1989-04-17 CC Minutes . . . COUNCIL MINUTES APRIL 17, 1989 The regular meet~ng of the Albertv~lle C~ty Counc~l was called to order by Mayor Gary Schwenzfeier Members present ~ncluded Bob Braun, Don Cornelius, Donatus Vetsch and Jim Krystosek Others present ~ncluded Maureen Andrews, Lor~e V~llareal, Bob M~ller, Thore Meyer, Bob Sullentrop and Ken L~ndsay The agenda for the even~ng-s meeting was reviewed by the Counc~l Don Cornelius made the mot~on and Donatus Vetsch seconded ~t to approve the agenda All were ~n favor and the motion carr~ed The minutes of Counc~l There were no a motion to approve the motion carr~ed the Apr~l 3rd meet~ng were reviewed by the add~tions or correction6 so Donatus Vetsch made the minutes of Apr~l 3rd All were in favor and The Counc~l heard from the Ma~ntenance Department f~rst Ken gave the Council an update on current proJects The crack sealing has been completed and the street sweeping is scheduled for Wednesday or Thursday of the week of April 17th Ken ~nformed the Council that because of dry condit~ons T&S Trucking had asked the C~ty to spray down the streets to keep the dust down Ken asked permiss~on from the Council to use the fire truck to spray down the streets before sweep~ng to elim~nate the dust, wh~ch was approved It was noted that the streets that were seal coated will be swept tw~ce to be sure that everything is gotten up off the streets Driving on the dikes at the Wastewater Treatment Facil~ty occurred again on Sunday night, April 9th Mike happened to be out at the ponds and seen this happen A deputy was called, however, the person was only charged with careless dr~v~ng Ken po~nted out that this was a good example of why someth~ng needs to be done to prevent damaging the dikes It was suggested by Ken that perhaps steel posts and 3 or 4 str~ngs of barb wire strung at ~ntervals would help Donatus expressed that he felt that there was really no need for two fences We should wa~t and move the ex~sting fence down the s~de of the dike at the t~me of an expans~on to the pond Don commented that barb w~re could be cut pretty eas~ly but a fence l~ke th~s would not be too expensive. . . . There was also come d1Scuss10n about how far off the road should the fence go and what 1S the speed 11m1t on that road No further act10n was taken at th1S t1me The Council next approved Ken's request to remove the grassy area along the north slde of the C1ty Hall bU11ding to make room for add1t1onal parking The area will be taken down 6 to 8 inches and leveled off and some Class 5 put down that gone fleet Replacement of the C1ty'S ma1ntenance veh1cle was d1scussed next A number of quotes were obta1ned for this purchase BUFFALO CHRYSLER Dodge truck - must be ordered $16,253 50 - 1ncludes plow $14,253 50 - pr1ce if $2.000 rebate is appl1cable MILLER CHEVROLET $14.991 97 - no plow - must be ordered, 2 month del1very - some questions on rebate ART. RIVER E.QlID $15,994 00 - 11ght duty w1th plow $16,990 00 - heavy duty w1th plow COUNTRY CHRYSLER $16,013 00 - 1ncludes electr1c plow $14,013 00 - price if $2,000 rebate 1S appl1cable SAXON MOTORS $14,666 00 - without plow, heavy duty, 3/4 ton $16,261 00 - with plow, heavy duty, 3/4 ton J1m presented a quote that he had obta1ned for a one ton truck had been ordered for a fleet but before del1very the company had bankrupt Therefore, the truck 1S ava11able Th1S truck has a discount $14,668 66 - w1thout plow $16.766 66 - w1th plow At this t1me is was decided that the matter would be d1scussed further at the end of the meet1ng -2- The Eng1neer1ng Department presented the Feasib1l1ty Study for 1989 Street Maintenance Bob Sullentrop went on to expla1n the report and what type of work will need to be ocheduled for the summer of 1989 to bring the C1ty in l1ne with the Street Maintenance program establ1shed 1n 1986 The follow1ng 1S a breakdown of the work be1ng proposed for the upcoming construct1on seaoon . Levellng courses to fll1 1n dlPS In the roadway are needed at the follow1ng locatlons All of the location6 would be where seal coatlng lS proposed except those on Barthel Industrlal Dr1ve * Barthel Industrial Drlve North of the rallroad tracks -- 3 locatlons * 54th Street between Maln Avenue and Barthel Dr1ve -- 4 locatlons * Large Avenue between 54th and 55th Street -- 1 locatlon * 51st Street between Lannon Avenue and Maln Street -- 2 locations PROPOSED STREET MAINTENANCE The streets proposed for sealcoatlng would f1rst have the level1ng coursed applled A llght seat coatlng of bitumlnous 011 followed by pea rock would then be applied to all streets except those street located in the lndu6trlal park which wlll receive