The regular meeting of the AlbertvIlle CIty Council was called to order
by MaY~jl Loretta Roden Members present included Bob Braun, Ibn CornelIus and
Donat us Vetsch ColmcIl member Gary Schwenzfe1er was absent Others present

The LJ.ons organization has requested that a legal document be drawn up
stJ.pAlatmg that the funds donated to the CJ.ty will be kept m a separate
account and that the City will not use any of those funds for any actJ. VJ. ties
other then what wJ.ll be agreed upon by the commJ. ttee The LJ.ons mformed the

The second J.ssue dJ.sCU6sed had to do with a storage problem the LJ.ons
have with bemg able to store equJ.pment, ete They have no room and would hk.e
the Counc 1. I to consider allowing them to have a semJ. truck traJ.ler on skl.ds
sl.milar to what the LegJ.on Club in St M1.chael has behind thelr bluldmg ThJ.s

There was some dl.sCU6sion that the ordinance may not allow 1. t m general
It is poss1.ble that there may be a bluldmg and zoning code problem It was
pomted out that 1.f the ordmance 1.S changed m order to accommodate the
Lions, then 1. t may allow for all others who want to have th1.s type of storage

towers are used to stabllize the pressure rot the wells themselves are not
be1.ng used St Ml.chael doesn . t want the cappmg done They want the wells
kept operatlonal m case of an emergency However, the State of MJ.nnesota says
that lf the wells are not m use or gomg to be used. then they must be
capped
There was some disCU6s1on concemmg the fact that m order to use the
wells, new p.;unps and screens would be needed It was also pomted out that the
company that bid on the Job to cap the wells w1.11 hold the bld a h ttle longer

suggestion was made that the City could poss1.bly sell the ]';lI..UQpB for whatever
they are worth to Joint Power's and then let Joint Power's 6ell them Agam,
they probably wouldn't get anythmg for them
The feelmg of the Council was to table the 1.ssue unt1.l the next meetmg
and decide at that time whether to sell or not The Jomt Power's Board will
be made aware of the dec1.s1.on once 1.t has been made
Brad Farnham of Juran and Moody was present to d1.sCUBS with the Council
the issue of Advance Refunding the 1982 G 0 Improvement Bond, the 1984 Clin1.c
Revenue Bond and the 1984 G 0 Sewer bond Brad had made a presentatlon of
Advance Refundmg issue ear lier m the sUlTlller but had recommended to the
Councl1 that they wa1. t to see if there would be a Shlft m mterest rates,
which if they lowered would provide add1.t1.onal cost savmgs to the the Clty
At this t1me lt appears that mterest rates are not l1.kely to get any lower so
Brad recommended that the C1. ty go ahead and order the sale of the bond
Brad reV1.ewed W1.th the Counc1.1 the new schedule, briefly reV1.ewmg W1.th
the Councl1 how the refundmg works (th1.s lssue had been dlsCU6Sed m great
detall ear l1.er m the year) Some of the 1 terns dlSCUB6ed were the "acqulred
oblJgat1.ons", which are the restr1.cted funds, the "open market securl.tl.es"
wh1.ch are unrestr1.ctl.ve, the "s1nkmg funds" and the "debt servl.ce reductl.on"
All of these 1. terns are used to determine whether or not an advance refunding
wl.II work and what w1.11 be the end result of the refundmg
Brad next went on to review with the Councl1 the Debt Servl.Ce Comparl.son
explaml.ng the difference between the old bonds and the refundmg bonds It
was pointed out that by doing the advance refundmg the Cl. ty would reduce the
prmc1.pal paYment from $710,1202l 021 to $680,1202l 120 and the Debt Serv1.ce from
$1,188,914 17 to $934,766 04
After some additional dl.sCUBs1.on regardmg the bond schedules the Councl.I
rev1.ewed the timetable established by Juran and Moody, WhlCh lS used to
determme the date of the sale From the schedule presented the date of sale
is scheduled for CCtober 3, 1988 at 11 120 a m wi th the award t1me bemg 7 30
p m of the same day at a regular Councl1 meetmg
In order to proceed with thls bond sale a motion to proceed was needed by

