COUNCIL MEETING MINUTES APRIL 18, 1988 The regular meetlng of the Albertvllle Clty Councll was called to order by Mayor Loretta Roden Councll members present lncluded Bob Braun, Don Cornellus, Donatus Vetsch and Gary Schwenzfeler Others present lncluded Maureen Andrews, Bob Mlller, Thore Meyer, Bob Sullentrop, Ken Llndsay and Lorie Vlllareal The agenda for the evenlng's meetlng was revlewed by the Councll A motlon was made by Don Cornellus and oeconded by Bob Braun to approve the agenda All were In favor and the motlon carr led The mlnutes of the Aprll 4th meetlng were revlewed by the Councll, before they were approved Donatus Vetsch asked lf Cyrll Beaudry had been contacted regardlng the dumplng on thelr land on Barthel Industrlal Park? Maureen lnformed the Councll that she had contacted the property owners and that it appeared that they would not be lntereoted In havlng the City level off the area and barricade lt off In speaklng wlth Mrs Beaudry, lt appears that she felt that her hUoband would be upset wlth the fact that the City lS maklng a lssue of cleanlng up the site when other properties eXlst In slmllar dlsrepalr Mrs Beaudry ouggested that lf the City wanted to do anythlng to the land that a member of the Councll should speak wlth her husband Maureen went on to explaln that the lSoue of the speclal assessmento and back taxes on the land was brought up as one of the . . . rea50ns why the owners are not 1nterested 1n 1ncurr1ng any more expense on the property It was explained to Beaudry's that the C1ty was 100k1ng to 5pend the money to clean up the land and barr1cade 1t off so that the owners would not be faced w1th any added expense At th15 p01nt, one of the members of the Counc11 que5tioned the fact that 1f the C1ty was to 1ncur the expen5e for clean1ng up the land would 1t el1minate the dump1ng problem or would it Just prov1de more room for dump1ng The discu5s10n then focused on the fact that th1S lS the f1rst 1mage that someone per0e1ves when they enter town from the freeway After some add1tional d1Scuss10n a anyth1ng to the property at th1S t1me Cornel1us and seconded by Donatus Vetsch mot10n carried motlon wa5 made to not do The mot10n was made by Don All were In favor and the A motlon to approve the mlnute5 of Aprl1 4th was made by Gary Schwenzfeler and seconded by Donatus Vetsch All were 1n favor and the mot10n carr led The first ltem on the even1ng'5 agenda was the sale of u5ed equ1pment The mlnutes should note that the ad for the fllght pump5 wl11 appear in the next lS5ue of the Leagu~ of M1nnesota Cltles magazlne The sealed b1ds for the All1S lawnmower and the Mars street 5weeper were opened and read by Maureen Th~ bld5 were as follows M1ke Potter 11650 57th Street Albertvl11e, MN Street Sweeper $151 51 Mlke Potter Lawnmower $101 51 page 2 . . . Gary Schwenzfeler made a motlon to reject the bid on the sweeper Bob Braun seconded this motlon All were In favor and the motlon carr led It was agreed that Ken would put an ad In the Trade and Tlme6 paper to sell the Mar6 Street Sweeper for $1000 00 or best offer The Councll was lnformed that there lS a $30 00 charge to run the ad for up to 5 weeks If at the end of the 5 weeks the equlpment has not been sold. there lS no charge Ken was asked to check with Don Cornellus lf someone offers less then the $1,000 00, but that lt would not need to come back to the Councll for flnal actlon Mr Kelth Franklln met wlth the Clty s attorney prlor to the evenlng's meetlng Bob pOlnted out to the Councll that Mr Franklln had seml-completed appllcatlon submltted to the Clty but had been waltlng for notlflcatlon from Burllngton Northern authorlzlng th~ location of the slgns and letter from a englneer statlng the necessary lnformatlon about the wlnd veloclty A member of the Councll asked lf all 61X permlts would have be approved or could the Councll llmlt the number approved Bob stated that if Mr Franklln has complled wlth the blllboard ordlnance. there was really nothlng the Clty could do regardlng llmltlng the number