1987-07-20 CC Minutes ~< . . . . ' COUNCIL MINUTES JUlY 20, 1987 The regular meet1ng of the Albertv111e C1ty Counc11 was called to order by Mayor Loretta Roden. Members present 1ncluded Gary Schwenzfe1er, Donatus Vetsch, Don Cornel1us, and Bob Braun. Others present 1ncluded Maureen Andrews, Bob M111er, Chuck Eberhard, and Ken L1ndsay. There was a mot1on to approve the agenda. The mot1on was made by Don Cornel1us I and seconded by Gary Schwenzfe1er. All were 1n favor and the mot1on carr1ed. There was a mot1on to accept the m1nutes of the July 6, 1987 Counc11 meet1ng. The mot1on was made by Bob Braun and seconded by Don Cornel1us. All were 1n favor and the mot1on carrIed. Chuck rev1ewed wIth the CouncIl the plans and spec1f1cat1ons for Barthel Manor - 2nd Addlt1on. (A ~opy of the plans and spec1f1cat1ons are ava1lable 1n the Adm1n1strators off1ce). The Counc11 was 1nformed that a fInal easement would be drawn up for the sewerl1ne that wIll extend across property located 1n frankfort TownshIp, the b1ds are opened. Other 1tems dIscussed were that the plans and spec1f1cat1ons called for rodk to be used 1f unstable ground 1S found when mak1ng the cuts, that the eng1neers had tr1ed to el1m1nate all deep cuts 1n the subdlv1s1on, and add1t1onal sewer and water serVIce for the 51st Street Park. In add1t1on Ken asked Chuck to look 1nto prov1d1ng some type of screen for the 11ft stat1on. Chuck Ind1cated that hel d1d not bel1eve that the screen 1dea could be assessed as part of the Barthel Manor - 2nd Add1t1on because 1t benef1ts the entIre area. There appeared to be no other dIScussIon regardIng the plans and speclflcat1ons. A mot1on was called for to approve the plans and spec1f1cat1ons and set a b1d open1ng date for August 25, 1987 at 11:00 a.m. at C1ty Hall. A mot1on to approve Resolut10n No. 1987+~ent1tled RESOLUTION APPROVING PLANS AND SPECIfICATIONS AND ORDERING ADVERTISEMENT fOR BIDS fOR BARTHEL MANOR 2ND ADDITION (1987-1 Improvement) was made by Don Cornel1us and seconded by Bob Braun. All were 1n favor and the mot10n carr1ed. The v1deo tape of the Ma1n Avenue sewer 11ne and the water p~pe cas1ng was d1scussed. (V1deo tape 1S ava1lable at C1ty Hall for rev1ew.). Chuck 1nformed the Counc11 that Ken and he had not had an opportun1ty to reV1ew the tape together so they would not be mak1ng any recommendatIons regardIng what should be done at thIS pOInt. The CouncIl was 1nformed however that 1t appears that the water cas1ng 1S all 1n tact, w1th Just a couple m1nor offsets, but that the lIne w1ll need to be cleaned before a water p1pe IS Installed. One of the Counc1l members asked what m1ght have been the problem when the contractor or1glnally tr1ed gett1ng the Ilne through the cas1ng p1pe. T , ' . . . . COUNCIL MINUTES PAGE 2 Chuck sald that the contractor may have hooked one of the offsets and that someone Just assumed the cas1ng was damaged. There was also d1Scuss10n regard1ng the sewerl1ne that was vldeotaped. Some of the problems that showed up 1ncluded off-set p1pe, broken t1les, low p1pes, sta1ned J01nts, leaking JOInts, and dlpS. A couple maJor problems are descrlbed below: At approxlmately 278 feet from the manhole on 58th Street the camera got stuck on a rock and they could not get lt past to the next manhole so a reverse setup was requlred. Between the manhole on 59th Street and 60th the sewerllne was very dlrty and the camera was pushlng a large plle of dirt. At approxlmately 47 feet from the manhole the camera became lodged on d1rt and had to be backed out. No reverse set up was done at Clty'S request. Ken Informed the Councll that he had already notified Roto-Rooter and that they would be out to reclean the sewer lines Just dlscussed. Ken sald that he would be out wlth Roto-Rooter when they reclean the Ilne. Other ltems dlscussed lncluded the posslblllty of lnstalllng an lnterceptor at the south end of town to help el1mlnate problems ln the system and how grease bUllds up on the sldes and top of the sewerllne. There was general agreement that the grease bUlldup 1n the sewerllne IS a serlOUS problem. There was addltlonal dlScusslon regardlng the televlslng of the dlfferent locatlons, but no new actlon was taken on the lssue. Chuck next revlewed wlth the Councll the letter he had recleved from Hudlund Englneerlng regardlng the Dalelden property at 