the Councl1 A motion was made by funatus Vetsch and seconded by fun
Cornel1us to approve the resolution call1.ng for the publ1c sale of the
refundlllg bond All were m favor and the motlon carr led
The CounCl1 next heard from the Mamtenance Department The sewer line
cleaning is now fmished A 11 ttle more was done than what was orl.glnally
planned, WhlCh lS shown in purple on the map included m the Council packet
Ken mformed the Council that paper and lathes (12 to 18 mches long) have
been found ln the sewer lme and seem to be cauSlllg oome obstructlons m
flows Bob Sullentrop commented that these lathes may be left over from the
constructlon of the sewer lme The Councll stated that they should have been
pulled out when the pipes were 1.nOpected and lt was the Ertgmeer's
responslbll1ty to assure that the lines were cleaned out properly
Ken next pointed out that a small problem was found by the elementary
school when clean1.ng the sewer lme from Mam Avenue to the parklllg lot
Rot..o-Rooter could not get through up to the mam entry Cement and gravel were
found m the lme, in fact, the lme was almost plugged solld Wl th cement,
probably caused from constructlon At 33/foot for 85 feet thlS cost amounts
to $28 05 The quest10n lS, should the school be bllled for the 85 feet or
ohould the C1.ty plck up the cost? The Councl1 dec1ded that the Clty w111 pay
for the expense, however, if it happens agam, the lme wl11 have to be dug up
and repalred because there could be a dlP m the lme It wlll be looked at
next year when lines are cleaned agam
The Councl1 was informed that the Mam Avenue Ime was pretty grease free
although there seemed to be alot of sand and gravel m the lme Ken went on
to say that this should not present any problem aD long as the lme lS well
mamtamed It was pomted out that good mamtenance records should be kept
on the lme m case there are ever any questlons regardlllg the mam"tP.-n.ance of
the lme
The mmutes should note that there was no charge to clean the lmes of

Ken expressed h1S concern that the new proJects do not have sewer lme
cleanlng lncluded in the plans and speclflcatl0ns It was suggested that
because it lS a polley of the City, the engmeerlllg flrm should be dlrected to

instruct that all new projects be required to have all sewer l1nes cleaned and
Jetted after the streets are in
The cleaning of the ditch by Barthel Industrial Drlve and the freeway is
almost done Heiny's Diggers will be out on Wednesday to do the dltch by the
railroad tracks The permit from lbrlington Northern granting perm1se.ion was
finally received by the City
There was some discussiOn about getting the extra Pea rock off the
streets after sealcoating The City will do thlS t1lDe, (contingency funds can
be used as long as they are documented) however, in the future lt wl11 be put
m the contracts to have thlS done by the contractor The Councl1 advlsed the
Mamtenance Department to get this done as soon as posslble
Ken then requested that the Council conBlder a heater for the ponds
btnlding out at the Wastewater Treatment Facility Ken has a used space heater
with fan in mind for the 32x38 roild1ng He pomted out that LP gas is cheaper
than an electrlc heater He is also request1ng a ce1lrng fan slmilar to the
one in the f1re barn The Council informed Ken to do some checking on prlceB
for a mounted heater and have them available at the next meet1ng
The mmutes should note that the heater and the ceil1ng fan are not
approved 1988 tudget items
Related to the Lion' s request to be allowed to locate the tral1er on the
City property, Ken pointed out to the Councll that there lS no room by the
Jal1, rot suggested that possibly 1 t could be set on the street easement by
Vetsch Cabmet' s trailer on Large Avenue
Ken next informed the Council that he was requestlng an mcrease m
salary for Mike Rutkowski He feels that M1ke lS a good worker and deserves a
raise fun Cornelius corr:mented that M1ke does a good Job and should get 50
more per hour There was some d1scuss10n over the fact that Lor1e also does an
excellent Job and she d1d not receive a ra1se until 6 months It was pomted
out by Loretta that 1 t would not be falr to Lor1e to g1 ve M1ke a ra1se after
only 6 weeks The feeling was to leave the wage where 1 t 16 for now and that
the lssue of wage mcreases wl11 be d1scussed at rodget t1lDe before mak1ng any
decisions Lorle also commented

