The l"f'"..gular meeting of the Albertville City Council was called to order
by Mayor Loretta Roden Members present included Bob Braun. fun Corneliub.
and Gary Schwenzfe1er Council member funatus Vetsch was absent Others
present included Maureen Andrews. Bob Miller. Bob Sullentrop and Lor1e
V 11lareal Ken Lmdsay was absent
The agenda for the evening - s meetlIlg was rev1ewed by the Counc11 fun
Cornel1us made a motion and Gary Schwenzfeier seconded 1 t to approve the
agenda All were m favor and the mot10n carr1ed
The mmutes of September 19th were rev1ewed by the Council Hearl.Ilg no
add 1 t10ns or corrections. Don Cornelius made a mot10n to approve the mmutes
and Gary Schwenzfe1er seconded the mot1on All were m favor and the mot10n
carried
The Council then ccmnenced W1 th the b1d opening on the sale of the f1re
department - s eqU1pnent vehicle One bid was rece1 ved from DJ s in the amount
of $1502 00
After some discuss1on. Don Cornel1us made a mot10n to table the b1d on
the eqU1pnent veh1cle Hearmg some further cx::mnents statmg that the $1502 00
amount 1S what the Fire Department expected to get for the veh1cle. Don
Cornel1us withdrew h1s motion He then made an amended mot10n to accept the
b1d from DJ- s for $1502 00 pendmg the approval of the F1re Department Gary
Schwenzfe1er beconded the mot10n All were m favor and the mot10n carr1ed
A Jomt Power - s update was then heard by the Counc11 The COl.UlC11 was
1rlformed that the 1ssue of the cappmg of the wells had not yet been resolved
by the C1 ty of St M1chael so the matter 1S st111 pendmg
Jomt Power - s has requested that each C1 ty supply the Board W1 th a map or
set of plans showl.Ilg the eX1stmg and potent1al exparunon of water for the1r
use There was some discuss10n regardmg how the Engmeers would determme
the future expans10ns to the system since tllat depends on 1OO1v1dual
developers The Engmeers w111 update the existmg system map and supple 1 t
to Jomt Powers
The Counc11 was also informed that the past due water accounts had been
5ent notices and were informed that the amount would be assessed to the tax
roles 1f not pa1d
Ed DeMars and Rand Patton of the Albertv111e L10ns were present at the
meetmg to present to the Council the donation agreement for approx1mately
$32.~ 00 that the Lions want to turn over to the C1ty for a desl.gnated
p..lrpose The money w111 be p..lt into a spec1al savmgs account or a long term
investment It was pointed out that longer term accounts Y1eld a better
interest rate and smce the money would not be needed nght away that the
comlu ttee should be looklIlg at spec1a1 mvestments

In reviewing the agreement the Council found that 1t calls for the
mvestment/admm16tering COIIIDittee to be made up W1th three Lion members and
two appointed City representatives. who would be respons1ble for admin1sterrng
and allocating the donat1on
Gary Schwenzfe1er made a mot1on to accept the $32.319 43 from the L10ns
Club to be kept m a separate savings accotmt subject to the donation
agreement Bob Braun seconded this mot1on All were m favor and the motion
carried
St Albert's Par1sh is requesting a lJ.m1 ted 3 2 beer 11cense for the
O::tober 29th Halloween Dance Bob Braun made a mot1on and Gary Schwenzfe1er
seconded 1 t to approve the 3 2 beer license for the Halloween Dance on O::tober
29th pending application and payment All were m favor and the mot1on
carr1ed
The Counc11 was wormed that in add1 t10n to the b1d rece1 ved from
Federated Coop at the September 19th meeting. Ken had rece1Ved an add1t1onal
bid from DJ's for the installation of the heater for the bnlding out at the
Wastewater Treatment Facility. The bid from DJ's was for a 60 thousand BTU 110
volt heater for $975 0a compared to the quote from Federated for a 75 thousand
BTU 110 volt heater with a propane tank for $625 e0 Both b1ds mclud.e

