The regular meetIng of the AlbertVIlle CIty CouncIl was called
to order by Mayor Walsh. Members present Included Gary Schwenzfeler,
Donatus Vetsch, Bob Braun, and Don CornelIus. Others present Included
Maureen Andrews, Barry Johnson, Gary Meyer and Don BernIng who came
late.
There was a motIon to approve the mInutes of the July 21, 1986
mInutes. The motIon was made by Donatus Vetsebcand~8econded by Gary
Schwenzfeler, All members were In favor.
Don CornelIUS asked Maureen If she could try to get the mInutes
of the meetIng done so that they can be Included In the packets before
the CouncIl meetIngs. No motIon was meeaed.

The follOWIng CounCIl members and staff WIll be attenalng the league's
RegIonal meetIng: JIm Walsh, Oonatus Vetsch, Don CornelIUS and Maureen
Andrews.
The follOWIng people were approved as ElectIOn( Judges: Barnadlne,
Roden, lOlS FarrIS, Mrs. Herb Scherber, Janet BernIng, Mrs. Harry Weber.
Gary Schwenzfeler saId that he would get some addltlonal names and would ~
get them to Maureen to be Included on the lIst. The Eiectlon Judges
were approved on a motlon made by Don Cornellus and seconded by Donatus
vetsch. All were In favor.

The Councl1 dIscussed garbage collectlon (prelImInary) and lt was
declded that Gary Schwenzfeler and Oonatus Vetsch would serve on a
garbage collectlon commlttee to see what type of Informatlon they could
come up wlth. Mr. Gary llndenfelser of llndenfelser's Garbage Servlce
was alos present to dISCUSS the matter.

The motlon to set up the commlttee was made by Bob Braun and seconded
by Don Cornellus. All were ln favor.
Mayot Walsh dlscussed wlth the Councll the meetlng that was held on
Monday July 28th wlth 2 representatlves of PCI, Thor, Barry, Maureen
and hlmself and the Clty'S walk through on the new system WhlCh was
conducted on Frlday, August 1st by Barry, Jlm, Maureen, Ken and a
representatlve of PCl.
Barry lnformed the Councll as of the Councll Meetlng the followlng
ltems have not been completea: Electrlcal lnpectlon by an Electrlcal
Englneer (there may be a punch IlSt that comes out of thlS lnpectlon),
flnal lnspectlon by the State 6lectrIcal lnpector., 11ft statlon control
panel, Ilmlted plumblng lnslde the bUlldlng, the Water Balance test
has not been approved by the MPCA, and some addltlonal clean-up ltems.

8srry was asked what the dollar flgure was left on the proJect.
He estlmated that the remalnlng amount was between $15,000.00 to $20,000.00.
He was also asked when he expected everythlng to be done, partlculary
the results of the Water Balance Test. He expects that we wl11 hear
back on the test later In the week (8-8) or early the next week, dependlng
on how lt takes PCA to flnlsh revlewlng the lnformatlon.
Barry also lnformed the Councll that the Change Order for the
safety equlpment and mower IS belng sent In. The amount of the
Change Order lS approxlmately $10,0001.00. And flnally that the MPCA
and Army Corp of Englneers Walk Through IS secheduled for Frlday
August 8th at 10:00 a.m. Barry was asked to request wrltten approval
of the proJct.
The Clty Councl1 ~€Xr dlscussed the road lmprovement In front
of the Hackenmueller's S~ore. Barry was requested to put tgether any
necessary lnformatlon and Marueen was asked to contact Vern regardlng
the lmprovements once Barry has glven her the new flgures.
The dlScusslon of C1Vll Defense came up as part of the agenda. The
Councl1 was lnformed that some tlme ago the Slren located on teh front
of the bUlldlng was removed resultlng ln no way of soundlng the C1Vll
defense Slren from Clty Hall. Maureen was requested to contact Greg
Bernlng and have hlm get ln touch wlth the necessary people to flnd
out what proceedures the Clty needs to take ln gettlng an actlve program
gOlng. One concern brought out by Bob Braun IS that when he was

the C1Vll Defense Dlrector he often tlmes dld not get warnlngs forwarded
to hlm. Greg should report back to the Councll at the September 2nd
meetlng. There was also aome dlScusslon that there may be a need to
do some communlty educatlng regardlng what C1Vll Defense and Storm Warnlngs
are all about.