granite ChlPS Once the streets have been completed and enough t1me has passed the loose rock will be swept and hauled away Replacement of the cross gutters would consist of removlng the eXlstlng cross gutters and the curb and radlus adJacent to them It was recommended that 6 foot gutters should replace the existing ones Reinforcement bar would be lncluded to add strength to the concrete ESTIMATED COST Sealcoating POlnt Repairs $40,835 00 3,775 00 $44,610 00 5,800 00 2,230 00 . TOTAL CONSTRUCTION ENGINEERING (13%) CONTINGENCIES (5%) TOTAL $52,640 00 The Feaslbllity Report also lncluded a serles of maps showlng the maintenance schedules of what was done ln 1988, the orlglnal schedule for the malntenance program and finally what was belng proposed for 1989 At thlS tlme the Councll questloned whether or not thlS work would brlng the Clty up to date on the street maintenance so that a regular schedule could be prepared and followed for future projects Bob noted that there were a couple other spots that had not been included because they were lower on the prlority llSt, but that they should be done in the next y~ar Additional discusslon also focused on the type of rock the report called for the sealcoatlng There was a request to have Meyer-Rohlin lnclude an alternate b1d ltem for red rock vs the pea rock It was the feeling of some of the Council that thlS 1S a better rock to be uSlng because there 1S not as much waste . -4- After come add~t~onal d~scuss~on it was agreed that Bob should prepare an addendum to the report for the Council to rev~ew It was noted that the costs prepared by Meyer-Rohl~n did not ~nclude the costs of f~nanc~ng the project These costs will be prov~ded by Juran and Moody at a later date for the Counc~l to review . A member of the Counc~l questioned how often seal coat~ng should be done It was pointed out that the optimum period to go between sealcoating is 3 years after the road has been ~n place 3 to 5 years There was Eng~neers could the Counc~l no other d~scuss~on so the top~c was tabled unt~l the put together the additional informat~on requested by There was an update on the dra~nage problem on the north side of 1-94 It appears that the drain tile is plugged up somewhere as the water ~s s~tting stagnate between the road and where ~t outlets ~nto the field The area ~mpacted by this drainage problem ~s rather &ubstant~al, runn~ng from the d~tch located behind the homes on 51th Street on the south of the railroad tracks, the swamp on the north s~de of the tracks, across the freeway, through Green Haven Est ~n Frankfort Township Bob po~nted out that the dra~n tile which appears to be causing the problems ~s located on pr~vate land so they were unable to ~nspect 1t There was some d~scuss~on about whether or not the State could get someth~ng done about the problem s~nce the water ~s stand~ng ~n the~r r~ght-of-way It was dec~ded that the State should be contacted by letter about the water that stands stagnate by the freeway Frankfort Townsh~p will be ~nformed that water ~s stand~ng stagnate and that dra~n t~les are not dra~ning the way they &hould be . It was brought to the Counc~lrs attent~on that the so~l bor~ng tests for the softball f~eld lights would be qu~te expens~ve A quote from Braun gave the cost at $1,350 for three holes The eng~neerr& felt that ~f steel posts are what the Jayce~s want, it would be cheaper to order longer posts and go deeper ~nto the ground Therefore, the soil bor~ng& were not ordered as the cOot ~& too expens~ve A comment was made that NSP usee f~berglass poles and mayb~ someth~ng l~ke that could be looked ~nto Bob told the Counc~l that a letter has been wr~tten to the man that they are dealing w~th on the water ma~n problem under the freeway Some k1nd of quote ~s being requested on the p~pe s~ze and the work that would be necessary No further action has been taken Bob M~ller ~nformed the Counc~l that the ordinance has been prepared chang~ng the days of not~ce on the sign ord~nance from fourteen to seven days The util~ty lo~ation ordinance and permit appl~cat~on have also been prepared . -5- Bob commented that the uti11ty compan1es are object1ng to be1ng charged fees and may request a pub11c hear1ng for be1ng charged these fees Only the City of Bloom1ngton chargee a $2 fee Bob adv1sed the Counc1l that th1s is not a money maker and the fees should be done away w1th . Before the Council cont1nued with the d1scuss10n on the ut1lity ord1nance 1t was suggested that the Council approve the amendment to the s1gn ord1nance At this p01nt, Bob Braun made a mot10n to approve ORDINANCE 1989-2, AN ORDINANCE FURTHER AMENDING ORDINANCE NO 1987-3 