Public hearing to consider a request from Simon Properties amending the Albertville Premium Outlet Mall Planned Unit Development changing the design and size of their freestanding signs. Al presented the three signs being requested by the applicant and went over his report. Anderson asked Brixius about the sign will be 2 feet shorter, Brixius responded that it will be. Brixius commented that he has also spoken with MN Dot to ensure no issues. Motioned by Anderson, seconded by Halling, to open the Public Hearing. Ayes. Buhrmann, Anderson and Halling. Nays: None. Absent: Brempell, Klecker. MOTION DECLARED CARRIED. Mike Lawrance with Signcrafters Outdoor presented himself and informed commissioners that an engineer has looked over and approved these plans and that he would answer any questions they had. Buhrmann asked what his time frame is. Lawrance stated they are hoping for mid June, and it is about a six week build. Anderson asked if the entire sign would have to come down. Lawrance informed it would not, the pole structures will remain. Motioned by Anderson, seconded by Halling, to close the Public Hearing. Ayes: Buhrmann, Anderson and Halling. Nays: None. BACKGROUND: Stormy Cycle has submitted application for a conditional use permit to expand the outdoor storage area at their site at 5640 Mackenzie Avenue N. The site is zoned B-3 Highway Commercial District, which allow outdoor storage as a conditional use permit. In 2005, this site was occupied by Protech Marine and they received approval for an outdoor storage conditional use permit. As such the proposed use has been on the site in the past. The current application expands the outdoor storage area beyond past approvals. This request is part of the property owners to improve and clean up the site. See Exhibit A Applicant project narrative. Exhibit H Fence covering detail Exhibit I Light Fixture detail. 0 ANALYSIS: The site is zoned B-3 district which allows outdoor storage by conditional use permit. Commercial outdoor Storage is regulated by Section 1000. 15. B and must meet the following requirements. Setbacks: The outdoor storage area occupied is not within a required front or required side yard. Comment: The front the proposed site is along Mackenzie Avenue. The proposed Storage area is located in the side and rear yards of the lots. The B-3 zoning district requires a 20 foot side and rear yard setback. The site plan shows the graveled and pave surfaces to be 20 feet off of the side and rear lot lines with the fence being located 17 feet from the south and east lot lines and on the north lot line. The boundary line fence along the north lot line is intended to allow space for snow storage within the fenced area. In review of the site plan we recommend the following changes to address the setbacks. 1. The fence shall be placed at the 20 foot setback line along the south and east lot lines. This will take the fence out of the existing 20 foot drainage and utility easement. 2. The Boundary line fence along the north lot line is acceptable provided the outdoor storage remains 20 feet off the north lot line. This setback are shall be used exclusively for snow storage. The setback between the fence and storage area must have a ground cover different from the storage are to insure compliance. Fence: The storage area is totally fenced, fully screened and landscaped according to a plan approved by the zoning administrator, and a landscape guarantee, as determined by the zoning administrator, is provided. Comment: The applicant is proposing to surround the outdoor storage area with an 8 foot chain link fence covered with fabric. This type of fencing is being requested by the applicant for its height, durability, appearance and effective screening. In the event of fabric tears replacement panels are simpler than replacing wood panels. Staff review we find that the city has had issues with wood fences as illustrated in the photographs of the applicants site (See Exhibit G). Wood fences both on this site and other commercial sites in Albertville require on -going maintenance or they weather, deteriorate, break and fall over. Wood fences have not stood up well as screening for storage areas large boats, equipment or vehicles. Additionally, wood or other solid wall fences typical do not exceed 6 feet in height. 61 While moving away from the typical fence design, staff agrees with the durability, the fence height and screening aspects of the proposed fence. We recommend approval of the proposed fence with the changes to the landscape plan provide in the screening / landscape section of this report. Screening / Landscaping: If abutting a residential district or use, screening and landscaping is provided according to a plan approved by the zoning administrator. Comment: The Fence will provide a screen wall 8 feet high to screen the contents of the storage area. The applicant has provided a landscape plan that showing the placement of coniferous tree along the east and south fence lines. These trees will be planted at 35 foot intervals and will be 4 feet in height at time of installation. These trees are intended to break up the appearance of the fence. While initially the landscaping will have minor impact breaking up the length of the fence, however, the tree height meets code and the spacing between is recommended to allow for their growth. Surfacing: The storage area is grassed or surfaced with asphalt, concrete, or crushed rock (concrete or granite) to control dust. Should an area surfaced with anything other than hard surfacing prove to be unmaintainable, the city shall require