PLANNING & ZONING November 10, 1992 Albertville City Hall 7:10 PM PRESENT: Members Donatus Vetsch, Howard Larson, Roger Johnson and LeRoy Berning, City Clerk Linda Houghton Acting Chairman LeRoy Berning called the regular meeting of the Planning & Zoning Commission to order. Larson made a motion to approve the agenda. Johnson seconded the motion. All voted aye. Johnson made a motion to approve the minutes of the October 27, 1992, meeting as presented. Larson seconded the motion. All voted aye. The Commission reviewed the subdivision request from Ed Bruen. Engineer Thore Meyer has indicated there is no need for additional drainage or utility easements. The Commission also reviewed the letter from Kevin Mealhouse, Building Inspector, dated November 9, 1992, in which he states that the door on the east side of the building must be removed and a one hour fire wall must be placed there. The door must be removed and the area filled. Linda was asked to check wi th Kevin to ensure that a concrete block wall constitutes a one-hour fire wall. Ed Bruen will be mailed a copy of Mealhouse's letter. The public hearing on Bruen's subdivision request has been scheduled for November 24. The Commission directed Linda to place a notice in the official newspaper advertising the upcoming vacancy on the commission as of the end of the year. The Commission reviewed the application from Janet Heikes but took no action on her application at this time. Don Hall, representing Aero Asphalt, addressed the Commission concerning his proposal for a 24' X 56' office/shop to be located on the property next to Hack's for his asphalt paving company. He explained that the office/shop building is a double-wide modular wood-exterior building. His plan is to use this office for a period of five years, before he replaces it with a prefab concrete building. The parking lot will be paved. He stated he will employ about 50 seasonal workers and six year-round employees, He will have six tandem trucks and eight tractor trailers on site. The Commission advised him screening and landscaping plans would be required at a later date. Johnson made a motion directing Linda to contact the planner to get his advice on the rezoning request as presented by Aero Asphalt and what is in the best interests of the City in reference to the requested rezoning. Larson seconded the motion. All voted aye. . . . ADDENDUM TO PURCHASE AGREEMENT Reference is made to that certain Purchase Agreement dated as of October 1, 1992 (the "Purchase Agreement"), by and between Edward F. Breun ("seller"), as seller, and Dennis E. Eull and Judy A. Eull (collectively, "buyer"), as buyers. Seller and buyer desire by this Addendum to provide certain supplemental terms and conditions to the Purchase Agreement, as follows: 1. delivered section 8 documents Seller agrees that the closing documents to be by seller to buyer at the closing pursuant to of the Purchase Agreement, in addition to the described therein, shall include the following: (k) A new easement from seller to buyer over the most easterly seven (7) feet of such Lamp Post Inn property as may be reasonably necessary to allow buyer to provide maintenance to the building located on the real property sold pursuant to the Purchase Agreement on the date of the Purchase Agreement; (1) A new easement from seller to buyer as may be reasonably necessary to allow buyer to access, use and maintain the automobile vacuum equipment located at the rear of such Lamp Post Inn property on the date of the Purchase Agreement; (m) A new easement from seller to buyer as may be reasonably necessary to allow buyer to access and use the enclosed garbage area located at the rear of such Lamp Post Inn property on the date of the Purchase Agreement; (n) A new easement from seller to buyer over such portion of such Lamp Post Inn property as may be reasonably necessary to allow buyer pedestrian access to the building located on the real property sold pursuant to the Purchase Agreement through the access door located on the wes~~side of such building on the date of the Purchase Agreement. 2. Except as specifically set forth in this Addendum, the Purchase Agreement shall remain unamended, unsupplemented and in full force and effect. 3. The defined terms used in this Addendum shall have the meaning ascribed to them in the Purchase Agreement.