ENTITLED "AN ORDINANCE REGULATING ADVERTISING DEVICES (BILLBOARDS) AND BUSINESS SIGNS AND PROVIDING A PENALTY FOR VIOLATION THEREOF" BY AMENDING PROVISIONS FOR VIOLATION NOTICE TIME Don Cornelius seconded the mot1on All were 1n favor and the mot1on carried There was then further di5cuse1on on the meet1ng between the eng1neer, Ken and the ut1l1ty compan1es Aga1n, 1t was p01nted out that the ut1l1ty companies b1ggest argument was that they have to pay a franch1se fee and now have to pay an add1tional perm1t fee It was p01nted out that only the cable company 1S 0urrently paY1ng a franch1se fee at this time The uti11ty compan1es are also balk1ng at restoring the r1ght of way They all think that 1t adds to the costs Each ut1l1ty company thinks that they shouldn't be bothered because each one is tear1ng up and then hav1ng to repair Above all, they each want to be treated fa1rly Some add1t10nal opt1ons will be worked out before the meet1ng to see 1f a better solution can be found to the problem They d1d l1ke the 1dea of runn1ng the sewer and water back further on the easement, wh1ch would g1ve each of the companieD more room to do their work . It was dec1ded that perhaps 1t would be a good idea to ask the ut1l1ty compan1es to come to the May 15th Counc1l meet1ng so that they can express the1r fee11ngs to the Council Don ut1l1ty mot1on Cornelius then made a motion to have Maur~en not1fy the compan1es of the forthcom1ng meet1ng Bob Braun seconded the All were 1n favor and the mot1on carried The contract between Central M1nnesota Emergency Med1cal Serv1ces Council and the Albertville F1re Department was discussed Bob M1ller felt that this contract should run with the City or the F1remen's Re11ef Assoc1at10n and not w1th the Fire Department because the F1re Department is not an entity of its own and the language 1mposes certa1n restrict10ns and respons1b1lit1es upon the Fire Department The C1ty should and w1ll own the p1ece of equipment that the contract is dealing w1th and the contract should be s1gned by the City Bob regard1ng M1ddleton as well Miller said that he would look 1nto the contract 1ssue having 1t changed and Maureen was asked to check w1th Arlan at the 1nsurance agency to see 1f that was the1r consensus . -6- J1m Krystosek made a mot1on author1zing the Mayor and C1ty Adm1n16trator to sign thi6 contract pend1ng language change appropr1ateness Donatus Vetsch seconded th1s mot1on All were 1n favor and the mot1on carr1ed . Another 1ssue brought up 1S that the C1ty is g01ng to have to take a look at what to do about whether or not the Waste Water Treatment Ponds are b1g enough for the necessary water retent10n and discharge what w1th upcom1ng projects and development Th1s year there will be no problem but one to three years from now there may be some problems 1f development cont1nues The Council d1scussed aerat10n br1efly, wondering whether or not aerated ponds were better Also, perhaps Hord1s could be approached with some opt1on6 for water separat10n Bob Sullentrop and Ken w1ll some check1ng to see 1f the gates at the ponds have moved at all and w1ll do some cross check1ng to make sure th1ngs are work1ng the way that they should It was also brought up that water may be running into the sewer from people's sump pumps People are obv10usly not aware that sump pump water should not be g01ng 1nto the sewer system Notif1cat10n should be g1ven to this effect, possibly on the f1rst quarter sewer bil11ng An ord1nance 1S already 1n place on sump pump water but 1t would not hurt to check 1nto 1t to see 1f 1t spec1f1es where and what direct10n the water should flow 1f a sump pump 1S be1ng used . The 1ncome rece1ved and the b1lls to be pa1d were rev1ewed next by the Counc1l The minutes should note that check #9508 has been v01ded because this 1S a J01nt Powers b1ll Dakota Techn1cal Institute and the An1mal control bills were que6t10ned Donatus wondered whether or not we were exceeding our budget on the DJ's bill It seems so h1gh and he just wants to make sure that we are staying w1th1n our budget Maureen rep11ed that the bill 1S d1str1buted amongst the d1fferent departments accord1ng to what was purchased Don Cornelius then made a mot10n to approve the 1ncome rece1ved and the bills to be paid J1m Krystosek seconded the motion All were in favor and checks 9499 through 9525 were pa1d Maureen passed out bond sizing 1nformat10n on Psyk's 4th Addit10n, a John-George Inc proJect, and possible construct10n of mun1c1pal bU1ldings to the Counc1l for their reV1ew It was p01nted out that Brad Farnham would be at the work meeting on Tuesday, Apr1l 18th and would go through these schedules in more