PRESENT: Chair Sharon Leintz, Commission members Frank Kocon, Scott Dorenbush, and
Dan Wagner, Council liaison LeRoy Berning, City Planner Al Brixius, Zoning Administrator/
Building Official Jon Sutherland, and City Clerk/Secretary Bridget Miller

Chair Leintz called the Planning and Zoning Commission meeting of the City of Albertville to
order at 7 :00 p.m.
ADOPT AGENDA
MOTION BY Commission member Wagner, seconded by Commission member Klecker to
approve the agenda as amended and on fIle in the office of the City Clerk. Motion carried
unanimously.

MINUTES
MOTION BY Commission member Wagner, seconded by Commission member Dorenbush to
approve the September 13,2006 regular Planning and Zoning Commission minutes as amended
and on fIle in the office of the City Clerk. Motion carried unanimously.
Previously read:
Erwin Greninger of Rogers asked what the city proposes to do about the
drainage of water issues he has been experiencing on his property, which
is located north of the Albertville Premium Outlets and east of the
Albertville Business Park 2nd Addition. Mr. Greninger reported that he
has never had problems with water on his property since the development
began around him.

PUBLIC HEARINGS
STARBUCKS' DRIVE-THRU V ARlANcElCONDmONAL USE PERMIT
Chair Leintz opened the public hearing at 7:10 p.m.
City Planner Brixius reported that Starbucks Coffee has applied for a variance/conditional use
permit for a drive through land and menu board to be posted on the north side of Building D of
Albertville Crossings Second Addition.
City Planner Brixius noted that the drive through will change the traffic pattern of the parking lot
from a two-way circulation pattern to a one-way circulation. Therefore additional signage will
be necessary to direct the traffic.
The Commission asked if the applicant was present to address any questions or concerns with the
application before the commission.
City Planner Brixius informed the Commission members that the applicant was not present.
Chair Leintz asked if there was anyone else present to speak regarding the Starbucks' Drive-thru
Variance/Conditional Use Permit.
The Commission members had reserves with the traffic circulation with the drive through lane
and parking stalls near the stacking lanes.
Chair Leintz continued the public hearing to the November 14,2006 Planning and Zoning
Commission meeting.
OTHER BUSINESS
PLANNING AND ZoNING COMMISSION RULES AND LENGTH OF TERM
Commission members wanted to review the Planning and Zoning Commission terms of service
on the commission.
According to the approved Rules and Regulations, it appears that the Chair position should have
expired in January 2006 or December 31, 2005. The next commission members whose terms are
expiring in January 2007 or December 31, 2006; therefore two seats would be open.
Commission member Meza was one of the members whose terms were expiring at the end of the
year. If there are commission members whose terms are expiring and would like to continue
serving on the commission would need to submit a letter of interest to the City Council before
the end of the year to be re-appointed to the Planning and Zoning Commission.

FILL THE PLANNING AND ZoNING COMMISSION VACANCY
Chair Leintz acknowledged the two applicants present who submitted their application to be
considered for the Planning and Zoning vacancy.
City Planner Brixius recommended interviewing applicant Denise Prow fIrst and asked Rob
Olson step out into the lobby.
Denise Prow introduced herself to the commission members and explained to them why should
would like to serve on the Planning and Zoning Commission. Ms. Prow pointed out that she has
previous experience working for Olmsted Co. in the Planning Department in the Housing and
Redevelopment area. Ms. Prow informed the commission that she is a concerned citizen that
takes pride in the City in which she lives.
Chair Leintz thanked Denise for her time and interest in wanting to serve on the commission.
Leintz stated that after they hear from Rob the commission would review the results and make a
recommendation to the City Council at the November 6, 2006 meeting.
Rob Olson proceeded by introducing himself to the commission members. Mr. Olson stated that
he recently received his P. E. in Engineering. Mr. Olson informed the commission that he would
like to contribute and help assure that the city continues to grow in a positive way. Mr. Olson
wanted to make sure that the growth was in compliance with the Comprehensive Plan that
Albertville adopted.
Chair Leintz thanked Rob for his interest and time in wanting to serve on the
MOTION BY Commission member Wagner, seconded by Commission member Kocon to
recommend appointing Denise Prow Motion carried unanimously.
ADJOURNMENT
MOTION BY Commission member Kocon, seconded by Commission member Dorenbush to
adjourn at 7:53 p.m. Motion carried unanimously.

Albertville - Starbucks Drive Through Conditional Use

BACKGROUND
Starbucks Coffee has applied for a conditional use permit/variance for a drive through
lane and menu board to be posted on the north side of Building 0 of Albertville
Crossings. Building 0 of Albertville Crossings is located at the corner of 57th Street NE
and Labeaux Avenue NE. The Starbucks will be located in the north portion of the
building along with the drive through. This application was heard at the October
Planning Commission meeting and was table so the applicant or a representative could
answer the questions of the Commission.

