Motion carried unanimously. PUBLIC HEARINGS AMENDMENTS TO THE FENCE REGULATIONS, SECTION 1000.6.A AND SECTION 1006.J. (TEMPORARY FENCES) OF CHAPTER 1000 OF THE ALBERTVILLE ZONING ORDINANCE (APPENDIX A) Chair Kocon opened the public hearing at 7:05 p.m. City of Albertville Planning & Zoning Commission Minutes January 11, 2011 Page 2 of 7 2 City Planner Brixius began the discussion stating that in June 2010 the Planning Commission reviewed the issues related to the placement of a temporary fence that was installed for the 2009- 2010 winter season. In 2009, the City received complaints regarding the location, appearance, and the duration of a temporary fence from the neighbors. Brixius continued noting that within the Albertville City Code Appendix A (known as the Zoning Ordinance) in Section 1000.6 deals with fences. Under Provision A it states that it is illegal for any person, except on a farm and related to farming, to construct or erect a fence within the City without a fence permit. Based on this provision, the City has informed the past violators that temporary fences are prohibited. Brixius explained that in some cases temporary fences may be acceptable or necessary such as those to secure a construction site. Yet, the question still remains “should the ordinance be amended to make some accommodation for the allowance of temporary fences?” Staff initially presented this information to the Commission in September 2010, with the outcome to pursue the consideration to amend the Albertville City Code. The suggestions and or recommendations to amend the regulations are as follows: 1. Construction site fences 2. Residential garden fences 3. Snow fences Below are the proposed changes to the Albertville City Code, Appendix A (Zoning Ordinances) Section 1000.6. 1000.6.J. Exception to Fence Permits. The following temporary fences may be installed or erected without a fence permit: 1. Construction fences needed to secure a construction or excavation site, provided: a. The project site has an active building permit, demolition permit, or excavation permit. b. Said fence location is approved by the City Building Official. 2. Garden fences used to protect gardens, shrubs or landscaping from damage from animals or ornamental fencing that accents a landscape feature may be allowed within a residential zoning district provided: a. Garden fences shall not exceed forty-two (42) inches in height. b. Garden fences shall not be a boundary line fence and shall not be located closer than five (5) feet from any lot line. 3. Snow fences for the purpose of controlling drifting snow shall be allowed provided: City of Albertville Planning & Zoning Commission Minutes January 11, 2011 Page 3 of 7 3 a. Snow fences shall not be a boundary line fence and shall not be located closer than five (5) feet from any lot line. b. Snow fences shall not be located in the front yard of any residential lot. c. Snow fences shall be of a temporary design. These fences shall not be installed prior to November 15th and shall be removed no later than March 15th. 4. Any fences related to an active farm and/or permitted farming activity. Staff has published the notice informing the residents there is a public hearing to express their opinion on the temporary fence ordinance amendment. Chair Kocon opened up the public hearing to the Commission members’ comments. Commission member Lindberg asked why five (5) feet away from the property instead of two (2) feet. Brixius commented the five (5) feet is the side yard setback. Chair Kocon appeared to be in agreement with the proposed ordinance amendment; however, Commission member Edgren inquired if this pertained to residential property or if it applies to all property that would include the homes along CSAH 37 zoned commercial or agricultural. Brixius noted this would apply towards residential more so than commercial or agricultural. Chair Kocon opened up the public hearing to the general public. There was no one in the audience to comment on the proposed language pertaining to signage throughout Albertville. Chair Kocon closed the public hearing at 7:12 p.m. P&ZCMs Edgren/Lindberg motioned to approve Ordinance No. 2011-001 entitled an Ordinance Amending Section 1000.6 (Fences) of Chapter 1000 (General Building and Performance Requirements) of Appendix A (Zoning Ordinance) of the 2005 Albertville Municipal City Code Relating to Temporary Fence Regulations as proposed. Motion carried unanimously. AMENDMENTS TO SIGN REGULATIONS, TITLE 10, CHAPTER 7 OF THE ALBERTVILLE CITY CODE RELATED TO NUMBER OF TEMPORARY SIGNS PERMITTED Chair Kocon opened the public hearing at 7:13 p.m. City Planner Brixius began by commenting business owners approached staff in 2009 inquiring about the possibility of increasing the number of temporary portable signs allowed in a year. The maximum is four (4) per year per building. The US and other countries have experienced City of Albertville Planning & Zoning Commission Minutes January 11, 2011 Page 4 of 7 4 tough times with the economic woes. Albertville amended the ordinance in 2010 to increase the number to six (6) per year that expired December 31, 2010. Staff is suggesting extending the allowance to December 31, 2012. Chair Kocon opened up the public hearing to the Commission members’ comments. Chair Kocon and Commission member Edgren were in agreement to allow business owners the ability to have six (6) temporary portable signs for a temporary length. Commission member Lindberg