1989-06-05 CC Minutes . . . COUNCIL MINUTES JDNE 5, 1989 The regular meet1ng of the Albertv111e C1ty Council was called to order by Mayor Gary Schwenzfe1er Members present 1ncluded Bob Braun, Don Cornel1us, Donatus Vetsch and J1m Krystosek Others present included Maureen Andrewsi Lorie V111areal~ Bob Miller, Thore Meyer, Bob Sullentrop, Bill Corre 1, Bob Merr111 ana Ken L1ndsay The agenda for the even1ng's meet1ng was reviewed by the Counc11 Donatus Vetsch made a motion and Don Cornel1us seconded 1t ~o approve the agenda All were 1n favor and the mot10n carried The m1nutes of the May 15th meet1ng were rev1ewed by the Council There were no corrections or additions so a motion was made by Don Cornel1us to approve the m1nutes of May 15th Donatus Vetsch seconded the motion All were in favor and the motion carr1ed. Sgt B111 Correll and Deputy Bob Merrill from the Wright County Sher1ff's De~artment were present at the meeting to update the Council on the traff1c survey done on 57th Street 1n the C1ty of Albertv111e Deputy Merrill reported that speed checks were done on June 1st] 2nd and 5th on the eastbound and westbound traff1c on 57th Stree~ dur1ng the early morn1ng hours and the late afternoon hours of the work week He found that there 1S no speed problem on th1S street - all speeds were under 30 m p h and the average speed was 20-22 m p h It would be the same effect on 55th Street Deputy Merr111 stated that putt1ng 1n stop slgns would aggravate the problem and possibly create more problems He said that the res1dents should get use to the traff1c on the through streets Sergeant Correll p01nted out that the average speed on Ma1n Avenue is 33 m p h The speed limit is 30 m E h if not posted with1n the C1ty unless there 1S not enough houses For 1nstance, Just beyond the school on Ma1n Avenue the speed zone is 40 m p h He also stated that the State w111 not approve any 30 m p h zone unless the C1ty takes over A 30 zone on short streets 11ke Lake or Lannon may 1ndeed look too fast A stop sign tends to slow somebody down, creates a rlght-of-way situation and determines control Yield signs on these streets wl1l create more confuslon There was some dlScussion that an lnventory of slgns wlthln the Clty should be done. There could be a 11abl1ity that signs may be posted ln one area and not ln others A member of the Councl1 also sald that perhaEs a 11ttle more exposure time wl11 slow up the trafflc Deputy Merrl11 agreed to do some speed checks on 55th Street as a comparison No further action wao taken on th1S issue The Councl1 thanked Sergeant Correll and Deputy Merrl11 for thelr tlme before they left the meetlng The Councl1 next heard a Joint Power's update Joint Power's is going ahead wlth the clean up and maintenance on the well The pump has been gone over and needs to be replaced It will cOot more to replace but lt is necessary . . . The Malntenance Department was heard from next Ken reEorted that there was a sewer llne plug up on Maln Avenue the week of Memorlal Day The llne was plugged good wlth paper products - probably dlaEers However very little grease was found ln the llne A member of the Councli que5tioned why the City did not experlence these kinds of problems for 15 to 20 years when the lines were flushed on an annual basis and now we have trouble 3 to 4 tlmes a year He was told that flushlng lS not recommended anymore and that there are two possible reason5 that there are problems wlth the line the flrst belng that the llnes are more than llkely gettlng pretty old and secondly the lines are being more fully utillzed Ken next ralsed his concern about the lnstallation of trash containers alon~ Maln Avenue and other potentlal areas Ken brought to the Council s attentlon that four years a~o the Councll said "No" to any kind of trash contalners located wlthln the Clty It was felt that they would end up more of a nuisance than anythlng else The contalners would end up disappearlng and people would be using them for di5Po5al of their own garbage The Clty would stlll like to look into two permanent mount attractive containers to be positioned on Maln Avenue The openlng could be kept small enough to prevent large amounts of trash being stuffed lnto the containers No other actlon was taken at this tlme The Councll was told that the ponds are ready for dlscharge The alum percentage lS at 1 58 The ponds will be treated on Tuesday and dlscharge will begin on Frlday Ken told the Council that someone has mowed down the 51st Street park area and now want5 to bale what was cut down It was also pointed out that the mustard weed is extremely bad ln the park Ken lnformed the Council that Mlke Rutkowskl had given him verbal notice of his resignation Ken has reque5ted the reslgnatlon be put ln writlng Mlke has been offered another Job that pays more money and will be leaving at the end of the week Ken 5tated that