deta1l Park Board vacancies were d1scussed next The Counc1l was 1nformed that the C1ty has had four app11cants apply for the three seat and that they would need to reV1ew the cand1dates and make a decis10n on the potent1al members It was quest10ned how the Council wanted to handle the situat10n -- A joint 1nterv1ew with Council and Park Board members present or . -7- Just Counc1l It was the general consensus of the Counc1l that they would llke to review the appl1cat10ns and then make the necessary d1Scussion on what would be the be5t cour5e of act10n . The slgn the bU1ld1ng meet1ng perm1t 1nspector for Braun's - Hardwood Ponds was not back from so therefore it was not approved at th1S The Board of Review meeting lS scheduled for Tuesday, Apr1l 18th at 1 00 p m A work meeting lS scheduled for the Counc1l on Tuesday, Apr1l 18th at 1 30 p m It was brought to the Counc1l's attention that the Barthel slgns are down Film has been obtained for taking pictures of the eX1sting slgns within the C1ty There w1ll be a meeting on the 1990 Sheriff's contract on Tuesday, May 9th at 2 00 p m at the Buffalo Courthouse J1m Krystosek gave the Counc1l an update on the Fr1endly C1ty Day's meeting Issues highlighted at the meet1ng were where to put the power and what type and deciding on how many satellites and where they should be placed Other informat10n included the fact that the rides will be set up and ready for operation on Fr1day night Bus1ness Appreciat10n N1ght will be Saturday n1ght at the Par1sh Center lot . Jim commented that right now money seems to be the biggest problem A letter lS being written to all the bus1nesses asking them for donat10ns to the Friendly City Day's fund The Comm1ttee also asked whether or not the C1ty would be w1ll1ng to donate one or two thousand dollars to the fund R1ght now there lS no place 1n the budget to donate that kind of money It was p01nted out that 1t lS easier for the C1ty to pick up those expenses sim1liar to the day-to- day operations of the C1ty (l.e power, satellites, street clean1ng, garbage, etc) One last thing Jim brought up was that the Comm1ttee would llke the F1re Department to participate in Friendly City Day's Dave Vetsch w1ll be asked for the Fire Department's part1c1pat10n The next Fr1endly C1ty Day's meet1ng w1ll be Wednesday, Apr1l 19th at 1 30 p m A question was raised as to what can be done about garbage that i5 left lying around and not be1ng cleaned up Is 1t a publ1C nuisance? No action was taken on th1s matter A member of the Council brought to the Counc1l's attention that Corny Paulson had mentioned to h1m that the Gary Lovle1n dog could possibly be a dangerous dog It is a llcensed golden retr1ever and 1t is fenced in, but the dog appears to have a very v1cious nature There are a lot of small children in that area and a dog w1th th1S temperament could cause reason for alarm It was asked if there lS . someth1ng in our ordinance pertaining to dangerous dog5 Maureen -8- . . . stated that she wlll check w1th Patty Salzwedel on the contents of the ord1nance that she use5 The Sheriff'5 Report for March was lncluded ln the packet for the Councll's reVlew An artlcle on sign ordlnances from the Montlcello Tlmes was lncluded in the packet for the Counc11 to reVlew "Small Talk" was included ln the packet for the Council to read The Tax Increment Financlng Album 1S avallable to the Council for reVlew What to do about replacing the Clty'S maintenance vehicle was agaln dlscussed The Councll showed the1r 1nterest ln the possib111ty of be1ng able to purchase a 1 ton pickup truck for about the same pr1ce as a 3/4 ton truck After some addltional d1Scusslon it was agreed that the specifications should be changed to a 1 ton and quotes taken on this type of vehicle It wa5 noted that an attempt should be made to contact some of the dealershlps already contacted to 5ee what they might have avallable for the City to look at It was agreed that the C1ty should obta1n two quotes from two different firms on the same spec1fications before any action would be taken by the Council It was also noted that the speclfication5 5hould be prepared to lnclude a quote for a truck wlth a plow and one wlthout the plow Provided that one of the quotes comes ln under the $15,000 b1dding requirement, the Clty could than take action on the vehlcle Prov1ded information could be made available the Counc11 agreed to meet later in the week and take any necessary actlon on a veh1cle if one could be found There was no other business so a motion to adJourn the meetlng was made by Bob Braun and seconded by J1m Krystosek All were ln favor and meeting adjourned 'iY\~ '-i ~~ -9-
