Bonner, Donatus Vetsch, Howard Larson and Sharon Anderson, City
Planners Liz Stockman and David Licht, City Attorney Mike Couri,
City Clerk Linda Houghton
Chair Berning called the regular meeting of the Planning
Commission to order.
Larson made a motion to approve the agenda and the format
presented for the informational portion of the meeting as
presented. Anderson seconded the motion. All voted aye.
Vetsch made a motion to approve the minutes of the December
27, 1994, meeting .s presented. Anderson seconded the motion. All
voted aye.
Dennis Fehn presented . site pl.n for a proposed 24' X 36'
office buildinqon his property located at the intersection of. 50th
Street and Barthel Industrial Drive. Fehn explained that the
building will house three separate offices, will be wood framed,
and will be slab on grade.
Larson made a mot.!on to approve FEhn' s si te plan and to allow
the office building to be constructed, contingent upon the building
inspector approving all parking and building requirements. Vetsch
seconded the motion. All voted aye.
Chair Berning turned the meeting over to City Planner David
Licht to present the background information regarding the rezoning
question referred tQ the Planning Commission. Licht advised the
Commission that this meeting is not a formal or official public
hearing on rezoning, but rather an informational meeting to discuss
potential rezoning considerations. The Planning Commission will
make. recommendation to. the City Council whether to set a public
hearing to consider rezoning.
Interested members of the audience were invited to address the
Commission with their concerns by being recognized by the Chair and
making comments from the podium.
Carolyn ~auer (11422 54 1/2 street ME) stated she is oppo~ed
to R-3 zoning in general because of the past history with twin
homes in the City of Albertville.
Dan Robertus (11401 54 1/2 Street ME) stated that the citizens
were opposed to the rezoning request from R-3 toR-4 back in
December and requested that the City consider rezoning the entire

area to R-1. Robertus believes that rental properties deteriorate
faster than owner occupied homes and the this may well happen to
the units proposed as Meadowview.
Curt Heffelfinger feels that ALbertville is equally
represented .with multiple or lower income housing already and does
not need more multipl~s.
Andrew Smith (5349 Lachman Avenue ME) stated that the
residents of Albertville do not w~nt R-3 zoning.

Bill Odegard (5349 Lambert Avenue) stated he moved from Maple
Grove from the same type of situation that is about to happen here
and it is unfair to the current residents who moved away from that
situation.
Carla Sullivan (11362 54th Street) stated it is unrealistic
to have the entire City zoned R-3. She suggested that the Planning
Commission look at the entire City's zoning and consider
amendments.
Mike Becker (11377 54 1/2 Street) has a fear of rental
properties in general and doesn't want to lose the n"niceness" of
the neighborhood.
John Vetsch (5618 Large Avenue) questioned the City Planner
why there was no R-l zones included in the original Comprehensive
Plan. He also expressed Concerns over subsidized. and/or SEction
8 housing.
Tim Backes of Lumber One Cold Spring Inc. explained that he
is proposing single family housing, not rental units. There will
be five, possibly six, twin homes on the north side of the street.
None. of t.he units are subsidized housing.
Connie }\nderson (5476 Lander Avenue NE) is concerned over
addi tional traffic generated in the area. She also questioned
whether the twin homes would readily sell, and if not, would they
become rental units.
Mike Becker is concerned that a management corporation would
buyout all twin homes and rent them out.
Carolyn Bauer stated that she is concerned there will be three
homes in her back yard. She feels the lots proposed are too small.
Bernard Marx stated his family has owned land in Albertvil.le
for the past fifty years and he does not feel that anyone other
than the landowner should be able to request rezoning of property.

City Planner Dave Licht explained that the City's,Comp Plan
and Zoning Map was adopted in 1988. The Ci ty went through the
entire process of public hearings, meetings and review processes
before the ordinance and the zoning was adopted.
Licht reviewed his letter to the Planning Commission dated
January 31,1 995. The Planning Commission should make their
decision based on facts which are legally defendable.
City Attorney Mike Couri advised the audience that it is his
job to keep the City out of lawsuits and to assure that the City
is "fair and equitable'" to all. Couri strongly advises the
PI anning Commission and the City Counci 1 not to downgrade the
zoning on a piece of property on which proposal have been received
by the City and the process of development has begun. Couri finds
no factual basi,s on which to justify a rezoning of this property.
. Larson made a motion to recolllnend to the City Counc;:i I thlit the
R-3 zone bli! c()ntinued on the properties that have presented
preliminary plans to the City at this time, i.e. Meadowview and
Brittany Kay Estates and that the Visonary Session to be held on
March 9 be used to consider other zoning changes. Bonner seconded
the motion. Larson, Bonner I Andet'son, and Berning voted aye,_
Vetsch abstained. The motion carried.
Larson made a motion to adjourn at 9:25 PM. Anderson seconded
the motion. All voted aye.
