MOTION DECLARED CARRIED. 7.PUBLIC HEARINGS –None 8.DEPARTMENT BUSINESS A.City Council 1).Committee Updates STMA Ice Arena Hudson reported the Board discussed a resolution approving the Joint Powers Agreement and it would be discussed at the October 30, 2017 Joint Governance Meeting. B.Planning/Zoning 1).Cielo’s Car Wash Site And Building Plan and Conditional Use Permit For Minor Auto Repair And Outdoor Storage Of Company Trucks Nafstad reported the applicant is proposing to reopen the car wash and add auto detailing services. This would be allowed as a conditional use under the current B-3 zoning. Since there will be no gas sales at the site any longer, the applicant must remove the gas canopy, gas pumps, pump islands, underground gas tanks, and the freestanding sign. The applicant must also restore the parking lot and provide documentation that the gas tanks left no contaminants in the soil. The applicant has also requested company truck parking in the rear of the building and that will be limited to six stalls for service vehicles. Nafstad clarified that no other outdoor storage or outdoor sales displays will be allowed at the site. Hendrickson mentioned she saw Facebook advertisements for a company that will be moving into the former Heidi’s Brew liquor store on the other side of the building. Hudson stated this was addressed at the Planning Commission public hearing and the applicant was not aware of those ads and is not necessarilyseeking a tenant atthis time. Brixius had clarified at the Planning Commission meeting that any newor change of use would require review. Hudson stated there was one comment at the public hearing from a neighboring company asking that the applicant have the same requirements in regards to outdoor displays, signage and storage of company vehicles. Staff clarified the businesses would have to uphold the same standards. Nafstad reported that sprinkling would be needed in the building. Cocking inquired how the City can ensure that the contaminants have been fully removed. Nafstad replied they are seeking documentation and there will be a report generated for the MPCA. City Council Meeting MinutesPage 2 Regular Meeting of October 16, 2017 Agenda Page 6 Cocking was not sure if this is the best use for the site, but since the property has been vacant for approximately four years, it would be nice to see a business move into the location. He inquired if there have been any other interests in the property. Nafstad replied there have been several inquiries relating to gas sales/c-stores. Motioned by Hudson, seconded by Vetsch, to Approve Resolution No. 2017-039 for a Site and nd Building Plan and Conditional Use Permit for a Car Wash and Auto Detail Located at 11850 62 Street NE within the City of Albertville. MOTION DECLARED CARRIED. 2).Central Parks Concepts –Discussion Nafstad reported the City Planner is updating the park concepts showing simplified modifications accommodating Albertville Friendly City Days(AFCD), Farmers Market, etc. Vetsch had concerns that if the AFCD or Farmers Market is displaced,it would detract from the overall feel of the community celebration or could result in the loss of vendors during the market. Hendrickson was concerned that if the overall Master Plan is segmented into too many parts, the Master Plan will not occur. Nafstad stated that he sees the streetscaping of Main Avenue NE th coinciding with the improvements to 58Street NE. C.Public Works/Engineering - None 1).MN DNR Grant for Westwind Park Nafstad reported that the grant agreement has been reviewed by the City Attorney. Items noted by the City Attorney are the City will be obligated to commit $150,000 matching grant funds and must pay prevailing wages. Couri informed Council that once Westwind Park is improved using these funds, it must remain a park forever. Hudson inquired what happens if it does not remain a park and Couri replied the State of Minnesota would either deny the property to be conveyed to another entity or would seek the grant dollars back. Hudson inquired if the improvements could be completed without the grant at a cost less than what isassociated with the grant. Nafstad replied he did not believe so. Olson inquired if the cost reflects excavation for a water view. Nafstad clarified it did not, but excavation in the wetland could be added to the plan. Olson inquired about timeline. Nafstad replied the agreement requires completion by December 31, 2019. Motion by Vetsch, seconded by Olson, to Approve the MN DNR matching grant in the amount of $150,000 for improvements to Westwind Park located at 10687 Kalland Drive NE. D.Fire –None City Council Meeting MinutesPage 3 Regular Meeting of October 16, 2017 Agenda Page 7 E.Finance –None F.City Clerk –None G.Building –None H.Legal - None I.Administration 1).Acquisition of Tax Forfeited Property –Discussion Nafstad reported Wright County has notified the City that PID # 101-124-004030 has gone tax forfeit. The lot is not developable as there is not sewer or water service to the parcel. It also would not meet 1306 Fire Code. There are two