COUNCIL MINUTES
AUGUST 17, 1987
The regular meetIng of the AlbertvIlle CIty Council was called to order by
Mayor Loretta Roden. Members present Included Gary Schwenzfeler, Donatus
Vetsch, Don CornelIus and Bob Braun. Others present Included Maureen Andrews,
Bob MIller, Thore Meyer, and Ken LIndsay.
There was a motIon to approve the agenda. The motIon was made by Gary Schenz-
feler and seconded by Don CornelIus. All were In favor and the motIon carrIed.
There was motIon to approve the mInutes of the July 31, 1987 and August
3, 1987 meetIngs of the CouncIl. The motIon was made by Don CornelIus and
seconded by Donatus Vetsch. All were In favor and the motIon carrIed.
Gary Schwenzfeler updated the CouncIl on the August meetIng of the JOInt
Powers Board. The fIrst Item dIscussed was the status on the constructIon
of the new well. The proJect IS expected to be completed wIthIn the next
month. There had been some addItIonal work that needed to be done for the
constructIon of the well.
The Plans and SpeCIfIcatIons for the Barthel Manor 2nd AddItIon have been
reVIewed and approved by the JOInt Powers Board.
The bIggest Issue dIscussed by the Board was the problem WIth the WaterlIne
In St. MIchael. TRe Board WIll have to deCIde at the next meetIng whether
or not there WIll need to be a laWSUIt to resolve the problems that have
occured In St. MIchael. Another Issue that WIll have to be deCIded IS wheth-
er or not other areas of the lIne WIll have to be tested to assure that
they were Installed properly.
The next Issue dIscussed by the CounCIl was an applIcatIon for a 3.2 Beer
LIcense for the August 23, 1987 PIg Roast. The motIon to approve the 3.2
Beer LIcense was made by Bob Braun and seconded by Gary Schwenzfeler. All
were In favor and the motIon carrIed.
In addItIon to the 3.2 Beer LIcense the LIon's requested permISSIon to sell
pull-tabs on the SIte of the PIg Roast for 1 day only on August 23, 1987.
The motIon to allow the sale of Pull tabs at the 1987 PIg Roast was made
by Gary Schwenzfeler and seconded by Don CornelIUS. All were In favor and
the motIon carrIed.
There was a request for a 3.2 Beer lIcense made by the AlbertVIlle Jaycees
for the August 21,1987 to allow the sale of 3.2 beer at the Queen's Coronatlon
and Dance. At the tIme the CounCIl dIscussed the matter no member of the
Jaycees were present nor the applIcatIon completed. A motIon to approve
the 3.2 Beer LIcense was made by Gary Schwenzfeler and seconded by Donatus
Vetsch, pendIng the completIon of the applIcatIon and the payment of the
lIcense fee. All were In favor and the motIon carrIed.
The CounCIl reVIewed some of the prelImInary InformatIon on the report that
IS beIng drafted to respond to the Hordls Brothers, Inc. letter of August
5, 1987. A meetIng of the task force was scheduled for Wednesday August
19, 1987 at 7:00 p.m. to work on the report.

The lncome recleved and bllls to be pald were revlewed by the Councll. There
was a motlon made by Donat us Vetsch and a second by Don Cornellus to approve
the bllls. All were In favor and checks 8121 through 8145 were approved.
The Councll reCBlved In thelr Councll packets the prellmlnary flndlngs from
Bruce Hall-Nelson. No actlon was taken on the materlal, the Councll was
Just asked to reVlew It.
The councl1 was lnformed that the KC's had gotten the bld fori the League
of Mlnnesota cltles Reglonal Meetlng. There was only one bld submltted
to do the work. a meetlng wlll be scheduled to dlSCUSS what has to be done.
There was a motlon made to set the Publ1C Hearlng on the Slgn Ord1nance.
The motlon was made by Bob Braun and seconded by Don Cornellus to set the
hear1ng for September 8, 1987 at 8:00 p.m. All were In favor and the mot10n
carrled.
BUlld1ng Permlts 45 through 48 were approved on a motlon made by Don Cornel1us
and a second by Donatus Vetsch. All were In favor and the motlon carrled.