of locatlons of slgns Bob was also questlon6 whether or not the Darkenwald development would have a bearlng of the approval of the slgn locatlons Bob stated that because the slgn appllcatlons had been put lnto place prlor to the Darkenwald development proposal that lt would almost imposslble for the permlt6 to be den led Other d16cus6ion lncluded the lssue of approvlng the permlts It was pOlnted out that each of the 6 permlt6 wlll be asslgned a deslgnated number and that each of the 6 slgn permlts could be approved by the Council all together ln6tead of lndlvldually Donatus PAGE 4 . . . Vet5ch raised a question regardlng fees and was told that the ordlnance sets the rate based on Slze and that the fee5 should be revlewed from time to tlme and adJusted when necessary Hearing no other dlScussion, Bob recommended that the Councl1 walt on making any declslon until Mr Franklln had submltted the necessary slgned appllcatlons and pay the nece5sary appllcatlon fees The Council agreed and no action wa5 taken on the matter The Councl1 Llndsay told the real good next heard from the Malntenance Department Ken Council that the street 5weeplng was done but not There appear5 to be problem5 wlth con5tructlon trucks leavlng large amounts dlrt behlnd ln the road rlght-of-way and not cleanlng up the dirt left behlnd Ken pointed out that ln the past he has Just 5topped the trucks that he has seen maklng the meS5 and have asked them to clean up the road rlght-of-way and asked lf lt wa5 ok lf he could contlnue brlnglng lt to the constructlon people's attentlon so that lt does not become a real blg problem It was also pOlnted out that under new Developer's Agreements, the developer wl11 be held are responslble for constructlon cleanup as part of the escrow ltems Ken also brought up the fact that several people have drlvewavs and yards that are washed out and should be made aware of thlS problem It was agreed that Maureen should send a letter out to the property owners that are presentlng a problem, once a 11St has been presented by Ken Gary Schwenzfeler made a motlon and Don Cornelius seconded the motion to have letter5 sent to th05e people who have washout5 All were ln favor and the motlon carrled Ken lnformed the Council that crack seallng would begln th15 week provlding the weather stayed nlce Ken thanked Don Cornellus for helping him to plck up the crack fllllng materlal PAGE 5 . Ken next reported to the Councl1 the results of the sampleD on the pond dlscharges SampleD taken last week met all but one limlt requirement It was pointed out that the ponds aga1n met 11m1ts w1thout uS1ng the chemical treatment As the Counc11 may recall th16 16 the second t1me that th1s has occurred Ken p01nted out the PCA w1ll not be conducting the exper1ment (noted 1n earl1er mlnute6) unt11 the fall d1scharge Ken expects to receive dlscharglng Pond 3, and wl1l prepare 1t for d1scharge perm1ss1on from the PCA to start then transfer Pond 1 lnto Pond 3 and The bid6 on the gravel for the d1kes at the Wastewater Treatment Fac1llty were presented next to the Councl1 Ken lnformed the Counc1l that he had asked for the b1ds ln two forms--1 Brought out and . dumped, w1th the C1ty d01ng the level1ng and the gradlng, and 2 Brought out, dumped, graded and packed The b1ds presented were as follows Buffalo B1tuminous $1,000 00/ton-Just brought out $5,750 00/shaped and compacted Hassan Sand and Gravel $1,100 00/ton-Just brought out $3,960 00/Dhaped and compacted $5,000 00/2" pure gran1te Denn1s Fehn $2,510 00/523 yards, Class 5 $3,477 55/2" pure grarllte . Ken recommended gOlng w1th just Class 5 at thlS t1me because of the fact that the d1kes are st1ll 1n the process of 6ettl1ng and the Class 5 lS easier to put down and eaSler to work w1th Ken stated that the Class 5 w111 pack down better than the pure gran1te Ken d1d suggest that with1n two years the C1ty may want to put down the 2" of pure gran1te PAGE 6 . . . Donatus Vetsch made a motlon to accept Dennls Fehn"6 bld of 52J yards of Class 5 gravel for $2510 00 Don