AN ORDINANCE REQUIRING RECYCLING SERVICES
FOR RESIDENTIAL BUILDINGS WITH MORE THAN
EIGHT DWELLING UNITS
The City Council of the City of Albertville, Hinnesota,
ordains:
Section 1.

Section 2. Definitions. The following terms as used in this
Ordinance, have the meanings as indicated:
( a) "Multiple family dwellings" means a building or portion
thereof containing eight or more dwelling units.
(b) "Designated recyclables" means the following recyclable
materials: aluminum recyclables, can recyclables, glass
recyclables, paper recyclables, plastic bottle recyclables, and
corrugated cardboard.
(c) "Aluminum recyclables" means disposable containers
fabricated primarily of aluminum, commonly used for soda, beer, or
other beverages.
(d) "Can recyclables" means all disposable containers
primarily of metal or tin.
(e) "Glass recyclables" means unbroken jars, bottles, and
containers which are primarily used for packing and bottling of
various matter.
(f) "Paper recyclables" means newsprint, office paper, and
other uncoated paper products. The term does not include paper
products with a waxy, polished. or glossy surface, such as glossy
magazines, and does not include paper products that are bound
together with glue, such as telephone books.
(g) "Plastic bottle recyclables" means all disposable
bottles fabricated from plastic.
(h) "Corrugated cardboard" means cardboard material with
double wall construction and corrugated separation between walls.
(i) "Collection" means the aggregation of recyclable
materials from the place at which it is generated and includes all
activities up to the time when the waste is delivered to the
facility designated by the owner of the multiple family dwelling.

Section 3. Collection Services ReQuired. The owner of a
multiple family dwelling shall make available to the occupants of
all dwelling units on the premises services for the collection of
designated recyclables. The collection services shall be available
on the premises and shall be provided on a regularly scheduled
basis. The owner and owner's employees may provide the collection
services personally, or the owner may contract with a licensed
collector.
Section 4. Recvclin~ Information R~Quired. The owner of a
multiple family dwelling shall provide information to the occupants
of each dwelling unit which notifies the occupants of the
availability of collection services, described the procedures
required to prepare the designated recyclables for collection, and
identifies the dates and times of collection.

Section 5. Container ReQuirements. The owner of a multiple
family dwelling shall provide containers for the collection of
designated recyclables and shall maintain the containers in a clean
and sanitary condition. The containers shall be sufficient in
number and size to meet the demands for recycling services created
by the occupants. Containers shall be placed in a location on the
premises which permits access for collection purposes but which
does not obstruct pedestrian or vehicular traffic and must comply
with the City's zoning ordinance.
Section 6. Transportation and Disposal. Upon collection by
the owner, owner's employees. or licensed collector, that person
shall deliver recyclables to a recyclable material processing
center, an end market for sale or reuse, or to an intermediate
collection center for later delivery to a processing center or end
market.
Section 7. Annual Report. Each owner of a multiple family
dwelling shall file a report with the City (i) within 60 days of
acquiring an ownership interest therein, and (ii) on an annual
basis no sooner than January 1st and no later than January 31st of
each calendar year. The report shall contain, at a minimum, the
following information:
(a) name of owner
(b) address of multiple family dwelling
(c) number of dwelling units
(d) description of collection services, including date and
time of collection, and who provides the services
(e) description of methods used to inform occupants of
availability of services
(f) name and address of licensed collector that provides the
service
.
Section 8 . Penalties for Violation. Violation of this
Ordinance is a misdemeanor punishable by a fine of $750.00. A
fourth or subsequent violation of this Ordinance is a misdemeanor.

A-200.1. Qualification. This Section shal I apply to the fol lowing
applicatIons:
In the case of a request to divide a portion of a lot where
dIviSIon is to permit the adding of a parcel of land to an
abutting lot so that no additional lots are created and both new
lots conform to 20nIng Ordinance lot size minImum standards.
(b) In the case of a request to combine two (2) existing platted
lots.
(c) In the case of a request to diVIde a lot from a larger tract
of land and thereby creating no more than two lots. To qualify,
the parcel of land shal I not have been part of a minor subdivision
WIthIn the last five (5) years.

(d) In the case of a request to divide a base lot which is a
part of a recorded plat upon which has been constructed a
two-family dwel ling, townhouse or quadraminium, where the division
IS to permit IndiVIdual private ownership of a Single dwelling
unIt within such a structure and the newly created property lines
will not cause any of the unit lots or the structure to be In
VIolation of thIS Chapter, the Zoning Ordinance, or the State
BUIlding Code.

Content and Data ReQuirements.
Certificate of Survey. The requested minor division shall be
prepared by a registered land surveyor in the form of a
CertifIcate of Survey.
Itb') Property DescriptIon and Submission Information. The data
and supportIve informatIon detailing the proposed subdivision
shall be the same as required for a preliminary plat as described

<a) If the land division involves property which has been
previously platted, or the total property area involved is greater
than ten (10) acres, the City Administrator shal I have the
authority to approve the subdivision, provided that it complies
with applicable provisions of this Chapter.
In the case of applications involving property not previously
platted, and is less than ten (10) acres in total area,
applicable precessing provisions of Section A-300.2 of this
Chapter, Preliminary Platting, shall be fol lowed.

A-300.1. Sketch Plan. In order to Insure that all applicants are
Informed of the procedural requirements and minImum standards of thIS
Chapter and the requirements or limitations imposed by other City Code
prOVISions or plans. prIor to the development of a prelIminary plat. all
applIcants shal I present a sketch plan to the City Administrator prIor
to filIng a prelIminary piat. The Cltr AdmInistrator may refer said
sketch plan to City Staff. the Planning CommIssion and/or the City

Filing:
(1) The applicant or his surveyor or hIS planner or another
deSignated agent, shal I prepare and fIle a plat which is In
conformity WIth the reqUIrements of thiS Chapter. The
applicant must demonstrate to the CIty, ownership of the
land In questIon or show the legal and written power to file
a prelimInary plat applicatIon for the land In questIon.
C. The applicant also shall complete an "Appl icaUon tor
ConslderaUon of Planning Request", and/or such other
application form as may be reqUIred, and shal I submit any
additional InformatIon, plans or studies as are reqUired by
this Chapter. and shal I furnish the City Administrator with

plat no larger than eleven by seventeen (11 x 17) inches.

(5) Should the applicant deSire to amend a prelIminary plat
as approvea. the applicant may suomlt an amended preliminary
plat. The applicant shal I fol low the same procedure as a
new preliminary plat. No public hearing or fee Will be
required unless the amendment. In the opinion of the City
Council, IS of such scope as to constitute a new preliminary
plat.

Final Plat.
(a) Filing: After the preliminary plat has been approved. the
final plat shall be submitted for review as set forth In the
subsectIons which fol low. The City may agree to reVIew the
preliminary and fInal plat sImultaneously. The final plat shall
Incorporate all changes. modifications and revisIons required by
the City. OtherWise, it shal 1 conform to the approved preliminary
pI at.
(b) Except as provided as specified as part of a Development
Contract, the sUbmIssion of a final plat application shall be no
later than one hundred (100) days after the date of approval of
the prelimInary plat for distribution to the City Council and
approprIate City staff. Ten (10) copies of the fInal plat and one
(1) reduced copy no larger than eleven OJ' seventeen (11 x 17)
Inches shal I be submitted to the City Administrator for City
review.

(c) All final plats shal I comply WIth the prOVisions of Minnesota
State Statutes and requirements of thiS Chapter.