Loren Kohen, the BUlldlng Inspector was present Just to get updated
on what lS happenlng ln the Clty. Some of the dlacusslon focused around
flnal gradea and proPAr dralnage. The Councll d1.scussed requu1ng that
a grade stake be requ1red to be located to show where flnal grade wlll
be to assure that the garage floor w1.11 not be below the flnal elevat10n
of the street. The BUlld1.ng Inspector has been requested to get some
add1tlonal 1nformatlon and forward lt on to Maureen and was also asked
to contact the Englneer from tlme to tlme regardlng any changes 1n street
plans.
Loren was asked about the house located at 5"(01 tD LAl<e:.. Street WhICh
appears to have the garage located below the top of the street and what
can be done. Loren told the Councll that he la aware of the problem
and that some yard gradlng may help wlth the problem, but the overall
repons1blllty lS that of the contractors.
The next ltem the Councll dlscussed was paYlng for 100 hours of
Ken Llndsays Comp T1me. There was a motlon made by Don Cornellus and
seconded by Gary Schwenzfeler to approve 100 hours of comp t1me at the
rate of $10.10 an hour.
The motlon waa then opened for dlSCUSS1.on. for the matter of
clearlflcatlon ss of August 4th Ken Llndsay has 221.25 of comp tlme
and the federal regulatlon allows for a person to carry 240 hours
before a C1ty lS requlred to buy back tlme. There was some dlSCUSSlon
about havlng Ken start taklng some frlday afternoons off to try to
cut down on some of the hours accuumulated, but no actlon was taken
on thlS ltem at thls tlme.

The dlSCUSSlon was closed and the motlon was put to a vote w1th
the followlng outcome: Gary Schwenzfeler - Yes; Bob Braun - Yes; Don
Cornellus - Yes; Donatus Vetsch - No; Mayor James Walsh - No.
There was a mot1.on posed by Donatus Vetsch to requlre Ken Llndsay
to get hlS overtlme hours down to 80 hours by January 1, 1986 and
make that the maXlmum number of hours allowed to be carr led at the end
of each month. There was no second and the motlon was wlthdrawn at
thlS tlme. The subJect wlll be dlscussed at a later meetlng once
Maureen Andrews has had an opportunlty to complete Ken's Job duty llSt.

There was a motlon made by Don Cornellus and seconded by Donatus
Vetsch to move the flrst meetlng ln September to Tuesday, September 2
because of the Labor Day hollday. All members were ln favor.
The Wastewater Treatment faclllty proJect was dlscussed agaln
Slnce the Clty Attorney and the Contractor were present. Items of
dlScusslon lncluded the contractor's request to have the reta1nage
reduced from 5% to 1%, based on the Eng1neer's reqommendatlon the
Councll acted not to make the reduct10n as requested.

As of August 4th the llquated Damages amount to $17,280.00 and
have not been d1scont1uned. They w1ll not be d1scont1nued unt1l after
the Water Balance Test has been approved and the C1ty Attorney and
C1ty Eng1neer recommend that we d1scont1nue the part1ce.
There was a mot1on to approve PCl pay requests 115 1n the amount
of $26,023.85 and pay request 116 1n the amount of $1,516.30, as
recommended by the C1ty Eng1neer. The mot10n was made by Gar~
Schwenzfe1er and seconded by Don Cornellus, all members were 1n favor.
(The pay requests lnclude the full 5~ retalnage and not the ~educed
retalnage asked for by PCl.
Mr. Ron Glbbons of PCl has been requested to be at the August
18th meetlng as well to d, 5( L/~~ flnal wrapup on the proJect. Maureen
sa1d that she would contact hlS as to the t1me he would need to be
present once she has looked at the schedule.
As a flnal p01nt of thlS dlScusslon Barry was asked to check
the Zlmmerman farm to be sure that the contractors have restore
the area they borrowed from accordlngly.

Representatlve of the people who Ilve on 51st Street were present
to dlSCUSS w1th the Councll thelr concerns about the speedlng that
1S occurr1ng on 51st Street. They explalned that there lS a problem
almost 24 hours but that lt lS the worst durlng the Shlft changes at
Hordls and Truss. All the resldents on the street have slgned a
pet1tlon request1ng that addlt10nal sher1ff patrol t1me 1S spent ln
the area and that the Clty look lnto putt1ng speed bumps ln to slow
the trafflc.
The C1ty Counc11 understands the1r concerns and agree there 1S a
pDoblem. A representatlve of the Sherlff's Department was here also
to hear the concerns and sald that the Department wlll make an effort
to lssue some tlckets ln the area.
There was some questlon about wether or not a Clty can located
speed bumps on a local street because of the 11abllty questlons that
mayarlse. Maureen waa asked to check w1th the Department of Safety
regard1ng speed bumps.
Maureen was also asked to put not1ces on bUlldlng permlts regardlng
NO TRUCKS on local streets that are posted and to aend not1ces to
Hordls Brothers and Truss requestlng lt to be posted on Bullltln Boards
asklng employees to be conSClence of the speed Ilmlt and the chlldern
who 11ve on 51st Street before someone gets hurt.
In add1tlon, Maureen was asked bo have Ken llndsay put up a
stop slgn on the corner of lannon at 51st Street WhlCh wlll hopefully
slow some of the trafflc down.