that a hard surface be installed within three (3) months of formal written notice to the property owner. Comment: The site plan shows that the outdoor storage area shall be paved using recycled aggregate. The drive lanes within the storage area will be paved with 12 inches of aggregate and the vehicle storage pads will have 6 inches of aggregate. These hard surfaces meet the city code requirements. The City engineer will provide comments for site storm water drainage. The area between the north fence and the storage area is intended to be seeded with a MN DOT seed mix 35-241 which is a Mesic Prairie General suitable for the roadside and drainage ditch plantings. Lighting: All lighting shall be hooded and so directed that the light source shall not be visible from the public right of way or from neighboring residences and shall be in compliance with section 1000.10 of this chapter. Comment: The site plan illustrates the 4 wall mounted exterior light fixtures and one freestanding pole mounted light fixture at the east fence line. The applicant has provided a photo of a 90 degree cutoff fixture with a shielded light source. The lighting plan is acceptable with the following conditions. 1. All light fixtures must be installed with a 90 degree cutoff down lighting and may not be angled that may expose the light source. 2. The pole height of the freestanding light shall not exceed 30 feet. C. Parking: The storage area does not encroach upon required public or employee parking space(s), required loading space, or snow storage area as required by this ordinance. Comment: The site plan shows the provision of fifteen parking stalls. One disability stall has been provided to meet code. The stalls are dimensioned to be 9 ft. wide and 18 feet in length. The length must be expanded to 20 feet to meet code. The parking area will be curbed, paved and striped to meet the city design standards. Landscaping is provided along the parking stalls south of the building to screen headlights shining toward the interstate. The parking area is segregated from the outdoor storage meeting code. Grading and Drainage: A site plan documenting the location and grading of the storage operation shall be submitted and shall be subject to the approval of the city engineer. Comment: The applicant has provided a grading, drainage and erosion control plans. These plans shall be subject to the review and recommendations of the City Engineer. Type of Storage: The applicant has indicated that the outdoor storage area will be will be limited to the storage of boats, recreational vehicles, cars and trailers. Comment: As a condition of the conditional use permit the storage area will allow the previously mentioned items provided they are licensed and operable and will prohibit the following: 1. Semi -trucks and semi -trailers. 2. Junk vehicles 3. Debris, litter, junk or nuisances as defined in Title 5 Chapter 1 of the Albertville city code. 4. Hazardous waste materials. CONCLUSION: Outdoor storage is an allowed conditional use in the B-3 zoning district. Based on our review of the Stormy Cycle Conditional use application staff recommends approval of the application based on plans dated 10/17/19 and revised 8/31/20 with the following conditions. 1. All site improvements shall be in accordance with the approved plans dated 10/17/19 revised 8/31/20. 7 2. The fence shall be placed at the 20 foot setback line along the south and east lot lines. This will take the fence out of the existing 20 foot drainage and utility easement. 3. The Boundary line fence along the north lot line is acceptable provided the outdoor storage remains 20 feet off the north lot line. This setback area shall be used exclusively for snow storage. The setback between the fence and storage area will have a ground cover different from the storage are to insure compliance. 4. Site landscaping shall be installed per the approved landscape plan. The Property owner shall replace any of the trees or shrubs that may become diseased or die upon notification by the city. 5. All exterior lighting shall comply with Section 1000.10 of the Albertville zoning code. 6. All parking stalls shall be dimensioned having a 20 length. 7. The grading and drainage plans shall be subject to the review and recommendations of the City Engineer. Cc. This building and Its grounds are approximately 35 years old and are showing signs of age. It is our Intention to renovate the facility as it is looking rather poorly at this time. Additionally, in the years that. we have been here, we are constantly asked by our customers if they can store their boats or RV's here, Therefore, we want to include building an outdoor storage facility as part of the renovation, It is our plat► to grade and level the grounds, install new asphalt and curbs and sidewalks, install new exterior lighting on the building as well as the addition of parking lot lighting on a pole, Paint the Building and install new fencing around the entire facility with vision screening. The storage portion of the renovation will Include a keypad access powered gate at the front (south) of the building to access the storage yard, This gate will only operate between the hours of Gam to 10pm. We will also set up a 24 hour access code for low enforcement. Egress will be from the rear (north) of the building with a sensor operated powered gate. Lighting will be motion activated In the storage yard and shielded as to not flood the neighborhood or freeway. We Intend to keep the facility meat looking. Only RV's or boats will be allowed, no semi trucks or trailers will be permitted.
