Mayor Hendrickson called the meeting to order at 7:03 p.m.

1). Committee Updates
Fire Board
Cocking reported Otsego has an RFP out for Station Response Study. Bullen reported that calls for
service are up and Otsego is increasing more. Vetsch inquired why calls were up. Bullen replied
calls for both Albertville and Otsego are up, but Otsego growth is faster than Albertville. Cocking
reported that a new engine is scheduled to be purchased and Bullen clarified it would be ordered in
2018 and delivered in 2019. Cocking reported the Relief Association wanted him to relay their
apologies for missing the Council meeting when the relief pension was discussed and wanted to
thank Council for the increase in benefit.
Planning Commission
Hudson reported the Commission approved a Conditional Use Permit for additional outdoor storage
for Border States Electric. Staff shared with the Commission a proposed amendment to the private
kennel ordinance. Currently, the City only allows two dogs per property and staff has received
complaints in the last year of properties that have more than two dogs. Private kennels allow up to
six dogs, but having the license does not abate the nuisance issues. The proposed change would still
only allow two dogs with the option to have three if at least one meets the State definition of a
service dog. The Planning Commission was split in their discussion of the amendment. Two
members felt that comfort or therapy dogs should be allowed as well. Hudson added there was also
a zoning amendment that outlines standards for commercial kennels and Hodena stated that must
have a public hearing.

2). Proclamation
Hendrickson stated there are a number of cities proclaiming February 15, 2018 as “Not for Sale
Day” to raise awareness about sexual exploitation and trafficking.
Motioned by Hudson, seconded by Cocking, to approve the proclamation. Ayes: Hendrickson,
Cocking, Hudson, and Vetsch. Nays: None. Absent: Olson. MOTION DECLARED CARRIED.
B. Legal
1). Amendment to Towne Lakes 6th And 7th Addition Development Agreements
Couri reported that the developer has inquired if the landscaping escrow in the development
agreements can be used towards the $2,000 per lot escrow required by the Towne Lakes
Homeowners Association (HOA). The developer’s costs have increased significantly and this would
help to free up cash for the developer. Couri stated that staff is not recommending that the total
escrow be increased and stated they believe there would not be more than $20,000 needed at any one
time (10 lots at $2,000). The HOA is willing to go along with this arrangement, but only if the City-
held escrow is put up. There is sufficient escrow held by the City in excess of the $20,000. Couri
reported the bank that issued the letter of credit for the landscaping escrow will need to sign off on
the arrangement as well. Cocking stated the HOA had concerns because landscaping is generally the
last item to be completed and they did not want to see it get overlooked.
Hendrickson inquired about the timeline for these developments. Nafstad replied that townhomes
are being built in the 6th Addition and there are six single family lots ready for homes to be built.
Utility and road construction on the 7th Addition and Hunters Lake Estates will resume in the spring.
Motioned by Cocking, seconded by Hudson, to approve First Amendment to Conditional Use
Planned Unit Development Agreement Towne Lakes 7th Addition and Third Amendment to
Planned Unit Development Agreement Towne Lakes 6th Addition, contingent on approval of the
same by the Sentry Bank. Ayes: Hendrickson, Cocking, Hudson, and Vetsch. Nays: None.
Absent: Olson. MOTION DECLARED CARRIED.
2). City Attorney Report
Couri reported that he has seen one sample of Charter’s franchise renewal for another city. He stated
the cable franchises are not exclusive in Albertville and there can be more than one provider in the
City. Hendrickson would like to make sure all cable providers are listed on the website.
C. Public Works/Engineering
1). Ordinances Relating to Storm Sewer System
Nafstad reported that due to the City’s new requirements under its MS4 permit, there are a number
of new regulations that city must put in place. The proposed ordinances pertain to prohibiting non-
stormwater discharge, establishing requirements for erosion and sediment control, and addressing
post–construction stowmwater management activities. The MPCA requires these ordinances to be in
place within 12 months of the MS4 permit issuance. He added that there will be additional
requirements that will need to be put in place in the future related to maintenance plans, inspection
plans, and public awareness of stormwater.

7-10 of the Albertville City Code relating to Drainage and Stormwater Management Standard in
the City of Albertville. Ayes: Hendrickson, Cocking, Hudson, and Vetsch. Nays: None. Absent:
Olson. MOTION DECLARED CARRIED.
Motioned by Hudson, seconded by Cocking, to adopt Ordinance No. 2018-03 Amending Section
11-7-12 of the Albertville City Code relating to Erosion and Sediment Control Standards
Associated with Subdivision of Land within Albertville. Ayes: Hendrickson, Cocking, Hudson,
and Vetsch. Nays: None. Absent: Olson. MOTION DECLARED CARRIED.