did not agree with the amendment and would like to keep it at four (4) per year. Lindberg thought four (4) temporary signs per year would be sufficient. Chair Kocon opened up the public hearing to the Commission members’ comments. Business owner Joe Holtz of Neighbor’s Eatery and Salon commented that six (6) signs per year does not allow many businesses to display specials or sales. Mr. Holtz also shared comments about the possibility of amending the sign ordinance pertaining to off-premise signage. Building Official Sutherland informed the Commission members that he did authorize and allow Neighbor’s Eatery and Saloon to place a temporary portable sign on CSAH 37. As Sutherland continued to explain, he noted that other business owners along CSAH 19 apply for a temporary portable sign that is placed within the right-of-way not directly in conjunction with their property. Taking those few businesses into consideration, Sutherland felt the approval or authorization for the Neighbor’s Eatery and Saloon temporary portable sign at the end of Main Avenue NE along CSAH 37 would be comparable to what the other sites have done in previous years. Council liaison Wagner made the suggestion that if you are going to increase the number allowed why not go with eight (8). There are a number of strip malls in Albertville that house multiple tenants, increasing the number to eight (8) per year per building, Wagner did not see it would be that harmful to the City. Wagner went on to inquire what other communities do when there are multiple tenants in a building and or structure. City Planner Brixius did not have the information at the moment, but would research for the Council meeting. Chair Kocon closed the public hearing at 7:52 p.m. P&ZCMs Lindberg motioned, no commission member seconded to approve Ordinance No. 2011-002 entitled an Ordinance Amending Section 7 (General Standards) of Chapter 7 (Sign Regulations) of Title 10 (Building and Development Regulations) of the 2005 Albertville Municipal City Code Relating to the number of Temporary and Portable Signs Allowed as presented. Motion failed due to a lack of a second. P&Z Chairman/CMs Kocon/Edgren motioned to approve Ordinance No. 2011-002 entitled an Ordinance Amending Section 7 (General Standards) of Chapter 7 (Sign Regulations) of Title 10 (Building and Development Regulations) of the 2005 Albertville Municipal City Code Relating City of Albertville Planning & Zoning Commission Minutes January 11, 2011 Page 5 of 7 5 to the number of Temporary and Portable Signs Allowed as amended increasing the number to eight (8) per year until December 31, 2012. AMENDMENT TO NON-CONFORMING USE REGULATIONS, SECTION 900.2 OF CHAPTER 900 OF THE ALBERTVILLE ZONING ORDINANCE Chair Kocon opened the public hearing at 7:55 p.m. City Planner Brixius informed the Commission members that a single-family home along 60th Street NE lost their garage due to a fire. According to the Albertville Zoning District map, this property is zoned B-4 General Business District making the re-establishment of a garage non- conforming use within the site. Building Official/Zoning Administrator Sutherland advised the homeowner that Minnesota State Statutes 462.357 had been amended a few years ago to allow the reconstruction of a legal non- conforming use or structure lost to fire or peril. Amending the Albertville City Code Appendix A (Zoning Ordinance) to include language similar to the Minnesota State Statutes would give the homeowner the ability to reconstruct the garage if a building permit is submitted in 180 days of the event. Staff continued commenting that the second part of the change is amending the City Code dealing with extending the time period for abandoned non-conforming use or occupancy to one (1) year. Chair Kocon opened up the public hearing to the Commission members’ comments. Commission accepted staff’s recommendation to take measures to correct the current language relating to non-conforming use in the various areas of the 2005 Albertville City Code as proposed below: SECTION 1. Section 900.2 (Provisions) of Chapter 900 (Non-Conforming Buildings, Structures and Uses) is hereby amended as follows: 900.2. Provisions. If at any time, a non-conforming building, structure or use shall be destroyed to the extent of more than fifty percent (50%) of its fair market value, said value to be determined by the City, it may be re-established to its prior size and form, but not expanded, if the property owner applies for a building permit within one hundred eighty (180) days of the damage event. If no building permit is applied for within the specified time period, then . . . Chair Kocon opened up the public hearing to the members present in the audience, which there were no additional comments made. Motion carried unanimously. AMENDMENT TO SIGN REGULATIONS, TITLE 10, CHAPTER 7 OF THE ALBERTVILLE CITY CODE RELATED TO LOCATION OF WALL SIGNS Chair Kocon opened the public hearing at 8:01 p.m. City Planner Brixius reported that Space Aliens recently requested to place a business sign on a wall that does not abut a public right-of-way. According to the Albertville City Code, allowing a business to install a sign on an exterior wall of a building that does not face a street is not allowed. As staff analyzed the City Code, they felt revising Title 10, Chapter 7, Section 8 allowing greater flexibility in the placement of business walls signs. Allowing business wall signs to be placed on the side of a building