options to purchase the property. Couri reported the State could convey the property to the City free of charge, so long as the parcel is used for a public use such as a street, park, ponding, etc. It cannot be used for government types uses such as a City Hall or Public Works Garage. It would be deed restricted so it could not be conveyed to another entity; it would go back to the State if the City no longer wanted the parcel. The other option is to purchase the parcel out right. The current value is appraised at $26,500. The City would receive clear title and could then convey it to another entity. Cocking inquired why the City would not want the parcel for public purpose such as freeway right- of-way. Nafstad suggested purchasing the parcel out right and selling the parcel once sewer/water is extended, and if needed, the city could use a portion of the lot for ponding or right-of-way if necessary. Cocking inquired about acquiring a portion for public use and selling the remaining remnant. Couri stated another aspect to review is when utilities are extended, the City would most likely special assess for those utilities. If the parcel is put to public use, the City would have to absorb those special assessment costs. Hendrickson asked for clarification on the benefit to outright purchase the parcel. Couri replied there are several benefits: The parcel could be worth more in the future. Special assessments for utilities would help fund the utility extension. If the City can somehow combine the parcel and the parcel to the north (PID # 101-124- 004020), the combined parcel would be more marketable and bring more tax value to the City in the long term. Nafstad stated it’s reasonable to assume the City would need some portion of the parcel. Couri stated the City will want to avoid any condemnation proceedings. Nafstad replied the City has 60 days to get back to the County and they could have six months to negotiate a price. Council was comfortable with that scenario. City Council Meeting MinutesPage 4 Regular Meeting of October 16, 2017 Agenda Page 8 Hendrickson inquired what is needed from the Council and Couri replied the draft resolution should be amended to notify Wright County of the City’s intent to purchase the lot and allow six months to negotiate a price. Motioned by Cocking, seconded by Vetsch, to adopt Resolution 2017-040 to notify Wright County of the City of Albertville’s intent to acquire PID# 101-124-004030. Ayes: Hendrickson, Cocking, Hudson, Olson and Vetsch. Nays: None. Absent: None. MOTION DECLARED CARRIED. 2).Lobbying Services –Discussion In regard tothe Wastewater Treatment Facility improvements slated for 2019, Nafstad inquired if the Council is interested in pursuing lobbying services for funding. He reported that staff has received a proposal from Leonard, Street, Stinson. There is one legislative session prior to the 2019 improvements. Vetsch inquired if it would be grant or bonding funds and Nafstad they would be focused on bonding. Cocking highlighted the last bonding bill line items for wastewater improvements. Hendrickson asked how much the City would be seeking and Nafstad replied it would be approximately half of the total project cost. Nafstad also stated the City would want to look into PFA funding and Clean Water grants. Nafstad inquired if Council would like multiple quotes from different lobbying groups or if the Council would be open to staff negotiating with Leonard Street. Olson suggested requesting scope and fees from Leonard Street and Lockridge Grindal. Cocking felt the City would be better off with two different lobbyists, so the lobbying message for transportation funding versus WWTF funding is not lost with just one consultant. Hendrickson stated that she also wants to keep the relationship with the City’s current lobbyist. Nafstad stated the proposal staff saw was a tiered concept of services. Hudson inquired if the City has used multiple lobbying groups at the same time before and Nafstad replied they have not. Cocking felt that it is in the City’s best interest to pursue lobbying for funding for the project. Nafstad stated he will bring a proposal back to Council in the near future. 3).City Administrator’s Update Nafstad reported the Joint Powers Water Board is getting quotes to paint the west water tower with a logo that will be the same as the logo on the east tower. Hanover’s share of Joint Powers Water Board is 9% and the Board is looking to the two cities to reimburse the Board for Hanover’s portion. This would be approximately 60% St. Michael and 40% Albertville to reimburse Hanover’s 9% portion. Olson suggested sprucing up the water tower logo. Hendrickson agreed and felt the text on the east tower was dated. Hudson inquired if Joint Powers will need another tower eventually and, if it would be in Hanover, how would financing be addressed. The Albertville Board members will inquire at the next meeting how that would be addressed. Nafstad is working with the City of Otsego and Wright County regarding routing of the WWTF piping to the Mississippi River. He