After some add1 t10nal discussion Don Cornelius made a motion to accept
the b1d from Federated Coop for $625 0a completely 1n6talled w1th the
understanding that Ken will do the w1rrng Gary Schwenzfe1er seconded the
mot1on All were m favor and the mot1on carr1ed The Mamtenance Department
was instructed to have the heater installed right away to prevent the freezrng
of the chelll1cal alum
Mr Dav1d Wolff. representrng Barthel Construct1on, and Mr Skip
Sorenson, the arch1tect, were present to give to the Council an updated
presentation on the Barthel apartment complex The mmutes should note that
the residents of LaSalle Cu'Cle and Larabee Cu'Cle were also present to hear
the presentat10n by the developer' s representatives
Mr Sorenson explained that Fhase I of Pheasant Run w11l COns1st of two
12 un1t OO1ldrngs wh1ch will be OO11t on approxlJDately 2 1/2 acres and w1ll
include 24 unit detached garage structure It was explamed that these un1ts
w1l1 be o1milar to ones that have been 0011 t in fuffalo and Princeton.
Mr Sorenson also pointed out that parkmg w1l1 be prov1ded on a 2 to 1
rat10 (1 space, 1 garage) for each un1t The entrance to the development will
be located on Barthel Industrial Dr1ve at the mtersect10n of 52nd Street
The OOildrngs w11l be of a wood frame fireproof construct1on with 70% bemg
br1ck veneer There w11l be decorated cedar shmgle accents Each apartment
w111 have carpeting, no wax floors, oak cabinets and w111 rece1ve e1ther the
east or west sun exposure An a1r cond1 t10ner sleeve w111 be prov1ded OOt
there will be no de<'...ks or patios
Ameni t1es provided by Barthel w111 be a landscaped barbecue areas. a tot
lot geared for those ch1ldren 10 years and under and a basketball backstop for
the older ch11dren

The res1dents from Barthel Residential--fllase II were mformed that the
ent1re area will be sodded and landscaped Trees and b..1shes w1ll be planted
along the north. west and south property lines Boulevard trees w1ll be Norway
Maples Landscaping around the wildings and garages w1ll consist of crushed
rock and shrubs No fence has been proposed at th1S tl.D'le for a Wffer. just
trees However, the developer wants to be sens1t1ve to the res1dents needs if
a fence 1S what they would like to see used as a wffer then an attempt will
be made to th1S need
The util1 t1es will come m off of Barthel Industrial Drive and f1re
hydrants will be installed W1 thm a 150 foot radius of each w1ldmg The
dumpsters w1ll be screened with a fence 60 as not to be v1s1ble from the
smgle-family res1dences There will be exter10r lighting on the garages The
garages w1ll be 50 feet off the west property lme, 15 feet off the side
property lme and 40 feet off the front property lme
The ma,)or1 ty of the water will dram towards the street to the C1 ty stonn
water drain on the p.lblic right of way No water w1ll drain onto any adJommg
property
Some of the other 1ssues pointed out included
* That the layout of the two wildmgs would con61st of one 12 un1t
w1ldmg wh1ch will have 4 - 1 bedroom and 8 - 2 bedroom un1ts, and
the other wilding w1ll con61st of 4 - 3 bedroom and 8 - 2 bedroom
un1ts
* When questioned on who many people w1ll live m a complex of th16
S1ze the architect stated that typ1cally there 16 an average of 2 2
people per dwelling with about 12 to 15 ch1ldren l1Vmg m the
entire COIlIPlex
* I t was also pomted out that tradi t10nally there are between 1 6
cars per un1t on the hIgh s1de and 1 2 cars per un1t on the low
side
* Market rents will be between $400 and $525 per month wh1ch w1ll
mclude apartment. garage and heat Typ1cally. people rentmg these
apartments will have mcome lunits of between $16.800 and $24.~
A quest10n concemmg the water pressure was directed to the Counc1l by
the res1dents It appears that the pressure 1S not good in the Barthel
Res1dent1al-Phase II area The Ci ty ~ s Engineer remarked that there may be a
hJ.gh spot in the lme causing an a1r lock A rel1ef valva may need to be
1nBtalled tr.> imProve the pressure The Council noted that a problem l1ke this
should be d1rected to the Joint Power ~ s Water Board Let the mmutes show that
the Counc1l was qU1 te surprised that a problem like th1s existed
Another questioned raised was how would the apartment complex affect the
value of the residents ~ property? The res1dents feel that m an area of
$1021.~ homes, their property values w111 go down with the presence of
apartmento They do not understand why the developer is not phasmg down and

