CALL TO ORDER - ROLL CALL - ADOPT AGENDA Chair Leintz called the regular meeting of the Planning and Zoning Commission to order. Amend the Agenda to add - Memo on Fences to be reviewed at the next Planning Commission meeting. PRESENT: Chair Leintz, Commission members Frank Kocon, John Meierhofer, Chad Engman, Scott Dorenbush and Council Liaison LeRoy Berning, City Planner Al Brixius, Zoning Administrator Jon Sutherland and City Clerk Bridget Miller Kocon made a motion to approve the agenda as submitted. Meierhofer seconded the motion. All voted aye. 2. MINUTES a) June 10,2003 regular meeting Kocon made a motion to approve the minutes as submitted. Meierhofer seconded the motion. All voted aye. 3. PUBLIC HEARINGS a) Heidi's Market Car Wash Chair Leintz opened the public hearing at 7:03 p.m. Chair Leintz turned it over to city Planner Brixius to go over the Public Hearing. City Planner Brixius commented that an application for Conditional Use Permit has submitted for Heidi's Market/Conoco Car Wash for the site located at 11850 62nd Street within the City of Albertville. The CUP is necessary for the construction and operation of a car wash. The site is zoned B-3 Highway Commercial District, for which commercial car washes are a conditional use. The site is located in the northeastern portion of the city and is surrounded by commercial and industrial uses. When considering a CUP, the Planning Commission and City Council shall consider six (6) adverse effects of the proposed conditional use. The applicant is proposing to provide delivery and car wash ingress on the eastern portion of the existing structure. The overall circulation of the site is an improvement over the current site. Deliveries will occur in the back (northern) portion of the building and exit via the western egress. . . . CITY OF ALBERTVILLE Planning and Zoning Commission July 8, 2003 Minutes Page 2 of7 The applicant has provided a landscaping plant. The applicant is proposing eight (8) Red Twig Dogwoods around the trash area. Four over story trees are being proposed to the north, east, and sought of the car wash. The existing trash area to the west of the existing building is being moved to the north of the building to allow for the construction of the car wash. Additional lighting is being proposed on the existing building as well as the proposed car wash. All lighting shall be hooded at a 90-degree cutoff and directed so that it is not visible from the public right-of-way. The applicant has submitted a grading, drainage and erosion control plan and is subject to the review ofthe City Engineer. The applicant is proposing a retaining wall on the northern portion ofthe lot line. Retaining wall over 3-feet will require engineering design and will be subject to the review and approval of the City Engineer. The applicant has identified one (I)-wall mounted sign on the southern (front) portion of the car wash. According to Section 4400.4(b), the architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or areas as to cause impairment in property values or constitute a blighting influence. Upon review of the application, the proposed car wash is consistent with the guidelines outlined within the Zoning Ordinance. There are nine (9) staff recommendations to the site plan. Engman had a question about the paved area. City Planner reviewed the plan to explain the paved area. What he explained was there would be a four-foot drop from the top of the retaining wall. A representative from the Gem Development had a concern with the retaining wall issue. It will force the water - rainfall to flow to his site. Engman noted with the way the run offis designed it should be able to flow properly. Representative from Land of Lakes Stone 'n Tile at 11800 62nd Street asked how the drainage concern was going to be handled. In the back section of his parking lot after a normal rain there is water that sits there. Now if they put up the retaining wall how much more water will be there in the parking lot. City Planner Brixius commented that he would check with the City Engineer to make sure that the elevations will be addressed. . . . City Planner Brixius reviewed the catch basin issue with the Commission. Dorenbush asked to continue the public hearing to the August meeting. Engman seconded the motion. All voted aye. b) Prairie Run Preliminary Plat Chair Leintz opened the public hearing at 7:18 p.m. CP Brixius reviewed the preliminary plat before the commission. He informed the commission that the applicant not only is looking for approval of a preliminary plat but for rezoning from R-1A to PUD with the special amenities. Gold Key Development, Inc. on behalf of property owner B. Heuring, are requesting Preliminary Plat approval for a 33.5 acre single-family residential subdivision of 52 single-family residential lots to be known as Prairie Run. The applicant is requesting that the site be rezoned Residential PUD, allowing some flexibility in lot width and area standards. The site is located within District 1 of the Development Framework of the Comprehensive Plan. The triangular shaped site is zoning R-1A, Low Density Residential District. Existing natural conditions, including the location of wetlands along the northern border of the site, surrounding development, commercial zoning to the east, and lack of access have proven to be constraints to the design and development of the site. Lots located east of the entrance onto County Road 18 and south of the service road raise issues related to lot width. A majority of these lots are 65.8 feet in width, with three narrower lots at the curve. Staff had the same concern at concept level, when the lot widths were actually a bit wider at 67 feet. Lots located west of the access point onto County Road 18 are intended to be serviced by a private street on an easement to which overlays the lots. The site will be accessed via County Road 19 to the East and County Road 18 to the south. Access points have been established based on subdivisions of adjoining properties. Access from the east will be provided by a service road that will connect with 53rd Street and pass through a commercially zoned area prior to moving into this residential subdivision. . . . CITY OF ALBERTVILLE Planning and Zoning Commission July 8, 2003 Minutes Page 4 of7 Shared driveways often lead to maintenance and complaint issues between neighbors. An association should be used for snow removal of all the lots south of the service road and accessing off of the private street. The Preliminary Plat indicates a storm water retention pond both at the northern portion of the site and at the western most portion of the site. The wetlands have been delineated as have the location of erosion control barriers. A landscape plan illustrating locations of existing trees and planned vegetation must be submitted and reviewed prior to final plat application. The City of Albertville requires a 10% land or cash park dedication for subdivisions. A