1987-02-17 CC Minutes .. CITY OF ALBERTVILLE .~ . ALBERTVILLE, MINNESOTA 55301 PHONE 497-3384 2-1'-81 The regular meetlng of the Albertvl1le Clty Council waa called to order by Mayor loreeta Roden. Members present lncluded Gary Schwenzfeier, Oonatus Vetsch and Bpb Braun. Councl1 member Oon Cornellus was absent. Others present lncluded Msureen Andrews, Barry Johnson, Gary Meyer and Ken llndsay. There waa a motlon made to approve the agenda. The motlon was made by Bob Braun and seconded by Gary Schwenzfeier. All were in favor and the motlon carrled. There was motlon to approve the mlnutes of the February 2, 1987 meetlng. The motlon was made by Gary Schwenzfeler and seconded by Donatu8 Vetsch. All were In favor and the motlon passed. Gary Shcwenzfeler and Jim Walah updated the Councll on the meetlng of the JOlnt Powers Board. ltems dlscussed lncluded: 1. A request to have Meyer-Rohlln update the Clty map ahowlng all shut- offs, water maln locstlon and valves on one map whlch could be forwsrded to JOlnt Powers. . 2. A questlon waa ralsed regardlng Meyer-Rohlln havlng orglnal maps of the water system. ::- ). The next ltem dlscussed was the change belng requested by Hanover re- gardlng the posslble shortfall of operatlng dollars and how each of the four cltles/townah1p would be respons1ble for maklng up the posslble shortfall. Gary Schwenzfeler pOlnted out that the Hanover concern would not 11kely happen because of the 1ncrease In rates charged. He suggested that 1f lt la pooslble that the rate lncrease would not make up for any shortfalls then why was It approved. It was agreed on by the Council that the Hanover change goes agalnst the general prlnclpal of the org1nal operatlng agreement and therefore the Clty of Albertvllle can not vote for lts approval. The Albertvllle Couoc11 representatlves both feel that It 18 not 11kely that the Board wll1 be faced wlth a shortfall but feel that the Clty can not be w1111ng to take a chance on lt occurrlng. It was then pOlnted out that St. Mlchael could be addlng an addltlonal clause 1f the Hanover amendment lS approved by thelBoard. The addltlonal clause had somethlng to do wlth if a shortfall dld arlse and add1tlonal money would have to be klcked In that the two cltles supportlng the largest part of the contrlbutlon would be repald flrst out of future excess funds. . It was Gary Meyer's recommendatlon that the Albertv1lle representatlves be dlrected on how they vote the resolutlon. In additlon lt was questloned who authorlzed the payment for G. The mot10n was made by Bob Braun and seconded by Donatus Vetsch. All were 1n favor and the mot10n carr1ed. The 1ncome recleved and bllls to be pald where revlewed by the Councll. There was some dlScusslon regardlng the payment of the Cllnlc bond. Maureen was dlrected to send a letter to Mr. Steven Bresnehan regardlng the payment along wlth a copy to Dr, Davld Ehlenz. It was dec1ded that the payment of the Cllnlc bond would be held untll the C1ty rec1eved payment from Buffalo Memorlal Hospltal. There was a motlon to pay all b1lls, except the Cl1nlc bond untll payment was recleved. The motlon was made by Gary Schwenzfeler and seconded by Donatus Vetsch. All were ln favor and checks 7732 to 7754 were approved. Maureen asked for clearlf1catlon regardlng the Clln1c bond check and 1f lt could be pald lf the Clty rec1eved the money. The Councll sald that was flne as long as we had the money. . The C1ty had recleved 1nformatlon regard1ng the Statewlde Tornado Awareness week ln March. There was a motlon that the Clty take part ln the mock tornado drlll on Wednesday, March IBth. The motlon was made by Donatus Vetsch and seconded by Gary Schwenzfeler. All were In favor and the motlon carr1ed. The Councll's packets lncluded lnformatlon on several ~ /traln1ng seSSlons. Gary Schwenzfeler 1ndlcated 1nterest ln attendlng the sesslon on PubllC POI1CY 1n Emergency Management and the one on Local Government Forum. Donatus thought that he m1ght be able to attend the seeSlon on Local Govenment lf he was able to get off work. Bob Braun sald that he would take the 1nformatlon to the Flre Department relatlng to Anhydrous Ammonla Workshop to see lf there was any 1nterest ln attendlng. No formal actlon was taken on any of the conferences at thIS t1me. THe Counc1l was lnformed that there were three people who had lndlcated lnterest ln servlng on the Plannlng Commlsslon at thls tlme. After some dlScusslon lt was dec1ded that Maureen should prepare an appllcatlon of sorts ask1ng why the person 1S lnterest lng servlng on the Plannlng comm1SS10n and what type of background dld have that would relate to the board. In addlt10n, the letter was to lnvlte them to meet wlth the Councll to dlSCUSS what all lS lnvolved 1n serv1ng on the Plann1ng Commlsslon. There were several quest10ns pOlsed to Gary Meyer regard1ng llquor llcenses. Flrst of all lt was dec1ded that Blll Hledelberger needed to slgn the transfer of the llcense from H1edelberg Inn to Ronay's on Maln. It was pOlnted out that Blll had not pald the second half of the 19B6-87 11qour l1cense. . It was suggested that the approval of the trsnsfer should be delayed untll some of the questlons were cleared up and the payment for llcenses was made. If thlngs were not cleared up by the March 2nd meetlng the Councll ~UUN~!L M!NUI~~ PAGE 3 ~. felt that they would have to look at suspendlng the llcense for Ronay's on Ma~n. Mr. Marvln Vetsch was present to dlSCUSS w~th the Councll the bUYlng of the Albertvllle Bar. There had been