1987-04-20 CC Minutes ~ .____.1 .' COUNCIL MINUTES APRIL 20, 1987 The regular meet~ng of the Albertv~lle C~ty Counc~l was called to order by Mayor Loretta Roden. Members present included Counc~l memebers Gary Schwenzfe~er, Oonatus Vetsch, Oon Cornel~us and Bob Braun. Others present ~ncluded Maureen Andrews and Gary Meyer. There was Bome l~m~ted d~BcuBBion regard~ng the PPM Agenda ~tem. MBureen was ~nformed that Gary Schwenzfe~er had been contacted by PPM and had had a request to meet w~th a representat~ve of the f~rm outs~de a regular Counc~l meet~ng. Maureen was not awsre of th~s d~scuss~on at the t1me of schedul~ng Mr. Dav~d Sm~th ~n at Donatus Vetsch's request. After rev~ew~ng the agenda there was a mot~on made by Don Cornel~us and seconded by Gary Schwenzfe~er to approve the agenda w~th the amendment of str~k~ng the PPM water problem 1tem. All were 1n favor and the agenda was approved. There was a mot10n made to approve the m1nutes of the Apr~l 4" 1987 Couoc11 Meet1ng. The motion waa made by Don Cornel1us and seconded by Bob Braun. All were ~n favor and the mot10n was carr1ed. . Gary Schwenzfe1er updated the Counc11 on the J01nt Power's well proJect. They are gOlng ahead w1th the dlgg~ng of the wwll and and sucur1ng the f1nanc1ng for the proJect. In addit10n, Gary Shcwenzfeler and Maxlne Ladda are 100k1ng 1nto the bU1ldlng addlt10n for the off1ce. Gary lS 100k1ng at what type of sewer/spect1c system would be acceptable w1thln the prox1mlty of the wells. Maureen also 1nformed the Counc1l that the Board of Health haa revlewed the plans and have found acceptable. . There was a mot10n to pay the bllls. The motlon was made by Oonatus Vetsch and seconded b y Gary Schwenzfeler. All were 1n favor and check a ~ 8"" through '18'10 were pald. All were 1n favor and the mot1on carr1ed. A resolution procla1m1ng Mayas Sen10r C1tlzen Month was read by Maureen. A mot1on was made by Bob Braun and seconded by Donatus Vetsch to aff1rm the State of Mlnnesota's proclaimat1on of SenIor Cltl~en Month. All were 1n favor and the mot1on carr1ed. There was a mot1on made by Donatus Vetsch and seconded by Gary Schwenzfe1er to spend between $200.00 to $250.00 for a heavy duty bush and weed cutter (e1ther a Johnsrude or Steel brand). All were 1n favor snd the mot1on carr1ed. Gary Schwenzfe1er quest10ned Gary Meyer on the possib1l1ty of sell1ng part of the park land so that the C1ty would not have to p1ck up the assessments for the street 1mprovements. Maureen 1nformed the Counc1l of the League of M1nnesota's f1nd1ng regard1ng the sale of land dedlcated to the C1ty. It 1S the1r belief that when the land 1S ded1cated that the property lS put 1nto a trust and not owned r1ght out therefore not allow1ng a c1ty to aell or exchange It. Gary Meyer sald that he would look 1nto the League's flnd1ngs as well to see what the C1ty'S optlons are. It was also p01nted out that the Park Board is in the process of trying to secure a lAWCON Grant for the park located on the corner of 51st S~reet and Barthel Industr1al Dr1ve. There was also some d1Scuss1on on what opt1ons the C1ty m1ght have lA rais1ng funds for Park DeveloPment. There was some d1Scuss1on about requ1r1ng park land ded~cat10n or 1nstead of land conveyance a cash settlement could be pa1d to the City at the C1ty'S request. Th1S opt1on would allow the C1ty to use the money to develop eX1st1ng parks and prov~de for a cash reserve for future land acqu1sitIon. It was agreed that Maureen should look 1nto poss1ble ordlances to develop one for the CIty of Ablertvllle. There was a motIon made to aet a spec1al publ1C hear1ng to Increase sewer hook-ups and sewer inspect10n fees for the C1ty of Albertv1lle. Maureen was aaked to check w1th Llnda to see lf there had been others. Maureen 1nformed the Councl1 that she knew that JOlnt Powers was to be flush1ng and that LaTour had done some testlng of the 11nes two pooslble causes for the rusty water cond1tlon. It was dlscussed to see 1f Llnda would be wllllng to do the sewer bl111ngs for the Clty Albertvllle. Loretta was to look lnto the posslblllty. Maureen was asked to brlng to Chuck Eberhard's attent10n the problem of LaTour's leavlng thelr equ1pment out on Lander Avenue and that the work was not properly barrlcaded. Members of the Albertv111e area Jaycees were present to request a 11m1ted beer llcense for the softball season. The 11cense would cover the : nlghts fo Tuesday, Wednesday, and Thursday dur1ng the per10d of May I, 1987 thorugh August 31, 1987. and the softball tournament June 19, 20, and 21, 1987. There wss some delcuss10n regardlng the ~lcense and some lssues brought up by the League of MN R1Sk Management people. It was their suggestlon that the followlng occur before a 11cense lS granted: . 