5616 lake Avenue. The Council was Informed that Hudlund had requested that the Clty reconslder the use of a French Draln WhlCh they feel IS the best Solutlon to the dralnage problem on sald lot. Accordlng to Chuck, a permeablllty rate for the SOlI was not provlded for the Dalelden lot, but vlsual Inspectlon Indlcates that the SOlIs are very permeable, therefore the french Drain Will not llkely cause problems to the Clty street. However, lt lS stlll the oplnlon of Meyer-Rohlln that the property owners wlll have contlnous dralnage problems wlth the French Draln. A question was asked regardlng what would be the City'S legal exposure lf the City recommends the exceptance of the proposal. The Clty Attorney said that there could be some legal exposure at a later date. There was some addltlonal dlSCUSS10n regardlng the Hudlund proposal but In the end lt was agreed that It was not a vlable Solution to the problem from the Clty'S vlewpolnt. Chuck then gave the Councll a Constructlon update on Barthel's ReSidential - Phase II and Beaudry's Second Addltlon. Chuck told the Councll that all the seedlng had been completed and that the C1ty IS on the top of the llst for sod when It becomes avallable. Chuck told the Council that there was one property where the owner had seeded and the Contractor had removed It. Chuck Informed the property owner that It had been an error and that 1t would be replaced wlth sod and would recommend payment for seed 1f they would present the Clty wlth the blll. . . . . . t ~COUNCIL MINUTES PAGE 3 Chuck further expla1ned that they had had a hard t1me determ1n1ng what was seeded, what was sodded at the t1me construct10n started last year, and what was weeds. The d1Scuss1on regard1ng the1restorat1on was opened up to some quest10ns from the floor. Mr. M1chae1 Veron1kas wanted to know why we were not gett1ng sod. Chuck exp1a1ned that the sod company has not been able to cut and roll the sod because 1t 1S too dry. Mr. Steve Kl1tzka who was also present from Barthel's Add1t1on ssked 1f 1t would be poss1b1e to get a copy of the IlSt of what was be1ng done 1n their area so that 1f any of h1S ne1ghbors had any quest10ns regard1ng the work that he would be able to answer them for the C1ty. Mr. Veron1kas stated that people who had put 1n thelr own sod or seed should be compensated for the1r work. No act10n was taken on th1s matter. Agaln Chuck assured everyone present that every effort was be1ng made so not tOI extend the sodd1ng out unnecessary. Another 1tem d1scussed was a compla1nt by M1ke Coffey who llves at 5170 Lannon Avenue regard1ng h1S dr1veway. Mlke sa1d that he felt h1S dr1veway had been cut 1nto further than the 11 i feet of easement and had then not been properly restored. Chuck sa1d that he would look 1nto the problem. It was agreed that the rock should have been salvaged and restored properly. Chuck asked Maureen to make a Ilst of lots that would need to be rechecked regard~ng sod or 1n the case of the Coffey res1dent the dr1veway. Mr. Vaughn Fesenma1er of Tela-Ad was present 1n an effort to clear up the quest10n regard1ng the sewer connect10n for h1S bU1ldlng located d1rectly beh1nd the Tela-Ad BU1ld1ng. The Counc1l was brought up to date on the problem that had arose when 1t was determ1ned that sewer and water had been connected 1n the storage bU1ld1ng (11517 59th Street) through the Tela-Ad bU1ld1ng w1thout J01nt Power's or the C1ty ever be1ng aware of 1t. Mr Fesenma1er told the Counc11 that he was not aware of the regulatlons regard1ng the hook up at the t1me he made the connect1ons In 1984 and had only Just became aware of the problem when he took out a perm1t for remodel1ng the second level of 11517 59th Street. The records should note that Mr. Fesenma1er had met w1th J01nt Powers Board and was be1ng requ1red to put 1n a new water connect1on. In dlscuss1ng what the Clty should requlre, 1t was dec1ded that w1th the seperate water meter readlng for the bU1ld1ng under d1Scuss1on the C1ty could determlne actual sewer use and unl1ke water connect1on 1t 1S less 11kely that sewerl1nes could be cut off lf the 2 bU1ld1ngs were ever sold as seperate unlts. The Counc11 d1d state that they felt that the property owner should be requlred to pay the sewer connect1on fee even though the connectlon 1S not be1ng changed. W1th no other d1Scuss1on