Cornellu6 seconded thlS motlon All were in favor and the motlon carr led Ken reported that the blds are slow comlng ln for the fence at the Wastewater Treatment Faclllty The 16sue was tabled untl1 the next meeting Ken lnformed the Councl1 that he has been asked to speak at the Minnesota Wastewater Operators A6soclatlon meetlng ln August He requested permlSSlon from the Councl1 to attend the 6emlnar ln August 4th He will glvlng the same presentatlon that he gave at the 6emlnar ln March Mlke Potter, representing the Park Board, was present to comment on the mlnute6 that the Councl1 lS reque6tlng from the Park Board Mlke stated that the mlnutes from Wanda Scherber are falrly 6cattered, however, they would try and get the mlnute6 to the Council for reVlew ln the future The overtlme calendars were next revlewed by the Councl1 Mlke lS not yet back to work He lS still recelvlng therapy on the rlght hand Bob Braun commented on Ken's Council meetlng tlme H1S tlme to attend Gouncl1 meetlngs was set at one hour, not two Maureen wll1 check from WhlCh set of mlnutes thlS matter had actlon taken on lt Lorle's overtlme was approved Gary Schwenzfeler asked why Maureen dld not have an overtlme calendar included in the packet Maureen agreed to have her overtlme flgured for the Councl1 for the next meetlng It was pOlnted out that currently Maureen had approximately 130 hours of stralght tlme ln, not flgurlng tlme and half There wa6 no further discu6s1on PAGE 7 . Stan Barthel of the Albertvllle Jaycees, requested a 11mlted 3 2 beer license for the summer softball league runnlng from May 1st to Augu5t 315t, Tuesday through Thursday, and for the two 50ftball tournaments scheduled for May 20, 21 and 22 and June 17, 18 and 19 The fee wll1 be $100 00 for all of the events Stan was lnformed that prlor to the City slgnlng the 11mlted beer license that a applicatlon form needed to be completed and that the Clty needed to have on file a copy of the Jaycee'5 Dram Shop In5urance, with the Clty of Albertvllle named a5 an addltlonal lnsured In addltlon, the Jaycee5's need to complete the INDEMNIFICATION AND HOLDHARMLESS AGREEMENT between the C1ty and the organ1zatlon . Don Cornelius made a mot1on to approve the 3 2 beer 11cense for the Jaycees pend1ng payment, the completlon of the necessary mater1als and the C1ty recelvlng a copy of the dram shop ln5urance Garv Schwenzfeler seconded the motlon All were ln favor and the motlon carr led The Westw1nd plat was revi~wed for final plat approval The Council wa5 lnformed that the Planning Commlsslon had revlewed the plat at the1r Apr11 14th meet1ng and approved a motlon recommend1ng to the Councl1 that the plat be approved as drawn The Counc11 was lnformed that the Plannlng Commlss1on had had some concern regardlng the lS5ue of the park land dedlcatlon and how that money wa5 to be spent It wa5 part of th~ Comm15s1ons recommendatlon that the Developer'5 Agreement 1nclude language pertalnlng to the fact the moneys rece1ved for thlS development should be used In the area of the development 1nstead of In any of the other park developments Bob Mlller pOlnted out that he d1d not feel that 1t was approprlate to lnclude such language, but that lt 15 approprlate to lnclude th15 request ln the mlnutes of the Councll and In the . PAGE 8 . . . m~nute6 of the Plann~ng Comm~6s~on and the Park Board It was po~nted out that the rea60n the Comm~os~on had the concern ~s that as members of the Boards and Commiss~0ns change there could be a problem w~th fundo be~ng expended for other park development not leav~ng enough funds for for the park that ~s park of th~s development, and that 6~nce the money was ded~cated for WESTWIND, ~t should be used for ~ts development There stat~on and Street was also some d~scuss~on regard~ng the ~ssue of the l~ft forcema~n ty~ng ~nto the sewer l~ne that runs down 60th It was pointed out that 6everal membero of the Counc~l had been contacted by the res~dents that l~ve on 60th Street regard~ng the adequac~es of the l~ne and the poso~b~l~ty