or tenant bay not facing a street right-of-way, provided that no sign is located on the side of a building where the lot directly abuts a residential zoning district. Chair Kocon opened up the public hearing to the Commission members’ comments. Commission members presented accepted staff’s recommendation to take measures to correct the current language relating to signage in the various areas of the 2005 Albertville City Code. There was no one in the audience to comment on the proposed language pertaining to signage throughout Albertville. Chair Kocon closed the public hearing at 8:09 p.m. P&ZCMs Edgren/Lindberg motioned to approve Ordinance No. 2011-004 entitled an Ordinance Amending Section 8 (Permitted Business Signs) of Chapter 7 (Sign Regulations) of Title 10 (Building and Development Regulations) of the 2005 Albertville Municipal City Code as presented. Motion carried unanimously. OTHER BUSINESS Appoint 2011 Planning and Zoning Commission Officers City Planner Brixius commented that the Chairperson and Vice-chairperson positions expired in December 2010. Since there was no meeting in December 2010 it is recommended that the Commissioner’s nominate and appoint those members this evening. The following nominations were made to fill the two (2) positions on the Planning and Zoning Commission. ADJOURNMENT P&ZCMs Edgren/Lindberg motioned to adjourn the January 11, 2011 regular Planning and Zoning Commission meeting at 8:15 p.m. Motion carried unanimously. _______________________________________ Bridget Miller, City Clerk/Secretary 8 PLANNING REPORT TO: Larry Kruse FROM: Alan Brixius DATE: February 3, 2011 RE: Albertville – Particle Control Rezoning and Site and Building Plans FILE NO: 163.06 – 11.01 BACKGROUND Particle Control is a family-owned business located at 6062 Lambert Street. They are a dry food processing business that specializes in milling, blending, air classifying, screening, and packaging dry food ingredients. Particle Control approached the City with a request to place up to two storage silos on their site to accommodate a new customer that required the handling of bulk materials. In review of Particle Control’s request, we discovered that their site is zoned B-3, Highway Commercial District. Their industrial use is a legal non-conforming use within this district, which may continue to operate in the same size and manner it existed as when the zoning changed. The B-3 zoning prevents the expansion of this existing industrial use. Their site is zoned B-3 based on the City’s ambition to promote commercial development along I-94 and County Road 37. Planning District 5 of the Albertville Comprehensive Plan calls for the phasing out of non-conforming uses in favor of commercial development. The plan recommends actively working with developers and landowners to achieve the desired redevelopment of non-conforming or incompatible land uses. Particle Control is a clean, quiet industrial land use that has been a good neighbor to the surrounding properties. The City has no nuisance complaints of this business. Additionally, it provides both industrial tax base and local employment opportunities. In the current economic climate, neither Particle Control or the City is prepared to seek redevelopment of this site. In light of these conditions, staff evaluated methods to accommodate Particle Control’s continued on-site growth and success, while protecting the City’s long range commercial goals for this area of the City. 9 REZONING The first option was to rezone the property to an I-1, Limited Industrial District. This option was reflected due to the range and intensities of the industrial uses that are allowed in this district. While Particle Control has demonstrated that it is a good neighbor, the reuse of the property for another I-1 use may not be as favorable. The alternative zoning option is to rezone the property to PUD, Planned Unit Development. Through the PUD zoning, the City may define the range of appropriate land uses and development performance standards unique to the proposed property. Following staff direction, Particle Control has submitted an application for rezoning to PUD and a site and building plan for the placement of up to two silos. In considering any change of zoning, the following criteria (Section 300.1.F) are applicable: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Comment: As mentioned earlier, the Albertville Comprehensive Plan guides this site for commercial land uses and includes recommendations for the relocation of non-conforming uses and redevelopment of these sites. Particle Control exists as a legal non-conforming use within the current B-3 Zoning District, however, neither Particle Control or the City is currently in the position of site redevelopment. To maintain the objective of the Comprehensive Plan goals, the proposed PUD would identify the following limited range of land uses that may be permitted on the site: • All permitted, conditional, and accessory uses of the B-3 Zoning District. • Industrial processing of dry food ingredients limited to milling, blending, air classification, screening, packaging, warehousing and storage. Through this list of land uses, the City preserves the long range commercial redevelopment goals, while making accommodation to continue operation and growth on the site. This strategy attempts to preserve and grow the City’s industrial tax base, local job opportunities, and hopefully will encourage Particle Control to relocate