ISSUE ANALYSIS
Zoning. Albertville Crossings Building "0" is currently zoned B-3, Highway Commercial.
The B-3 District allows for drive through service lanes by conditional use permit.

RECOMMENDATIONS
Based on the review of the plans dated 10/03/06, staff recommends approval of the
conditional use permit for a drive through lane for Starbucks Coffee with the following
conditions:
1. The parking lot shall be signed to signify a one-way traffic circulation pattern on
the north side of the building.
2. The drive through lane and the by-pass lane shall be properly striped and signed
to illustrate the separation and show one-way circulation.
3. The landscape screen along 57th Street NE shall be planted with five Austrian
Pines, no less than five feet in height and shall be guaranteed for two years.
4. If lighting is to be added to the drive through area, a new lighting plan shall be
submitted.
5. All comments by the City Engineer in the letter dated September 1, 2006 shall be
satisfied.

BACKGROUND
The City of Albertville has submitted an application for preliminary and final plat of the
Barthel's Industrial Park 2nd Addition in the 1-1, Limited Industrial District. The plat
includes approximately 22 acres of land on the north and south side of 52nd Street NE
and the corner of Marlowe Avenue. The land includes Lots 7, 10, 11 and 14 of Block 2
and Lots 1 and 2 of Block 10 all in the original Barthel's Industrial Park, a portion of Lot
9 Block 2 of Barthel's Industrial Park, and a part of Mackenzie Avenue NE which is to be
vacated. The proposed plat is to subdivide the areas north of 52nd Street NE into three
lots and one outlot, and the land south of 5200 Street NE into two lots and one outlot.

ISSUE ANALYSIS
Zonino. The area proposed for Barthel's Industrial Park 2nd Addition is zoned 1-1,
Limited Industrial and shall remain zoned 1-1.

RECOMMENDATION
Based on the review of the submitted plats, we believe the proposed Barthel's Industrial
Park 2nd Addition meets the requirements of the 1-1 District; therefore, our office
recommends approval of the preliminary plat and final plat with the following
condition(s):
1. Frasier Steel shall submit a signed purchase agreement for the expansion of
Lot 1, Block 1 prior to the plat being finalized.
2. A signature line shall be added to the final plat for Frasier Steel.
3. The approval of the plat is dependant on the vacation approval of Mackenzie
Avenue NE by the City Council at the December 14,2006 meeting.
3. Site and building plan reviews will be required for all new developments in the
Barthel's Industrial Park 2nd Addition.

BACKGROUND
Discussions with the City Staff have lead to the recommendation that the fees for PUD
Rezoning or Conditional Use Permit be increase to reflect the amount of time need to
review and comment on the application. The City is proposing to amend Ordinance No.
2004-23. The amendment would be for Section 100.10(a) Fees, Charges and
Expenses to change the Proposed Fee 1 Escrow for PUD Rezoning or Conditional Use
Permit from $300 + $501l0t 1 $1500 to $300 + $50/10t 1 $5,000. This fee change would
be reflective of the review level required for a PUD Rezoning or Conditional Use Permit
which is similar to the review level of a Preliminary Plat, due to the fact that the PUD
results in multiple building reviews just a Preliminary Plat would. Only the portion
underlined in the attached ordinance is proposed to be changed.

SECTION 1. Section 100.10 of the Albertville Zoning Ordinance is hereby amended to read
as follows:
100.10 Fees, Charges and Expenses.
(a) Fees and charges, as well as expenses incurred by the City for engineering, planning,
attorney and other services related to the processing of applications shall be established by this
Zoning Ordinance and collected by the Zoning Administrator for deposit in the City's accounts.
Fees shall be established as follows. The Council may establish charges for public hearings,
special meetings, or other such Councilor Planning Commission actions as are necessary to

Zoning Admin strator/Building Official Jon Sutherland stated that it would be a good idea to
have this desig ed before it goes to the City Council.
City Planner Brixius recommended adding the condition to the variance/conditional use permit
as;
7. Additional investigation to be done for public tie to sidewalk along 57th Street as reviewed
by the City Engineer.
Commission member Dorenbush asked if there was going to be outdoor seating.
City Planner Brixius stated that this would require a separate zoning application forthis' to be
considered.
City Planner Brixius recommended to the Commission approving the variance/conditional use
permit with the seven items noted.

PRELIMINARY AND FINAL PLAT - BARTHEL'S INDUSTRIAL PARK 2ND ADDITION
City Planner Brixius stated The City of Albertville has submitted an application for preliminary
and fInal plat of the Barthel's Industrial Park 2nd Addition in the I-I, Limited Industrial District.
The plat includes approximately 22 acres of land .on the north and south side of 52nd Street NE
and the corner of Marlowe Avenue m NE. The land includes Lots 7, 10, 11 and 14 of Block 2
and Lots 1 and 2 of Block 10 all in the original Barthel's IndustrialPark, a p.orti.on of Lot 9
Block 2 of Barthel's Industrial Park, and a part of Mackenzie Avenue NE which is to be vacated.
The proposed platis to subdivide the areas north .of 52nd Street NE into three lots and one outlot,
and the land s.outh of 52nd Street NE into two lots and one outlot.