of problem6 wlth backups ~n the 11ne Meyer-Rohl~n ~nformed the Councl1 that they were aware of thlo concern and had surveyed the home on the end of the sewer l~ne where the sewer line io the most shallow and had found approxlmately a 3 5 foot drop in elevat~on It was also po~nted out that ~n check~ng w~th Ken L~ndsay that the only problem that haD ar~sen ~n the pa5t on that l~ne has been m~nor problemo directly related to the lack of flow Meyer-Rohl~n went on to expla~n that the capaclty of the eXlst~ng sewer 11ne on 60th Street will be able to handle the flow from the new interceptor, s~nce the l~ft 5tatlon wl11 only be~ng using one 175 gallon per mlnuter(gpm) pump ThlS along w~th the degree of slope In the l~ne and s~ze of 11ne the property owners on 60th Street should experlence any problems Maureen aoked ~f the eng~neers could send a letter to the C~ty explaln~ng th~s s~tuatlon so ~f any add~t~onal quest~ons are ra~sed that the letter w~ll be available for rev~ew Thore agreed to get a letter r~ght out to the Clty The m~nutes should also note that at such t~me the sewer 11ne starts operatlng at capaclty that the Counc~l w~ll then need to look at ~nstalling the rema~ning portlon of the new oY6tem PAGE 9 . There was no other d1Scusslon regard1ng the approval of the f1nal plat for WESTWIND, so a mot10n was made by Bob Braun and seconded by Don Corne11us All were 1n favor and the mot10n carr1ed, pend1ng the approval of the Developer'o Agreement The Mayor and City Adm1n1strator were author1zed to o1gn off on the plat for record1ng once all the necessary paperwork was completed . The WESTWIND Developer's Agreement was d10cussed next John Darkenwald, George Yankoupe, and Wally Odell were present to dlscuso w1th the Counc11 the Agreement Iosues ra1sed 1ncluded the1r request that language be 1ncluded regard1ng the fact that the1r property should be allowed to have pylon s1gns to attract the freeway or1entated busineos (i e Perk1no, McDonald'o etc ), there ~oncern regard1ng the language regard1ng the app11cat10n of spec1al assessments after the award of the conotructlon contract, the poss1b11ity of reducing the Letter of Cred1t from 30% to 20%, language regard1ng the portland ded1cat10n, lengths of not1ces and some other m1nor language clar1f1cat10ns The Counc11 and the developers went through the agreement on a page by page baois and were able to resolve each of the 1Soues ra10e 1 FREEWAY ORIENTATED SIGNS--It was p01nted out by Bob M111er that the ment10n of approval for freeway or1entated o1gno does not make lt b1nd1ng to the Developer'o Agreement, because of the nature of ord1nances . It was agree that the m1nutes ohould reference the fact the that the C1ty hao reVlew the matter and agree that the property has the appropr1ate need for th1s type of s1gnage in the commerc1al area and that the Developer's Agreement would make reference to the boundary of the commerc1al area on the map 1ncluded 1n the Developer'o Agreement It was also agreed that the C1ty of Albertvl11e PAGE 10 . . . would review the Roger's Slgn Ordlnance regarding the helght llmltationo for pylon slgno It was explalned to the Councll that the Roger's Ordlnance uses a deslgnated HEIGHT ABOVE SEA LEVEL lnotead of a helght reotriction for thelr freeway orientated olgno, because the fact that they are deallng wlth overpasses and dlstance In addltlon, Bob suggested that a b~st way to deal wlth the Darkenwald's concerns regardlng the slgno would be to designate the commercial area as an overlay dlstrict, and approprlately lndlcate the dlstrict on the map attached to the Developer's Agreement 2 SPECIAL ASSESSMENT LANGUAGE--The Developers were concerned wlth the language regardlng the Clty'o rlght to levy for assessments once the constructlon has commenced It wao their request that the Agreement oay that the asoesoments could not be levied untll fall It was pOlnted out that thls language follows that of the State Statute wlth regards to 429 flnanced proJects The developers were also assured that the Clty