COUNCIL MINUTES
MAY 5, [986
The regular meet1ng of the Albertv111e C1ty Counc11 was called to order
by Mayor J1m Walsh. Members present 1ncluded Gary Schwenzfe1er, Donatus
Vetsch, Don Corne11us and Bob Braun. Others present 1ncluded Maureen
Andrews, Don Bern1ng, Gary Meyer, Barry Johnson and Ken L1ndsay.
There was a mot10n to approve the m1nutes w1th the neccessary correct10n
made. The mot10n was made by Bob B. and seconded by Donatus V. All were
1n favor.
There was some d1scuss10n about who would represent the Park Board on
the Park Land Exchange. Maureen was asked to have a not1ce put 1n the
paper about needed an 1nterested c1t1zen to serve on the Comm1ttee.
The Aud1t B1ds were rev1ewed and based on Bob M1nkema's recommendat10n the
counc11 selected Gruys, Johnson to do the 1985 Aud1t Report. The mot10n
to approve was made by Gary S. and the second by Don C. All were 1n favor.
Maureen was asked to'contact the two f1rms and 1nform them of the Counc11
ch01ce.
The Counc11 d1scussed a letter from M1ke and He1d1 Potter regard1ng a dead
elm tree on the adJ01n1ng property. They have attempted to get the property
owner to remove the tree w1th no results and have requested that the C1ty
contact the owner (R1chard Norarack) to see 1f the problem can be resolved.
Donatus V. brought up the dead elm on Lander and 1nformed the Counc11 that
Duane Auger had expressed some 1nterest 1n remov1ng the tree for the wood.
Maureen was requested to send a letter to Mr. Auger 1nform1ng that the
C1ty 1S 1nterested 1n hav1ng h1m remove the tree. Th1s letter should 1nclude
a release from the C1ty for any damage or 1nJury that m1ght occur 1n remov1ng
the tree. Ken L1ndsay was also requested to look at the tree to determ1ne
wh1ch meathod would work best 1n remov1ng the tree. There was a mot10n made
by Donatus and seconded by Don C. to go ahead and allow Mr. Auger to remove
the tree on the cond1t10n that a release of the C1ty was s1gned. All were
1n favor.
Maureen 1nformed the Counc11 that she rec1eved a call from Mrs. Menzel regard1ng
the yard ma1ntenance (or lack of) of the aJ01n1ng property. Her request
of the C1ty was to contact the property owner--W1111am Sm1th and ask h1m
to make an effort to clean the yard up. Maureen was asked to wr1te Mr.
Sm1th and ask that he attempt to get the yard cleaned up. If the problem
1S not resolved the Counc11 w111 take 1t up at a later date.
Mr. Ray Carron was present to request that the assessment on h1s property be
deferred. These assessments have been on the property for several years
and accord1ng to Gary Meyer the State Statute only allows that assessments
can be deferred at the t1me of f1rst 1nstallment of t~assessment.

