COUNCIL MINUTES
JULY 11, 1989
The regular meeting of the Albertvllle City Councll was called to order
by Mayor Gary Schwenzfeier Members present mcluded Bob Braun, ]x.>natus Vetsch
and J1m Krystosek Council member fun Cornelll.lS was absent Others present
included Maureen Andrews, Lorle Vlllareal, Bob Mlller, Bob Sullentrop and Ken
Lmdsay
The agenda for the evenlllg' s meetlllg was revlewed by the Councll A
motlon was made by Bob Braun and seconded by J 1m Krystosek to approve the
agenda All were m favor and the motlon carrled
The mmutes of the June 19th meeting were revlewed by the Councll A
correction on page 5, Paragraph 2 was made by Bob Sullentrop The sentence
corrected should have sald "It passed the denclty test but not the roll test'
Hearing no other correctlons or add 1 tlons, funatus Vetsch made a motion and
Bob Braun seconded 1 t to approve the mmutes of June 19th All were ln favor
and the motion carrled
The mmutes of the June 28th special meetmg were revlewed by the
Colmcll A motlon wao made by J1m Krystosek and seconded by funatus Vetsch to
approve the mmutes All were m favor and the motlon Garrled
Mr Ken Tlernan and two repreoentatlves of the Albertvllle Queen
Comlu ttee were preoent at the meetlllg along Wl th two of the 1989 M1So
Albertvllle Royalty Queen Lorl Barthel and Prmceos Jade Holland presented to
the Albertvllle Cl ty Councll and the Cl ty of Albertvllle a trophy award that
was won by the Albertvllle Royalty'o float m the St Francls parade Thlo 10
one of the 20 Parades the Royalty rldes m each year The trophy wlll be on
display at Clty Hall
The Councll then went on to the matter of the publlC hearlllgo scheduled
for thlS partlcular evenlllg
A motlon was made by funatus Vetoch to call the PubllC Hearlllg to order
for the Vacation of Right-of-Way for ExlStlllg Park and Rlde Lot ThlS motlon
wao seconded by ,J1m Krystosek All were m favor and the motlon carrled

A quest10n was ra1sed by .J1m Krystosek as to whether or not the eX1strng
park and r1de will be able to be used unt1l the new lot 16 done Bob MJ.ller
noted that J.f the property was vacated at t.Jus tJ.me that J. t would preclude
anyone from U6rng the lot because J.t would be under prJ.vate owner6hip and
there J.S then an lssue of personal lJ.ab1h ty for the Weber's and trespassmg

assure the adJoinrng property owners of the CJ. ty' s mtent to vacate that the

property lS m place and adv1sed the CouncJ.l to d1rect the preparat10n of a
resolution
Bob stated that he had 6poken WJ. th the WrJ.ght County Attorney, Bill
McPhaJ.l, and wac mformed that documents needed for the turn back of the
proPC-.>6ed Park and RJ.de lot should be completed WJ. thm a week The minute6
should also note that Harry Weber then commented that he would be w1llrng to
help in whatever way he can and that he lS donatrng $500 to the proJect
A motJ.on was made by Donatl..lS Vetsch and seconded by J1m Krystosek to
close the Publ1C Hearrng All were 111 favor and the motJ.on carr1ed
J1m Krystosek made a motion to approve the resolut1on to vacate the
rJ.ght-of-way for the eX1stmg Park and RJ.de Lot and to dJ.rect the completJ.on
of the necessary paper work for the new Park and R1de lot Bob Braun seconded
the motJ.on All were m favor and the mot1on carrJ.ed
The Counc1l next heard a Jomt Powero update
Gary Schwenzfeier stated that there was nothJ.ng 6J.gn1fJ.cant to report -
the meetmg was Just the usual proceedmgs At that pomt, Bob Sullentrop
asked Gary to request that Meyer-Rohlm be present at the next JOJ.nt Power6
meetrng Act10n wJ.ll be commenced on thJ.s request
The Mamtenance Department was heard from next
Ken gave a brJ.ef SynOP01S of what the l1mits have been on the ponds The
phosphorus has not been meetmg l1mJ. ts and the pond6 have had to be tr'l"'..ated