reported the County had some concerns with widening of CSAH City Council Meeting MinutesPage 5 Regular Meeting of October 16, 2017 Agenda Page 9 39. Staff is currently working with a property owner who is willing to allow easement along their property for the WWTF piping. The City has a right-of entry for the property and soiling borings are being conducted. MICHAEL OCTOBER 30, 2017 – JOINT SPECIAL MEETING The St. Michael-Albertville School Boardmet in a joint session with officials from the cities of Albertville and St. Michael on Monday, October 30, 2017,at 6:00p.m.in the St. Michael City Center. STMA School Board Members Present: ChairmanDrew Scherber; Board Members: Kari Dwinnell, Jeffrey Lindquist, Jennifer Peyerl, Hollee Saville, Gayle Weber; and Superintendent Ann-Marie Foucault. City of AlbertvillePresent: Mayor: Jillian Hendrickson; Councilors Walter Hudson and Rob Olson; and City Administrator Adam Nafstad. City of St. Michael Present: Mayor Kevin Kasel; Councilors: Cody Gulick,Nadine Schoen and Keith Wettschreck;City Administrator Steve Bot and Administrative Assistant Amy Woitalla. The meeting was called to order at 6:07 p.m.Albertville Councilor Hudson/School Board moved Member Savilleto set the agenda. Arena AgreementUpdate Doug Birk, Director of Administrative Services, was present to give an update on the Joint Powers Board Agreementand make sure everyone is on the same page.He started with a history of the board whichstarted in 1997andconsists of 2 appointed representatives from Albertville, St. Michael and the School District. Each entity reserved 1/3 ownership and liability interest in the current ice arena. In February 2017, the STMA Community passed the district bond referendum to build a new arena. Under state law, the new arena addition must be owned exclusivelyby the School District for bonding/state aid equalization. The district wants to continue the tradition of shared governance and prior serving arrangement; is asking to prioritize ice time in the arena addition for the boys and girls varsity and junior varsity hockey teams; and will provide funding for the admin and management. City Administrators and the School Superintendent along with Legal Counsel have worked together to draft a new Joint Powers Agreement, which will need to be approved by all entities involved. Following a final joint agreement, Albertville and St. Michael will deed via quitclaim the property currently owned by the Joint Powers Board to the school district to build the Arena Addition andin return, the School District will provide the cities with a perpetual ingress, egress, and parking easement over the vacant lot. The target date for completion of construction of the new arena addition is November 1, 2018. The changes that will occur with the Arena Additionare - the addition will be owned exclusively by the school district; all common equipment shared by the two arenas will be owned: 1/6 by the City of St. Michael, 1/6 by the City of Albertville, and 4/6 by the STMA School District; and The Arena Board will move from a six-member board to a seven-member board (two members from Albertville City Council, two members from St. Michael City Council; and three members from STMA School District).Nothing is changing with the original arena as far as ownership; the basic governance model will remain intact; and the arena board will continue to make policy decisions for the original area. Albertville will assume sole responsibility for the management of both arenas, but will not be responsible for any liabilities or costs. All liabilities for the admin and management of the combined Arena including taxes, bills,or other obligations and shared combined arena expenses are the responsibility of the Arena Board. The target agency fund balance is 35% of the estimated annual expenditures. Agenda Page 11 October 30, 2017 - Joint Meeting - Page 2 Birk reported the current Zamboni machine is aged and cannot meet the needsof both arenas. A new Zamboni for use in both arenas shall be purchased out of existing agency funds, and after purchase, will be considered an operational asset of the Arena Board. As far as ice time,budget impacts and termination are concerned, the girls program is anticipated to migrate back to STMA. The district will pay agreed upon regular rental rate for the first 222 hours of ice time in a fiscal year; then the district will receive 176 practice hours; and the district will pay for any additional ice time beyond 398 hours in a fiscal year. The district is responsible for all personnel related to games and will retain game revenue. The primary consideration for scheduling ice time is boys and girls varsity and junior varsity games and practices. The district retains the right to use non-ice community and private rental spaces at no charge if not rented out, and may adjust the amount of time it rents in the Combined Arena on a year-to-year basis to reflect the needs and requirements of boys and girls hockey programs. Parties intend that this arrangement will have a net neutral revenue/expense effect on the