Mayor Hendrickson called the meeting to order at 7:04 p.m.

3.RECOGNITIONS –PRESENTATIONS –INTRODUCTIONS
A.Legislative Recap –Representative Eric Lucero
Hendrickson thanked Representative Lucero for his work on co-authoring the bill that provided
Albertville with $2 million in funds for the Wastewater Treatment Plant (WWTP) improvements.
Lucero provided a summary of legislative action taken this session.He felt it was a successful
session except that the tax conformity bill did not get approved. He stated that hundreds of hours
have been spent on Corridors of Commerce funding and he is excited to see the three lane expansion
of I-94 into Albertville. He stated his frustration with regulatory mandates that greatly impact the
cost to taxpayers and that is why he co-authored the bill for the WWTP funding.
Lucero reported that the student data privacy legislation did not move forward.
Hendrickson inquired about the total amount dedicated to the Corridors of Commerce projects and
Nafstad replied it was $400 million. Lucero stated it has been a huge year in terms of transportation.
Hudson inquired about the recent movement of voting for super omnibus bills that include
everything rather than bills specific to certain projects. Lucero replied that it is a much divided
legislature and some feel it is easier to get votesthat way. However, he felt it reduces

accountability. Hudson would like to see measures put in place that would require votes earlier in
the session rather than waiting until the last minute.
The Council thanked Lucero for his work and especially for his efforts for the funding for the
WWTP improvements. Nafstad also thanked him for the ease in which it is to get ahold of him.

There was no one present for the forum.
5.AMENDMENTS TO THE AGENDA
Nafstad added STMA Ice Arena Screening as item F1 under Planning and Zoning.

STMA Ice Arena Second Sheet Roof Screening
Nafstad reported that as part of the construction of the second sheet of ice, the equipment on the roof
is required to be screened from view by City Code. This is required for all new commercial
buildings. The school district’s architect has asked if they can forego that requirement on the east
side of the building due to costs associated with it. Cocking inquired if the screening also reduced
the noise of the rooftop equipment and Nafstad replied it did not. Nafstad offered painting the
rooftop equipment as a possible solution.
Vetsch stated that when the Joint Powers Water building was constructed,the same concerns were
raised; but the City requested that the equipment be screened. He did not feel it would be fair to
require it for one and not the other. Brixius offered two options: paint the equipment the color of the
building or stick with the original plans as submitted. Cocking felt it is not appropriate to exempt
the projectfrom the city’s own building regulations, especially being a partial owner of the facility.
Couri reported with variances, financial hardship is not a reason to grant a variance. The hardship
should be unique to the property itself and not be financial in nature.
Council directed staff not to waive the screening requirement.

1).Centennial Celebration –Discussion
Nafstad reported that planning for the centennial celebration should begin as early as possible and he
wanted to get Council feedback on planning for the centennial as well as the types of events that
could go along with the celebration. He stated that as they begin the 2019 budget discussions, they
will need to determine budget amounts.
Council directed staff seek input from the Parks Committee as the group represents many different
areas of the community.
Nafstad briefly discussed timing of the celebration as well as a commemorative art piece.
Council referred the centennial discussion to the Parks Committee to discuss at their next meeting.

2).City Administrator’s Update
Nafstad reported the Depot is nearly finished and the Lions are hoping to use it shortly after Friendly
City Days. He reported that rental of the depot will slowly be rolled out as they figure out details
and policy.

BACKGROUND:
The applicants: Rose Thunder, Rebecca Dallin and Cari Smiley,have applied
for a Therapeutic Massage Enterprise License for their business, St. Michael Massage and

Bodywork, located at 10904 57 Street NE, Suite 109. This space is located in the Parkside
Commercial Center. The business is relocating from their current location in St. Michael.
City Code requires each business that offers massage therapy to obtain a yearly Therapeutic
Massage Enterprise License.There must be an original investigation of the business owner and
inspection of the property before issuance of the license. In addition to the enterprise license,
each individual practicing massage therapy at the enterprise must obtain a yearly Individual
Massage Therapy License. The applicants will be persons performing massage at the location
and have submitted the appropriate license applications and fees.
KEY ISSUES:
The applicants havesubmitted a complete application and have been made aware of the
required fees, insurance requirements, and inspection.
Staff has submitted the applicants’ background investigation to the MN BCA as well as
Wright County Sheriff’s Office and is waiting for the results.
The location is compliant with fire code and building as required by the City Code. The
Building Department also requires a tenant occupancy permit.
POLICY/PRACTICES CONSIDERATIONS:
The Mayor and City Council have the authority
to approve or deny any application for a city-regulated business.
FINANCIAL CONSIDERATIONS:
The fee for a Therapeutic Massage Enterprise License
covers both administrative, inspection, and background costs.

