PRESENT: Chair Jim Brown, Commission Members Carolyn Bauer, Ed Budde,
Keith Franklin, Ray Meyer and Council Liaison Patti Stalberger, City Administrator
Linda Goeb, Zoning Administrator Kevin Mealhouse and Planner Al Brixius
Chair Brown called the regular meeting of the Planning & Zoning Commission to
order.
City Administrator Goeb presented the Commission with a note from Keith
Harstad dated September 13th requesting that the public hearing regarding the Albert
Villas project be postponed until the October meeting. Goeb suggested the public
hearing be opened and then postponed to October to avoid having to republish the
notices. The Commission agreed and the agenda was approved by consensus.
Meyer made a motion to approve the minutes of the July 14, 1999, regular meeting
as presented. Bauer seconded the motion. All voted aye.
Chair Brown opened the public hearing to consider the preliminary plat for
Mooney Addition and conditional use permits for a convenience store with gas sales and
a car wash.
Mooney Development Corporation has submitted a preliminary plat to subdivide a
parcel located at the northwest comer of the CSAH 19 and 37 intersection. Additionally
the applicant is requesting consideration of a conditional use permit. The site is part of
the Westwind PUD which was established in 1988. As part of the negotiated PUD
zoning, the site is to be developed for freeway oriented businesses.
Planner Al Brixius reviewed his report with the Commission. The applicant
proposes to subdivide the parcel into two commercial lots. Both lots appear to exceed the
City's lot requirements, however, the drainage and utility easements on Lot 2
significantly reduce the buildable are of the lot to approximately 13,200 square feet. No
building can be constructed within utility easements but driveways and parking lots may
extend into easements. Brixius recommends the applicant provide a concept plan for Lot
2, illustrating a building location and a functional parking lot layout without variance as a
condition of preliminary plat approval. Alan Nations, architect for the development,
agreed to prepare a concept plan for Lot 2.

Brixius also is concerned with the visibility at the site access. One option would
be to reduce the site grades toward the CSAH 19/37 intersection. Nations indicated he is
reluctant to reduce the site grades more than 6" because of storm drainage issues.
In response to a concern from one commissioner over the windows on the car
wash facing the street, Nations indicated the developer is willing to enter into an
agreement with the City that requires the owner to keep the car wash windows clean and
clear.
Chair Brown asked for public comment.
Cindy Fredericks asked about hours of operation. The developer stated the store
will be open 24 hours a day.
Ray Fredericks is concerned that gas fumes from filling the underground tanks
may permeate the air quality. The developer assured Fredericks that fumes would
certainly not travel into the residential areas of Westwind.
Cindy Fredericks also stated she is concerned with the potential of teenagers
hanging around the site. She was informed that the City has a curfew ordinance and the
Wright County Sheriff's Department has been directed to enforce that ordinance.
Chair Brown closed the public hearing.
Budde made a motion to continue the public hearing to the next regular meeting
on October 12th in order to give the developer time to present a concept plan for Lot 2.
Franklin seconded the motion. All voted aye.
Chair Brown opened the public hearing to consider the Albert Villas plat.
As a guide for staff discussions with the developer, the Commission reiterated
their position that a PUD zoning may be acceptable for the Albert Villas project but the
PUD should basically follow R1-A guidelines.
Bauer made a made a motion to continue the public hearing on the Albert Villas
project to October 12th. Budde seconded the motion. All voted aye.

The Commission briefly reviewed the proposed Ordinance #1999-5. City
Administrator Goeb explained that the ordinance is being and will be considered at a later
date.
The Commission viewed the proposed layout of the addition to City Park, showing
a baseball field, soccer field, etc. Commissioners commented that a softball field may be
more appropriate for the site and questioned the need for a soccer field. The
Commission's comments will be considered by the City Council before the park is
actually developed.
Budde made a motion to schedule a public hearing on Tuesday, October 12, 1999,
to consider amendments to the zoning and subdivision ordinances regarding
sidewalk/trail construction, fencing regulations, etc. Bauer seconded the motion. All
voted aye.
Bauer made a motion to adjourn at 8:35 PM. Franklin seconded the motion. All
voted aye.