entities, and each entity remains committed to a $15,000 contribution annually for capital costs. The agreement is effective until June 30, 2019 then subject to one-year renewals, and any party retains the right to st terminate the new agreement by submitting notice on or before August 1.Albertville Administrator Adam Nafstadreported the Arena Board has already approved the agreement. He then complimented them and thanked them for their service. East Water Tower Logo Update St. Michael Administrator Steve Botexplained the Joint Powers Water Board has agreed on a logo tocomplete the east water tower. The plan is to mirror the west water towerwhich reads “Home of the Knights”. He thanked both cities and the Joint Powers Water Board representatives who made this happen. Bot said this is a great partnershipand the logo is a good representation of the partnership. School Facilities ProjectUpdate Superintendent Ann-Marie Foucaultprovided a brief update on the school facility projects. Primary School. A security entrance was added to the front of the building requiring visitors to buzz in. There are also eight classrooms being added to the east side of the School. This project is well underway. Middle School East. A security entrance was added which was quite involved and will be finished over fall break. The pool had some corrosion in the pipes that needed to be addressed as well as some upgrades to the diving boards. The swimmers are reporting the water quality is much better. Technology. This will be a four-year project, but a lot happened this summer. The district has purchaseda Poster Printer, Smart Boards, Laptops for Science and Administration, Ipads for the Art/Music Department, Desktops and Monitors at the High School, ChromebookCarts and Chrome Bases,as well as upgrades to the Network Infrastructure at the High School and Middle School. Energy Efficiency. Director of Buildings and Grounds Terry Zerwashasinstalled 10,000 LED lightbulbs. In addition, the boiler at the Community Education Building has been replaced and is now more efficient, as well as the generator at St. Michael Elementary. High School. The security entrance is now complete. There are also two additions taking place which will add 12 classrooms. The dirt work has started for the All-Purpose Facility, but construction has not begun yet. There will also be new tennis courts and ball fields added next summer. The plan is for everything to be complete and open by August 2018. Ice Arena. Dr. Foucault reminded everyone there is a groundbreaking ceremony scheduled for th November 6at 4:00 pm; all are invited to attend. Mayor Kasel also reported Wright County wants topartner with Wright County Area Transportation (WCAT) and over the next five years they will completely take over everything. BACKGROUND: On August 7, 2017, the Albertville City Council approved the draft AUAR dated August 1, 2017 for the Albertville Business Park for distribution to all applicable agencies. This AUAR was sent to 22 different agencies and units of government. The City received comments from the following: Wright County MnDOT MPCA City of Otsego Minnesota Historical Society Army Corps of Engineers City staff and Landform have met to discuss these comments. Landform has created a response for each of the submitted comments for review of the City Council. Per EQB Rules 4410.3610, the RGU has 30 days after receipt of objections (comments) to prepare a written response to the objecting agency and EQB Chair. Within five days of receiving the RGU’s response, the objecting agency shall advise the EQB Chair if they accept the response or continue to object. If the objection continues, the EQB Chair shall placethe matter on the next regularly scheduled EQB meeting to make a determination if the document is adequate to prevent the occurrence of potentially significant impacts. Following the EQB finding that the AUAR document is adequate, the City may formally adopt the document. The final document with responses to the commenting agencies were sent to the EQB and commenting agencies on October 5, 2017,;the EQB has notified the City that they have received no objections to the document or the responses. They have requested that the city forward a copy of the signed Council resolution approving the final AUAR document. KEY ISSUES: The Cityhas received comments from six agencies/units of government. BACKGROUNDINFORMATION: Attached are the concept designs for both Westwind Park and Central Park. Westwind Park received a MN DNR grant fund for redesign and park improvements. The revised design illustrates the location and layout of the recommended play equipment, park shelter, free play green space, trails and boardwalk. The design reflects the comments and equipment selection of the Parks Committee. Central Park concept’slayout attempts to provide an attractive park area that facilitatesmany park activities includingFriendly City Days, Farmer’s Market, Music in the Park,etc. Each of these activities has different needs. The concept provides a significant park entrance along Main Avenue