1989-05-01 CC Minutes . . . COUNCIL MINUTES MAY 1, 1989 The regular meetlng of the Albertville City Council was called to order by Mayor Gary Schwenzfeier Members present included Bob Braun, Don Cornellus, Donatus Vetsch and Jim Krystosek Others present lncluded Maureen Andrews, Lorie Vlllareal, Thore Meyer, Bob Sullentrop and Ken Llndsay The agenda for the evenlng"s meetlng was revlewed by the Councl1 Don Cornellus made a motion and Jlm Krystosek seconded lt to approve the agenda All were in favor and the motlon carried The mlnutes of the April 17th meetlng Council A correction was made by Ken Lindsay 4, lt should state "staff gauges" and not "gates" moved to accept the mlnutes of April 17th Cornellus seconded the motlon All were in carried were revlewed by the On page 7. paragraph Donatus Vetsch then wlth correctlons Don favor and the motlon The Councll"s Bob Braun the motion mlnutes of the April 18th Board of Revlew meetlng and work meeting were revlewed Don Cornelius made a motlon seconded it to approve the mlnutes All were in favor carr led the and and The mlnutes of the Aprl1 20th speclal meetlng of the Councl1 was reviewed It was brought to attention that the statement "Separate Price For 8 Foot H D Plow" should be struck from the mlnutes Don Cornellus then made a motion to approve the mlnutes of Aprl1 20th wlth corrections Jlm Krystosek seconded the motion All were ln favor and the motion carried The Albertvllle Area Jaycees are requestlng a 3 2 beer 11cense for the 1989 softball season and for the Frlendly Clty Day"s tournament There was some discusslon regardlng what the cost has been in past years and Maureen stated that she thought that the total licence package ran a total of $125, but would check to be sure Donatus . . . Vetsch made a mot1on and Don Cornelius seconded 1t to approve the 3 2 beer 11cense for the Jaycees pending confirmation of fee charge, appl1cat1on, 1nsurance and payment All were 1n favor and the mot1on carried The Council next heard from the Ma1ntenance Department Before gett1ng into any ma1ntenance updates, Ken thanked the City and the Counc11 for purchas1ng the new truck He is pleased with it and has heard many favorable comments from the re51dents of Albertv11le The sale of the old p1ckup was discussed For the t1me being, the truck will be stored and used ~ for emergency purposes For 1nstance, 1f the h01st needed to be used at the Waste Water Treatment Fac1lity The new truck will be the only one used for C1ty ma1ntenance It was agreed that the C1ty would need to th1nk about how to go about making a mount for the hoist to pull behind the pickup No further action was taken The catch bas1n by 55th and Large Avenue is caved 1n The curb has sunk down and the blacktop has caved in caus1ng dirt and gravel to accumulate in the basin Ken hac requested that th1s be put on the project 11st to repair It was noted that there 1S no warranty left on th1s curb Also, 1t was suggested that 1t would be a good 1dea to check and see how many other curbs in the C1ty are s1nking There was some discussion that curbs can be fixed by mudJacking or pos51bly by pressure Jack1ng, although the latter method 1S a more expensive procedure The sidewalk by the school is buckl1ng and could prove to be dangerous for people walk1ng S1nce the sidewalk 1S 1n the r1ght of way, the C1ty is responsible for repairing the damages Some issues regarding the new pickup were discussed We got the jack but no spare tire with the truck It was suggested look1ng 1nto f1nding out what the cost of a good used rim and t1re would be versus a new one Jim sa1d that he would check w1th the dealersh1p to see if they have a tire and rim around that would fit the truck The letter1ng for the sign on the doors of the p1ckup need to be done Ken would like to have CITY OF ALBERTVILLE MAINTENANCE DEPARTMENT done 1n silver lettering Two quotes were presented FRANKLIN SIGNS - Albertville - $100 BOB PEDERSON SIGNS - St Michael - $60 The Council felt that we need just the CITY OF ALBERTVILLE lettered on the truck Donatus expressed h1s feel1ngs that the C1ty should continue w1th Frankl1n S1gns There 1S some obl1gat1on there -2- . . . s1nce Ke1th has helped the C1ty out w1th the use of the boom truck, etc It was agreed that Ken and Don would talk to Ke1th about the letter1ng The cost should be limited to or less than the obta1ned quote It appears water is turned Some damage has repa1red that the park bathrooms are be1ng used before the on for the season resulting 1n a mess to clean up also been done to the k1tchen which w111 have to be Ken asked whether or not the locks can be changed every season or should we put a padlock on the doors at the end of the season There was discussion that 1t would cost at least $50 to change locks and make up extra keys No keys would be given out before the season opens and keys would have have to be replaced annually After some addit10nal discussion, 1t was agreed that instead of changing the locks on an annual bas1s. it would be more cost effect1ve to put a padlock on the doors at the end of the season when the w1nter preparation