ALBERTVILLE, MINNESOTA 55301 PHONE 497-3384 1-6-61 Mayor-elect Loretta Roden and Incumbents Gary Schwenzfe1er and Robert Braun were sworn 1n by Clerk Donald Bern1ng pr10r to the open1ng of the C1ty Counc11 meet1ng. Mayor Roden called the f1rst regular meet1ng of 1987 to order. Members present 1ncluded Gary Schwenzfe1er, Donatus Vetsch, Bob Braun and Don Cornel1us. Others present 1ncluded Maureen Andrews, Barry Johnson, Don Bern1ng, and GAry Meyer. There was a mot1on to approve the agenda made by Donatus Vetsch and seconded by fary Schwenzfeler. All were 1n favor. Then m1nutes of the December 15th Counc11 meet1ng were d1scussed next. After some d1scuss10n the follow1ng two changes were made: e Page 4, Paragraph 5--The amount of the settle~ent was reached by count1ng days of damage up unt11 the date that the MPSA-8~~.8Ye8-6Ae water balance test was subm1tted to the MPCA for approval on Auqust 14, 1986. All were 1n favor and the mot1on carr1ed. Mayor Roden made the 19B7 App01ntments (see attached 11st). There was some d16cuss10n regard1ng hav1ng two Off1c1al Newspapers, Maureen was asked to check w1th the League to see 1f 1t was pos1ble to have two papers des1gnated and 1S to br1ng the results back to the Councll at a later meet1ng. Mayor Roden held off appolntlng the BUlldlng Inspector and CIty EngIneer unt11 after the dlscusslon wlth same regardIng the cooperatlon between the two departments. Loren Kohnen of Metro West BUlldIng InspectIon was present to dlscuss the meetlng that had been held between h1mself and Thore Meyer of Meyer-Rohlln. Loren handed out to the Councll hls recommendatIon relatIng to the mInImum elevatlon of the garage floor, top block or walk out basement. Thls recommendatIon w1ll nBed to be passed onto the PlannIng Comm1sslon for theIr reV1ew and recommendatlon. . Gary Meyer lnd1cated that he thought there would be more procedures layed out on how the two departments would be worklng together. Wlth the conclwslon of thlS dlScusslon, Mayor Roden appolnted Loren Kohnen as Clty BUlldlng Inspector and Meyer- Rohlln as the Clty Englneer. There was a motlon made by Bob Braun and seconded by Don Cornellus to approve the 1987 Appo1ntments. All were 1n favor and the motlon carr1ed. The next ltem d1scussed was the C1ty of Albertvllle's vote for the NBA Basketball franch1se name. Don Cornel1us mad a motlon to select the "Mlnnesota hmberwolves" as the Clty'S cholce, but no second was offered and the motlon was wlthdrawn. Gary Schwenzfeler next made teh motlon to vote for "m1nnesota Polars" Wh1Ch was In turn seconded by Bob Braun. All were In favor and the motlon carrled. e There was a motlon to approve the payment of the bllls WhlCh totaled $184,144.13. The motlon was made by Don Cornellus and seconded by Don5l.tus Vetsch to approve checks 'ltr.'6\ through 'lib 1'=:, and check # ~~ . All were In favor and the bllls were pald. Mr. George Weber of Century 21 was present to dlSCUSS some problem lots out In Beaudry's 2nd Addltlon. The problem arlses from the fact that flll was added to a number of lots and the buyers were not lnformed of fact, maklng the effectedlot dlfflcult and expenslve to develop. Mr. Weber was present to see lf there was anythlng or any suggestlons from the Clty Councll on how to resolve the problem wlthout havlng the lssue taken to court. The records should note that Mr. Weber was not referrlng to the Clty belng taken to court but rather the seller of the lot and the flrm he represents. The dlScusslon focused on what the Clty of Albertvllle's lnvolvement was at the tlme of approvlng the plat and presently. It was pOlnted out even though the Clty approved the plans for the subdlvlslon ltS llablllty does not extend out beyond that pOlnt. There was some dlScusslon on whether or not the Plannlng Commlsslon should have some responslblllty of determlnlng lf lots are bUlldable at the tlme that a plat lS approved, but the fact that thls type of reponslbltlly opens the Clty up for llablllty problems. It was declded that lt was best to leave the proceedures for approvlng plats as they are so not to make the sltut10n more compl1cated. Mr. WEber told the Councll that though he was present to see lf the Councll had any suggestlon that he had not expected that there would be anythlng the Clty could have done about hlS problem; The next ltem dlscussed by the Clty Councll the League of Mlnnesota Clty'S request that the Clty of Albertvllle host the fall Reglonal meetlng for thlS area. Gary Schwenzfeler made a motlon WhlCh was seconded by Bob Braun to have Maureen proceed wlth flndlng out lf the Parlsh Center was avallable for use In September and get back wlth the League