COMMISSION MEMBERS PRESENT: Tom Haller, Donatus Vetsch, and
Secretary Ann Culley.
ABSENT: LeRoy Berning
Chairman Haller called the meeting to order at 7:05 PM.
Vetsch made a motion to amend the agenda to include the
resignation of Rick Bishop from the Planning and Zoning Commission.
Haller seconded the motion. All voted aye.
Vetsch made a motion to approve the amended agenda. Haller
seconded the motion. All voted aye.
A motion was made by Vetsch to approve the minutes of the July
14, 1992, meeting as submitted. Haller seconded the motion. All
voted aye.
Vetsch made a motion to open the public hearing for
consideration of Security State Bank's requests for variances for
rear lot setback requirements, parking/driveway setback
requirements, and loading berth requirements. Haller seconded the
motion. All voted aye.
There were no comments from the public. The Commission
questioned Paul Ederer with regard to the variance needed for the
possible, future, 3rd canopy over the drive-thru. Ederer stated
that it would probably not be built for a couple of years, but that
he would like to address the issue at this time. He is willing to
move the building 5' to the north so the supports for the canopy
will not be so close to the property line.
Haller made a motion to close the public hearing.
seconded the motion. All voted aye.
Vetsch
Haller made a motion to recommend that the City Council
approve the variance on the condition that the furthest edge of the
canopy will not be within five feet of the adjacent property line.
Vetsch seconded the motion. All voted aye.
Vetsch made a motion to recommend that the City Council
approve the loading berth variance. The motion was seconded by
Haller. All voted aye.
Vetsch made a motion to recommend that the City Council
approve the variance for the parking/driveway setback requirements
on the northern edge of the parking lot, allowing it to abut the
adjacent property line.

Vetsch made a motion to open the public hearing concerning
Securi ty State Bank's request that the City vacate the public
right-of-way. There were no comments from the public.
Vetsch made a motion to close the public hearing.
seconded the motion. All voted aye.
Haller
Vetsch made a motion to recommend that the City Council
approve Security State Bank's request to vacate the public right-
of-way in the northeast corner of their property, as legally
described in the QuitClaim Deed from Wright County. Haller
seconded the motion. All voted aye.
Vetsch made a motion to open the public hearing to consider
Security State Bank's request for replatting. Haller seconded the
motion. All voted aye. No comments were forthcoming from those
present.
Vetsch made a motion to close the public hearing.

Haller
Haller made a motion to recommend that the City Council
approve Security State Bank's request for replatting in order to
combine Lots 7, 8, and 9, Block 1, NW 1/4 NE 1/4 into one lot. The
motion was seconded by Vetsch. All voted aye.
Haller made a motion to recommend that the City Council
approve the final site plan subject to all variances, setbacks, and
right-of-way vacation. Vetsch seconded the motion. All voted aye.
Vetsch made a motion to open the public hearing regarding Doug
Psyk's request for vacation of Drainage & Utility easements.
Haller seconded the motion. All voted aye. There were no comments
from those present.
Vetsch made a motion to close the public hearing. The motion
was seconded by Haller. All voted aye.
Haller made a motion to recommend that the City Council
approve Psyk' s request that the City vacate the drainage and
utili ty easements as shown on his submitted plans. Vetsch seconded
the motion. All voted aye.
Haller made a motion to open the public hearing in order to
consider Psyk' s request for replatting. Vetsch seconded the
motion. All voted aye. There were no comments from those present.

Haller made a motion to recommend that the City Council
approve Psyk's replatting request as submitted. Vetsch seconded
the motion. All voted aye.
Bob Swenson and Tim Barthel addressed the Commission regarding
the possibility of lowering the speed limit on Main Avenue near the
new High School. They were informed that Main Avenue is a County
Road and that was a County matter.
Swenson and Barthel also addressed the Commission requesting
that they be allowed to maintain the lot between their homes which
is currently designated as a possible future extension of 51st
Street. The Commission informed them that the City Council would
have to be addressed with regard to this issue.
Haller made a motion to open the public hearing concerning
changes to the current Zoning Ordinance. Vetsch seconded the
motion. All voted aye.
Neither the Commission, nor Psyk were clear on the proposed
change to Sec. 1000.4 (i) (2) which, if changed, would require
buildings in commercial and industrial districts to face 50% of
sides and front with finish materials other than steel.
Vetsch made a motion to close the public hearing.

