JULY 7, 1986
The regular meetlng of the Albertvllle Clty Councll was called to
order by Mayor Jlm Walsh. Members present lncluded Gary Schwenzfeler,
Donatus Vetsch, Don Cornellus and Bob Braun. Others present lncluded
Maureen Andrews, Don Bernlng, Barru Johnson, Gary Meyer and Ken Llndsay.
There was a motlon to approve the mlnutes Of the June 9 and 12 speclal
meetlngs of the Clty Councll and the June 16th regular Councll Meetlng.
The motlon was made by Don Cornellus and seconded by Bob Braun. All were
In favor and the motlon carrled.

Mayor Walsh brought up the followlng subjects and requested that the
Councll thlnk about them so that at a later meetlng they could be dlscussed
In more detall. The ltems lnclude: Three and four Wheel Vehlcles, Enforce-
ment of Ordlnances and Pollce Protectlon. In addltlon Mayor Walsh asked
the Councll to thlnk of some ltems that the resldents of Albertvllle for
do WhlCh would save the Clty money In the long run. The dlScusslon
focused around thlngs llke belng careful 1 not to blow grass lnto the street
when mowlng, sweeplng the gravel back lnto a drlveway after a hard ran,
havlng the nelghborhood be responslble for cleanlng out around flre hydrants
durlng the wlnter.
The Councll dlscussed an Ordlnance pretalnlng to on-street parklng for
seml-tractor trallers, axel Ilmltatlons, permlted parklng and what the
Clty can do wlth these matters. There was some dlScusslon on what wordlng
would flX on out eXlstlng slgns and who would or could be exempt from a
new ordlnance (thlS dlScusslon regarded garbage trucks). No actlon was
taken and wlll be dlscussed future at the July 21, 1986 meetlng.

Maureen lnformed the Councll that the BUlldlng Inspector would not
be able to attend the meetlng, but Barry had checked the setback on the house
on Lannon and belelved that lt met the setback requlrement. ThlS was the
same lnformatlon Maureen had gotten from the BUlldlng Inspector as well.
The followlng Buildlng permlts were approved on the followlng motlon:

Motlon made by Donatus Vetsch and seconded by Gary Schwenzfeler. All

There was a motlon made by Gary Schwenzfeler and seconde by Don Cornelius
to have Ken Llndsay palnt the old storage bUlldlng out at the wastewater
treatment slte.

The Councll Wlll walt to approve addltlonal gravel for around the
old bUlldlng untll the wastewater treatment project 1S completed, per
Barry recommendatlon.

The Cownpll d~scussed the fact thst the wastewater treatment faclllty
was not completed on ltS scheduled completlon date and what optlons they
they could use to get the problem resolved. The followlng optlons were
proposed and the following motlon was made:
1. Wlthhold Payment Request No. 15 untal a eepresehtatlve of pel
meets wlth the Councll and explaln why the project has not been
completed and why there were not more people out worklng on the
before the completlon date of July 3, 1986.
2. The Councll could start assesslng llquldated damages as of July
3rd ln the amount of $540.00 a day.
3. Extend the 60mpletlmn Date to July 16, 1986 and lf the project lS
not completed sssess the llquldated damages as of Jully 3rd.

also explalned that he had not reduced the retalnage from 5 % to ~ S" %

The Councll declded that they would wlthho~d Payment REquest No. 15
untll the next Councll Meetlng and requested that someone from PCI be
present to dlSCUSS the proJect.

