Licht, City Attorney Mike Couri, and Deputy Zoning Administrator

Chair Berning called the public hearing of the Planning and
Zoning Commission to order.
The agenda was amended by delet~ng Items 2a a~d 2b and adding
prior to Item 2c-l Public/Institutional Zoning District. Larson
made a motion to approve the agenda as amended. Vetsch seconded
the motion. All voted aye.
Chair Berning turned the meeting over to Planner David Licht
for an overview of the issues being considered.
Licht explained that by creating a Public/Institutional Zoning
District (P/I) to zone public/semi-public properties in the City
(churches, school s , uti 1 i ti es , etc.) the Ci ty coul d avoid SOme
Conditional Use Permits if those parcels remain in a residential
district. Licht further explained that the P/I zone could be added
to the index of the Zoning Map but not used at this time.
Licht ,explained that the R-IA Zoning District is a low
density, single family zone. The minimum lot size is 15,000 square
feet with a minimum .100' frontage on interior lots and 120' on
corner lots. The front setback for lots in R-IA are 30 feet. In
creating this new district, the R-l District has also been .amended
to reflect that all uses allowed in a R':'IA District are allowed, in
the lower zones as well. Licht pointed out that the front setback
on all It-I lots created after July 1, 1996, will be 30'. He
clarified that should an existing house is destroyed, the setback
for the rebuilt house would be 35' to match the setbacks in the
rest of the development.
Licht explained that the z.oning map has been updated to
reflect the newly adopted Comprehensive Plan Land Uses.
The moratorium on two family homes in a R-3 zone can be
removed at this time if the Commission wishes, since there are no
R-3 zoning districts on the proposed zoning map.
Chair Berning asked for comment from the audience on the
creation of the P/I zoning district. There were no comments.

Kent Roessler questioned the Commission on the reasons for
creating the R-1A district.
Planner Licht explained that 'the Comp Plan Inventory
identified life-cycle housing as one of the needs of the City.
Currently the balance of homes is skewed to "starter" homes and
high density. Creation of the R-IA district will 'add higher value,
larger lot homes to the City. Licht further explained that taxes
generated by lower valued homes are not sufficient to pay for the
services required by the homeowners.
Commissioner Larson stated the taxes generated by homes valued
less than $14(),000 are not sufficient to pay for municipal
services.

Curt Muyres stated his family is ready to move up to a larger
home on a larger lot but those types of homes are not available in
Albertville at this time.
John Vetsch stated that larger lots may sell more slowly, but
allowing the City to grow too quickly can drain a City financially.
There were no more comments.
Chair Berning asked for comments on the zoning changes
proposed.
Residents along 60th street currently in an R-3 zone would be
rezoned into a B-3 district. Those homes would be a non-conforming
use in the B-3 zone, meaning that repairs and maintenance on homes
is allowable, but no new homes could be constructed.
Ray Vetsch stated that if a home is damaged more than 50% of
the value of the home, the zoning ordinance would not allow the
home to be repaired.

Donald and Patti Vorderbruggan stated that their home is
currently in a B-3 zone. They reported difficulty in getting
financing for the home. They were unaware that they would be
unable to rebuilt on the site if their home we~e destroyed.
Planner Dave Licht stated that the solution may be to leave
the property zone~R-3 at this time and not lift the moratorium on
twofamdly homes. . This would allow the Commission to proceed with
the other issues now and review this zoning issue separately at
another public hearing. .
Kent Roessler asked the Commission to consider changing the
zoning on the 70 acre parcel (John Roden property) and the 80 acre
parcel annexed into the City from otsego to R-l instead of R-IA.

Roessler would not object to zoning the rest of the property west
of County Road 19 R-1A.
Dan Robertus indicated he does not feel the Commission should
make changes to the zoning map even before it is adopted.
Chair Berning called for public conment on the R-3zone
moratorium cancellation. The Commission concurred to leave the
moratorium in effect until after the 60th street zoning has been
reviewed.
There were no further comments from the audience.
Larson made a motion to close the public hearing at 10:05 PM.
Vetsch seconded the motion. All voted aye.
Larson made a motion to adopt RESOL~IOR '96-2 reconmending
that the City. Council approve the public/institutional zoning
district text amendment. Vetsch seconded the. motion. All voted
aye.
Larson made a motion adopting RBSOLU~IOR '96-3 reconmending
that the City Council approve the Zoning Ordinance text amendment
creating a R-1A Zoning District text and modifying the R-l Zoning
District text. Berning seconded the motion. All voted aye.
The proposed zoning map was amended as. follows:
(1) The properties along 60th street proposed to be changed
to a B~3 zone will remain R-3.
(2) The parcel of property previously platted as Sunmerfield
Addition will be zoned R-1A.
(3) The three separate lots at the Albertville Primary School
location will be zoned PlIo
(4) Zoning on the properties on the south side of 58th street
between Main Avenue and Lander Avenue will be B-4.
Larson made a motion to adopt RESOL~IOR. '96-4 reconmending
that the zoning map as amended at this public hearing be approved
by the City Council. Vetsch seconded the motion. All voted aye.
Vetsch made a motion to table further discussion on lifting
the moratorium. on two family homes in.an R-3 zone at this time.
Larson seconded the motion. All voted 'aye.
Larson made a motion to schedule a public hearing to consider
zoning on the 60th street propertie!\ currently zoned R-3 for
Tuesday, July 9, 1996, at 7:00 PM. Vetsch seconded the motion.
All voted aye.