Mike is an excellent worker and has excellent quallty ln hlS work That klnd of quality is not always found in employees Ken would like to see Mlke stay on and would like to request that the Councll offer a counter offer Mlke has real mixed feellngS about leaving this posltion but can't turn down the money on the Job offered to him In answer to thlS request, Ken was told that the money lS not in the budget at this point and that it would take a healthr increase to get Mlke to stay Also, thls same type of thing wlll only keep hap~enlng More money can not be offered Just because he is quitting. Besldes, it is not a good tlme of the year to qUlt A member of the Council then pointed out that lf a raise for Mike lS considered, an lncrease ln Lorie's salary must also be looked at D1Scussion brought up the lssue as to whether or not lt would be feaslble to allow Mike to take a leave of absence untll August 1st to see if he llkes thlS other posltion Mlke wlll also be wllllng to check the pumps on weekends until someone is hlred full tlme The representative from the MEED program will be contacted The position will have to be replaced for the duratlon of the el~hteen month agreement or the Clty wlll lose the relmbursement There wlll be no addltional MEED money on the filling of thlS posltion No further action was taken at thls time untll after Ken contacted Mike to see if he wanted to talk with the Council later th8t evening The Councll then went on the Engineering Department -2- Bob Sullentrop gave an u~date on proJects In Braun's Addit~on, Denn~s Fehn will do the shaplng of the Class 5 The flnal tolerance before paving wl11 be done next week as ~t has been too wet th~s week In Savitskl'S project a lot of water lS standing and not drYlng up the way it should. The tests on the pack did not work because it was way too wet and will have to be redone If geotech ~s u5ed (at $2 00 a square yard) it will be at the Clty's expense Latour has put down the Class 5 on the right turn lane but no tests for comparison have been done on the sub-ba5e It w~ll have to be taken out and redone if lt does not pass test requirements Almost all of Westwind has now been paved w~th the second 11ft Only a small portion ~s left to do Bob ~nformed the Councl1 that he has a pay request from Latour ConstructlQn for the curb work done on Braun's Addltion for $8,600 73. Don Cornelius made a mot~on and Jim Krystosek 5econded lt to ap~rove the pay request for Latour ~onstruction All were ln favor and the mot~on carried Bob also ~nformed the Council that he was wlthhold~ng the pay request from Latour on Savitski's because the work i5 not done A call for the Feasibility Report for water in5tallation ~n the I-94 cas~ng was made next Bob Braun made a mot~on to order all in one report, the Feas~bility Report for water installation ~n the I-94 caslng and to make sewer and water aval1able to the Swanson and Emma Krumbie projects Don Cornellus seconded the motion All were in favor and the motlon carr~ed There w~ll be two optlons ln laYlng out the Park and Rlde lot It can either be laid out flush with the railroad or flush with County Road #37 Almost the same amount of cars will flt ~n each layout The ra~lroad layout ~s preferred as we would not have to touch the C~ty s~gn There w~ll be the costs of posts and cable and Class 5 Jlm Krystosek made a motlon to order the Feaslb~l~ty Report for the Park and Ride lot Bob Braun seconded the motion All were in favor and the motion carrled Don Cornel~us made a motion to approve the Resolut~on call~n~ for the PubllC Hearlng for Street Improvements ~n Psyk's 4th Addlt~on (1989-1) on June 28th at 7 p m (The hearing on Barthel's apartment building is also this same date) Bob Braun 5econded the motion All were ~n favor and the motion carr~ed Donatus Vetsch made a motlon and Don Cornellus seconded ~t to approve the Resolution calling for the Publ~c Hearing for Street Maintenance Improvements (1989-2) on June 28th at 7 p m All were ~n favor and the motion carrled Bob Braun made a motion to a~prove the Resolution calling for the Public Hearlng to authorize the F~nallzat~on of the Storm Water Taxlng Plan, Time Schedule and Meetings with the Property Owners Impacted by Plan on July 17th at 7 p m Don Cornellus seconded th~s motlon All were in favor and the motion carried At this point in the meetlngh Ken ~nformed the Counc~l that M~ke sald No" to talking wlth the vounc~l He lS taking the other job ad will be put in the Crow River News to run for two w~ek5 aSKlng full tlme help at a start~ng rate of $5 50 per hour Ken wl11 look some part time help until someone full tlme lS h~red . . has An for for Bob M~ller then told the Council that a number of ord~nances needed formal approval . -3- . . . Don Cornelius made a motlon to approve Ordlnance 1989-7 AN ORDINANCE REGULATING EXCAVATIONS AND CONSTRUCTIONS ON PUBLIC