As a result of Gary Meyer's InformatIon there was a motIon made by Gary S.
and a second by Bob B. to deny the request of Mr. Carron to have the specIal
assessments deferred on hIS property located at the IntersectIon of 1-94
County Road 37 and Barthel IndustrIal DrIve. All were In favor.
Mr. Carron Informed the CouncIl that he belIeved that he IS aware of a
Instance were the assessments were deferred after the fIrst Installment.
He was Informed IS any addItIonal InformatIon was brought before the CouncIl
that they would reconsIder the Issue.
There was a motIon made by Bob B. and a second by Don C. to approve a
PaYIng Agreement wIth FIrst Trust St. Paul for the 1979 G.O. Imp. Bond.
All were In favor.
JIm Walsh brought up a mower that a couple a CouncIl members had looked at for
purchase. It was a Toro Groundsmaster and was beIng sold by MIke DeMars of
Elk RIver. The mower has a 6 foot cuttIng deck and seemed to be In good
runnIng condItIon. Mr. DeMars saId that he was wIllIng to sell the machIne
for $4,200.00 If the CouncIl was Interested In the machIne. Ken L. was
requested to have Mr. DeMars brIng the machIne In so that he and Don C.
could look over the equIpment and based on theIr recommendatIons purchase the
equIpment. There was a motIon made by Gary S. and a second by Donatus V.
All were In favor.
Ken gave the CouncIl an update on the schools he had attended thIs SprIng.
He talked about crack fIllIng proceedures that the schools recommend uSIng,
dIfferent types of materIals that sould be used and dIfferent types of
maIntenance schedules the CIty should consIder In order to get the best
lIfe out of the roads as possIble.
Ken also Informed the CouncIl of the fact that he had passed the Class C
Operator's LIcense exam whIle he was at the Stabllzatlon Pond School.
Ken was requested to start puttIng together a lISt of equIpment that he
could use for budgettlng purposes. In addlton Ken went thourgh the
streets that he felt were "trouble spots". These spots are to be revIewed
by a couple of dIfferent contractors to see how much It would cost to repaIr
them.
Other Items that were dIscussed was the number of hours that Ken IS gOIng to
be requIred for Start-up of the new wastewater system, hIS overtIme and
vacatIon. Ken requested that the CIty look Into gettIng a MEED person In
for the summer. ThIS Item has been tabled untIl Ken SItS down wIth the
CIty AdmInIstrator and Don Cornel~us to work on a lIst of Job dutIes that
are preformed In the MaIntenance Department. Once the lISt IS completed
It should be brought back to the CouncIl for dISCUSSIon.
Sewer lIne cleanIng was dIscussed agaIn. Ken has fIgured that the entIre
system can be cleaned for $4,500.00. ThIS fIgure does not Include Barthel
IndustrIal DrIve, Beaudry 2nd AddItIon or Barthel Resldentlal--Phase 2.
NothIng was fInalIzed on the sewer lIne cleanIng.
Don CornelIUS and Donatus Vetsch both dIscussed the need for haulIng In gravel
to a couple of areas In town. The CounCIl was Informed that H. Weber has
agreed to grade the road that we share WIth them If the CIty would agree
to have a load of gravel brought In. The CounCIl agreed to thIS arrangement.

Mr. Howard Larson of Radltlon Products was present to request that the
road lmprovements on 52nd Street be done thls summer as part of the constructlon
projects currently out for bld. Barry was requested to lnclude thlS
work In the plans and specs.
Mr. Larson also lnformed the Councll that hlS company lS looklng lnto gettlng
lnto Radloactlve Isotobes. He gave the Councll a llttle background lnformatlon
and wlll keep the Councll lnformed of the development of the posslblllty.
Gary Meyer and Barry Johnson dlscussed the recent developments wlth the
MPCA and Corp of Englneers NOVls. Paul Meyer lS redlrectlng pOlnts of the
letter Slnce the Clty lS lndeed reclevlng our payments for the two
agencles. Jlm expressed hlS concerns regardlng the warrenty from Poly-Amerlca
and has asked that there lS a letter on flle wlth the Clty clearlfy the
warrenty of the materlals and the upfront cost of any repalrs.
Englneerlng ltems that were dealt wlth lncluded extendlng the dralnage plpe
along slde the Potter home on 57th to correct a dralnage problem. ThlS
work wlll be done at the same tlme that constructlon occurs thlS summer.
KeVln Roden had requested that he be placed on the agenda but dld not appear.
He wanted to lnform the Councll that the curb In front of hlS home lS
slnklng and ask what can be done wlth It.

Other ltems that were dlscussed were addltlonal trouble spots (Lander belng
a large problem). Barry sald that we need to document the wet areas to that
they are noted for future reference durlng dry years.
Barry lnformed the Councll that the MPCA has approved the preflll of Cell
3. ThlS was a verbal approve WhlCh Barry followed up wlth a letter to
Bruce Weaver of MPCA. MPCA wlll be sendlng the Clty notlflcatlon of the
approval but told Barry that everythlng looked great.
There was also some dlScusslon by the Councll that a llght seal coatlng on
Barthel Industrall Drlve may be the "tlcket" to clean up the proJect.
No actlon was taken on the matter.
Maureen lS to lnform the BUlldlng Inspector that the Clty would llke to the
foundatlon helght approved for landscaplng and dralnage purposes.
There was a motlon by Bob B. and a second by Gary S. to set the hearlng
on the Shoreland Management Overlay for June 2, 1986 at 8:00 p.m. All were
In favor.
There was a motlon to approve the blll made by Bob B. and seconded by Don C.
All were In favor.

2. Need for Volenteers to work for the Clty
3. Need for Volenteers to serve as electlon Judges
4. Need for persons to serve on the Flre Department.
