvements are found unacceptable.

SUBJECT: FINANCE – 2017 PRELIMINARY BUDGET AND PROPERTY TAX LEVY
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO:
• Approve Resolution No. 2016-023 adopting the 2017 Preliminary Property Tax Levy.
• Approve Resolution No. 2016-024 adopting the 2017 Preliminary Budget.
BACKGROUND: Annually, the budget and property tax levy process starts in June with staff
preparing estimates and projections for the following year’s preliminary or draft budget.
Through meetings and workshop sessions, the City Council reviews the preliminary budget and
amends it as desired. Prior to September 30 of each year, the following year’s proposed tax levy
is submitted to Wright County for preliminary certification.
Attached is the preliminary summary budget for 2017.
The preliminary budget for 2017 totals $3,762,183. The budget includes a General Fund tax levy
of $2,863,190 for taxes payable 2016 and the debt service levy of $916,045. The total levy, both
general fund and debt service has increased from $3,671,239 in 2015 to $3,779,235, which is a
2.94% increase.
KEY ISSUES:
1. Levy Adoption Schedule: The final levy is not certified until mid December so there is
still an opportunity to review, discuss, and change the 2017 budget and tax levy as
needed. The important thing to note is that the final levy can be less than the preliminary
levy, but it cannot be more. For the preliminary levy, it is best to avoid “locking” into a
levy that could be inadequate to fund operations and programs for next year.
2. LGA/Levy Limits: The City is estimated to receive LGA in the amount of $92,181,
which reduces the general fund levy by that amount. The attached budget includes using
the amount received to assist in paying debt service shortages.
POLICY CONSIDERATIONS: It is the City’s policy to review and approve the 2017 Budget
and Proposed Property Tax Levy.
FINANCIAL CONSIDERATIONS: In reviewing the Albertville projected 2017 Budget, we
anticipate maintaining the Office of the State Auditors minimum requirements of 35% of the
budget in designated funds for general reserve, as well as, Albertville’s policy of 40%.

BE IT RESOLVED by the C ouncil of the City of Albertville, County of Wright,

A RESOLUTION ADOPTING THE 2017 PRELIMINARY BUDGET
WHEREAS, the City Council of the City of Albertville has adopted a proposed budget;
and,
WHEREAS, the Albertville City Council has adopted a preliminary tax levy to be placed
upon the taxable property in the City of Albertville; and,
WHEREAS, the Albertville City Council desires to reserve within the General Fund
those monies designated as capital outlays within various budget classifications, such that those
monies can be disbursed only for those capital outlays so specified within the budget; and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ALBERTVILLE, MINNESOTA:
1. The attached budget is hereby adopted as the preliminary budget for the City of Albertville
for the period January 1, 2017 through December 31, 2017.
2. All monies designated within the budget as capital outlays shall be reserved within the
Capital Reserves Fund, such that those monies can be disbursed only for those capital
outlays so specified within the budget.
3. The Albertville City Council has hereby complied with Minnesota Statutes.
4. The Finance Director is hereby authorized to transmit certification of compliance with
Minnesota Statutes to the Commissioner of Revenue as required.

SUBJECT: FINANCE – AUDIT SERVICES
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following motion.
MOTION TO: Approve the quote from Abdo, Eick & Meyer, LLP for 2016 audit services in
the amount of $24,000.
BACKGROUND: The City is required to have an independent audit annually. Abdo, Eick &
Meyer is familiar with the City as they have performed a number of accounting
services/consultations for the City, including preparing the annual financial statements. Their
quote for services for the City of Albertville Audit for year ending December 31, 2016 is in the
amount of $24,000.
KEY ISSUES:
• Staff requested quotes for 2016 service from BerganKDV and Abdo, Eick & Meyers.
• Abdo, Eick & Meyers, submitted the low quote for 2016 services in the amount of
$24,000.
• BerganKDV is the firm the City has used the past several years.
• As the City’s auditor, Abdo, Eick & Meyers will also perform the Ice Arena Audit under
a separate contract.
FINANCIAL CONSIDERATIONS: The City budgets for the annual audits across all funds.
LEGAL CONSIDERATIONS: Cities over 2,500 in population are required to have an annual
audit in accordance GAAP.

GENERAL ADMINISTRATION
2017 Budget and Levy: The preliminary budget and levy are included in the agenda packet for
approval on Monday.
Fall Newsletter: The fall newsletter will be going out around the first week of October. Please
let us know if you would like to see anything specific included.
Arena Board/Ice Arena: At Mondays’ Arena Board meeting, the bulk of the discussion was
regarding an item not on the agenda, related to ownership/operation responsibilities should a
second sheet of ice be built. The District is going to draft a MOU for the cities consideration.
Also, we have two new seasonal employees starting at the arena this week.
Open Streets: The STMA Open Streets event was well attended and was another success this
year.
2017 School Referendum: Kim and I met with the STMA School District to discuss the proposed
February bond referendum regarding each entity’s participation in the election. Both
Albertville and St. Michael will contribute resources to the District in terms of absentee voting,
equipment, and supplies.
Joint Fire: The Fire Chief, City Attorney, and I have been discussing options for the shared
service agreement. We would like to schedule a workshop with the Council in October to
discuss staff suggested terms.
Neighbor’s Saloon and Eatery: The owner has submitted a request to City Council to appeal
the code violation and administrative fine they received in regards to the trash enclosure
compliance for the property. We anticipate the owner to be at the September 19 meeting.
Facebook: Staff met with Samara to discuss the status of the City’s Facebook account, develop
promotion steps, and set goals. In the next several months, there will be new features added
to the page for residents to use (service requests, calendar, etc.), specified advertisement of
posts will occur, and more consistent posting will be done.
Trailblazer Transit: I attended the September WCAT meeting and can report Monticello and
Otsego are now officially members, there are 14 buses currently in service in Wright County
with plans for 6 more in the next year. Also, WCAT is pursuing a change to the Trailblazer joint
powers agreement that would allow for WCAT to have three voting members. WCAT
represents approximately 40% of Trailblazer’s ridership. At any time, please let me know if you
would like more information regarding transit.

Karston Cove 4th: We have an application to re-plat the south half of Karston Cove 3rd Addition
to an Outlot. This application is due to an expiring Development Agreement and letter of credit
that is subject to statute of limitations. The application was reviewed at this week’s Planning
Commission meeting, but the Commission tabled the item and requested more information. I
have added this item to the agenda for discussion, as it will be coming back to the Council at
the October 3 meeting.
ENGINEERING/PUBLIC WORKS
Detour using CSAH 37 and CSAH 19: On September 22 and 23, Hwy 241 will be closed for
railroad crossing repairs. MnDOT has notified us that it will be using CSAHs 37 and 19 as part of
the posted detour route.
Ballfield Lighting: We are working to get fencing proposals and finalize schedules. It is planned
to complete both fencing and lighting this fall.
Main Avenue RR Crossing: I have not yet heard when the Railroad will commence work on the
crossing.
CenturyLink Fiber Projects: CenturyLink recently picked up three R/W permits to extend fiber
to several neighborhoods. Project information will be added to the website as it becomes
available.