1). City Administrator’s Update
Nafstad reported that staff has received a development application for Kwik Trip for the Knechtl
property located in the northeast corner of the I-94/CSAH 19 intersection. Vetsch inquired if the
property would have a right in, right out entrance and Nafstad replied it would. Cocking inquired if
they would need easement(s) from the outlet mall and Nafstad stated they will need to coordinate
with the mall. Cocking commented that the lot seems small for the C-store, parking lot, and car
wash. Nafstad reported they plan to utilize the whole lot and the use would require a CUP, and the
city could require specific conditions of the site.
Cocking inquired if the applicant would need to submit some type of bond to cover costs associated
with any potential gas leaks. Couri explained that the owner of the property is responsible to cover
any leaks and there are reporting and testing requirements at the State level. Couri further explained
that the owner would need to maintain their own stormwater pond; the City would need easement
over that.
Vetsch felt it will be a very congested intersection. Nafstad agreed and stated staff is aware of the
current issues at Mall’s signal and those identified in the Mall of Entertainment AUAR. Nafstad
noted there are planned improvements occurring in 2019 and 19 and suggested that signal
improvements at the Mall be included.

Nafstad reported that the application will have a public hearing at the February Planning
Commission meeting.
Nafstad reported that the Joint Powers Water Board will be replacing and extending the water main
along 50th Street NE in 2018. The original main was put in during 1977, which is often called the
EDA watermain or the Joint Powers watermain.
Nafstad identified the mains that were owned by Albertville and the ones owned by Joint Powers.
He stated there is a gap in the main under I-94, as there is on the main going the tower. He stated
that replacement policies need to be equitable to all entities of Joint Powers Water and stated that
Albertville has been treated differently than this in the past. He noted in the past watermain was not
replaced as part of projects in Albertville and that Albertville has always been told Joint Powers only
owns what was built as part of the 1977 plan. He wants to be sure improves related to capacity
expansion are done using development fees and not rates. He would also like to see Joint Powers do
the utility locates for Albertville as it does for St. Michael; currently Albertville staff does the locates
in Albertville.
Nafstad reported staff purchased a used speed trailer on MnBid, which was quite a bit less expensive
than a new speed trailer. He stated he receives a good number of speeding complaints and this will
be useful to locate around town. Cocking inquired about the location of the complaints and Nafstad
replied it is mostly 51st Street NE, 57th Street NE, Kassel Avenue NE, and Karston Avenue NE.
Couri stated that speed trailers are generally very effective.
Nafstad reported the State of the Cities will be held in St. Michael on January 30.
Nafstad stated that Henry Hanson has requested to present concepts for the Heuring property along
CSAH 19. The concept would be multi-family and townhomes. Vetsch stated that during previous
conversations, the Council had indicated that apartments were not a fit for that location.
Hendrickson felt they need to see the concept and should allow the developer the opportunity to
present the concept.

BACKGROUND: The City processes claims on a semi-monthly basis. The bills are approved
through their respective departments and administration and passed onto the City Council for
approval.
KEY ISSUES:

POLICY/PRACTICES CONSIDERATIONS: It is the City’s policy to review and approve
payables on a semi-monthly basis.

payments presented.
LEGAL CONSIDERATIONS: The Mayor and Council have the authority to approve all bills
pursuant to Minnesota State Law, which requires all bills to be paid in a timely manner,
generally within 30 days unless one party determines to dispute the billing.

SUBJECT: PLANNING - BORDER STATES INDUSTRIES CONDITIONAL USE PERMIT FOR
EXPANDED OUTDOOR STORAGE
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Adopt Resolution No. 2018-04 approving the conditional use permit for Border
States Industries for expanded outdoor storage at property located at 11927 53rd Street NE in
Albertville.
BACKGROUND: Border States Industries, Inc. has submitted an application for a conditional
use permit amendment and site plan review for property located at 11927 53rd Street NE. The
proposed site plan is for the expansion of outdoor storage for truck parking.
The site is zoned I-1 Limited Industrial. Under the I-1 Zoning District, outdoor storage as an
accessory use is an allowed use by conditional use permit. The site is currently occupied by the
Border States Industries building and outdoor storage. The site is approximately 14.49 acres.
The site is adjacent to I-1 zoning on all sides.
The applicant seek to expand their outdoor storage to the east by way of amending their existing
conditional use permit.
KEY ISSUES:
• The site in question is zoned I-1, Limited Business. The current business is conforming
to City zoning. Outdoor storage is allowed by conditional use permit in the I-1 District.
• The site of the outdoor storage area is an isolated location that is screened and separated
from adjoining properties.
• A January 4, 2018 planning report reveals that the proposed outdoor storage
development plans meet the City’s standards for the conditional use permit.
• The proposed outdoor storage area will have grading, site improvements, and surfacing
that may impact in-place wetlands and drainage, requiring submission of a grading,
drainage, erosion control, and stormwater management plan to be approved by the City
Engineer. The site improvements will also require an MPCA NPDES permit.
POLICY/PRACTICES CONSIDERATIONS: In accordance with State law, public hearing
notice was published and a public hearing was conducted on January 9, 2018. The Planning
Commission found that the proposed application was consistent with the City Comprehensive
Plan, which encourages the growth of local industries, and met the standards of the Albertville