NE and center path way intended to serve each of the various uses. KEY ISSUES: WestwindPark There is a need to replace old equipment. The existing gravel area is unsightly and detracts from the park. There is a need for shaded areas i.e. shelter and landscaping The wetland area provides an opportunity for a unique boardwalk feature. The landscaping and trails will addtothe park’s aesthetics. Central Park The park’s physical configuration and existing facilities i.e. shelter, depot, and caboose serve to dictate park uses and layouts. The park’s various uses include Friendly City Days, Farmer’s Market, Music in the Park. The events contribute to the park’s accessory uses and layout. I-94 Ramp Easement. The State is asking the City to obtain I-94 ramp easement from Albertville Marketplace using a revised legal description as the State wants clearer language in the deed from the City to the State for the ramp easement. The easement area remains unchanged—the State simply wants its specific language used in the easement document. Adam is trying to reach the owner to get the new deed signed. Charter Cable. Charter Cable has replied to our request regarding the free cable service it is to provide to the City. Their contention is that the City is only entitled under Federal law to collect a maximum of 5% in franchise fees, which we are already collecting. Charter believes that provision of free cable service to municipal buildings over and above that 5% is prohibited under Federal law. I will check the law on this and see if Charter’s interpretation is correct. I have begun to compile recent Charter franchise agreements with other Cities and will be preparing a proposed franchise agreement to begin negotiations with Charter soon. Prairie Run Lots. Fieldstone Family Homes is in the process of closing on the last of Prairie Run tax foreclosure lots. Once that lot is sold, the City will own only the last undeveloped commercial lot from the Prairie Run subdivision. That lot still has unpaid special assessments related to it which the City will attempt to recoup once commercial land values recover sufficient value. Page 1 of 2 Agenda Page 53 Small Cell Antennas. In 2017, the Legislature passed a series of laws that regulate the location of the next generation of cell phone antennas, which range up to 65 feet tall and can be located within the city’s street rights of way. BACKGROUND: Pursuant to Council direction at the October 16, 2017 meeting, attached isa negotiated proposal from Stinson Leonard Street for lobbying services specific to MPCA required waste water treatment plant improvements. KEY ISSUES: Currently the City on is task to implement MPCA required WWTP improvements by 2019 at an estimated cost of $10,000,000. The City desires state funds, likely general obligation bond dollars, to greatly assist with the cost of the improvements. The Stinson Leonard Street proposal is for a term of 14 months at a cost of $2,333 per month, or $4,667 in 2017 and $28,000 in 2018. It is staff’s experience that the best way to successfully secure a state bonding dollar is with the assistance of a government relations team, such as Stinson Leonard Street. The attached proposal is specifically for state funding of the WWTP and does not include lobbying services for transportation improvements. POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority to enter into agreements for services such as lobbying. FINANCIAL CONSIDERATIONS: Funding for the lobbying services will come from capital funds designated for lobbying services from reserves and the 2018 budget. The minutes are included in the packet for Council’s review.Also, included on the consent agenda is a motion to approve the Arena Management Agreement between the two cities and School District. WWTP Project Appraisal Services: We have ordered an appraisal of the easement needed for the forcemain on the Riverwood property from Nagell Appraisal. The cost of the appraisal services is estimated to be $2,700 and is necessary to negotiate the cost of the easement. ENGINEERING/PUBLIC WORKS CSAH 18 Improvements: There will be an open house for the project from 6:00 - 7:30 p.m. on November 15 at the St. Michael City Hall. I will present the preliminary layout at the meeting. CASH 38 Improvements: The County is also working on the preliminary engineering for CSAH 38 west of CSAH 19. This is scheduled to be a 2019 project. th CSAH 19 and 57 Street Signal Improvements: There will be a couple of days next week when the signal needs to be off and temporary all-way stop signs will be used. With the exception of painting the pole and mast arms, the project is scheduled to be completed next week. WWTP Upgrades: The lake study is complete and will be presented at the November 20 meeting. th Karston Cove 4 Addition: The developer is looking at a concept with 10 single family lots. The developer has been working with the existing HOA; however the two groups are at an impasse as to whether or not the lots should be included in the existing HOA. Staff will discuss this further at the meeting.