Haller made a motion to recommend that the City Council
approve the following changes to the Zoning Ordinance:

Haller made a motion to recommend that the City Council

This memo is in response to OUr phone conversation regarding City Park

Lacking copies of plans being Supplied to Our office, we would urge
that the City BUilding Official verify bUilding setback requirements
so as to insure Placement is in accord with Ordinance requirements.
Relative to the gravel parking lot, a variance to the ZOning Ordinance,
Section 1200.4.(h).(13) is required. From Our discussions, it would
appear that soil conditions warrant such an Ordinance deviation.
Verification of the soil problem should, however, be established. The
City Engineer or BUilding Official should view the site and provide a
letter of his oPinion in this regard. We would not believe that soil
tests would be necessary as bUilding history in this Portion of the
City will likely verify the problems and as such, a professional
opinion on this matter should be sufficient documentation for the
variance action. It would be OUr opinion that a variance could be
processed as a minor variance requiring only City COuncil action and
no pUblic hearing.
Again, lacking site plans, We are not in a Position to review other
aspects of the parking lot layout and design per Ordinance requirements.
Possibly, the Building Official could be consulted for at least a basic
review of such matters.
If we can be of further assistance regarding the park, please contact
our office accordingly.

Based UPon OUr phone discussion on 15 July, I have checked
the Comprehensive Plan relative to the City Hall zoning
question. While I have not verified the present R-3 zoning
which yOU indicated is applicable to the site, the R-3 zone
does allow governmenta 1 bui1 dings as a conditional use
(3500.4.(a) references to 3300.4.(a)). As such, the City
Hall is a confonning Use due to grandfather rights in the
R-3 Zone.

The Comprehensive Plan, Planning Oistrict g indicates this
area of the City should, however, be Commercial and mixed
use in character (see pages 113-115). As a result, a 8-4
Zoning District would in fact be more appropriate for the
site in question.

POD Ordinance from Wayzata which provides an example of how the
Ordinance can be tailored to the specific issues relevant to the
industrial Uses along the railroad tracks. The City can control
the existing buildings and future expansions without the need for
any future development contracts.
Again, the only unresolved issue at this point is if lot
consolidation is necessary.

AN ORDINANCE AMENDING THE CITY OF WAYZATA ZONING MAP TO REZONE A
"C-4" CENTRAL BUSINESS DISTRICT ZONED AREA TO PLANNED UNIT
DEVELOPMENT (PUD) ZONING DISTRICT.
THE CITY OF WAYZATA DOES ORDAIN:
Section 1. The City of Wayzata Zoning Map is hereby amended
to rezone from "C-4" to "PUD" the property described below:
301-303 S. Broaday, 644 Indian Mound, 630 Indian Mound and
308-318 Walker. The property P.I.D. Numbers are 06-117-
22/42-0023, 06-117-22/31-0017, 06-117-22/31-0018 and 06-
117-22/31-0019.
Section 2. The following prov~s~ons and conditions are
required in this PUD Zo~ing District:

Allowed Uses:

Any change in use, expansion and/or redevelopment to an
activity allowed within the C-4 Zoning District of the
City of Wayzatamay be considered for the property in
question. The determination of use acceptability on
the part of the City will be based upon the proposed
development's compliance with design and performance
standards specified for the C-4 District and the
standards specified below.
Design/Performance Standards:
A. The use shall be able to exist in harmony with the
immediately surrounding properties and
neighborhood area.
B. Within the limits specified by the Zoning
Ordinance, noise, lighting, signing and other such
operational concerns of a development shall not
negatively impact the abutting and neighboring
residential and institutional ;uses.
C.
Building height and massing shall take into
account the preservation of lake views from
adjoining and abutting properties. It shall be
the Developer's responsibility to fully evaluate
the impact so created and to justify that the
impact being made is to the minimum possible.

development on the Lak~view skyline of the City is
to be a positive contribution. It shall be the
Developer's responsibility to fully evaluate this
impact and to justify that the resulting
development will contribute positively to the
image of the community.
The traffic generation of the proposed development
shall not exceed the capabilities and functional
classification of Indian Mound as it exists today
or as acceptability proposed for improvement. The
general area street system and access shall be
similarly impacted.
Off-street parking and off-street loading shall be
provided as specified by the applicable zoning
ordinance provisions.

3.
Utility service and storm drainage shall be in
compliance with systems and specifications
directed b~.lthe City Engine~r.
Responsibility:

It shall be the Developer's responsibility to fully
document all aspects of their proposed uses and to
comply with modifications and requirements as directed
by the City.

Existing Uses
Any established use which legally existed within its
respective zoning district prior to the enactment and
application of the PUD classification, may be
continued in like fashion and activity and shall
automatically be considered as being a permitted
activity. A change in ownership of such property shall
not affect the permitted activity status so long as the
business or use continues in a like fashion and
activity.
Section 3. Effective Date. This Ordinance shall be in full
force and effect upon its passage and publication.