Ken mformed the CounCl.l that there appearo to be a ntunber of addresseE.
m the Clty where the drlveways are washmg out and there lS dlrt and sludge
m the streets Also, there are some areas where the weeds are bad or the
lawns are trashy
It was brought to the Councll's attentlon that two lndlvlduals have
already been sent the letter on the weeds and the rest wlll be sent the
standard weed letter A letter wlll be composed and sent out concernmg the
dlrt wash outs to those resldences affected
The cleanrng of the E.ewer lmes haE. now been completed and the lmes were
found to be m good shape Grease waE. found m the hne by the school and
there was lots of soap m the lmes
The Councll was told by Ken that the overhead garage door on the shop
need5 to be repalred There has been a molsture problem Wl th the panels and
some sectlOns have been replaced m the past but not the entlre door Ken
obtamed one quote from AUtomatlC Garage 1))01" Company to gl ve the Col..lncll an
ldea of what lt would cost to repalr the door To replace the three Sectl0ns
1 t would cost $558 50 installed To replace the eXlstmg door Wl th a new
msulated door J the cost would be $685 00
After some dlscueslon, the Conncll told Ken to obtam three quotes to
have available for the next meetmg and to check on the dlfference between
wood or e teel doors
Approval of the prel1mmary plat for Westwmd was next
The Plannmg Commlsslon has held a pubhc hearmg and recommend approval
pending the dramage and elevatlon be looked at The minutes should note that
there were no commente from the Plannmg Commlselon members who were present
.John Darkenwald expressed the concern that ,John-George J Inc has over the
park dedlcation fees for Westwmd - Phase I I
The Council directed Maureen and fub Mlller to meet Wl th John-f'~rge,
Inc to diE.CtteS the language m the eXlstmg developers agreement ThlS wa.c:;
put lnto a motion by J 1m Krystosek and seconded by fub Braun All were m
favor and the motlon carried
fub Braun made a motlon to contmue the approval of prel1mmary plat for
Westwmd untll the next regular meetmg Donatus Vetsch seconded the motlon
All were in favor and the motlon carrled
Planning Commlsslon member Donatus Vetsch called the PubllC Hearmg "to
order on the condltlonal use permlt for Donatus Vetsch to allow for an
addltlon to an eXlstmg storage shed The hearmg was then turned back to the

The Planm..ng Comrrll.sslon and the Cl ty Councl1 were l.nformed that the
current ordinance (Section 1020 4. Subd b3) states that The total floor
arP...a of elther an attached garage or a detached garage for a smgle faml1y
detached dwellmg shall not exceed seven hundred (700) oquare feet of floor
area and not exceed the ground coverage of the dwellmg, except by COnd1.tlon
use
It was noted that request was to allow for the oquare footage for the
0Jmbrnat1.on of garage and storage ohed to equal 1, 138 98 square feet and
exceso of 438 98 square feet It was pomted out that m th1.S part1.cular
Sl tuat1.on that the excess l.S Jl..1.6tif1.ed because of the fact that there l.S an
unusually large garage attached to the house because l.t was bt.nlt as a
hand1.capPed access1.ble home Secondly l.t wac noted that the mtent of the
addl t1.on l.S for addi t1.0n to a hobby shop and shall not be cone tru.ed as an
additional garage
There was a quest1.on regardmg an add 1. t1.onal ohed on the property and
whether or not it would stay on the Slt..e The Counc1.1 and the Plannmg
Comm1.ss1.on was mformed that th1.s shed would be moved off the property as soon
as the new addlt1.0n was completed
The Planning Comm1.SS10n noted that they had d1.sC1..1.6sed the 700 square foot
max:unum requ1.rement and would be addressmg the1.r concemo W1. th Dav1.d L1.cht to
have it amended
A motion was then made by fun Bemmg and oeconded by Kevm Mealhouse to
close the publ1.c hearmg All were m favor and the mot1.on carrled
Hearing no other comments or quest1.ons fun Bernmg made a mot1.0n from the
Plannmg Comm1.ss1.on to the Counc 1. 1 recommendmg that the cond1. tlonal use
perml t be granted Kevm MP...alhouse seconded the mot1.on All were m favor and

voting
Bob Braun made a mot1.on to accept the recommendat1.on from the Plannmg
Comm1.ssion and to grant the cond1. t1.onal use perm1. t J 1.m Krystosek oeconded the

The Council heard an Engmeermg uPdate next
Bob Sullentrop reported that the d1.tch along C S A H #37 and Westwind
has been cleaned up Sod will be put down m order to help ooak up some of the
excess water that is standing in the ditch

Some of the curbs m the Westwind area have settled and are m the
process of bemg replaced
The roll test on the Class 5 gravel dld not paso - probably due to