Bob Mlller revlewed wlth the Counc11 the changes made to the Parkland ordlnance.
Bob p01nted out that a fee for res1dentlal development had been establlshed
uSlng a formula of $500 per acre + 3 lots = $170.00 per lot. It was also
d1scussed that that 1S a need to lncrease the amount for multlple dwelllng
un1ts because of the lncrease the amount for multlple dwelllng unlts because
of the lncrease In populatlon, that lS, more people Ilvlng In a smaller
area so a step up provlslon was 1ncluded In the ordlnance. It was also
clear1fled that the money earned through Parkland dedlcatlon wlll need to
go lnto a seperate account and not be put lnr the general, fund. (Our accountlng
system wlll allow us to keep th~slmoney seperate).
There was no other dlScusslon of the ordlnance so there was a motlon to
adopt Ordlnance 1987-2, An ORDINANCE REGULATING THE DEDICATION Of LAND fOR
PONDING AREAS AND fOR PARKS OR IN LIEU Of PARK DEDICATION A CASH PAYMENT
TO BE USED IN ACQUISITION AND DEVELOPMENT Of PARKS IN THE CITY Of ALBERTV[LLE.
rnemotlon was made by Bob Braun and seconded by Gary Schwenzfeler. All
were In favor and the motlon carrled.
The next ltem dlscussed by the Councll was the letter to MPCA regardlng
a Shlft of dollars from one catagory to Englneerlng to cover the costs created
by the NOV. ThlS request 1S ~ for addltlonal dollars but lS a reapportlonment
of money awarded tOlthe Clty. The Clty wlll need to hold on thlS matter
unt11 we/hear from MPCA.
The next ltem dlscussed was the letter from Meyer-Rohlln regardlng the Waste-
Water Treatment facll1ty. Thore Meyer revlewed the flrms flndlngs and what
needed to be done on each of the followlng ltems:

Chemlcal feed Pump - In revlew1ng the orlglnal plans there were no
1ndlcatlons that the motors would not malntaln a charge to operate
the chemlcal feed pump. It was not untll the Chemlcal fee system
was used that lt was determlned that lt dld not work.
In order to correct the problem a portable generator wlll eed to be
mounted on the pontoon. Meyer-Rohlln agreed to partlclpat In the
cost sharlng of the generator.

A questlon was asked regardlng the why the Clty's should share ln the
cost Slnce the system was suppose to work.
Thore stated that he dld not belleve the problem was a deslgn error
and therefore they should not have to bear the full cost of the correct-
10n.
It was asked when the flnal 1nspectlon took place, and the Counc1l
was lnformed that 1t was completed ln August and the plant went on
llne ln September.
Gary Schwenzfeler questloned why the experts from the suppllers dld
not pOlnt out that the des1gn would not work so that rlght equlpment
could be lnstalled rlght of way. It was asked lf the Englneers knew
what Slze generator would be needed to correct the problem, because
of problems wlth underslzed equ1pment. It was also suggested that
the Clty mlght conslder looklng a llttle larger generator WhlCh could
be used ln other parts of the Clty.
Manual Trlm Control - A manual trlm control was supplled because of
the constralnts put on by MPCA and the EPA.

Ventlng of Chamlcal Tank - The deslgn of the storage tank was des1gned
so that lt would be done through the manway hatch w1th the bUllding
doors open, so that other ventlng would not be requlred. If the Clty
chooses to change the way teh storage tank lS fl11ed lt would fall
entlrely on the Clty and the englneers would not be responslble for
any cost lncurred.
Transfer Pump - There was a problem wlth the transfer pump WhlCh has
been co~rected and wlll be tested before the next dlscharge.
Mlnor Items - Pontoon - At the tlme the project was deslgned all posslble
equlpment was lnstalled to allow by constralnts of the MPCA and EPA.
It may have been posslble to lnclude some of these ltems on change
orders lf they had been pOlnted out before the system went lnto operatlon.
Control Panel - The lssue regardlng the panel has been d1scussed on
numerous occaSlons and that at the tlme the meters were lnstalled the
Counc1l was 1nformed and no actlon was necessary.
The letter from Meyer-Rohlln Also pOlnted out that had the panel been
1nstalled 1n the bUl1dlng 1t wuold requlre 2 people to check out the
11ft statlon and that Control panels for the 11ft statlons such as
Albertv1lles are normally mounted outslde 1n a weather-proof enclosure.
It was agreed however that the present locatlon of the panel 1S dangerous
and should be ra1sed and turned 180 degrees. ThlS wlll be done at
the Englneer's expense. Th1S proposal was found acceptable by Ken
llndsay.

It was agreed that Meyer-Rohlln would get back to the Clty w1th the
cost of the portable generator flrst by phone and then wlth a follow
up letter. The Council would llke to know what lS belng purchased
before lt lS ordered to assure proper operatlon.