work has been completed and remove them in the spr1ng once the facility has been prepared for summer use Storage rental for the dump truck was diocussed next The dump truck will be stored at Loren Becker's for $20 a month Donatus w111 check w1th Loren about storing the old p1ckup along w1th the dump truck and how much more that will cost The dump truck 1S 1n need of repa1r The problem 1S w1th the power steer1ng cy11nder 1t is leak1ng real bad Ken checked w1th Don'o Auto and was told that the cy11nder can't be repaired It would have to be replaced with a new one at a cost of $500 At thio p01nt, Jim Krystosek mentioned that Ken should call Joe at Custom Motoro in Elk R1ver and get an op1nion from h1m No further act10n was taken F111ing in around the old plant at the Waste Water Treatment Facility was discussed next The front and the one s1de are f111ed in already The other side and the back need to be filled 1n so as to reassure that the old plant w111 be safe Ken 1nformed the Counc11 that he had talked to Denn1s Fehn and the C1ty can get the f111 for the cost of hauling 1t in from other 10cat10ns No act10n was taken on this matter Ken told the Council that he had gotten the costs for add1t10nal gravel for the d1kes that 1S needed to complete the 1988 proJect The cost will be $5 a yard. 425 yards for a total of $2.125 This cost 1ncludes the gravel be1ng delivered and spread and compacted down to 4 1nches thick The general consensus of the Council was to get the work completed w1th1n the next month At this point. Jim Krystosek made a mot1on to approve the -3- . . . add1tional gravel for the dikes at $5 a yard, 425 yards, total1ng $2,125 Don Cornelius seconded the motion All were 1n favor and the motion carr led The Council was 1nformed Treatment Facillty began today limlts on everything which is very be1ng necessary Ken noted that because of the weather that dlscharglng at the Waste Water (May 1) Samples came back with low good as it results 1n no treatment dlscharg1ng was a 11ttle behlnd The Council heard next from the Englneerlng Department Bob reported that there was some question about uS1ng red rock for the street sealcoatlng He is checking on a 3/8 washed red rock with a company ln Shakopee There appears to be some concern about the size Also, we w111 have to use twice as much oil for sealcoat1ng with that size red rock Addltlonal checking on cOot wl11 be done before any spec1fications are prepared There was an update on the dralnage problem on the north slde of I-94 MNDOT was contacted and stated that they were aware of the problem. but feel that lt 1S not the1rs They stated that they had determined that the problem is further down the 11ne The Councl1 was 1nformed that Frankfort Township has been notifled and they will br1ng the matter up at thelr next meet1ng There was a made of concrete problems It was affected comment made that the draln t11e be1ng affected lS and that posslbly, road constructlon has caused the noted that M1ke Potter's property lS also be1ng Bob next told the Counc11 some lnformation regardlng Protox The Pollution Control Agency knows the company They have acted as a consultant to gao statlons when they have ground contamlnat10n due to a leak in their underground storage tanks In the past, Protox has been allowed to haul the contaminated soils to asphalt plants where 1t was used in the asphalt production process Accord1ng to PCA, regulatlons are belng changed and the vapors w111 now need to be burned off before lt is reused The PCA has stated that Protox is a rel1able corporation with not too much to worry about The work will probably be seasonal and the company probably wl11 not employ many employees The City would get some increased taxes Protox wl11 have to obtaln PCA permits for all three dlv1s10ns There wao some mixed feelings amongst the Counc11 J1m Krystosek stated that he d1d not 11ke the 1dea of oppos1ng the1r possible relocat1on but that the C1ty w111 not move forward on th1s unt11 more 1nformation 1S rece1ved from them We need to know more of who they are and what they are A Hardwood by the w111 be gravel construction update has the curb and gutter be1ng done at Pond the f1rst week in May Savitsk1's proJect could be done end of the week The Counc11 was reminded that 52nd Street paved this month and Savitski's project w111 get only Class 5 The memo to the util1ty compan1es regard1ng the restorat1on of the easement wao reviewed by the City's attorney Bob seemed to th1nk that the obl1gation should be taken out of the City's contract and left w1th the developer to worry about Espec1ally S1nce there 1S usually a number of empty lots, etc The perm1t w111 deal w1th everything else The Council reviewed the declarat10n r~garding the publ1c san1tary sewer connect1on and waiver of damages on a house bU1lt by Psyk Construct1on Because the lots are really low, the sewer 11ne 1S shallow The line will flow but 1t 1S below standard Mr Psyk agreed to having an agreement drawn up that would protect the City and the maintenance people This agreement would be s1gned by himself and would also be signed