Dennis Fehn: A decision should be made with regard to how you want to deal with this situation. Is re-zoning the only option, and is that in the best interest of the City? Is it feasible to change the Zoning Ordinance to incorporate this type of situation. 2. Russ Voght: Would like to address the Commission regarding the on-going drainage problem at the old PPM building. 3. Proposed Mini Storage Facility: The plans are at City Hall should you wish to review them prior to the meeting. 4. Deborah Carron is requesting permission to put up a temporary hoop-house on Hackenmueller' s property from which she would sell flowers during the months of May and June. It appears that the property is zoned correctly and is a permitted use. 5. Proposed Steffen Brothers Meats: The plans are at City Hall should you wish to review them prior to the meeting. 6. Ordinance Amendments: Please review prior to the meeting. This will save time both on the 14th and at the Public Hearing on the 28th. Please review the enclosed proposed amendment to the Subdivision Ordinance. This should make the subdivision process easier for people in the same type of situation as Dayle Veches. This ordinance amendment would require a public hearing. . . . 7. Dennis Olson is considering the purchase of property located on 50th Street and wants to know what kind of cost factor he will be looking at when the street is blacktopped. I have enclosed a copy of an estimate from Thore Meyer dated 9/3/91. Mr. Olson was given this information but still wishes to address the Commission. The city Council of the City of Albertville hereby ordains: The Albertville Subdivision Ordinance, as codified by the City of Albertville, shall be amended by the addition of the following text to the Administration Section of the ordinance: sectidn A-900.7 Fees, Charges and Expenses (a) Fees and charges, as well as expenses incurred by the City for engineering, planning, attorney and other services related to the processing of applications under this ordinance shall be established by resolution of the Council and collected by the Zoning Administrator for deposit in the City'S accounts. Fees shall be established for the processing of requests for platting, maj or and minor subdi visions, review of plans, and such other SUbdivision-related procedures as the Council may from time to time establish. The Council may also establish charges for public 'hearings, special meetings, or other such Councilor Planning Commission actions as are necessary to process applications. (b) Such fees, charges and estimated expenses (as well as a deposi t, if so required by the Zoning Administrator) shall be collected prior to City action on any application. All such applications must be accompanied by a written agreement between the City and the applicant/landowner (when the applicant is not the same person or entity as the landowner, both the landowner and the applicant must sign the agreement) whereby the applicant/landowner agrees to pay all applicable fees, charges and expenses as set by Council resolution as provided above, and which allows the City to assess the above fees, charges and expenses against the landowner if such monies are not paid within 30 days after a bill is sent to the applicant/landowner. Inc.. have forwarded me a proposed grading plan for a mining project on the Eicker property in the City of Albertville. A copy of their transmittal letter is attached. The project proposes considerable gravel mining in the easterly portion of the Eicker property and a small adjoining area of the school property. The final grades will be 30 feet below existing grades at the point of maximum cut. The plan, provides a 3: 1 slope along the common prqperty line between the Eickers and the City of St. Michael. This is a stable slope as long as good topsoil and turf restoration is placed. No general drainage patterns will be changed; the site will still slope to ~~e north. The only point we should make is that the City of St. Michael will not be responsible for any erosion problems that may arise during or after mining, caused by drainage from St. Michael. Attn: Robert Roblin 1111 Hwy. 25 North Buffalo, MN 55313 Dear Bob: CITY OF ALBERTVllLE; WETLAND NO. 86-414W OHW DETERMINATION As you requested, I have reviewed the concept plan of the Douglas Psyk property located in the SW 1/4 of Section 1, T120N-R24W; City of Albertville. On March 31, 1992 I inspected Wetland No. 86- 414W, which is located on the Psyk property. Wetland No. 86-414w is classified as a ''Public Water Wetland." Any alteration of the bed of this wetland is regulated by the Department of Natural Resources (DNR). You asked me to determine the legal boundary of Wetland No. 86-414w. On the basis of my inspection and your concept plan, I recommend that the Ordinary High Water (OHW) level of this wetland be considered to be approximately elevation 952.0 feet. AIl land shown to be lower than 952.0 feet on the concept plan should be considered part of the bed of Wetland No. 86-414w. Unfortunately, this wetland was partly drained many years ago. The OHW evidence is difficult to interpret due to this drainage. For example, I feel that the pre-drainage OHW level was around elevation 956 feet. With its current outlet, this water level could not be reached. The water surface level of the wetland is currently at elevation 950.5 feet. The control point of the basin is located at the downstream end of the County Road #19 Culvert, at elevation 950.48 feet. The old ditch that connects the main part of the wetland to the Co. Rd #19 culvert is choked with cattails. Based upon my experience, I would expect the OHW level to be about 1.5 feet above the runout level. Attached find a photocopy of a portion of the National Wetlands Inventory Map for this area. This map correctly shows that much of the area near the wetland, above elevation 952 feet is still considered wetland. Alteration of this portion of the wetland may be controlled by the 1991 Wetland Conservation Act. Drainage, filling or burning of any wetland area is now prolubited, unless the affected wetland is replaced. An information sheet on this program is attached.
