PLANNING & ZONING COMMISSION UNApproved Minutes September 9, 2003 1. CALL TO ORDER - ROLL CALL - ADOPT AGENDA ChairLeintz called the regular meeting of the Planning and Zoning Commission to order. PRESENT: Chair Sharon Leintz, Commission members Frank Kocon, Scott Dorenbush and John Meierhofer, Council Liaison LeRoy Berning, Assistant City Planner Al Brixius, Zoning Administrator Jon Sutherland and City Clerk Bridget Miller Meierhofer made a motion to approve the agenda. Kocon seconded the motion. All voted aye. 2. MINUTES a) August 12, 2003, regular meeting Kocon made a motion to approve the minutes as amended. Meierhofer seconded the motion. All voted aye. 3. NEW BUSINESS . 4. PUBLIC HEARINGS a) Heidi's Market Car Wash (continued from August 12th meeting) Chair Leintz noted that the applicant asked for an extension of the Public Hearing. City Planner Brixius had a conversation with Rob Nelson of Heidi' s Market. Rob and Greg from Land of Lakes Stone 'n Tile were working on the storm drainage issue. Rob has been notified of the time frame for extension on the Variance - Conditional Use. Put back on the October 14,2003 Planning and Zoning Commission meeting. 5. OTHER BUSINESS a) Interview candidates First candidate was Dan Wagner. He explained that he has lived in Albertville for a number of years. He ran for council in 2002 and received a couple hundred votes. He wants to get more involved in the community. Second candidate was David Noto. He was before the commission earlier this year. He has lived in Albertville for about 4-5 years. He also would like to get more involved in the community by serving on the commission. . Chair Leintz thanked both candidates for attending the meeting and introducing themselves to the commission. The commission will do their rating and make 2 . . . At the September 15th City Council meeting they will appoint one of the candidates to the Commission. b) Albertville - Zoning Ordinance Amendments Chair Leintz turned it over to City Planner Brixius to go over the Ordinance Amendments. Assistant City Planner Kirmis with the guidance of the City Planner prepared an update. It stated that in previous correspondence dated June 5, 2003, various areas of the Zoning Ordinance in need of revision were identified. While the identified area related primarily to the City's commercial zoning districts, a number of other miscellaneous areas of the ordinance were also referenced. The purpose of this memorandum is to provide draft ordinance language for the identified amendments to be considered by the City. If the draft language is determined acceptable, it will be reformatted into individual amendments and a public hearing or hearings will be scheduled. COMMERCIAL USE DEFINITIONS - SECTION 200.2 It was suggested that a broader description of commercial uses be provided in the definition section of the ordinance so that an extensive listing of all types of retail or service businesses will not have to be listed within individual commercial zoning districts. City Planner Brixius then went over some of the areas of changes. As they went along Commission member Dorenbush asked about' Adult Uses' . City Planner Brixius stated that 'Adult Uses' is a separate Ordinance. No municipality can really prohibit adult uses, but can put restrictions in the Ordinance. SHOPPING CENTER PROCESSING- SECTION 1 000.3 (d) The Ordinance presently requires that shopping centers be processed as a planned unit development - conditional use permit. The City Attorney has suggested that multi- tenant buildings (i.e., shopping centers) be allowed as permitted uses without the need for a conditional use permit. POLE BARNS - SECTION 1000.4(i)(2) Section 1000.4(i)(2) of the ordinance addresses pole barns. Presently, pole barns are allowed within A-I and A-2 Zoning Districts as a permitted use and within residential districts by conditional use permit. It is suggested that pole buildings continue to be allowed in association with agricultural operations but that such building type not be allowed in association with single-family residential uses. GLARE - SECTION 1000.10 3 Planning and Zoning Commission UNApproved Minutes September 9, 2003 Page 3 of 4 . This section has been modified to include specific requirements for parking lot lighting. As they proceeded through the section - it was suggested to put in illustrations of the types of lighting preferred in Albertville. REFUSE - SECTION 1000.15 This section has been modified to stipulate that all refuse containers within commercial and industrial districts be located within an enclosure (to screen their view from adjacent properties and rights-of-way). Additionally, it is proposed that such enclosures be constructed of materials similar to those upon the principal building. OUTSIDE STORAGE - SECTION 1000.21 Presently, outdoor storage is allowed in all commercial and industrial zoning districts by conditional use permit. At the suggestions of the Planning and Zoning Commission, this section has been modified to reference respective zoning districts in regard to the allowance of outdoor storage. . BUILDING TYPE AND CONSTRUCTION - SECTION 1100.4 With the introduction of the B-2A Zoning District, building materials requirements, will differ from district to district. With this in mind, it is proposed that the business district standards be referenced in the individual district provisions rather than the general performance standards. OFF-STREET PARKING REQUIREMENTS - SECTION 1200 Several changes are proposed to this section - see packet for update. ZONING DISTRICTS Section 4200, Neighborhood Low Intensity Business District - In examining the City's zoning map and the district itself, it is believed that this district has become obsolete in the range of uses and its application within the community. Section 4300, B-2 Limited Business District. This district will apply to county Road 19 south of 57th Street and is intended to be a neighborhood friendly commercial area with limited commercial uses. Section 4350, B-2A Special Business District. This is a new district that will apply to much of County road 19, both north and south of the I-94/County road 19 interchange. The district is intended to impose performance standards that result in high quality development. . Section 4400, B-3 Highway Commercial District. This district has been modified to include only highway-oriented uses. This includes, but is not limited to, dance halls, other commercial recreational uses, automobile sales lots, hospitality businesses, restaurants, motels, etc., automobile oriented type uses and a full range of retail goods and services. 4 . . . This district has been modified to reference use changes in the B-2 and B-3 Districts which consequently roll over into the B-4 District. Section 4501, B-W Business Warehousing District. This district has been modified from a strict warehousing to a district that accommodated wholesale showroom type uses. Specific performance standards for sales lots and outdoor display activities have also been incorporated. Section 4900, Shore land District. This section has been modified to clarify previous setback reference conflicts resulting from the JMJ Phase III Outlet Mall pun and Towne Lakes projects. Section 5000.1, Wetland Systems Overlay District. It is recommended that this district be omitted from the ordinance and that the requirements of the Wetland conservation Act apply to the City's wetlands. 6.