Zoning Ordinance. Planning Commission recommended that the City Council approve the
application based on the findings and recommendations of the January 4, 2018 planning report.
FINANCIAL CONSIDERATIONS: The applicant shall be responsible for all costs associated
with the conditional use permit.
LEGAL CONSIDERATIONS: In accordance with Council procedures, the Council has the
authority to approve the conditional use permit request. Approval of a conditional use permit
requires a majority vote of the Council.

WHEREAS, Border States Industries has submitted an application and plans for a
conditional use permit to expand their outdoor storage yard at their property located at 11927
53rd Street NE in Albertville; and
WHEREAS, City staff has reviewed the application materials and plans and prepared a
planning report dated January 4, 2018; and
WHEREAS, the Albertville Planning Commission met and held a public hearing on
January 9, 2018 to consider the application, plans, and the January 4, 2018 planning report and
take public testimony; and
WHEREAS, upon closing the public hearing, the Planning Commission recommended that
the City Council approve the conditional use permit with conditions outlined in the January 4,
2018 planning report; and
WHEREAS, the Albertville City Council has received the conditional use application, staff
review comments, and the Planning Commission recommendation, and agrees with the findings
and recommendations of the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Albertville, Minnesota
hereby approves the conditional use permit for Border States Industries at property located at
11927 53rd Street NE in Albertville, Minnesota based on the plans dated 12/12/2017 with the
following conditions:
1. Submission of a detailed grading, drainage, and erosion control plan.
2. Subject to the recommendations of the City Engineer with regard to site grading,
surfacing, erosion control, and stormwater management.
3. The site will require an approved MPCA NPDES permit.

ISSUES ANALYSIS
Visioning Study. The Visioning Study for the City of Albertville identifies the goal to
“promote continued industrial development in order to expand local employment
opportunities and the City’s tax base.” The applicant’s’ proposal fits with the goal of the
Visioning Study.

Zoning. The subject site is zoned I-1, Limited Industrial. Within the I-1 District, outdoor
storage is a conditional use.
Existing Adjacent Uses. The site is adjacent to I-1 zoning on all sides. The site is also
heavily wooded and limited visibility from abutting sites is expected.
Setbacks. The following table illustrates that the proposed building will meet the required
setbacks:

Lot Area, Width, and Depth. The subject site is approximately 14.49 acres in area; has a
lot width of approximately 600 feet; and a depth of approximately 958 feet. This exceeds
the standards for the I-1 District.
Easements. The site has a drainage and utility easement that runs along the south side of
the property. This is subject to further review by the City Engineer.
Maximum Site Coverage. Within the I-1 District, the total impervious surface is limited to
85%. The total lot area is 14.49 acres. The existing site coverage is approximately 7.39
acres. With the proposed outdoor storage expansion, the impervious surface will increase
1.85 acres for a total of 9.24 acres and 64% impervious surface. The site coverage will be
well below the 85% limit.
Site Lighting. The applicant has submitted a lighting plan (Exhibit C) that shows nine
lights. The lights will be angled at 90 degrees toward the ground. The photometric plan
shows that the perimeter of the property will have between 0.2 foot candles and 3.9 foot
candles. The applicant has provided information on the proposed light fixtures the mounting
height will be 28 feet high and the fixture will be 90 degree full cutoff lights. Both features
meet the City Code standards.
Parking. The parking area is on the west side of the building away from the proposed
storage expansion. The storage area will be enclosed with a fence. By code, the outdoor
storage area cannot encroach on the parking area. The existing fence on the west side of
the building will ensure compliance with this requirement.
Landscaping. The site is heavily wooded on all sides. No additional landscaping will be
necessary with the outdoor storage expansion. The area has wetlands to the south and
north of the site and thus, no development.
Grading and Drainage Plan. The applicant has submitted a grading and drainage plan
(Exhibit B) that directs hard surface stormwater to the south central part of the expansion