Don Cornelius made a motion to give M1ke 50 more per hour There was no
second and the mot1on did not carry
Bob Braun made a motion to open the Publ1c Hearrng on Subd1 vis10n
Regulations Don Cornelius seconded the motion All were m favor and the
hearing was opened
Maureen Andrews then read the publ1c hearing not1ce The minutes should
note that none of the local developers were present for the d1scuss1on
Staff reviewed W1 th the Colmcil issues that they felt needed to be
addressed prior to the adopt1on of the Subdi V1S1on Regulations The 1SSUes
included 1 125% surety coverage, 2 the issue of the 4/5 vote requu'ement
vs a s1Jllple ma.JOr1 ty . and 3 standards for not1crng hearrngs
1 125% Surety requirement--There was d1scussion regarchng the fact
that the City of Albertv11le has set forth some policy regardrng
the amount of surety requ1red for a development through the
developer agreement I t was pointed out that the 125% coverage
16 total protection for the City but that somet1meS it is not
feasible to requ1re such a hJ..gh percentage furrng the course
of discussion it was agreed that the C1ty of Albertv111e could
requ1re 6/21% Letter of Cred1 t unless the developer can
demonstrate that a reduct10n in 6ize of the Letter of Credit is
Just1fied either through smaller S1Zed plattrng proPOSals or
past experience W1 th the developer

2 4/5 Approval on Variances--It was suggested that a 4/5 vote
prov1des the City W1 th the most protection because 1 t assures
that the there 1S a COIJIIlOn consc1ences of the Counc11 when
approvrng a S1 tuation dlfferent then the norm A mot1on of
support of this stipulat10n was made by Don Cornelius and
seconded by Bob Braun All were m favor and the mot1on
carr1ed
3 Notice of Public Hearrng--350 feet ThJ s requu'elnent
standardizes the Notl.ce requl.rements so that they are all the
same

There was no other discussion so Don Cornellus made a motion and Bob
Braun seconded it to close the p;.bl1c hearrng All were m favor and the
hearing was closed
Don Cornelius made a motion to have Davld Licht complete the subdivislon
regulations with changes Bob Braun seconded the motlon All were m favor and
the motlon carrled
Mr Neil Meyer was present to inform the Councl1 that he was concerned
that the catch basin installed behmd hlS property may have been set wrong and
is requesting that the City look at the location and if needed prov1de hl.m
with black dlrt to correct the problem The Council was remmded that the
catch hasm was mstalled because he was experiencrng a problem Wl th dralnage
prior to the platting of the Braun plat
Now that the catch basin is in, he lS stating that he wanted the dral.l1.age
to go from the house to the catch hasm, not from the catch hasm to the
house He is having a problem W1 th the drainage :poolrng in hlS hack yard In
order to remedy that I he is asking that the C1 ty brrng in two loads of black
dirt and level and grade it so that the drainage w111 run properly It was
p:>mted out that the City does not normally do gradrng for prlvate property
owners Mr Meyer state that if the City provided the two loads of black dlrt
he would level it, grade and shape 1 t
Donatus Vetsch made a motion to let the property owner and the engineer
work out to their discretion how Dllch black dlrt up to two loads would be
necessary for the grading Don Cornellus seconded the motlon All were m
favor and the mot1on carried
Two pay requests I one for Latour Construction m the amount of
$115,103 30, and one for fuffalo B1tuminous in the amount of $68,412 49 were
presented by Bob Sullentrop Donatus Vetsch made a motlOn and Don Cornel1us
seconded it to author1Ze the pay request for Latour Construction m the amount
of $115 I 103 30 All were in favor and the motion carr1ed Bob Braun made a
motlon and Don Cornelius seconded it to honor the pay request for fuffalo
Bitummous in the amount of $68,412 49 All were m favor and the motlon
carried