by a potential owner, 1n the event that the home 1S sold before the agreement io signed No certificate of occupancy will be 1ssued unt11 the agreement 1S signed The minutes should note that, 1f 1t proves to be necessary, the line can be cleaned once or tW1ce a year It was brought to Maureen's attent10n that water appears to st111 be runn1ng at the PPM build1ng The pond seems to be too full of water for a bU1lding that 1S empty There was some quest10n as to whether or not there would be a crack 1n the water line somewhere and 1f the water was ever turned off 1n that build1ng It was check 1t out decided to call Linda at J01nt Power's and have Mun1tech Perhaps a chlorine test could be done on the d1tch Darkenwald's are requesting a reduct10n 1n the letter of cred1t on the Westw1nd plat The inspection of the s1te needs to be done f1rst Maureen and Thore Meyer will do the inspection but it needs to be decided if there 1S a prescr1bed way of check1ng things out or of d01ng 1nspections such as th1s The C1ty has up to 45 days but it needs to be done as soon as poss1ble. -5- . . . The would be re1mburse the tests Jaycees were 1nformed what the cost of the soil boring tests and want them done regardless of the expense They w111 the C1ty Therefore, Meyer-Roh11n has ordered Braun to do as soon as poss1ble The income rece1ved and the bills to be paid were rev1ewed by the Council There was a question on the Pommer Company b111 wh1ch was the plaque for M1ke Potter from the Park Board and the Saxon Motors b111 for $906 87 wh1ch was for the tax and 11cense on the new truck Hearing no other quest10ns, Bob Braun made a motion and Donatus Vetsch seconded 1t to approve the income rece1ved and the b111s to be paid All were 1n favor and checks 9526 through 9560 were pa1d The d1scussion next went to a poss1ble new ord1nance regarding extended parking on City streets Do we want to ticket dr1veable veh1clec that have been parked longer than 48 hours on C1ty streets? The tires will have to be marked 1n order to determ1ne 1f they have been moved h111 1sn't can't Don Corne11us made ment10n that there 1S a truck parked on the of 51st Street wh1ch could conce1vably cause some problems 1f 1t moved He w111 talk to whomever owns the truck and ask 1f they get 1t moved It was also adv1sed that the C1ty needs some radar on C1ty streets The cross streets, 51st, 55th 57th and Ma1n Avenue need to be watched - espec1ally during the early morning and the end of the work day hours Many people are driv1ng way too fast on these part1cular streets Maure~n will check with the Sheriff's department to set this up We also need to follow up with MNDOT on the 30 m p h s1gns for Ma1n Avenue Approval of the new Park Board members was next on the agenda Don Cornelius made a mot10n to app01nt L1sa Shulstad and Paul He1nen to a 2 year term and Jill Merges and Steve Klitzka to a 1 year term commenc1ng May 1, 1989 J1m Krystosek seconded the mot10n At th1s point, Don amended h1s motion to state that these members would be up for reV1ew at the end of the1r term All were in favor and the mot10n carried The m1nutes should note that the Counc1l was very 1mpressed w1th the 1nterv1ews of the new members The m1nutes should also note that Ed Hackenmueller has now moved to St Michael The Council felt that since there were enough res1dents interested 1n serv1ng on the Board that the commun1ty m1ght be critical of apP01nting a nonresident In the future, the Council can use their discretion about using nonres1dents as members -6- . . . All were ln favor and the motlon carr led The mlnutes should note that Bob Braun abstained from votlng A work meetlng has been tentatively scheduled for Monday, May 8th at 7 00 p m This will be conflrmed wlth the Council members The letter to Arlyn Nelson regarding community growth in the City of Albertvl11e was lncluded ln the packet for the Councl1's review This letter will be sent to Ms Nelson along wlth the Comprehenslve Plan, Zoning and Subdivlsion Regulations There was some mlnor garbage haullng and reCYCllng needs to be ln place by perhaps the organlzatlons toward5 the purchase of Otherwise, they may be certiflcate dlScusslon about coordinatlng contract in the Clty Some sort of recycllng plan the 15th of May It was suggested that could be approached about donatlng money contalners to be used for the recycllng able to be purchased through an equlpment A questlon was brought up as to whether or not there lS an ordlnance about garbage left lying around ThlS lS deflnitely a nuisance, Maureen wl11 check wlth Bob Ml11er on th15 Jlm Krystosek gave the Councl1 an update on Friendly Clty Days. A letter was made up and sent to the bU51nesses asking for cash and prlze donations There has been some good response to the letter and the Commlttee now feels more comfortable There wl11 be a meetlng May 9th, 23rd, and 30th One more wl11 be held lf need be The Mayor thanked Jlm Krystosek for dOlng all the foot work on the purchase of the new Clty truck There was no other business so Donatus Vetsch made a motlon to adJourn the meeting Jim Krystosek seconded the motlon.