some dlScusslon relatlng to hlS clos~ng date WhlCh was orglnally set for after the 15th of Aprll at whlch tlme of llcenses have to be approved, lnstead the closlng date has been moved up t~ slmpllfy the llcense transfers. There were some questIon regardIng the transfet of the lIcenses maded out to the AlbertvIlle Bar as of January 1, 1987. Gary Meyer told the Councll that he dld not feel that there was any problem wlth transferlng them to the new owner. The only other questlon pOl sed was that regardlng the Jaycees' lease for selllng pull tabs. Marvln was lnformed that he should get back to the Councl1 once he has worked someth~ng out wlth the1organlzatlon. Ken ~lndsay was present to lnform the Counc~l that the sewer l~ne l CleaMlng of the Barthel Industrlal Park l~ne had been completed and that a lot of gravel had been ln the 11ne. He also let the Councll know that the 11ft statlon had been cleaned as well. . There was then a dlScusslon regard~ng the steerlng ln the snow plow veh~c1e. Ken and Gary Schwenzfe~er had looked ~nto havIng the steer~ng replaced our rebu~lt. If the Councl1 went wIth replac~ng the equ~pment ~t would run about $1,500.00 and lf lt was rebul1t It would run about $880.00. It was decIded that steerlng should be rebullt at thlS t~me. The Counc~l's packets 1ncluded ~nformatlon relatlng to membershlp to MN Rural Water Assoclat10n. It was agreed that the C1ty not become a member, but that Gary should take the 1nformatlon to the next JOlnt Powers meet~ng. Barry Johnson revlewed wlth the Counc~l h1S concerns regardlng a weIght restrlctlon ord1nance. Some of the ltems he pOlnted out where problems wlth enforcement, that new construct10n ~s a baslc lndustry 1n Ab1ertv1lle, but that the largest degree of demage 1S done by overw1eght vehlcles on local streets. It was suggested that a better proposal could be establ1sh~ng a truck route for the vechlles to use. The Counc11 was also 1nformed that the County bel1eves that the Clty slgns statlng no trucks 1S not clear enough and does def~ne what truck ~s. It was suggested that we check w~th the Councty to see what they would feel comfortable enforc1ng (Co. Attorney's offlce). Barry futher p01nted out that the streets he 1S the most concerned about are the new streets w1th only one 11ft of black top. He want to protect these streets as much as poss1ble so that Buffalo B1tum1nous can come back to the Counc1l and say that any demage to the backtop was done by local contractor therefore not mak1ng them responsIble for any repa1rs. . It was then dec1ded that at the tlme that a bUlldlng permlt was lssued the Clty would attach a map 1ndlcat1ng Wh1Ch route should be followed 1n maklng dellver1es. The other 1ssues brought up under eng1neer1ng 1ncluded puut1ng gravel 1n by Cathy Carron's on the corner of Lander and 55th Street. Barry told the Counc1l that he had asked LaTour to get some Class 5 1n to where they had to d1g up to make the sewer connect10n. There was some d1scuss10n regarding Doup Psyk's request to put gravel 1n up to the new house h1s 1S bU1ld1ng on the south end of Lander. Barry rem1nded the Counc1l that he had had LaTour use the extra gravel last fall 1n the same area and that 1f addltlonal gravel 1S brought 1n 1t wlll be wasted because 1t wlll not be able to be reused once the subgrad1ng 1S done. Barry also expla1ned to the Counc1l that 1f the Counc1l d1d dec1de that the gravel should go 1t 1t would have to come out of the general fund because there are not enough funds left for the extra gravel. It was declded that the Clty would not put the gravel 1n at th1s tlme, Barry agreed that he would talk to Doug about the reasons why. Gary Shcwenzfeler brought up the problem there has been gett1ng Doug to follow the sewer dlg-in ordlnance. It was agreed by the Councll that lf another v10lat1on occurs the f1ne wlll be 1mposed. In another pOlnt related to sewer dlg-lns but not d1rectly related to Doug Psyk, Ken suggested that the Councll conslder 1ncreas1ng the charge for sewer lnspectlons. No act10n was taken at th1S tlme. The Counc1l revlewed the zonlng app1l1catlon for a day Care llcense for D1anne Youngdahl. There were not problems wlth the zon1ng so no act10n was taken. The Counc1l was lnformed that Jones Intercable was glvlng them an opportuntlY to meet wlth them and d1scuss the transfer of the cable system. There was a motlon made by Gary Schwenzfeler and a second by Bob Braun to have a representat1ve of Jones Intercable at the next meet1ng so that the Councll could dec1de If they would llke to have a publlC hearlng on the transfer. The followlng bUlld1ng permtIs were approved: Permlt II for Leonard Tallman for a new home at 5555 Lake Ave.-- The motlon was made by Donatus Vetsch and seconded by Gary Schwenzfe1er. All were ln favor and the motlon carrled pendlng payment of perm1t. Perm1t 12 for M1ke Van DeBerg for an add1t10n at 11387 54th Street-- The mot10n was made by Bob Braun and seconded by Oonatus V~hto approve the bU1ld1ng perm1t pend1ng payment. All were 1n fayor. Perm1t 13 for Barthel Construct10n for a new home OD 5155 Lannon Ave-- The mot1n was made by Gary Schwenzfe1er and seconded by Donatus Vetsch to approve the bU1ld1ng permIt pend1ng payment. There was more dlSCusslon regardlng the PPM water dlscharge. Maureen IS to arrange that Dav1d Smlth and a water tower expert be at one of the upcomlng meetlngs. It was explalned to the Councll that Gary Schwenzfeler had talked to Mr. Smlth about the problem and felt that dId not need to be at the meetlng.