There was no other eng~neer bus~ness perta1n~ng to the pond so the
letter from the eng~neer was accepted and made part of the record.
Ken L1ndsay next updated the Counc11 on the problem of what appears to be
power surges on the 11ne. On the weekend of August 15-16, the system went
down pumps went out. It appears that there was problems w1th h1gh voltage
because the connect~ons were welded together. 100 amp fuse were blown out
as well as both capac1tors.
In check1ng w1th NSP they bel~eve that 1t 1S not the1r problem, say~ng that
there must be someth~ng faulty 1nt he system. Accord1ng Ken Just about
everyth1ng has been changed or replaced.
It 1S the C1ty'S contens10n that the problem 1S d1rectly t1ed to the work
done by NSP at the end of June because pr10r to that there had not been
any problems. The C1ty has requested NSP to put 1n a new transformer 1n
hopes that ~t would resolve the problem. NSP says they w111 not change
the equ1pment unt1l the C1ty proves NSP at fault.
It appears that the C1ty has three opt10ns: 1) Cont~nue to change equ1pment
when fa11ure occurs. 2) Ask NSP to put another recorder on the l1ne unt1l
such t1me there 1S a problem and, 3) Have NSP change the transformer.
Waldorf Pump representat1ves had been out to see ~f equ1pment was funct10nlng
normal and everyth1ng checked out o.k.

The C1ty wants to know what klnd of proof NSP needs before they w1l1 change
teh transformer. It was agreed that 1f the C1ty does not get any cooperat10n
from the St. Cloud offlce that the M~nneapo11s off1ce be contacted to see
what they can do.
Ken L1ndsay also suggested that the C1ty look 1nto an alarm system for teh
Wastewater Treatment fac1l1ty 1n case there add1t10nal problems 1n the future.
No act10n was taken on the suggestlon.
Ken L~ndsay next 1nformed teh Counc1l that had been vande11sm done to the
Clty Hall, Water Tower, County Garage, and the s1de of Vetsch's Scout.
The Sher1ff's off~ce had been notlf1ed and are 1nvest1gat1ng.
There was some d1scuss1on regard1ng the cond1t~on of Psyks 4th Add1t10n.
Ted LaTour 1S suppose to have someone 1n to correct the problem w1th the
water holes develop1ng. It was p01nted out that someone had been out dragg~ng
the road and as a result two crowns have started to develop. Ken L1ndsay
stated taht the C1ty has not bladed the road because of the one year warranty
where teh contractor 1S respons1ble for am1nta1n1ng the road.
Mayor Roden d1scussed w1th the Counc1l the Commun1ty Celebrat10n meet1ng
she had attended on August 8, 1986, and 1nformed the Counc1l that another
meet1ng had been scheduled for Tuesday the 18th. The Counc1l br1efly d1scussed
the proposed 1deas and what act1v1ty the counc1l would l1ke to be respons1ble
for promohng. It was agreed that the C1ty would be 1n charge of the "Buttons"
and would attempt to t1e 1n a logo contest as well. As more 1nformat10n
becomes ava1lable the Counc1l w1ll be kept 1nformed.

Mr. J1m Walsh was present to express h1s concern to the Counc~l regard1ng
the purchase of the John Deere Tractor. He stated that he d1d not be11eve
that he tractor should have been purchased because 1t had not been budgeted
for 1n 1987. In add1t10n, J1m quest~oned why a tractor had not been b1d
out and why had, not the Counc1l used the 11qu1dated damages to cover

the costs fo the back sewer bllllng.
~ The Clty Attorney stated that process used by the Clty, that lS gettlng
2 wr1tten quotes meet1ng state law. Jlm Walsh pOlnted out that lt had been
the Clty'S POllCY to bld out all ltems.
In addltlon Jlm wanted to know why the Clty had looked only at John Deere
equlpment. Gary Schwenzfeler stated that other equlpment had been looked
at but dld not meet the needs of Albertvllle. Jlm Walsh dlsagreed and sald
there was, but no other brands were mentloned.
It was pOlnted out htat the repalr lssue had been dlscussed and lt was agreed
that Scherber ln Rogers would be easlly accessable.
Jlm Walsh stated agaln that he has concern wlth how the process took place
and that the Councll's decis10n surprlsed hlm. He also stated that the llquld-
ated damages money would be set aSlde for a new truck and that when the
Toro mower had been purchased that lt had been agreed that another mower
wuld not be needed. Don Cornel1us pOlnted out that the "Grounds Master"
and that the Clty needed equlpment that would work on the slopes.
Jlm Walsh requested that the m1nutes show that he protested the procedures
used ln purchaslng the tractor and that he dld not belleve the equlpment
should have been purchased.

Jlm Walsh also requested a copy of the Wastewater Treatment faclllty statement
showlng lncome and expenses as soon as lt lS avallable.
Jlm Walsh then revlewed some of the same JOlnt Powers lssues dlscussed by
Gary Schwenzfeler. New JOlnt Powers lnformatlon was that H1Ckok and Assoclates
had been named the temporary Englneers for the JOlnt Powers until Jan. 1,
1988.
Gary Schwenzfeler lS to pOlnt out to Munltec that when flushlng water llnes
ln Albertvllle about yard of gravel of mud was blown out lnto the street
nght of way.
Loren Kohnen sald that he had been out by Andy's and that some of the work
has been done, but that there lS stlll more to be done. No actlon was taken
on thlS matter.
There was no other new buslness so there was a motlon to adJourn the motlon