per lot cash contribution for this project is recommended. Upon review of the proposed project, it is staffs' view that both the proposed rezoning from R-IA to PUD, and the preliminary plat subdividing the site into 52 single-family residential lots are generally consistent with the intent of the comprehensive plan as well as the standards of both the zoning and Subdivision Ordinances. Dean Johnson from Gold Key Development, Inc. on behalf ofB. Heuring. He came before the Commission with the preliminary plat and PUD. He went over the history of the site before the Commission. He informed them that they have present a number of concept plans to the City council. He showed the commission the first plan was townhomes. The Council looked it over and was more in favor of single-family homes. The developer again came before the council with a concept of single- family homes. Dorenbush asked about the size of the lots in question that butt up to the wetland if they would consider to converting it into a park. If the lots become a lot of work to make them build able for a house. Leintz asked about the shared driveway area. In her knowledge of shared driveway area is not favorable to the owners. Leintz asked why a private drive. The commission is rather new and it seems every developer that has come before them asks for a PUD. Engman asked about the private driveway. Who will be responsible for the snow removal? Kocon had a concern about the site in question. He lives near the area and with the recent storm there was water sitting on the site for about 3+ days. . . . CITY OF ALBERTVILLE Planning and Zoning Commission July 8, 2003 Minutes Page 5 of7 City Planner Brixius shared with the commission that there was about 3 hours of listening to homeowners and the water problems. Kocon had a question about the width of the lots. Mr. Johnson defined the areas and what the lot widths are proposed for. Engman had a concern as well with the lot widths. He asked what it is zoned and what the applicant is looking for. He is concerned about homeowners with the possibility of having children and so close to the road. Kocon asked City Planner Brixius about anything in the works for a 4-way intersection with lights. City Planner Brixius had no knowledge at this time. He asked CL Berning ifhe knew of anything. Councilmember Berning shared that it would be up to the county. They are expanding on CR 37 already. Meierhofer asked if the proposed buyers would be able to see what is planned for the commercial portion of the site plan. Chair Leintz asked if there was anyone from the audience regarding this public hearing. There was no one present. Chair Leintz closed the public hearing at 8:08 p.m. Meierhofer motion to approved the preliminary plat and the rezoning from R-IA to PUD. Dorenbush seconded the motion. All voted aye c) Kollville Estates Third Chair Leintz opened the public hearing at 8:10 p.m. City Planner Brixius reviewed the Kollville Estates Third Addition. Leuer- Munsterteiger Properties has submitted plans for development of 66 single-family lots as part of the Kollville Estates project. The proposed project is the third and final addition of the 64-acre site. The site is located within District 1 of the Development Framework of the Comprehensive Plan. The northern portion of the site is designated for medium Density Residential development, the northwestern portion of the site is designated for . . . CITY OF ALBERTVILLE Planning and Zoning Commission July 8, 2003 Minutes Page 6 of7 future park and open space and the southern 40+ acres is designated for low-density residential development. The proposed project has a gross area density of 1.56 units per acre, which is consistent with the City's general definition oflow density. The site will be accessed via 62nd Street to the west, 62nd Street to the east, and Kahl Avenue to the south. The plans show an eight-foot bituminous trail along the northern side of 62nd Street from the western portion of the site to the eastern portion of the site and connecting to Kollville Estates 2nd Addition to the north. The Preliminary Plat indicates a storm water retention pond on Outlot A in the eastern portion of the site. Threes wetlands have been delineated within the site. The City Engineer should make comment as to the filling of these wetlands. A landscape plan illustrating locations of existing trees and planned vegetation must be submitted and reviewed prior to final plat application. The City of Albertville requires a 10% land dedication or per unit cash dedication in lieu ofland for each subdivision. The Albertville Comprehensive Park and Trail System Plan calls for approximately 18 acres of land in this area of the city for the development of a "community park", identified as Winter Park. Scott Dahlke representing the Kollville Estates went over the preliminary plat before the commission. He had a concern about the trail that would lead into the park area. Would the city like them to narrow up the trail to prevent vehicles from trying to get access to the park? City Planner Brixius would leave it up the Public Works department to make that decision. Scott went over the drainage around the area. He showed and how the flow would go through the development. They will be removing the road in Kollville Estates 2nd addition and expanding the ponding area. Chair Leintz asked if there was anyone from the audience regarding this public hearing. There was no one present. Closed the public hearing at 8:44 p.m. . . . Dorenbush seconded the motion. All voted aye. 4. OTHER BUSINESS a) Swimming Pools Dorenbush asked the Zoning Administrator Sutherland regarding the temporary pools. He noticed that with any pool you regard a building permit. Is that for every year or just the initial year it is installed? The commission reviewed the remainder of the ordinance and came to a consensus to go to public hearing with the ordinance at the next planning commission meeting. It would be the City council's final decision as to approval amending the ordinance. b) Fences There was a considerable amount of discussion about chain link fences whether they should have slats or not. Dorenbush asked if it would be retro to any fence that is installed as of today? City Planner Brixius and Zoning Administrator Sutherland confirmed that it would not be retro to current fences. It was asked if the city could make the homeowners install fences if they have a pool. They would like the city attorney to look into the possibility of enforcing this. Engman asked how the process would go once this ordinance is approved. Zoning Administrator Sutherland went over the procedure of what the process will be with the amended fence ordinance. There was clarification about the chain link fence with slats be noted in the amended ordinance. There was talk of the front area where a fence could be placed. 5. ADJOURNMENT Meierhofer made a motion to adjourn at 9:24 p.m. Engman seconded the motion.
