Chairman Haller called the meeting to order at 7:07 PM. Berning motion to amend the agenda to include the site plan for City Park and the shel ter addition. Haller seconded the motion. All voted aye. Vetsch made a motion to approve the amended agenda. Berning seconded the motion. All voted aye. Berning made a motion to amend the minutes of the August 25, 1992 meeting to read: 50% of the entire front of the building will be of material other than steel. 25% of the wall height, of the side walls. final grade to the bottom of the eave, will be of material other than steel. Vetsch seconded the motion. All voted aye. Berning made a motion to approve the amended minutes of the August 25, 1992 meeting. The motion was seconded by Vetsch. All voted aye. Berning presented a copy of the final site plan for the new shelter at City Park for the Commissionsr thoughts and suggestions. Haller made a motion to recommend that the City Council approve the final site plan, dated August 10, 1992, as submitted for the City Park. Vetsch seconded the motion. All voted aye. PLANNING AND ZONING FONcrIONS ~ The City of Elk River currently has many functions for dealing with Planning and Zoning issues. These functions are intended to provide flexibility 1n the zoning process. The procedures, principals and legal limitations in handling these functions are quite different. Failure to distinguish between them can result in confusion and possible inappropriate action. These functions include amendments, variances, conditional uses and subdivisions. Each of these functions are handled in a distinct and different fashion. The City has developed this bandout to better inform the public about Planning and Zoning issues. The following is a breakdown discussing the options and requirements in dealing each of the functions mentioned above: AMENDMENTS (TEXT AND MAP AMENDMENTS) Amendments are Changes in district boundaries or the text of the zoning ordinance. Amendments are necessary in order to meet Changing conditions within the community. Amendments can be made only by the City Council and should be made only when it is in the public interest to make the amendment. When considering an amendment, the City Council must determine that the proposed change is due to one of the fOllowing conditions: A. Change in circumstance within the City. B. An error was made in the original plan. C. The proposed change is consistent with the Land ase Map. . In dealing with amendments, the City may chose one of the following options: 1. Approve the request. 2. Deny the request. 3. Table the request. 4. Continue the Public Hearing. CONDITIONAL OSES These are uses which may be permitted within a certain zoning district if it is found that they meet specified standards and are not detrimental to the district. The zoning ordinance must contain a list of uses permitted as conditional uses within each zone. The zoning ordinances should also contain explicite standards, which the conditional use must meet in order to qualify for a permit. The standards must insure that the conditional use is permitted only when the public convenience and welfare will be served and appropriate use of neighboring property will not be substantially or permanently injured. . 3. VARI1'.NCES .These are mod ifications of the strict terms of the Zoning Ordinance in order to provide relief for a property owner because of undue hardship or a peculiar difficulty imposed upon him by the zoning ordinance. These perculiar difficulties or undue hardships must be unique and apply only to the applicants property and not be difficulties or hardships commonly shared by other property owners. Variances are normally limited to height, bulk, density and yard requirements and are not to be used to allow a use of land prohibited by the Zoning Ordinance. In dealing with variances, the City made choose one of the following options: 1. Approve the request. 2. Approve the request with conditions. 3. Deny the request. 4. Table the request. s. Continue the hearing. In order for the City to grant the 7ariance, the request must adhere to the following five (5) standards: 1. That the literal enforcement of the ordinance would cause undue, unnecessary, unavoidable, or extreme hardship. . 2. That the hardship caused by special conditions and circumstances which are oeculiar to the land and structure involved and which are not characteristic of or applicable to other lands or structures in the same district. 3 . That the literal Ordinance would enjoyed by other the terms of this application of depri7e the properties in Ordinance. the provisions of this petitioner of rights the same district under 4. That the special conditions and circumstances are not a consequence of the petitioner's own action or inaction. s. That the variance will not be injurious to or adversely affect the health, safety or welfare of the residents of the City or the neighborhood wherein the property is situated and will be in keeping with the spirit and intent of the Ordinance. . s. ~ . PARK BOARD MEETING AUGUST 20, 1992 ALBERTVILLE CITY HALL 7:00 PH PARK BOARD MEMBER.S PRESENT: Sharon Anderson. Pam Roden. Barbara Creighton. Marvin Vetsch. Ken Lindsay and Mike Rutkowski of the City Maintenance Department. ABSENT: Dean Spencer Rox Mathews and Henry Sandbulte of Noble Nursery presented their special pricing on 3"-4" trees for the Boards' information. No action was taken. Creighton tendered her resignation as Chairman of the Park Board due to personal conflicts. Anderson made a motion to recommend that the City Council accept Creighton's resignation. Roden seconded the motion. All voted aye. It was the decision of the Board that all future meetings of the Park Board will be recorded to aid the Secretary in recording the minutes of the meetings. . Roden made a motion to nominate Anderson as Chairman of the Park Board. Vetsch seconded the motion. All voted aye. Anderson accepted the position of Chairman. The Park Board requested that the City Council clarify who. if anyone, from the Maintenance Department is to attend the Park Board meetings. The Park Board feels strongly that any questions or problems that arise are to wait until the next regularly scheduled meeting. Lindsay reported that the merry-go-round in City Park has been repaired. Both Anderson and Creighton stated that it had been repaired properly. Lindsay reported that the steps on the play equipment in City Park cannot be repaired; they have been in that condition since their installation. The Board directed Lindsay not to take any further action. Lindsay reported that the gazebo in City Park will be painted within two weeks. Lindsay stated that the rough spots in Four Seasons Park need to be tilled in order to smooth them out. He will check on tiller rental. He further stated that sod will be needed for the tilled area; approximately 750 yards will be needed. The Board will look ~ into the cost of this project. . . . PARK BOARD - 8/20/92 Page 2 Lindsay reported that the Four Seasons Park sign has not yet been repaired. Anderson made a motion to repair the sign at a cost not to exceed $200. Vetsch seconded the motion. All voted aye. The Maintenance Department was directed to complete the necessary repairs within the cost parameters set by the Board. The Board directed Lindsay to remove the top two timb$rs in the retaining wall by the small playground in Four Seasons Park due to the fact that the timbers are warping. The Board and the Maintenance Department agreed that three loads of sand will be needed for each of the play areas in the parks. The Board will have to include this cost in the 1993 budget. Anderson will check into the possibility of starting an "Adopt a Park" program. Lindsay reported that the trash containers are missing from Four Seasons Park. He will look into something more stationary. Lindsay reported that they painted the swing set. Lindsay mentioned that lime would be needed for the softball field this fall. Lindsay reported that the back drop fence in the softball field is bent and in need of repair. The Board directed him not to do anything with it at this time. The Board directed Lindsay to get quotes for the ballfield. The Board discussed having an appreciation open house for the Lions J Jaycees, and anyone else connected with the new park shelter. This would be done after completion of the shelter. The Board discussed having a band concert once a month at City Park next summer. The Board briefly discussed the budget for 1993. Anderson will discuss further with Mark Barthel. Vetsch made a motion to adjourn the meeting. The motion was seconded by Roden. All voted aye. Pam Roden, Secretary