within the City when the business outgrows the site. 2. The proposed use is or will be compatible with present and future land uses of the area. Comment: As noted earlier, Particle Control has not presented any compatibility issues for the surrounding properties. The site design locates the 10 buildings in a manner that all traffic and operations are on the north side of the site, away from the residential properties. The proposed silos would also be located on the north end of the building. This takes truck deliveries and silo filling away from the adjoining land use. 3. The proposed use conforms with all performance standards contained herein. Comment: The current land use and building location are legally non- conforming in the current B-3 Zoning District. The change in zoning will allow the use, however, staff proposes to retain the B-3 District required setbacks. The existing buildings will remain legally non-conforming as shown below. Any new expansion, such as the silos, will be required to meet all B-3 District setbacks and height restrictions. Architectural Standards. The B-3 District restricts building height to 35 feet. The district also mandates that 50 percent of all building walls must have an exterior finish of brick, stone, replicas, etc. Currently, the building meets the B-3 height standards, but fails to meet the exterior finish standards. Staff is recommending that through the PUD, the following architectural standards be applied: (1) All buildings shall not exceed 35 feet in height. This will limit the silo height to existing standards. (2) Within the approved PUD shall be the following standards: (a) Any and all permitted conditional and accessory uses allowed within the B-3 Zoning District shall meet the architectural standards of Section 4400.8 of the Albertville Zoning Ordinance. (b) Industrial processing of dry food ingredients buildings may have a metal exterior finish provided the color of any new building or structure matches the color and design of the principal building. This PUD flexibility will preserve the appearance of Particle Control while accommodating the existing conditions. The new silo will need to match the color of the principal building. The addition of the site will not immediately increase employment. No additional parking is required. No parking lot improvements are necessary. 11 4. The proposed use will not tend to or actually depreciate the area in which it is proposed. Comment: Particle Control is a long standing industrial use on this site. The continuation of the use through the rezoning to PUD is not anticipated to depreciate the values of the surrounding properties. The PUD zoning will accommodate the continued operation and growth of Particle Control, while maintaining the City’s long range objectives for commercial redevelopment. 5. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Comment: The Particle Control site has access to public utilities. The process of dry food ingredients is not a high water user. The existing use and proposed silos will not overburden City utilities or services. 6. Traffic generation by the proposed use is within the capabilities of streets serving the property. Comment: The addition of the silo is not anticipated to dramatically increase traffic to the site. The site is accessed via 60th Street. The traffic generation is within the capabilities of the streets serving the site. RECOMMENDATION The requested rezoning is a means for the City to retain and grow a local industry, while retaining its long range ambitions for commercial redevelopment along County Road 37. Absent a current viable redevelopment/relocation alternative, staff is recommending approval of the applicant’s request for rezoning from B-3 to PUD and approve the applicant’s site and building plans to construct up to two silos on the site. The approvals are recommended with the following conditions: Planned Unit Development. In establishing the PUD Zoning District, the following use and performance standards shall be applied: 1. Uses. Within the approved PUD, land uses shall be limited to the following: a. All permitted conditional and accessory uses allowed within the B-3 Zoning District. Any change of use from existing conditions shall be processed through the appropriate development applications called for by the Albertville Zoning Ordinance. b. Industrial processing of dry food ingredients limited to milling, blending, air classifying, screening, packaging, warehousing, and storage per the approved site plan received December 2010. 12 2. Setbacks. All new development and any further expansion of the existing building shall comply with the following setbacks: a. Front Yard. Thirty-five (35) feet. b. Side Yard. Twenty (20) feet or thirty-five (35) feet where abutting an “R” District. c. Rear Yard. Twenty (20) feet or thirty-five (35) feet where abutting an “R” District. 3. Building Height. Thirty-five (35) feet. 4. Architectural Standards. Within the approved PUD, architectural standards shall be the following: a. Any and all permitted conditional and accessory uses allowed within the B-3 Zoning District shall meet the architectural standards of Section 4400.8 of the Albertville Zoning Ordinance. b. Industrial processing of dry food ingredients buildings may have a metal exterior finish provided the color of any new building or structures match the color and design of the principal building. These PUD standards shall be used to process any future additions or redevelopments to the site. Site Plan. The following conditions shall be required for installation of the proposed silos: 1. Silo shall not exceed 35 feet in height. 