LAND AND EASEMENTS, PROVIDING FOR PERMITS AND PROVIDING PENALTY FOR VIOLATION THEREOF Jlm Krystosek seconded the motlon All were ln favor and the motlon carr led Donatus Vetsch made a motlon and Don Cornellus seconded lt to approve Ordinance 1989-8 AN ORDINANCE PROHIBITING PUBLIC NUISANCES~ UNWHOLESOME AND UNHEALTHY LITTER, AND PROVIDING A PENALTY FO~ VIOLATIONS THEREOF All were ln favor and the motlon carr led Don Cornellus made a motlon to approve Ordinance 1989-9 AN ORDINANCE ADOPTING THE UNIFORM FIRE CODE PROVIDING FOR ITS ADMINISTRATION AND ENFORCEMENT AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF Bob Braun seconded the motlon All were ln favor and the motion carried Don Corneliu5 made a motlon and Jlm Krystosek seconded lt to approve Ordlnance 1989-10 AN ORDINANCE AMENDING ORDINANCE 1988-88~ ENTITLED AN ORDINANCE RELATING TO SUBDIVISION REGULATIONS" Br REQUIRING HOUSE SERVICES INTO LOTS AND REQUIRING BOULEVARD SOD AND GRASS All were ln favor and the motion carr led Jlm KrY5tosek made a motlon to schedule a PubllG Hearlng for the Vacatlon of Rlght of Way Adjacent to the Harry Weber Property at the Inter5ection 0f Main Avenue and County Road 37 on July 11th at 7 p m Bob Braun seconded the motlon All were in favor and the motlon carr led There wa5 d15cu5s1on on July 3rd's Councl1 meetlng next Because thlS date falls before the 4th of July hollday, lt was agreed that the July 3rd meetlng would be cancelled and re5cheduled for July 11th at 7 p m It lS anticipated that this wll1 be Just a short meeting The Councl1 next heard from Steve Klltzka to announce the Wlnner of the Name the Park contest and Park Board update Steve told the Council that the name 5elected for the park was "Four Seasons Park" submltted by Carolyn Llndsay "Hlllcre5t" was also 0onsld~red as a second option The Park Board did not feel that naming the park after a certaln lndlvldual was approprlate The prlze of a $100 U S Savlngs Bond wll1 be awarded durlng the Friendly City Days celebratlon Playground equipment need5 to ordered a5 soon as possible Steve wll1 be talking to the Llon's and the Jaycees to see lf they will help with the funding of the equipment The income received and the bills to be pald were reviewed by the Councl1 Income from Wrlght Tltle and the Royal Tlre and Menth Sod bills were questioned After having recelved satlsfactory answers, Donatus Vetsch made a motion and Don Cornellus seconded lt to approve the income recelved and the bills to be pald All were ln favor and checks 9594 through 9646 were pald Maureen brought to the Councll's attention that the contract garbage haullng case in Henne~in County was settled A work meeting now needs to be scheduled to dlSCUSS contract garbage haullng ln the City of Albertvllle A meetlng will need to be scheduled wlth the Fire Department and appointment of a bUllding commlttee task force done A meetlng wlth Frankfort Townshlp regardlng the dralnage problem wll1 also need to be scheduled -4- Maureen told the Council that Bertha Paulson had asked that the Council ap~rove the add1t10n of park development and ch1ld abuse to the Commun1ty Chest 11st for donat10ns People want to see some of the1r money spent locally Donatus Vetsch made a motion and Bob Braun seconded 1t to approve the add1t10n of 2ark development and ch1ld abuse to the Commun1ty Chest All were 1n favor and the mot10n carried Don Cornel1us made a mot10n to set a Public Hear1ng on the Barthel Pheasant R1dge apartment building for June 28th at 7 p m J1m KrY6tosek seconded the mot10n All were 1n favor and the motion carried It was brought to the Counc1l's attent10n that 1t would be good to eetablish a check 11st of who is responsible for what when it GOme6 to inspect1ng s1te plans on s1ngle fam1ly homes and large dwel11ngs such a6 apartment build1ngs The bU1ld1ng 1nspector always does the checking but having a check list would indeed be helpful at times There was an update on Fr1endly C1ty Day's Schumm's Electric estimated the cost of the electr1cal work to be done at $946 This does not 1nclude NSP's costs wh1ch w111 br1ng the cost to well over a '1,000 It was suggested that maybe a generator would be a better 1nvestment for the C1ty to make at th1s t1me We would have to make sure 1t is b1g enough and powerful enough for the needed power It was the general consensus of the Counc11 to proceed w1th checking 1nto the costs of rent1ng a generator for Fr1endly C1ty Day's and then procur1ng 1t for the days necessary The Wr1ght County Sher1ff's report for Apr11 was 1ncluded 1n the packet for the Council's review The comp1lat10n of statement and schedules for January and February were 1ncluded 1n the packet for the Counc1l's reV1ew There was no other comments or bus1ness so Don Corne11us made a . mot10n to adJourn the meet1n~ Th1s was seconded by Bob Braun All were in favor and the meet1ng adJourned . . ~~ -5-