S~nce the Deputy was present the Counc~l asked h~m about three
and four wheel veh~cles and what can be done w~th them enforcementw1se?
He 1nformed the Council that the last one they caught ~n Albertv111e
had to walk the veh~cle home.
Maureen informed the Counc~l that Ken said that new check valves
would need to be put ~n the l~ft stat~on as the old ones are leak1ng.
Ba~ry was 8sked ta check the valves and 1f Ken and h~m determ1ne that
they need to be replaced Ken 1S to get two d~fferent pr1ces for Maureen
to reV1ew before order~ng the necessary parts.
Maureen 1nformed the Counc~l that the grad1ng ~n front of the
Hackenmueller's store has been completed.
The Counc~l dec1ded to have Syv11a K1l1an stay unt1l Ken gets back
from vacat10n at the end of August. The C1ty w111 be respons1ble for
her salary after August 15th.
Clem Marx, V~rg~l Poul~ot and Doug Psyk were present to d~scuss
the Psyk 4th Add~t~on and the requ1red easements needed for the proJect.
The follow1ng 1tems were d~scussed:

1. Mr. Marx ~s concerned about not be~ng assessed for the storm
sewer l~ne at th~s t~me because the propert1es do not benef1t
from ~ts locat~on unt11 after the overall storm water proJect
1S completed. IlL
2. He also feels that the property on wh1ch h1s house 1S located
on (the lot between Ma1n Avenue and the extens10n of Lander)
should excluded from be~ng assessed because 1t w111 not
benef1t from the 11ne at any t1me 1n the future. Barry 1S
look1ng 1nto that matter.
3. Mr. Pou110t 1S request~ng the follow1ng ~tems before he 1S
w1111ng to sign the easements for the street, the storm sewer
and the temporary construct10n easement.
a. That the assessments be deferred for f1ve (5) years or
unt1l such t~me that he develops h1s back lot, wh1ch
ever ~s less.
b. That the Counc~l prov1de some wr~tten assurances that
at the t1me he develops the back lot that he w1ll be
g1ven the requ~red var1ances needed to develop the lot.
c. That the C~ty pay for the land needed for the street
r1ght-of-way, or that he 1S g~ven on s~te f11l to make
the lot bUlldable 1n lue of a cash payment.

In an effort to clear1fy these requests the follow1ng 1tems w1l1
need to be rec~eved and rev1ewed by the Attorney and the C1ty Counc1l:
1. Pr1ce for the land needed for the easement (POUl1ot), 2. Amount
of f111 that would be needed to make PoUl10t's lot bU11dable (Barry),
3. Requ1red agreementa regard1ng the 1tems l~sted above. (Gary Meyer).

The next ~tem discussed by the Counc~l was the Junk Car problem
Maureen was requested to send another letter to those people who have
done anyth~ng w~th the~r cars and ~nform them that the Sher1ff's
Department w111 be not~f~ed and t~ckets w~ll be ~ssued 1f the veh1cles
are not removed by August 13. And lf by the August 18th Councll
meet~ng ~f the veh~cles st~ll rema~n a problem that the Counc~l wlll
be appo~ntlng offlc~al tow~ng company and the veh~cles w~ll be lm-
pounded. ThlS d~scuss~on resulted In a mot~on of tbe same made by Gary
Schwenzfeler and: 'a second by Don Cornel1us, w~th all member ~n favor.
Maureen was asked to check wlth M~nnegasco to see when they have
the gas l~nes scheduled to go ~nto the Beaudry 2nd Addlt10n. Barry
asked to have them contact h~m as well before any work 1S done.
There was llm1ted dlScusslon regard~ng gravel~ng the tops of the
d~kes out at the Wastewaster Treatment fac~llty from the llquldated
Damages. It was declded that the Councll would hold off unt1l the
nex Councll meet1ng before mak~ng any dec1s10ns. There was also some
d~scuss~on regard1ng the rent~ng of the extra land. There 1S the
poss~bllty of 100k1ng 1nto exchang~ng the use of the land for hav1ng
one of teh farmers mow~ng the outslde of the facll~ty. No act10n
was taken on th~s matter at th~s t~me.

Judy Roden asked that Maureen contact the Buildlng Inspector
regardlng the camper bUlldlng place (MAT Propertles) regardlng the
mess they were suppose to clean up as part of the bu~ld1ng perm~t.
To date the work has not been completed. Judy also asked about
the PPM problem of water runnlng 1nto the pond. Maureen has been
d~rected to speak w~th Gary Meyer regardlng th~s matter as well.
The Counc~l has set the Open House for the Wastewater Treatment
fac~l~ty for Thursday September 4. Maureen ~s suppose to get the
lnformatlon together' an~ send out the ~avltat~ons regard1ng the Open
House.
The Counc~l approved a l~m~ted llquor l~cense for the llon's for
the ~lg Roast on August 24th. The mot~on to approve the llcense was
made by Oonabus Vetsch and seoonded by Gary Schwenzfe1er. All were
~n favor.

seconded by Bob Braun. All the' I member s were ~n favor and checks