hao a polley to hold the assesoments hearlngo In the fall prlor to the tlme that the asseosments have to be recorded at the County Courthouse 3 The next lssue dlscussed was that the of the amount of the Letter of Credlt that the Clty wao requeotlng The Developers lnformed the Council that they felt that the 30% wao to much to ask for but would be wllllng to use a Letter of Credlt In the amount of 20% The reaoon glven was that when the Developer flrst approach the Clty regardlng the proJect the Clty wao not requlrlng the use of Lettero of Credlt, then It wao put In at place at 60% and later lowered PAGE 11 . . . to 30% The Developers fee16 that 20% would suffic1ently cover the amount of the debt serV1ce therefore there wa6 not the need for the add1tional 10% There was some d1Scuss1on at Council"s and 6taff 6 comfort act10n was taken at th16 t1me th16 t1me regard1ng the level w1th the 30%. but no 4 PARK LAND DEDICATION--The Developer6 proposed that the language 1n the Agreement perta1n1ng to the tran6fer of land and the second 1nstallment of money be changed to 6ay that the money or land would not be due to the C1ty unt1l Phase II of WESTWIND 16 developed, because of the fact that the land w1ll not be access1ble unt1l that t1me Some of the Counc1l memb~r6 expre6sed the1r concern regard1ng the fact that the land that lS be1ng dedlcated lS falrly low and may be expenSlve to develop There was also some discusslon regarding how much land w1ll be used for the storm water retent10n pond that w1ll be needed to handle some of the exceS6 water that wlll be generated by the WESTWIND development Thore informed the Counc1l that the retentlon pond may take up 60me 3 acres of the 14 2 acres be1ng ded1cated to ~ne Clty It was p01nted out that the construct1on of thlS retent10n pond would result ln the Clty obtalnlng the flll that will have to be removed dur1ng the constructlon The Developers also agreed to glve to the Clty any exceS6 d1rt obta1ned from the constructlon of the houses and apartments or from the rough gradlng if there 16 any extra There was also some dlScus610n regardlng the condltlon of County Dltch #9 WhlCh wlll recelve most of the water from PAGE 12 . . . the development of WESTWIND It was agreed that thlS dltch wl11 have to looked at closely and lf need by the County wlll need to look lnto cleanlng lt out Slnce it i& under thelr Jurlsdiction At thlS point the Council did not a deC1Slon of the park land dedicatlon lssue, but agreed to paso on lt untl1 the end of the di&cuSS10n when the Letter of Credlt was dlscussed 5 Some other dlScusslon focused on some minor language clarlflcatlon that were re&olved prlor to the meetlng of the Councll 6 There was also Dome concern regarding the lack of requlrement for notlce on the part of the Clty wlth regards to the rlght of entry onto private property to malntaln th'9 treeD and berms in the case that they are not properly maintained by the Developer or the property owner It wac agreed that the Clty would provlde notlce and would clarlfy the language regardlng the requlred malntenance of trees, plantlng and the berm At this point the Councll and the Developers went back to the issueD of the Letter of Credlt and the park land dedlcatlon Bob Mlller lnformed the Councl1 that hl& mlnlmum comfort level wlth the the Letter of Credlt was 30% and that he felt that the rest of staff was ln agreement wlth that amount Bob pointed out that ln the worst case &CenarlO lf &Omethlng was to happen and the the Letter of Credit would need to be drawn on the 30% would not leave much room for tlme delays or court litlgatlon PAGE 13 . . . He pOlnted out, however, that the amount for WhlCh the Letter of Credlt lS made out for 10 a POllCY declslon of the Councll and therefore lt lS the flnal declslon of the Councll After a llttle more discusslon the Mayor stated that In past dlocusslon th~ Councll had made the cholce to use a 30% Letter of Credlt and otlll believ~d that lt provlded the the best amount of protectlon for the re6t of the communlty, wlth