2. Silo shall be located on site per the approved site plan dated December 2010 and provide a minimum setback of 35 feet from the north lot line and 20 feet from the east lot line. 3. Our facility is FDA and AfB inspected and certified to handle Kosher and organic ingredients. Bill Arns is the president and sole proprietor. Particle Control currently employs seven full time and thee part time workers, some of which have been with us for 15 years or more. Particle Control is a nationally known food processing company. Some of our biggest customers include the NutraSweet Company, General Mills, ADM, Con-Agra, and others. Recently, one of our customers has inquired about having the ability to handle bulk materials, which would require us to erect a bulk silo at our facility. This would be a smooth wall bofted (non-permanent) structure. Being able to handle bulk materials would be a significant addition to the company for it would create new opportunities. Looking to the future, Particle Control may be seeking to expand our services which would require us to hire more employees. Recommended Action None Background Activity Report for Council review. The report has additional information than normal in order to provide greater detail for the new Mayor and Council member • Construction Activity in December is typically a slow month; however, this year it was better considering the economy. We had a total of 17 permits issued in December for a value of $1,304,309. We had 241 permits for the year with a total permit value of $3,361,990. December’s residential activity included one (1) Single-family Dwelling located at 10141 Karston Court NE, five (5) more furnace/AC replacements, several window and door replacements, and a water heater. • Commercial activity included an interior door for Patty J’s new Restaurant at 5262 Kyler Avenue NE, Westwind Apartments obtained a commercial alteration permit for building maintenance and improvements at 10740 CSAH 37, Summit Chiropractic installed an x-ray room at 10904 57th Street NE. We also had several commercial mechanical and plumbing permits. I worked with the League of MN Cities Insurance agent and the contractor regarding the replacement of the City Hall skylight that was damaged by hail. I also worked with the sub-contractor who has submitted a proposal to repair the water damage to City Hall due to the leaking skylight. • New Laws enacted by the State Legislature, I reviewed new laws relating to building codes, contractors, and additional duties of the Building Official and the City that are now required by these laws (Mike Couri is our expert and advised me of the ramifications of these laws or unfunded mandates). Agenda Item No. 6.D.1. Meeting Date February 7, 2011 • Planning and Zoning; December was another busy month for planning and zoning activity and we responded to various issues including but not limited to; general inquiries related to commercial exterior storage (Scherer Bros. Lumber), developers agreements and maintenance of improvements and stormwater ponds (Kollville Estates), discussion of defunct associations and plowing of Streets (Prairie Run – 51st Street), landscaping requirements and enforcement (Emma’s Express). Staff assisted the planner who prepared zoning ordinance changes that will be submitted to the Planning Commission in January. We reviewed a proposal for a new sign at Space Aliens and staff will propose a sign code modification for interdepartmental review and bring this to the Planning Commission for input. We conducted a zoning review of the Particle Control site at 6062 Lambert Avenue NE and met with the owner, Bill Arns who is interested in erecting two (2) silos on the property. Staff discussed if fences are required when a person is required to have a private dog kennel permit. • Ordinance Enforcement; issues include sign code enforcement, removing signs from the right of way, enforcement of commercial temporary signage, building code violations, water drainage/water problems, refuse in the ditch, continued work with Pro-Tech Marine and Emma’s Express regarding Council CUP approval. We worked on dog kennels, wetlands, and fences. • Foreclosures; our work continues with vacant foreclosed houses with registration and inspections. Foreclosure work includes investigation, registration, inspection, and follow up. A few of our foreclosures are apparent because their driveways may not be plowed this time of year. Many housing maintenance, building, electrical, mechanical, and plumbing code items are being addressed through the enforcement of the Vacant Property Registration Ordinance. • Rental Housing inspections; rental licensing, and inspections continue; we obtain many corrections to rental housing violations including but not limited to safety, gas leaks, smoke and carbon monoxide detectors, and electrical code violations. Our local state electrical inspector assists me with resolving the electrical code violations with the rental properties. Some foreclosures are turning from owner occupied into rentals and this could be a concern for the Council. • Fire Department; I continue to assist the Fire Department with the Fire Code enforcement and general assistance with their program. We continue to work with Burger King, the Outlet Mall, and other businesses.