AMENDMENT TO FEE SCHEDULE
City Planner Brixius stated discussions with the City Staff have led to the recommendation that
the fees for PUD Rezoning or Conditional Use Permit be increase to reflect the amount of time
needed to review and comment on the application. The City is proposing to amend Ordinance
No. 2004-23. The amendment would be for Section 100.1O(a) Fees, Charges and Expenses to
change the Proposed Fee / Escrow for PUD Rezoning or Conditional Use Permit from $300 +
$50/lot / $1500 to $300 + $50/1ot / $5,000. This fee change would be reflective of the review
level required for a PUD Rezoning or Conditional Use Permit which is similar to the review
level of a Preliminary Plat, due to the fact that the PUD results in multiple building reviews just
as a Preliminary Plat would. Only the escrow fee would change for PUD Rezoning or
Conditional Use Permit.
Council liaison Berning asked why the fee for residential land fIlling or excavation was $200.
City Planner Brixius stated that this particular land fIlling and excavation deals only with a CUP
orPUD.

ordinance.

have the current ordinance in our city code book.

BACKGROUND
Starbucks Coffee has applied for a conditional use permit/variance for a drive through
lane and menu board to be posted on the north side of Building 0 of Albertville
Crossings. Building 0 of Albertville Crossings is located at the corner of 57th Street NE
and Labeaux Avenue NE. The Starbucks will be located in the north portion of the
building along with the drive through. This application was heard at the October
Planning Commission meeting and was table so the applicant or a representative could
answer the questions of the Commission.

ISSUE ANALYSIS
Zonina. Albertville Crossings Building "0" is currently zoned B-3, Highway Commercial.
The B-3 District allows for drive through service lanes by conditional use permit.

RECOMMENDATIONS
Based on the review of the plans dated 10/03/06, staff recommends approval of the
conditional use permit for a drive through lane for Starbucks Coffee with the following
conditions:
1. The parking lot shall be signed to signify a one-way traffic circulation pattern on
the north side of the building.
2. The drive through lane and the by-pass lane shall be properly striped and signed
to illustrate the separation and show one-way circulation.
3. The landscape screen along 57th Street NE shall be planted with five Austrian
Pines, no less than five feet in height and shall be guaranteed for two years.
4. If lighting is to be added to the drive through area, a new lighting plan shall be
submitted.
5. All comments by the City Engineer in the letter dated September 1, 2006 shall be
satisfied.

RECOMMENDATION
Based on the review of the submitted plats, we believe the proposed Barthel's Industrial
Park 2nd Addition meets the requirements of the 1-1 District; therefore, our office
recommends approval of the preliminary plat and final plat with the following
condition(s):
1. Frasier Steel shall submit a signed purchase agreement for the expansion of
Lot 1, Block 1 prior to the plat being finalized.
2. A signature line shall be added to the final plat for Frasier Steel.
3. The approval of the plat is dependant on the vacation approval of Mackenzie
Avenue NE by the City Council at the December 14, 2006 meeting.
3. Site and building plan reviews will be required for all new developments in the
Barthel's Industrial Park 2nd Addition.

BACKGROUND
Discussions with the City Staff have lead to the recommendation that the fees for PUD
Rezoning or Conditional Use Permit be increase to reflect the amount of time need to
review and comment on the application. The City is proposing to amend Ordinance No.
2004-23. The amendment would be for Section 100.1 O(a) Fees, Charges and
Expenses to change the Proposed Fee I Escrow for PUD Rezoning or Conditional Use
Permit from $300 + $50/10t 1 $1500 to $300 + $50/10t 1 $5,000. This fee change would
be reflective of the review level required for a PUD Rezoning or Conditional Use Permit
which is similar to the review level of a Preliminary Plat, due to the fact that the PUD
results in multiple building reviews just a Preliminary Plat would. Only the portion
underlined in the attached ordinance is proposed to be changed.

EXPENSES BY WAY OF A ZONING ORDINANCE
THE CITY COUNCIL OF THE CITY OF ALBERTVILLE, MINNESOTA ORDAINS:
SECTION 1. Section 100.10 of the Albertville Zoning Ordinance is hereby amended to read
as follows:
100.10 Fees. Charges and Expenses.
(a) Fees and charges, as well as expenses incurred by the City for engineering, planning,
attorney and other selVices related to the processing of applications shall be established by this
Zoning Ordinance and collected by the Zoning Administrator for deposit in the City's accounts.
Fees shall be established as follows. The Council may establish charges for public hearings,
special meetings, or other such Council or Planning Commission actions as are necessary to
process applications.