As a result of thlS dlScusslon the followlng motlon was made:
The C1ty Counc1l wlll allow PCI untll the 16th of July to comolete
the constructlon proJect wlthout assesslng llquldated damages, lf un
the 16th oflJuly the proJect lS not completed then the Clty wlll begln
assesslng the damages at $540.00 a day from July 3rd. Addltlonally,
Payment Request No. 15 wlll be wlthheld untll a representatIve of PCI
meets wlth the CouncIl and explaln the delays that have occurred on the
proJect. The motlon was made by Gary Schwenzfeler and seconded by Don
CornelIUS. All were 1n favor.
There was a motIon made by Gary Schwenzfeler and a second-by Don
Cornel1us to approve fInal payment to Buffalo Bltumlnous for the 1985-1
proJect. Barry has rec1eved the reaults of the core borIngs and wIll
be forwardIng cop~es to the CounCIl. He told the Councll that the test
came back and all passed.
Barry went through the feaslblllty studles for Barthel Manor/Maple
Hllls and Psyk's 4th Addltlon. . As part of thlS dlScuss10n Barny pOlnted
out that parts of the Barthel Manor/ MapleiH~llsl)pmaJects have been
completed on other proJects or are about to become so. The feaslbllity
Report estlmates the cost of these Improvements to be $66.000.00-(whlCh
lncludes SanItary Sewer, Watermaln, Storm Sewer, Street Impro~ements--
gravel only.)
Barry next went through the feaSIbIlIty Study for the Psyk 4th
Addltlon. Brry expla1ned that the cost fIgures Included In thIS study
flgures thel footage of lIne, lncludlng the Marx and POUllOt propertles,
but the number of lots used ln the calcuat10n does not. AgaIn the
Study lncludes Sanltary Sewer, Watermalns, Storm Sewer, and Gravel
Street Improvements at the cost of $213,800.00 not lncludlng the cost
the 360' of 18" R.CAP. WhlCh would be part of the master stromwater
runoff plan for thlS area. The cost of thlS llne lS estl,ated at
$8t800.00 should be assessed over the entlre area, not Just thlS proJect.
There was a motIon made by Gary Schwenzfeler and a second by Don
CornelIUS to accept the Feaslb1l1ty Study on Psyk's 4th Addltlon. All
were ln favor.
The next motlon was made by Don Cornellus and seconded by Gary Schwenzfe1er
to proceed wlth the plans for lmprovements pendlng the approval of the
flnal plat, abstract reV1BW and recordlng of the requlred easments. All
were 1n favor.
The thlrd mot1on was made by Gary Schwenzfeler and seconded by
Don Cornellus to accept the feaslblllty Study on Barthel Manor and
proceed wlth the plans for lmprovements. All were ln favor.

The fourth mot~on was made by Bob Braun and seconded by Gary
Schwenzfe~er to approve the feas~b~l~ty Study for Barthel Maple
H~lls and proceed w~th the ~mprovement plans. All were ~n favor.
There was a mot~on to set the Bond hear~ng for August 18, 1986 at
8:00 p.m. pend~ng Spr~ngsteads schedule. The mot~on was made by
Don Cornel~us and seconded by Donatus Vetsch. All were ~n favor.
Barry w~ll prepare the b1d for advert~sement and the b~d open1ng
was scheduled for Sugust 21st at 10:00 a.m. The Improvement hearlng
has been scheduled for August 28th st 8:00 p.m. on a mot~on made by
Donatus Vetsch and a second by Don Corne11us. All were 1n favor.
Gary Meyer updated the Counc1l on the outcome of the Annexat~on
Hear1ng. The Mun1c~pal Board's dec1s10n was a mot10n to deny petltlon
for annexat10n. Comments regardlng why they felt the annexat~on should
not take place ~ncluded that they d1d not feel that the delopment should
be next to a lake that lS know to be polluted from the D~sposal Plant;
they d1d not belleve that the Clty of Albertv~lle could handle the
addltlonal pollce and f1re protect~on; the C1ty was to ,far In debt to
be able to handle the addltlonal bondlng costs; and that the Clty had
presented a clear plcture on what types of lmprovements would be needed
In the future.

These reasonlngs were the basls for the prellmlnary flndlngs but the
flnal decls~on w~ll not come unt11 Mr. Merr~tt has completed a f1nd~ng
of fact based on the record of test~mony.
Gary expla~ned to the Counc~l what would be the next opt~ons for the
developer, that the rul~ng could be appealed to the Court of Appeals.
He also expla1ned that th1s 1S a costly expense and that Mr. Stalland
~s wa~t~ng to see the flnal rul~ng, but any add~tlonal ~nvlovement w1th
the annexat~on would have be dec1ded on by the Valer~us famlly and the
developer.
The Counc~l went through the ~nsurance l~st for the new wasterwater
treatment fac~l~ty and approved the recommendatlon of the Insuance
Agent and the C~ty Englneer, wlth the exceptlon of the pontoon wh~ch the
Counc11 ~ncrease the value to $13,000.00 (see llst In July 7th Councl1
packet for cost breakdown.
Barry was asked to check w1th Hord~s Brothers to see IS they would share
1n the cost for encloslng part of the dra1nage dltch that runs behlnd the1r
bu~ld1ng. Once he has meet w~th the company he w~ll get back to the
counc~l.
Barry also update the Counc~l on 1986-1 proJect. He told the Counc11
that the pre-construct~on meet~ng wlth Buffalo Bltum10us had been held and
that they should begIn the subsurvlce dra1nage work In about Ii weeks and
. that the b~tum~nous work w11l follw about 30 days later. ~~ ~~~

Gary Schwenzfe~er noted that a car located at 11~16 has been Jacked up
for several days and requested that Mauren check on the veh1cle WIth the