representatlves. All were In favor and the motlon carrled. . The Councll revlewed the flnal notlce on Albertvllle's mlll rate for 1987, WhlCh lS 36.262. The flnal flgure--36.262 was about 4 mllls lower than what had been projected due to the fact that the estlmated COUNCIL MINUTES PAGE 3 . was somewhat h1gher then proJected. No act10n was needed on th1s 1tem. The Counc11 was 1nformed that the League of M1nnesota C1t1es was holdwg a sem1nar on "Short-term Investments Pool" at the Sunwood Inn 1n St. Cloud. It was dec1ded that Maureen and Gary Schwenzfe1er would attend the meet1ng to see how the pool was be1ng set up and would report back to the Counc11 at a later meet1ng. Ms Ronay He1delberger was present to d~scuss the proceedure she needed to take to get the l~quor i~cense (on-sale) for the former He~delberg Inn 1nto her name for "Ronay's on Ma1n". Gary Meyer 1nformed the Counc11 that the app11cat~on would have to go th~ough the same proceedures 1t would ~f ~t was a new app11cat~on. Gary suggested that the Counc11 go on w1th other agenda 1tems wh11e he meet w1th Ronay 1n the Adm1n~strator's off1ce and reV1ew the appl~cat10n w1th her. The next 1tem d1scussed by the Counc11 was that of the need for add1- t~onal storage ~n C~ty Hall for the ~tems brought over from Don's. It was dec~ded that the ~tem would be tabled unt11 the next meet1ng. Ken L1ndsay requested that he be allowed to attend the COLLECTION SYSTEM OPERATORS SEMINAR hanuary 20-22 ~n Bloom~ngton 1f weather perm1ts. The mot~on was made by Donatus Vetsch and seconded by Don Corne11us to approve Ken's attendance of the sem1nar. All were 1n favor. e The Counc~l was 1nformed of the f~nal rul1ng on the Valer1us Annexat10n. The packet conta~ned the f~nal rul~ng and a memo from Maureen regard1ng the f1nal hear~ng. No act~on was needed on th1s 1ssue. There was a mot10n to approve the payment of Ken L1ndsay's overt~me for 138.5 hours at the rate of $10.10 per hour or $1,398.85 gross ($983.88 net pay). The mot~on was made by Don Corne11us and seconded by Gary Schwenzfe1er to approve the payment of overt1me. All were 1n favor and the mot~on carr~ed. Th~s was a follow up to the December 15, 1986 Counc11 meet1ng atwh1ch t1me the Counc11 dec1ded to pay Ken for h1s unused comp t1me at the end of 1986 and then l1m1t the number of hours of comp t1me to 24 hours. Barry rev1ewed w1th the Counc1l the pay request for PCI. The Counc11 was 1nformed that PCI had requested a $0.00 reta~nage and that 1t was Meyer-Roh11n's recommendat~on that the reta~nage rema1n at $2,500.00 for the f1nal clean up work 1n the spr1ng. In add1t10n, the Counc11 was 1nformed that as of January 5th the C1ty had not yet rec1eved a copy of the s1gned L1quadated Demages Agreement from the contractor. There was a mot10n to approve the pay request 1n the amount of $25,906.27 pend1ng the C~ty's rec1ev1ng the s1gned agreement. The mot10n was made by Don Cornel1us and seconded by Bob Braun. All were 1n favor and the mot1on was carr1ed. . Barry next went through the pay request for LaTour Construct~on. there was a mot10n to approve payment of $132,306.70 for LaTour Con- struct1on. The f~nal pay request that Barry d~scussed was for Buffalo B~tum~nous for the amount of $6,263.10. There was a mot~on to approve th~s pay request. Barry next ~nformed the Counc~l that he had rec~eved a verbal report on the water sample testlng done by PACE Lab. The test showed that the water look good except that there was a hlgh amount of maganese present wh~ch would account for the black water problems. It was po~nted out that w~th a h~gh content of maganese the water system should be flushed w~th a h~gher frequency hten a system wlthout the maganese. PACE Lab lS to belng sendlng out a wrltten report to the Clty of Albertvllle. Barry suggested that he have a legal desclptlon of the vacant land out at the wastewater treatment plant drawn up and brlng lt back to the next Councll meetlng so that the Clty can get the land rented out for the next growing season. Gary Meyer lnformed the Councll that he had not yet gotten ahold of the attorney for the JOlnt Powers regardlng the change in the agree- ment but sald that he would try agaln before the JOlnt Power's Board meebng. e There was a motlon to change the January 19th Counc1l meetlng to January 20th because of Martln Luther Keng's Blrthday (legal hollday). The mot1on was made by Don Cornel1us and seconded by Bob Braun. All were In favor and the mot1on was approved. Don Cornel1us 1nformed the Councll that he had meet wlth Ken L1ndsay at some length regardlng the grader and that hlm felt that 1t was 1n the best lnterest of the Clty to stay away from a used plece of equipment.