RECOMMENDATION:
It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO:
Authorize the purchase of2 portable radios for the Fire Department.
BACKGROUND:
The Fire Department’s portable radios arepart of a planned rotation of
equipment and budgeted in the Fire Department’s capital plan.
To coincide with the FEMA Assistance to Firefighters Grant application, which requested 20
portable radios, the Fire Department also requested 2 additional portable radios from the 2018
Wright County Area United Way Grant program. The two portable radios requested from the
2018 Wright County Area United Way Grant program are for the two driving positions in Engine
11 and Ladder 11 and are not allowed for request from the FEMA AFG grant program.
The grant request to cover the equipment cost of the portable radios was $5,780.88.
The Fire Department recently received notification from theWright County Area United Way
that they were graciously awarded a partial grant of $2500.00 to assist in covering the cost of the
two portable radios.
The total cost of the portable radio purchase, with radio programming, is $6,392.88. With the
$2500.00 in grant money, the remaining cost to the Fire Department of $3,892.88 will be paid as
aplanned purchase and will come fromthe FireDepartment’s capital budget.
Staff is recommending approval of the purchase of 2 portable radios for the Fire Department.
KEY ISSUES:
TheFireDepartment Board of Officershasreviewed the purchase and isrecommending
Council action.
$2,500 of the purchase will be covered bya grantfrom theWright County Area United Way.
The remaining $3,892.88 will come from the Fire Department’s capital budget.
The purchase of the portable radios is a planned replacement and part of the capital plan of
the Fire Department.

ABSENTEE BALLOT BOARD FOR THE 2018 PRIMARY ELECTION
WHEREAS,
a State Primary Election will be held on Tuesday, August 14, 2018 and a
State General Election will be held on Tuesday, November 6, 2018, and;
WHEREAS,
the City of Albertville is the responsible authority to conduct absentee
voting for such election and is required by Minnesota Statutes 203B.121, Subd. 1 to establish an
Absentee Ballot Board effective June 26, 2018, and;
WHEREAS,
this board will bring uniformity in the process of accepting or rejecting
returned absentee ballots in Albertville, and;
WHEREAS:
the Absentee Ballot Board will consist of a sufficient number of election
judges, as determined by the City Clerk, as provided in sections 20B.19 to 204B.22, and;
NOW, THERFORE, BE IT RESOLVED

BACKGROUND:
The City has been notified that the current owner of the Cottage of
Albertville, REE Cottages of Albertville LLC (the “Seller”),intends to sell the facility to Kalland
Avenue Properties, LLC (the “Buyer”), and the Seller has requested that the City consent toan
assignment of the Contract for Private Development and the TIF Note by the Seller to the Buyer,
an assignment of the Regulatory Agreement that governs the use of the facility by the Seller to
the Buyer, and a collateral assignment of the Contract and TIF Note by the Buyer to the lender
providing the financing to the Buyer. Under the original Contract, the City agreed that it would
consent to such assignments if required by the lender, so City Development Counsel (Kennedy &
Graven) recommends approval of these documents as required under the Contract.
KEY ISSUES:
The Council has previously approved substantially similar assignments of the Contract
for Private Development, the TIF Note, and the Regulatory Agreement in connection
with the sale of the facility from the original developer to the Seller in December of 2016.
There is no basis on which to deny these assignments in connection with this sale.

There are no financial considerations for this item.

RESOLUTION APPROVING ASSIGNMENTS OF TAX
INCREMENT FINANCINGAND REGULATORY
AGREEMENT IN CONNECTION WITH COTTAGES OF
ALBERTVILLE; AUTHORIZING EXECUTION OF
CONSENTS TO SUCHASSIGNMENTS
WHEREAS, the City of Albertville(the "City") executed and enteredinto that certain
Contractfor Private Development dated as of September 22, 1999(the “Contract”) with Cottages of
Albertville, LLC (the “Developer”) and Group for Affordable Housing – Albertville, LLC(the
“Holder”) for the construction of a certain senior housing facility within the City (the “Facility”);
and
WHEREAS, pursuant to the Contract, the City issued its Tax Increment Revenue Note,
Series 1999 in the original principal amount of $390,000 (the “TIF Note”) to the Holder; and
WHEREAS, the Developerconveyedthe Facility and assignedits rights and obligations
under the Contract to REE Cottages of Albertville LLC (“REE Cottages”) and the Holder assigned
the TIF Note toREE Cottages, pursuant to anAssignment and Assumption of Contract for Private
Developmentbetween the Developer, the Holder, and REE Cottages, dated as of December 22,
2016(the “TIF Assignment”), approved bythe Cityby resolution on December 19, 2016;and
WHEREAS, by resolution on January 16, 2017, the City additionally approved an
Assignment and Assumption of Amended Regulatory Agreement between the Developer and REE
Cottages, dated as of December 22, 2016 (the “Regulatory Assignment”); and
WHEREAS, REE Cottages now desires to convey the Facility and to assign its rights and
obligations under the Contract, TIF Note, and Regulatory Agreement to Kalland Avenue Properties,
LLC (“Kalland”), and has requested that the City approve the form of a new Assignment and
Assumption of Contract for Private Developmentand a new Assignment and Assumption of
Amended and Restated Regulatory Agreement (together the “2018 Assignments”); and
WHEREAS, in order to obtain financing for the acquisition of the Facility, Kallandintends
to collaterally assign to American Heritage National Bank(the “Lender”)its rights under the
Contract, including its right, title to and interest in the TIF Note, pursuant to the Assignment, Pledge
and Security Agreement of Tax Increment Financingbetween Kallandand the Lender (the
“Collateral Assignment”), and has requested that the City acknowledge and consent to the Collateral
Assignmentthrough execution of the Consent of City of Albertville, Minnesota(the “Consent”);
and
WHEREAS, the City’s DevelopmentCounsel has reviewed and approved the language of