why they were never told what the zonlIlS in that area was when they bought
the1r lots They feel that there is plenty of land elsewhere (the Westwind
area. for mstance) and it would be m the best interest of the C1 ty to keep
the property values up
The City's Attorney COIIIDellted that it 1S not unOODlOOn to prov1de a
transitional zone of mlt1ple housl.llg between single-faul1ly and mdustr1a1
uses I t was also pointed out that the property ia currently zoned properly
for Il'UI t1ple fam1ly residential and has been since the orig1na1 plat was
presented to the City for adoption It was also pointed out that the plan
meets all the requlI'eI1lent so the City has no authority to turn down the
developer's proposal and he would never adv1se the Council to do 60
To the point made by the residents that the realtor told them that there
were going to be homes behllld them Bob went on to say that 1f Barthel
misrepresented. 1t 1S a civil matter for the residents to resolve ind1v1d.ually
and not a matter for the C1 ty
A representative of the residents went on to ask why they had not been
mformed as to what was being proposed for the property It was explamed
that there had been mention of it in the Crow River News when the proJect was
f1rst ment10ned and they were also informed that there had been no need for a
p.lbl1c hearmg. and that m fact the presentat10n was Just a courtesy call for
the Counc11's benef1t
A member of the Council expressed h1s concern that the res1dents were
perceiving that the project had not been handled properly It was pointed out
that everythmg about the apartment OOIIJPlex has been p.lt m the mmutes and
p.lblished m the paper - nothing has been kept undercover
Barthel's representative explained to the res1dents that the1r market
Stud1es showed that the area can now support rwlt1ple fam1ly housmg whereas 6
or 7 years ago it could not
The residents then requested a meeting W1 th the developer hl.D'J6elf 60 that
he could answer their questions I t was agreed that a meeting would be
scheduled and the issue was then tabled and the developer w111 be asked to
meet with representatives of the neighborhood for an informal disCU6610n
LeRoy Bernl.llg. manager of DJ' s Total Home Care Center. 1S requesting a
proposed 10 x 80, 40 foot h1gh, d1g1 tal lighted message S1gn that would hang
directly on the hnlding One existing sign would stay on the buildlrlg and one
other one would be taken off
The C1ty's Attorney will take a look at the dimens10ns to see how they
OOIIJPly with the C1 ty ordinances The 1ssue was tabled until the next meetmg
fun Sav1tsk1 has made a request to the C1ty to hook up to C1ty sewer He
w111 pay the $475 e0 hook up charge rot would hke to put the $6,750 f2t2J (which
is 75% of the improvement cost) assessed agamst the property on the
assessment role The Counc11 was informed that the owner had agreed to pay
this amount with interest over the period that the other parcels w111 be
assessed
Gary Schwenzfe1er made a motion and Bob Braun seconded it to approve Ihn
Savitsk1' s request to be able to pay m the same manner as a sPec1al
assessment All were in favor and the motion carried

The next i tern di6CUBsed by the Councl.l was a request by Bruce Batzer of
the Astech CorPOration to be paid for the sealcoat appl1cation that they
provl.ded for the C1 ty The issue ra1sed was that the contractor inadvertently
appl1ed to much material and was requesting that the Cl. ty p1ck up the coot of
h1s error. argument being that the City mspector was there and d1d p1ck up
the problem
There was dl.sCUBsion by the Engineer statl.Ilg that the error was m fact
the contractor' 5 rot that in an effort for them to pick up some of the coots
50% of the overrun was included m the pay request for Buffalo B1 tummous
Mr Batzer stated that by passing through the money to Buffalo B1tuminous that
they would be taking the1r cut as well and requested that the Cl.ty pay h1m
dl.rectly
After some additional d16CUBs10n the C1ty agreed to pay an additional
$1.417 80 for the sealcoating rot was not wl.lll.Ilg to front the entl.re cost of
the error made by the contractor Addl.tionally the Councl.I requested that
Meyer-Rohlm not charge the Cl.ty their percentage of cost overrun smce the
added expense d1d not add any additional work for the engmeer' s mspector
There was no other dl.6CUBsion regardl.Ilg thl.S matter Mr Batzer thanked
the Councl.I for 11.stenl.Ilg to hl.S sl.de of the story and respondl.ng to his
request The CounC1.l mformed Mr Batzer that they felt he had done a good Job
representing himself and h16 fUDl to the CounCl.I
The final pay request for fuffalo B1 tummous m the arnotmt of $11.362 32
was presented to the Counc1.1 by Bob Sullentrop This pay request mcludes the
50% due to the sub contractor for the sealcoatl.Ilg

An uPdate on the Savitskl. feasl.b111ty report was presented next Bob
Sullentrop stated that the costs are up somewhat from the f1.rst report because
legal and bondl.Ilg costs were added as was oversized sanl.tary sewer line,
makl.Ilg the total cost of the project $208,020 00 It was also pomted out
that because of the t1ml.ng of the project that there will be at least 19
montho of cap1.tall.zed mterest on the proJect because two bond payments wl.ll
have to be made before the C1ty will receive any money from the tax roles
Smce thl.S was an update of an earl1er feasl.bl.lity report there was
rather 11mited d16CUBsion on the report It was however pomted out that the
streets in the SaVl. tski project wl.II be mstalled Wl. th just Class 5 gravel
thl.S year
Bob Sullentrop explained that because of the timl.Ilg of the proJect the
blacktop wl.ll not be mstalled untl.l 1989 and that the provisl.on for a r1.ght
turn lane will not be completed until next year as well There was some
concern expre5sed by the Council that the turn lane should be mcluded thl.S
year if there l.6 gol.ng to be activity in the plat before next sprl.Ilg