At thls pomt, Donatus asked whether or not anythlng 10 bemg done about
the railroad crossing on C S A H - s #19 and #37 Maureen stated that thlS
property lS rJ.g]1t-of-way that belongs to the County and a letter wac sent to
the County requestmg that they look mto the lssue Maureen wlll agam check
wlth the County
The Feaslblllty Report for the 1-94 Watermam Crossmg and for Water and
San 1 tary Sewer Along the Frontage Road North of 1-94 was dlocuosed Fob noted
to the Councll that the report was wrltten m two parts, the flrst dealmg
wlth the croSomg of 1-94 wlth the water lme and secondly the cost of
motallmg utlhtles on the north slde of freeway
As noted m the report and m preVlOUS dlocusslons, the Cl ty had place a
21 mch reinforced concrete pipe across 1-94 prlOr to the constructlon of the
freeway Wl th the mtentlon that the watermam would be lnstalled at a later
date to servlce the area north of the freeway Smce the eXlstmg casmg lS
not m good condl tlon, apparently damaged from hlghway constructlon the exact
Slze carrler Plpe that wlll now work has not been determmed
Normallv the casing Plpe lS approxlmately 10 mches blgger than the
carrler Plpe to allow room for the bells on the ends of each sectlon of Plpe

road, from the western end to across CSAH 37 and would C0n61St of
approx:unately 2580 feet of 12 mch ductlle iron Plpe (DIP) Hydrants
would be placed every 350 feet, per the .Jomt Powers' reqUireI\'lF'.nt5
Servlces would be extended to the property hnes lot the lot5 along the

lowest elevat10n of the wetland area Therefore, m order to develop the

wormed the Counc1.1 that he had prepared a letter to the MPCA on the change6

Ken Lmdsay for reV1.ew Maureen noted that a copy should be put on f1.led W1. th
her off1.ce of any commun1.cat1.on w1.th MPCA
Bob al60 noted that it was the opmJ.on of Meyer-Rohlm that what Ken 1.S
proposmg for the plant 1.S a good 1.dea and would l1.kely work that the
engmeers are not 6ure that not whether or not 1. t 1.S needed at th1.s t1.me,
feelmg that 1. t mJ.gh.t be somewhat premature He noted that they do not feel
that all the other avenues have been address to cut down on the tran6fer t1.me
and that the C1. ty should exhaust those before th1.s solut1.on 1.S tr1.ed
Ken Lind6ay took 1.ssue w1.th th1.S statement by poss1.bly havmg
m1.smterpreted what Bob had sa1.d Bob tr1.ed to clar1.fy that they were not
quest1.onmg whether or not the solut1.on would work, but rather 1.t's t1.mmg
Ken noted agam that he can not complete the pond transfer and d1.scharge m
the prescribed time allotted by MPCA
After some add1.t1.onal discuss1.on, 1.t was agreed that the Counc1.l, Ken,
Maureen and the engmeers should meet out at the Wastewater Treatment Fac 1.1 1. ty
and walk through the S1. tuat1.on before any other act1.on 1.S taken on the matter

City had rented for the weekend were cancelled

The next lssue before the Counc1.1 was the appomtment of the BLl.lldJ.ng
Comm1. ttee for the Flre Station - Cl ty Hall There was some d1.scuss1.on
regarding the size of the comm1.ttee and who would serve on 1.t After some
discussion 1. t was dec1.ded that the Counc1.1 would walt unt1.1 the members had
had an opportun1.ty to talk w1.th some people to see 1.f they would be interested
m serv1.ng on the comm1. ttee
In a related matter, a mot1.on was made by funatus Vetsch and oeconded by
Bob Braun, d1.rectJ.ng Maureen to prepare a Request For Proposal for the Needs
Assessment and P05sible design of building All were m favor and the mot1.on

asked to present proposals to the Counc1.1

Maureen Andrews had been before the Wrl.ght County Board that mornrng to
d1SCUSS W1 th them the C1 ty - s proposal to capture the tax mcrement off of two
proposed apartments Maureen explamed that the plan had been presented to the
Board and the1r quest10ns had been ane,wered It was noted that they had made
a motion to rrake "no comment" on the proJect, recogrnzmg the fact that they
had the cho1ce to rrake negat1ve comment, no comment or pos1tive ~omment on the
use of the proceeds The mmutes should note that the plJ.bl1C hearlllg' on the
tax mcrement fmancmg plan lS scheduled for July 17th at 7 30
The Counc1I commented on the recyclmg articles presented m the agenda
packet I t was suggested that the C1 ty put as1de some tlme to develop our
r9Cyclmg and garbage plan m more deta11

Sher1ff - s Report for the month of May and mformat1on pertaming to the NEW
PROPERTY TAX LAW provided by Juran and Moody