area lot as well as the northwest part of the expansion area. This plan is subject to further
review by the City Engineer.
Conditional Use Permit. The applicant has applied for a conditional use permit to expand
their outdoor storage as an accessory use. The following is an analysis of the requirements
for outdoor storage:
1. The area occupied is not within a required front or required side yard.
Staff Comment: The proposed location meets this requirement.
2. The storage area is totally fenced, fully screened, and landscaped according to a plan
approved by the Zoning Administrator, and a landscape guarantee, as determined by
the Zoning Administrator, is provided.
Staff Comment: The applicant is proposing a chain link fence to comply with this
requirement. The existing tree and vegetation provide required screening on the site.
The outdoor storage site is also isolated from adjacent properties.
3. The storage area is grassed or surfaced with asphalt, concrete, or crushed rock
(concrete or granite) to control dust. Should an area surfaced with anything other
than hard surfacing prove to be unmaintainable, the City shall require that a hard
surface be installed within three months of formal written notice to the property
owner.
Staff Comment: The applicant is proposing a gravel surface for this area. This is
subject to further review by the City Engineer.
4. All lighting shall be hooded and so directed that the light source shall not be visible
from the public right of way or from neighboring residences and shall be in
compliance with Section 1000.10 of this chapter.
Staff Comment: The applicant has submitted a lighting plan for review. The height
and illumination comply with the City’s requirements. Staff is requesting a sample of
the type of light fixture and pole height for review.
5. The storage area does not encroach upon required public or employee parking
space(s), required loading space, or snow storage area as required by this ordinance.
Staff Comment: The proposed storage area is on the opposite side of the building
from the parking lot.
6. A site plan documenting the location and grading of the storage operation shall be
submitted and shall be subject to the approval of the City Engineer.
Staff Comment: The applicant has submitted this plan. The City Engineer will review
and provide comments.

SUMMARY AND RECOMMENDATION
Border States Industries, Inc. has applied for an amendment to an existing conditional use
permit to allow for the expansion of outdoor storage. The storage is on the east side of the
property and is surrounded by trees and wet areas. The proposed expansion will have
minimal impact on adjacent land uses.
Based on our review of the plans submitted on behalf of Border States Industries, Inc. dated
December 12, 2017, we recommend approval of said plans with the following conditions:
1. Submission of a detailed grading, drainage, and erosion control plan.
2. Subject to the recommendations of the City Engineer with regard to the site grading,
surfacing, drainage, erosion control, and stormwater management.
3. The site will require a MPCA NPDES Permit.

4th Quarter Budget to Actual: Attached is the 4th Quarter 2017 un-audited General Fund
summaries of revenues and expenditures. Revenues and expenditures are generally expected to
be at 100%. This summary shows operating revenues are at 104.31% and operating expenses are
under budget at 95.12%. Staff is continuing to process 2017 expenses and must also complete
transfers, allocations of interests for investments, receivables, contract payments, and capital
assets, so this is only a preliminary summary of the 4th quarter. Council can expect to see the
final 4th quarter summary and audited financial statements in April.

RESOLUTION NO. 2018-05
A RESOLUTION OF SUPPORT FOR INTERSTATE 94 EXPANSION
CORRIDORS OF COMMERCE PROJECTS
WHEREAS, Interstate 94, between St. Michael and St Cloud, is the most heavily
traveled and congested corridor in Greater Minnesota connecting individuals and businesses
across the state to and from the Twin Cities Metropolitan Area, St. Cloud Region, and beyond;
and
WHEREAS, the Corridors of Commerce program was created and funded by the
Minnesota Legislature in 2013 for the specific purpose of funding the expansion and
improvement of interregional corridors like Interstate 94, which play an important role in the
movement of freight and people between regions of our State and throughout the Country; and
WHEREAS, in 2013 the State of Minnesota Corridors of Commerce Program invested
to expand Interstate 94 from TH 101 in Rogers to TH 241 in St. Michael from four to six-lanes;
and
WHEREAS, in 2014 the State of Minnesota Corridors of Commerce Program invested
an additional 1.4 Million Dollars to design the next four to six-lane expansion segment of
Interstate 94 from TH 241 in St. Michael through CSAH 19 in Albertville; and
WHEREAS, communities and businesses across northwest Minnesota, including the
City of Albertville have publicly voiced their support for this project through their membership
in the I-94 West Corridor Coalition.
NOW, THEREFORE, IT BE RESOLVED that the City of Albertville supports the use
of Corridors of Commerce funding to expand Interstate 94 to six lanes between St. Michael and
Albertville.