feae.lbll1.ty study on the Sav1tski's Feaa1bility Report (1988-7) fun Cornel1us

Bob Braun made a mot1on and fun Cornelius seconded 1 t to dlrect the
engineero to order the plans and specs on the Savi tski project, WhlCh should
include a turn lane from C S A H 19 All were in favor and the motion
carr1ed
The next 1 tern d1scussed by the Council was when the d1 tch by the ra1lroad
tracks was cleaned out it appears that Memy may have went too far up on the
rIght of way and as a result some of the property owner's corner stakes are
missl.llg The minutes should note that the Cl ty w1II replace these stakes at no
expense to the owner, b..1t that 1t wlll not 11kely be unt11 cpring
Bob M1ller next reviewed with the Counc1I fmal Subdivls10n Ordmance,
entitled ORDINANCE 1988- ~J AN ORDINANCE RmULATIt13 THE SUBDIVISION OF LAND
AND IMPOSlt13 A PENALTY FOR THE VIOLATION THEREOF and the summary of the camEl
Bob explamed that a motlon was necessary to approve both the SUbd1v1slon
Regulat10ns Ordinance and the summary
Gary &mwenzfeler made a motion and Bob B!,9Ufi seconded 1 t to approve the
Subd1Vision Regulatlon Ordinance No 1988- 4 All were m favor and the
mot1on carr1ed J:bn Cornelius then made a motion to approve a summary of the
Subdivision Regulat10nB to be printed Bob Braun seconded the mot1on All were
in favor and the mot1on carried
The mcome received and the b11ls to be paid were rev1ewed by the
Counc1I There were no quest10ns or corrments 60 fun Cornellus made a mot1on
and Gary Schwenzfeier seconded it to approve the b11ls All were in favor and
checks 9039 through 9064 were pa1d
Maureen updated the Council on the lssue of off1ce furnl ture Dave Vetsch
could auld a con:u;uter counterspace area Wl th she I ves that would extend to the
ceill.llg for approximately $8f20 f20 This furniture would be constructed in such
a way that 1 t would be able to be taken apart and moved
The Counc1l advlsed Maureen to have Dave draw up some plans and specs for
their review
I t was brought to the Council's attention that the cost to lnBtall a
l1ght at the Hackenmueller corner would be $1, 188 50 The higher expense lS
because of the way the wire has to be run from the transformer After some
mmor d1.6CUSSlon. 1t was decided to table the lssue unt11 spring before dol.llg
anythl.llg positive about the installation
Maureen informed the Council that Bobby Heurl.llg has stopped by the City
Hall with a request to have his ditch that runs from County Road 19 to County
Dltch #9 cleaned out by the C1ty After some dlscusslon. the general concensus
of the Council was that because other farmers clean out the1r own ditch. the
Cl ty does not want to get involved in cleanl.llg out Mr Heurl.llg S
The lssue of weed removal on properties Wl thm the City came up agam for
discuss10n Property owners have been noticed mdiv1dually and through the
newspaper Now the Cl ty Jl1lSt decide what they are gol.llg to do

The Council was in IWtual agreement that the weed need to be cut down as
ooon as P08s1ble, therefore, they instructed the Maintenance Department to go
ahead and rent somethrng and make the weed d1sposal the1r f1rst pr10r1 ty The
minutes should note that the cost w1ll be assessed back to the owners
The C1 ty' s b..uldrng UlBpector was present to inform the Counc11 that the
sPeC1f1cat10ns s for the Westwind APartment have been approved and work w111
begm on Wednesday
M1ke Potter, representing the Park lbard, mformed. the Counc11 that he
had rece1Ved a b1d from Dennis Fehn on the gradrng of the 51st Street Park
There 1S 10,e0Z/ yards to move at a cost of $10,02l2J et2J Th1S 1S slightly hlgher
than ant1c1pated At th1s pomt, the C1ty has $4,e0Z/ et2J to spend on this
project M1ke pomted out that the Jaycees have 1nchcated an mterest m the
Park He 1S also gomg to talk to the Lions and see 1f they would 11ke to
offer the1r support
A queo t10n was ra1sed as to whether or not the work could be phased? In
answer, it was pointed out that all the grading has to get done before any of
the other work can be started Dennis Fehn has agreed to be somewhat flex1ble
on how he gets pa1d
In other b..tsmess, it was reported that the park b..ulding 1.S now

It was also pomted out that there has been dr1vmg occurring on the
d1kes agam as well as people are dump:mg garbage on Beaudry' s property agam
John-George, Inc approached the C1ty about the street SlgnS for
Westwmd They were told that the City orders and UlBtalls the oJ..gnS In turn,
the C1 ty will bill John-George for the number of SJ..gn. ordered and UlBtalled
Ken Barthel needs to be mformed that the tree mess on the empty lot on
Lannon Avenue st111 needs to be cleaned up
There 1S no money ava1lable for the retam:mg wall that needs to be put
up m Barthel Manor, 2nd Add1tion Barthel needs to be aware of the fact that
he is reqUll"ed to install this wall
