COUNCIL MINUTES MARCH 20, 1989 The regular meeting of the Albertville C.l ty Council was called to order by Mayor Gary Schwenzfe.ler Members present included Bob Braun, Don Cornelius, Donatus Vetsch and Jim Krystosek Others present mcluded Maureen Andrews, Lor.le V.lllareal and Bob Miller The agenda for the evem..ng' s meetrng was reviewed by the Counc.lI Donatus Vetsch made a motion to approve the agenda Don Cornelius seconded the mot.lon All were in favor and the mot.lon carr.led The minutes of the March 6th meetrng were rev.lewed by the Council HearJIJg no correct.lons or additions, Don Cornel.lus made a mot.lon to approve the mmutes of March 6th Jim Krystosek seconded the mot.lon All were m favor and the motion carried Harry and Edna Weber were present to hear the fmdrngs on the commuter parking lot and to formally request that the C SA. H 37 easement be vacated Maureen stated that she and Bob Miller attended the hearing the County Board held on Tuesday, March 14th m order to determine if the property in quest.lon should be turned back to the City for publ.lc purpose The Counc.lI was informed that the County d.ld agree to convey the street back to the C.l ty for road purposes therefore releasing the restrict10ns of a Park and Ride" lot This action will allow the City to undertake a street vacat10n proceeding in the future Mr and Mrs Weber informed the Council that they were makrng the request for street vacat10n for a couple reasons The first berng that there has been mtel't"'--Bt in 'OOying their lot contrngent on the ab1li ty to obtam the easement and the discontmued use of the land as a parkrng lot Secondly. they pomted out that the easement being used for the lot 1S not adequate m size so there 1S a continual problem W1 th cars wrapping around the corner. therefore parking in front of the private dr1ves along Lander Avenue And f1nally it was pointed out that there 1S a problem of the long haul trucks pullrng m and parkrng over m.ght with their refr1.gerat10n running It was noted that pr10r to any act.lon by the Counc11, the C1ty mlght want to look at potential sites for another Park and R1de lot The reasonrng for . . . this 1.S that without a defmed lot the C1. ty could have the commuters cars parked along the maJor right-of-ways malnng 1.t d1.ff1.c1..1It to plow snow in the wmter The Webers noted that 1.f the C1. ty agrees to vacate the property that they would agree to leave the current commuter lot as 1.S unt1.1 ouch time the land was sold or unt1.1 the C1. ty could find another area sui table for a Park and R1.de lot It was pointed out that the triangle spot on C S A H 's 19 and 37 1.S a P1.ece of property that could be of potential use for a park and r1.de lot (m the area of the Welcome to Albertv1.lle sign) It appears that th1.S property 1.S owned by fur lington Northern Railroad and the County Harry Weber mentioned that he bel1.eved that approxJ..Jnately 30 to 35 cars could be parked m the triangle and that by installing some Claso 5 gravel that the C1. ty could define the parking lot To th1.s Donatus commented that he did not look favorably on spending C1.ty mon1.es for improvl.ng a commuter lot It was then suggested that perhaps somethl.ng could be worked out to lease the property 1.f we fmd out what the feas1.bil1.ty of the costs would be Some thl.ngs to be done init1.ally on this 1.S to check W1.th the railroad and the County to see 1.f the property would even be available, determme how much Class 5 will be needed and check the drainage m that area A formal request was then made by Harry Weber, the adJoming property owner, to vacate the easement Donatus Vetsch made a motion to set a date for the publ1.c hearing pendl.ng the City's receivl.ng the conveyance of easement from the County Bob Braun seconded the motion All were in favor and the mot1.on carr1.ed The Council next heard an uPdate from the Maintenance Department Ken Lindsay was not at the meetl.ng, but he wanted the Council to know that there w1.ll be an evening meeting pertainl.ng to Gopher State One Call1.ng procedures, etc on Apr1.1 4th m St Cloud He would 11.ke to