SUBJECT: CITY HALL - AUTHORIZE IMPROVEMENTS FOR THE COUNCIL CHAMBERS AND
MULTI-PURPOSE ROOM
RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO: Authorize new flooring, paint, and window coverings for the Council Chambers
and Multi-Purpose Room at a cost not to exceed $22,500.
BACKGROUND INFORMATION: The Albertville City Hall was constructed in 2006. The
carpet and window coverings in both the Council Chambers and Multi-Purpose room are original
to the building. The paint has been re-done one time, but only under the chair railing in both
rooms.
Both rooms, especially the Multi-Purpose Room, get extensive use during the week as part of the
City’s rental program and the carpet and walls are showing signs of age. The carpet is in need of
replacement and the walls are in need of repair.
Staff has consulted with an interior designer to get input on type/color of flooring, paint color,
and window covering ideas. The current plan is to install a strip of luxury vinyl flooring along
the outside of the kitchen (typically where buffet tables are set) and carpet tiles in the remainder
of the space. The luxury vinyl flooring will hold up to high use and food service lines better than
the carpet has. The carpet tiles would allow us to replace individual tiles if one is stained or
damaged. As part of the project, the entire room will be painted and new window coverings
installed.
Based on the low quotes received for the various work, staff recommends authorizing a project
budget of $22,500. The work and related cost is as follows:
• Flooring $18,586.93
• Paint $1,900.00
• Window Coverings $1,700.00
The project could potentially be completed in one week, around the last week of March.
KEY ISSUES:
• The original carpet, paint, and window coverings in the Council Chambers and Multi-
Purpose Room are 11-years old and in need of replacement and repair.
• The existing finishes would be replaced with luxury vinyl flooring, carpet tiles, new paint,
and new window coverings.

GENERAL ADMINISTRATION
Resolution of Support for I-94: Included in the packet is a resolution of support for I-94 as a
Corridor of Commerce project. The project recommendation period ends February 5, and it is
expected project award announcements will be made in April.
Doug Carlson Development Concept: Henry Hansen with Doug Carlson Development has
asked to be on the agenda to present a preliminary concept for multi-family housing on the
Leuer Property located on the west side of CR 19. Mr. Hansen is looking for feedback from the
council if they are supportive of the concept.
Central Park: Included in the packet is revised Central Park concept staff would like to discuss at
the meeting.
Pay Equity Implementation Report: Every three years cities are required to complete and
submit a pay equity report. Albertville has completed and submitted the report and will review
the results at the next Personnel Committee meeting.
I-94 West Corridor Coalition: We have renewed the city’s membership with the I-94 Corridor
Coalition. Membership fees are based on population at $0.50 per capita.
Personnel Committee: The personnel committee will be meeting to review 2017. Annually the
committee meets to review personnel policies, pay schedules, salary surveys, employee
performance, staffing levels, etc.
Public Works Committee: We plan to have a Public Works Committee meeting prior to the
second meeting in February to review the city’s fleet CIP and proposed purchases for 2018.
ENGINEERING/PUBLIC WORKS
2019 WWTP Improvements: Bill Waytas, of Nagell Appraising, has reviewed the two parcels
between CR 39 and the Mississippi that we need utility easements for the new discharge pipe. I
anticipate Bill’s report in the next few weeks. The preliminary design of the project is
progressing well. We have reviewed the preliminary plans with the County and will be
conducting small utility meetings later this month.
Mapping: We are in the process of updating the City’s infrastructure maps. 2018 maps should
be available in late February.
Sliding Hill: Staff is reviewing options for a sliding hill at Four Seasons Park, as we believe
Central Park poses too many challenges given the limited space.

Park Property: Staff is researching park property pursuant to previous Council discussions.
CSAH 19 and 57th Street Signal Improvements: In the spring, the Contractor will need to sod all
disturbed areas, and paint the signal poles and mast arms per the contract.
CSAH 18 (Barthel Industrial Dr. to Naber): The County is progressing well with the design of
CSAH 18. They intend to bid the project in April, with construction beginning in May.
Construction will require the road be closed during the construction season. Due to poor soils,
it is likely certain area of the road will need to be corrected by means of surcharging.
Surcharged areas or the road will not be completed until the following year; however, the road
will be open to traffic during the school months. The project is estimated to cost $2.9 million
(not including land). Albertville’s share per the County’s funding policy is estimated at
$213,000.