regards to the generally obllgated moneY6 backlng the improvements The park land dedicatlon was dlscu6sed In a llttle more de~all and lt wa6 flnally agreed that language would be added to allow the developers to transfer the land and the $6667 00 to the Clty at the tlme of Phase II of WESTWIND or after a perlod of two y~ar6 from the date of the agreement dependlng on WhlCh ever came flr6t Wlth no other dlScusslon a motlon was made by Don Cornellu6 and 6~conded by Gary Schwenzfeler to approve th6 Developer S Agreement wlth the approved changes All were In favor and the motlon carrled Representatlves of Barthel Constructlon presented to the Councll the pIano of the proposed apartments to be located on a 2+ acre parcel west of Barthel Industrlal Drlve and 52nd Street The proposed apartments wlll be two 12 unlt bUlldlng of brlck and cedar materlals There wlll be a two to one parking ratlo avallable for each famlly unlt as well as a garage for each unlt (Whlch 15 what currently required In the Clty Zonlng Ordlnance Some of the detalls presented about the complexes ln0luded the following informatlon One unlt will be the handlcapped acce5sible The apartments wlll have carpeted Ilving rooms, hallwaY6, etc PAGE 14 . . . ---.... There wlll be no decks A sleeve will be ava1lable w1th each un1t should a tenant want an a1r cond1t1oner (A1r Cond1t1onero can not be included in the proJect cost to FmHA ) Each un1t will have e1ther the east or west sun expooure There w1II be sound buffers between flooro and walls (The SCT rat1ng lS a m1nimum of 50) The sidewalks w1II be the SlX foot sidewalks w1th a two feet overhang leav1ng four feet to walk on The ut1lities w1II come 1n off of Barthel Industrial Dr1ve Also, there will be front door secur1ty A key must be uoed 1n order to get 1nto the bU1ld1ng These be w1II be moderate 1ncome FmHA apartments Rents w1lI 1 BR - $260 00, 2 Br - $290 00, 3 BR - $310 00 Garageo are extra There wao some d1Scussion about the bU1ld1ng of the apartmento It was p01nted out that Barthel'o wonld llke to see conotruct1on otarted by the m1ddle of the summer, 1f the f1nanc1ng can be lock 1n by that t1me The Counc1l looked at the plans and some of the general d1Scussion focused on the follow1ng lssues It was a concern of one of the Counc11 members that a buffer would be needed (poss1bly a double row of p1nes) between the apartments and the slngle fam1ly res1dent1al homes that would be look1ng down on the apartment bU1ld1ngs PAGE 15 . . . The entrance to the parklng and facllltlc6 would be off of Barthel Indu6trlal Drlve and 52nd Street However, It wa6 felt that the entrance should be moved further north allowlng for 125 feet between 6treets and acce66 for better visibillty Another area of concern was the locatlon of the dumpster It was felt that the area should be moved down 60 that the truck would not have to back all the way up the parklng lot to get at the dumpster It wa6 also suggested that the area be screened In The representatlves for Barthel pOlnted out that they have bUllt a 6lmllar bUlldlng as to the ones belng proposed for Albertvllle In Elk Rlver and If any of the members of the Councll were lnterested In seelng the bUlldlng he would make arrangements that they could g~t In It was agreed that Dave Wulff would set up an appolntment to see the apartments In Elk Rlver Dave asked If the Councll would provlde a letter to Barthel Constructlon 6tating that they are aware of the proJ~ct He assured the Councll that thls letter lS not a commltment to the deslgn of the bUlldlngs or actual layout, but rather an assurance to the Agency that the community lS aware of the proJect Maureen next informed the Councll that the Plannlng Commlsslon had made a recommendatlon to the Councll to approve the final plat for Braun's Addltlon pendlng approval of the developer's agreement There was some dl6cusslon concernlng snow plowlng Ken felt that Slnce the cul-de-sacs were of an "Eyebrow' de6lgn they would caU6e problems when It came tlme to plow 6now PAGE 16 . . .