att..end th1.s meetl.ng prov1.dl.ng the Council has no object1.ons Don Cornelius noted that Ken had told hm that he wOlJ.ld not charge time and half for the evening meetl.ng, but would like to be reimbursed for mileage if he took h1.s own veh1.cle The Counc 1. I agreed that attending th1.S meetl.ng was benefic1.al and gave the1.r approval The Council was requested to start thinking about doing somethl.ng to prevent damage being done to the d1.kes at the Wastewater Treatment Fac1.lity As in the past there was disCU6s1.on regarding whether or not a guard rail system W1.th cable put up around the wastewater plant would probably be the best way to stop the problem It was noted that the use of barb wire would not be a good enOlJgh solut1.on as 1. t 's not protective enough and would be expens1. ve to move down from the tops of the dikes -2- . . . It was pomted out, however, that the Council hao not yet agreed for the C1.ty to do th1.S It was suggested that the organ1.zat1.ono could send a letter out to the C1. ty one week pr1.or to putting a oJ..gIl up 48 hours would then be g1. ven to take the SJ.gn down Ken w1.11 take the current SJ.gn down and put up a "Happy Easter" . The 1.ssue of the hand held rad1.os was then d1.scussed J 1m told the Counc1.1 that there were now new batter1.es m the battery packs and to change the crystals t..o the City's fre:quency would cost $9I2l, not $150 for all the radios Two other rad1.os, d1.fferent from these, could go on the oame fre:quency Jim also sa1.d that no problems were ant1.cipated m gettrng a couple of Jl1()re rad1.os to use during Friendly C1. ty Days Total cost for the hand held radios 1.S now $8W Radios $602l Fre:quency Change $ 9I2l Cabinet $ 60 Antennae $ 50 Total $800 At th1.S point, Gary brought up the fact that a good CB rad1.o would only cost between $100 and $125 Probably about $400 total for three CB's Gary said that corrm1Il1.cat1.0n l.S necessary and that perhaps CB' s would be another way to go $400 compared to $800 l.S quite a sav.lD,gS and something the Cl. ty needs to keep in mind as this l.ssue is st1.11 being questl.oned as whether or not it l.S a high priorl.ty or not Council action was needed at th1.S pomt, therefore, 1.t was agreed that Gary would check into the some d1.fferent brands and costs of CB' s to have for the next meeting The hand held rad1.os w1.11 be taken back They W1.11 be available should the C1.ty dec1.de they want them A Joint meetrng W1. th the Counc1.l, Plannrng Comm1.ss1.on and the Development Corporat1.on will be held on April 13th at 7 p.m the purpose of this meeting will be to reV1.ew and discuss the Cl.ty'S comprehens1.ve plan The Counc1.1 was reminded that the League of Mmnesota C1. t1.eo Legislat1. ve Conference w1.11 be March 29th m St Paul Maureen and P06sl.bly fun Comehus w1.11 be attending The Park Board mmutes were included in the packet for the Councl.I's reV1.ew -4- I t was brought to the CounCl.I' s attention that no prev1.OUS mot1.on had been made to accept Mike Potter' s res1.gllation from the Park Board Don Cornelius made the mot1.on and J l.m Krystosek seconded 1. t to accept MIke . Potter's resignation from the Park. Board effective March 3, 1989 Maureen informed the Counc1.1 that there were a number of l.ssues needing further disCU6sl.on Personnel Policy, Contract Garbage Haulmg, Recycling and Newsletter It was pomted out that the City needs to prioritize what issues Councl.I wants to deal with, what our goals are and what do we hope to accomplish goal this coming year A work meeting w1.11 be scheduled for this purpose Other 1. tem6 of interest There w1.11 be a meetmg m the Commun1. ty room at the &1.ffalo Courthouse on March 28th at 2 30 p m to dl.sCU6s the new tax law changes May, 1989 l.S Arbor Month We need to encourage the plantmg of trees The fate of the poplar trees 1.S st1.11 undetermmed Ron Becker dl.d not take down the trees for reasons of hl.s own There l.S going to be a meetmg for informatl.onal l.tems on the Sheriff's contract A work meetmg has been scheduled for 7 p m March 28th to dl.sCU6s the personnel poll.CY and other issues .