regard1ng the matter a mot1on was made to approve perm1t 139 for $799.40. The mot1on was made by Bob Braun and seconded by Don Cornel1us. All were 1n favor and the bU1ld1ng perm1t was approved pend1ng payment. Gary Schwenzfe1er next updated the Counc1l on the July meet1ng of the J01nt Powers. The f1rst 1tem d1scussed was the resolut1on that would allow the J01nt Powers to f1ne for 111egal use Rf water by contractors. Bob M~ller's react~on to the proposal of the f~ne ~s that he 1S not sure that the J01nt Powers does not have pol~ce power to regulate the flne. If the J01nt Powers does not have the pollce power and author1ty, lt wlll not be able to enforce a flne. In addltlon to the dlScusslon of flne for lllegal water use, there was also some dlScusslon regard~ng not a110w~ng the 111egal user use of the system aga1n. Bob caut10ned the use of th~s 1dea because he feels that the Board may not be able to put th~s type of restr1ct10n lnto effect for perpetulty. Bob Braun asked ~f there had ever been any dlScusslon about each Clty or at least the southern end of the system hav~ng a hydrant wlth the backflow preventor. Other ltems dlscussed lncluded that some of the plpes between the well and the pump house were leak~ng. The contr ctors are correctlng the problem and may be maklng some changes so there may be added costs lnvolved. In addltlon, there have been some complalnts a out low water pressure ln Barthel's addltlon. Someone mentloned ~t could be a acuum problem, the level ln the water tower may be low or that there ma be some valves shut off. There have also been some complalnts about rown water as well. Maureen was asked to contact JOlnt Powers so that t ey can check on' the problems. Mr. Steve Klltzka of Barthel Manor was pres nt to dlSCUSS several lSSUPS that concern the nelghbors of the Barthel A dltlon. The resldents ofthlS area had met at the home of Steve Klltzka 0 July 9th to d1scuss the followlng lssues: The problem wlth speed on Lannon Avenue dur breaks at the buslnesses ln the lndustrlal ~n thlS area and the ne~ghbors are trYlng t wlth the Chlldren. There are alot of chlldren address the safety lssues ng for "30 mph" slgns as well The Sherlff's offlce wlll be asked to check speed down ln the area ln questlon. There was no response to the slgn request - Ken wlll order. There was a request that the Clty 1nstall t Street locatlon slgns for the Barthel area. Ken lnformed the Councll that the slgns had been ordered and would be lnstalled as soon as they come In. Steve told the Cnuncll that he had contacted the Sherlff's offlce requestlng "Safe House" slgns and when they became aval able that he would nohfy the Clty so that other lnterested partles co ld get them as well. He also asked about "Tot Flnder" shcker and was tol that the fue department had them avallable. The next lssue d1scussed was to plan to plac 1n the subd1vlslon. The Councll was 1nformed that there has be n add1t10nal damage out at the d1kes. It was agreed that the Clty should set a reward 1n effort to get Informatlon regardlng the vandel1sm. A mo 10n was made by Gary Schwenzfeler and seconded by Donatus Vetsch to set a re ard for up to $200.00 for 1nform- , atlon lead1ng to the arrest and conv1ctlon of the person or persons responslble for cr1mlnal damage to the C1ty of Albertvllle Wastewater Treatment faclllty and C1ty Park property. All were In favor and the mot10n carr1ed. Ken told the Counc1l that there appears to e a power surge problem out at the Wastewater Treatment faclllty and as a result the start1ng capacltors are blown out of the pumps. Ken also talke about the problem wlth the locatlon of the Control panel Wh1Ch he bell ves 1S wrong and dangerous. f1nally lt appears that there may be some t pe of gas In the 11ft stat10n WhlCh would requlre add1tlonal vent1ng. No actlon was taken on these ltems at the tlme of the meet1ng. The next 1tem d1scussed was the quote for t e sldewald repalr at the corner of lander & 57th. MIke Potter, Chalrman of the Park Board was present and lnformed the Councll that the doors ln the Shelter area needed to be replaced as the result of contlnuous vandallsm problems. No actlon was taken at thls tlme. Mlke also lnformed the Councll that a sprlng for one of the park toys had been repalred and would be plcked up. There was no other new busIness.