CONSENT OF
THE CITY OF ALBERTVILLE, MINNESOTA
City
The CITY OF ALBERTVILLE (“”) acknowledges that it has reviewed the
Assignment
Assignment, Pledge and Security Agreement of Tax Increment Financing (“”)
entered into by andbetween KALLAND AVENUE PROPERTIES, LLC, a Minnesota limited
Borrower
liability company (“”), and AMERICAN HERITAGE NATIONAL BANK, a national
Lender
banking association (“”) datedJune ___, 2018, and consents to the endorsement of the
TIF Note (as defined in the Assignment), to the assignment of the Collateral (as defined in the
Assignment), and toBorrower’smortgage of the Property
(as defined in the Development Agreement) to Lender, its successors and/or assigns, and to the
pursuit of all of Lender’s remedies in connection therewith. Payments under the Note (as defined
in the DevelopmentAgreement) shall continue to be madetoBorrower, until Lender gives notice
to City thatpayments under the Note shall be paid to Lender. Upon receipt of such notice,
payments under the Note shall be made to Lender. All terms used herein not otherwise defined
shall have the meanings set forth in the Assignment and the Loan Documents described therein.
City further covenants, represents and warrants to and agrees with Lender as follows:
1.That it has received good and valuable consideration for the TIF Note and the
Development Agreement.
2.That the unpaid principal balance due on the TIF Note as of the date hereofis $263,300,
andno defaultsor events of default exist under the terms of said TIF Note or the
Development Agreement.
3.The Minimum Improvements, as defined in the Development Agreement, have been
fully constructed in accordance with the Development Agreement.
4.The Borrower is in compliance with theterms of the Development Agreement,and the
Development Agreement and the TIF Note remain in full force and effect.
5.There are no defenses, setoffs or counterclaims against or with regard to the TIF Note
or the Development Agreement or the indebtedness evidenced thereby. The TIF Note
and the Development Agreement constitute all of the documents entered into by the
undersigned in connection with the TIF Note and have not been amended or modified
except as described in the Assignment and are valid and enforceable obligations of
City in accordance with their terms.
6.City hereby agrees that should Lender obtain the appointment of a receiver or become
the owner of the Property, or otherwise enforce its rights under the Loan Documents,
Lender shall not be obligatedto perform the terms and conditions of the Development
Agreement; provided, however, that performance of the terms and conditions thereof

shall be a condition to City’s payment of tax increment under the TIF Note to Lender
under the terms and provisions hereof.
7.In addition to providing the Borrower notice of default under the Development
Agreement, the City agrees to provide Lender, its successors and assigns, with copies
of any notice of default given under the Development Agreement and that Lender, its
successors and assigns, shall have the right but not the obligation to cure any such
default on behalf of the Borrower within the time specified in the Development
Agreement, provided that should possession of the Property be necessary in order to
cure such default, such time shall include a reasonable amount of time for Lender to
obtain possession of the Property and to cure such default. Should an Event of
Default occur under the Development Agreement, such that the City has the right to
cancel, terminateor rescind the TIF Note and the Development Agreement or the
TIF Note and Development Agreement are cancelled, terminated or rescinded for
any other reason, the City shall upon request of Lender honor the TIF Note and the
Development Agreement as a directobligation to Lender, its successors or assigns,
for the remaining unpaid principal balance thereof, provided that Lender has cured
the Event of Default under the Development Agreementexcept Events of Default
resulting from a bankruptcy filing by the Borrower or foreclosure of the Security
Instrument.
8.Provided all other provisions of the Development Agreement which are conditions
to payment under the TIF Note are satisfied, the Development Agreement and the
obligations of the City under the TIF Note shallnot be relieved, hindered or
restricted in any manner by reason of the foreclosure of the Security Instrument or
any other remedies which Lender may pursue under the Note or other Loan
Documents, including the transfer of the Project to or by Lender, its successors and
assigns.
9.The undersigned understands and agrees that this Consent of the City of Albertville
(“Consent”) is executed and delivered in order to induce Lender to make the Loan (as
described in the Assignment) and but for this Consent Lender would not make the
Loan.