1. That the Clty of Albertv1lle be named as an addltlonal 1nsured; 2. Ths~ the Cert1flcate of Insurance be In the amount of $500,000.00; and 3. That the C1ty Attorney prepare an lndemnlflcatlon and holdharmless agreement to be algned by the Albertvl1le Clty Councl1 and Jaycees,.protect1ng the Clty from potent1al lawsults. There was a mot10n made by Donatus Vetsch and seconded by Bob Braun to approve a 11m1ted beer 11cense for the Albertvllle Area Jaycees, pend1ng the st1pulatlons llsted above are met and that the fee of $75.00 be pa1d to the City of Albertvllle. All were In favor and the mohon carned. The next ltem dlscuased by the Jaycees was the1r 1nterest In purchaslng ehrlstmas Llghts for the C1ty of Albertv111e wlth some of the proceeds of the Chsr1table gambling revenue. They wanted to know 1t the Clty was lnterested In replaclng eXlst1ng llghts and what they would be d01ng wlth the old ones. It was agreed by the Councl1 that lf the old 11ghts could be sold that the C1ty would put that money lnto the "k1tty" for the new 11ghts. The Jaycees asked that s commlttee be made up w1th representat1ves of the Counc11 and the Jaycees to look 1nto the 11ghts. Members Gary Schwenzfeler and Donatus Vetsch sald that they would be w1lI1ng to meet w1th the Jaycees on the Chr1stmas Llghts proJect. . The flnal Jaycees related lssue had to do wlth the agreement between the Albertv111e Bar and the Jaycees for the rental of the space for the pull tab. The Jaycees were 1nformed that they needed to get a new agreement slgned Slnce the bar had been recently sold to a new owner. PAGE 4 COUNCIL MINUTES .. . Jerry Holland of the Albertvllle Llons was present to dlSCUSS the City Slgn. It lS the feellng of the Llons that one organ1zatlon should be responslble for tak1ng care of the slgn and that lt should be the C1ty, because of liablity and convenlence. The Llons also feel that they do alot for the C1ty and feel that the Clty should be dOlng somethlng in return. They c1ted the fact that they 1nstalled the slgn wlth the understand1ng that the C1ty would take lt over and malntaln It. In add1tlon they feel that the bU1ldlng down at the park 1S not belng ma1nta1ned as well as 1t should, that 1t doea not have proper securlty llghtlng and that the door to the batheroom Wh1Ch was kicked In has not beem repa1red. The last 1tem 1S the ma1ntenance around the "Welcome" slgn st each of the entrances lnto the Clty. They feel that these areas are not properly mowed and trlmed and that it presents a bad 1mage for the C1ty. The L10ns wanted the Counc11 to know that they are w1111ng to donate to the Clty as long as the Clty follows through and keeps th1ngs up. There was other d1Scussion by members of the aud1encel, but lt was f1nally agreed that lt lS 1mportant that the C1ty work wlth the d1fferent organ1zatlons so tbat the communlty 1S work1ng together and not aga1nst one another. . The next 1tem that was d1scussed was a request to have a Sergeant from the Wr1ght County Sherlff's Department at the next Counc11 to d1Scusslon some general law enforcement ltems. Maureen agreed to call and schedule someone In for the meetlng. The Counc11 was lnformed that the Park Board was plannlng on putt lAg up a gazebo In the Clty Park uSlng the money that was donated by the Amer1can Leglon In St. Mlchael. The Board was lnformed that they would need to get a bUlldlgn permlt for the stucture. Maureen sald she would pass that on to the Park Chalr--Mlke Potter. The Councll was updated on the Local Government Ald status In the tax blll. It was recommended that each of the Councll contact the local representatlves regarding the matter. The bUlldlng Inspector was requested to go out and lnspect the slte out at ANdy's Manufactur1ng and prepare a wrltten report on the problems that seem to eXlst on the slte.