The blacktopping has been done in Westwind except for the cal-du-sac The
curb, sutter and blacktop were held up here because of redesign of the
cal-du-sac The blacktopping will be done th16 week and the patching of cuts
will be done at the same time OJ's driveway will also be done
The new lift station is COIQPlete except that there 1S no electricity yet
Latour is wa1 ting on a panel that had to be ordered special The sewer lines
need to be tested also
The final p..mch list for Barthel Manor 2nd Ackhtion has been prepared and
the work will be scheduled to be completed by EW:falo B1 tum100us Ken po1Oted
out that &tffalo Bituminous would need to redo some of the grouting of the
manholes 10 the subdivis10n
There was some discussion regarding the ra1sing of fire hydrants
throughout the City Ken questions why the C1ty should be responsible for
doing the work. There needs to be a clar1ficat10n so that hydrants can be
raised before winter
The Slgn ordinance amendment was tabled unt1l the next meeting.
The income received and the b1lls to be pa1d were rev1ewed by the Coonc11
next There was a question as to why the NSP b1ll remcuns 60 hIgh It was
pointed out that there are more street l1ghts and the air condJ. t1.oning at City
Hall has been on a great deal The bill for Ihn Barthel for storage of the
Miss Albertville float was also questioned Th1s bill will not be paid because
the Lion's pay the storage for the float Hearing no other quest10ns or
comments Ihn Cornelius made a motion to approve the b1lls except for the Ihn
Barthel check #8985 Ihnatus Vetsch seconded the mot10n All were 1n favor and
checks 8965 through ge06 except for 8985 were paJ.d
Maureen requested that the Counc11 consider the Plrchase of some computer
furn1 ture and a lateral filing cabmet for the off1ce There 16 money from the
bond sale that can be used for these Plt'Chases Pr1ce estimates w111 be
obta1Oed for the computer fumi ture and the lateral f1ling cab10ets Maureen
adv1sed that any of the Council members that would like to check into the
prJ.ces of these necessities with her were more than welcome to
The matter of junk cars was again brought up The Sheriff had to deliver

must pass before anything can be done It should be decided who will do the
towing if it should become necessary
The Council approved the hiring of Patty Sal vwedel, the new dog catcher
that took David Stromberg's place She w111 use the same qontract that was in
effect W1 th Stromberg
It was brought to the O:>uncil's attention that a public hearrng needed to
set for special assessments for Westwind. Braun's Addit10n and Barthel Manor
2nd Addi tion Don Chrnelius made a motion to set a publ1c hearing for special
assessments for Westwind, Braun's Addit10n and Barthel Manor 2nd Adcht10n for
October 3rd at 8 ~ p m Donatus Vetsch seconded this mot10n All were m
favor and the motion carried
The State of Minnesota has declared that September 24th 1S Kid's Day in
Minnesota Don Chrnelius made a motion and Bob Braun seconded 1 t to declare
September 24th Kid's Day in Albertville All were m favor and the motion
carried
The 1ssue of weeds on lots throughout the C1 ty was raised agam The
Council was informed. that letters had been sent to the property owners and the
notices of weed removal were published in the Crow R1 ver News
Bob Braun made a motion to approve partial release of assessments for
II'llI t1ple fam1ly lots in Westwmd Donatus Vetsch seconded the mot10n All were
in favor and motion carried
A OOdget meeting was set for Thursday, September 9th at 6 30 p m
A question was brought up on the sewer accounts and why the year to date
variances were so great This will be discussed at the b.1dget meetlIlg

adJourn the meeting Bob Braun seconded the motion All were m favor and the
meeting adjourned