KEY ISSUES:
A resolution to approve the Lawful Gambling Premises Permit for the STMA Youth
Hockey Association is attached. Local governing board approval is required prior to
submitting the application to MN AGED.
Lawful Gambling Premises Permits are perpetual, requiring no renewals once issued.
No new investigation is needed on the applicant as one has already been conducted for
their other establishments.

This space on the agenda is reserved for the City Council to consider
approval of the plans and specifications and acceptance of the lowest bid received for the
Westwind Park Improvements project. It is respectfully requested that the Mayor and Council

INFORMATION:
The proposed improvement project was advertised and on
June 13, 2018, bids
for the improvements were opened. A total of two (2) bids were received with proposals in the

improvements generally include excavation and grading, concrete sidewalk and bituminous trail
construction, and turf restoration.
KEY ISSUES:

Low Bid Received by Omann Brothers, Inc.
The City has received a $150,000 matching grant from the DNR for improvements to
Westwind Park and has entered into a contract with the DNR to have the park
improvements completed by December 31, 2019.
Last fall the City purchased new playground equipment under a separate contract.
Separate contracts will be required for installation of playground equipment, purchase of
woodchips, installation of drinking fountain, park shelter, and construction of wetland
boardwalk.
FINANCIAL CONSIDERATIONS:
Thetotalproject will be funded through multiple funds,
including the $150,000 DNR grant, and will include multiple construction contracts. Thelow
bid for site improvements, as included in the Bolton and Menk plan set and dated 5/29/18, is for
$134,472. This amount does not include the overhead costs associated with surveying services
or construction inspection and testing.
LEGAL CONSIDERATIONS:
The Mayor and Council possess the authority to authorize
municipal improvements,and to accept or reject bids for municipal improvements.

GENERAL ADMINISTRATION
Depot Project: The Depot project is complete and looks great. The Lions had the Depot open
today for a music performance during the farmers market.
Centennial Celebration: I will be meeting with the Parks Committee at the end of the month to
discuss planning for the events.
July 2 Meeting: This meeting has been cancelled. We will plan for a workshop meeting and
regular meeting for July 16. Topics will include fire capital and budget.
Park Property Acquisitions: We have prepared draft purchase agreements and are in
discussion the two property owners.
Conduit Financing:We are working with Kennedy and Graven on a possible opportunity to
provide conduit debt for a project in Buffalo. Albertville has no plans to utilize its bonding
authority in 2018 and conduit financing would provide the city with a one-time revenue source.
$2,000,000 Appropriation: Included on the agenda is a resolution needed by the State to be
included with the application for Albertville’s grant funding from the 2018 state bonding bill.
ENGINEERING/PUBLIC WORKS

70 Street (west of CSAH19): Staff from Albertville and Otsego are working with MnRoad to
th
see if there is a possibility to partner on a project to improve the 1 mile segment of 70
between Kadler and CASH 19.
2019 WWTP Improvements: Preliminary design is nearing completion and we continue to
work to negotiate the needed easements between CR 39 and the Mississippi.
Mapping: We are in the process of updating the City’s infrastructure maps. 2018 maps should
be availablesoon.

CSAH 19 and 70 Street: The County is progressing with the preliminary design of CSAH 19 and
CSAH 38, which is scheduled for construction in 2019. Next week I will be meeting with the
Outlet Mall to review options for intersection improvements and the County will be holding the
first open house in July.
Westwind Park Improvements: Bids were opened on June 13 and are on the agenda to award.
We are still working on quotes for the shelter and boardwalk.

Karston Cove 5 Addition: The City has received the development application for final plat for

Karston Cove 5 Addition and will be presented to Council in July.

Towne Lakes Trails: It is anticipated the contractor will be able to complete paving of the trails
in Towne Lakes next week.
MS4:As a requirement of the City’s NPDES permit, the City needs to hold an MS4 stormwater
meeting prior to June 30 of each year. This will be the City’s first stormwater meeting and will
generally consist of a brief educational stormwater presentation and Q&A. We will be sending
out public notice later this month and holding the meeting the last week of June.
