SPECIAL COUNCIL MINUTES
AOOUST 25. 1989
A spem.al meet~ of the Albertv111e City Council was called to order by
Mayor ~ Schwenzfe1er Members present mcluded Jim Krystosek Donatus
Vetsch, Don Cornelius and B::>b Braun. others present included Maureen Andrews
The purpose of the meeting was to meet and discuss three conditional use
permits. set the public hearing for the amendment to the Tax Increment Plani
the Developer's Agreement for Pheasant Ridge Apartments and update the Counci
on the Street Maintenance program
The first Conditional Use Permit discussed was for Sunrise Plumbing The
Council was informed that the purpose of the permit was to allow for pole type
construction of the wilding becaUse of the fact that the lot was considerably
lower than the street and required alot of fill to meet the 18 inch above curb
requirement for construction
The rep:>rt for Northwest Associated Consultants. Inc stipulated 8
conditions that would need to be meet prior to the approval of the wilding
permit (the report has been attached for further reference)
In ad(h t10n the Council was provided with a reJ2Qrt from Meyer-Rohlin
Inc regarding the condition of the soil and the need for 4 to 5 feet of fill
over the original ground line to bring the lot up to standard elevation This
report also noted that the excavation for concrete footings to a stable J
bearing soil could be substantially more J resulting in footing aepths of 10 to
15 feet J which would cost prohibitive to develop tFiis particular lot
The Council was informed that the Planning Cormnission had recommended the
~roval of Conditional Use Permit J provided that Andy Savi tski prescribe to
the 8 conditions of the Planner r s Report. In addition to these conditions J the
Planning Cormnission requested that the City reserve the right to require
additional parking in the event that the use of the wilding would change and
more parking would be needed
There was some discussion rega~ wh1ch site plan was preferred w1th
regards to parking It was agreed that ing layout that was most preferred
by the Council was ExhibIt E-1 Si Plan Al ternati vel wh1ch placed the
majority of the parking along the north and east property ine It was noted
that Andy was only required to provide parking for 9 S;ce6 and 1 handicapped
provided that s~ce was provided for additional park in the event that tt
was needed The Council was informed that Andy 5avi tsk had agreed to follow
the Exhibit E-l 5i te Plan Alternative and would like be incluaing additional
parking at this time
Hearing no other comments or quest10ns a mot1on was made to approve the
Conditional Use Permit to allow for the construction of a pole type wilding
for Andy Savi tski r s Sunrise Plumbing provided the following stipulations were
met
1 That the 8 stipulations outlined in the Planner r s Report are followed
Along with points detailed in the review and comment section of the
report
2 That the City reserves the right to require additional parking in

south and west side of the building the minutes should note thalj
the additional siding is not requIred on the east side of the
buildrng since this is the location of the service door and truck
entrances

The rotion was made by Donatus Vetsch and seconded by .Jim Krystosek All
were in favor and the rotion carried
The next Conditional Use Permit di6CU6sed was that for Metro}20litan
Underground, The Council was informed that this permit was to allow for the
construction of a second principal building on their property site to allow
for the constl'UCtion of a cold storage building,
It was noted that it was the intent of the property owner to building the
second building out of the same materials as is the principal building and
located as according to the site plan
A rotion was made by Don Cornelius and seconded by Bob Braun to MlProve
the Conditional Use Permit for Metropolitan Underground provided that the
following stipulations are met
1 That the building be constructed out of the same materials as the
principal building
2. That the building serve as stor~e to the princ1.pal building, in the
event that the use of the building change the Council reserves the
rlgh.t to review the purpose and intent of the building,
3 That Maureen note the Council- s concern regarding the need for
vegetation screening, such as trees and bushes
All were in favor and the motion carried
The last Conditional Use Permit was for the extension of Barthel- s fu6
Garage office facility It was noted that the reason for the perm1.t was to
allow the addition on an existing building that is located on a lot with two
principal bu1.ldings
The Council was informed that the plan called for the expansion of the
office with the same type of building materials both for siding and roof The
addition falls well within the setbacK requirement for the lot
A rotion was made by Jim Krystosek and seconded by Don Cornelius to
@Prove the conditional use permit for Don Barthel- s addition, All were in
favor and the motion carried The minutes should note that the Council
requested that the existing plantings around the building be save and roved to
accommodate the new building
The Council next set a p..l.blic hearing for the amendment to the Tax
Increment Financing Plan for the Fraser Steel Project,
A rotion was made by Don Cornelius and seconded by Donatus Vetsch to set
the hearing for October 2, 1989 All were in favor and the rotion carried
The Council was informed that the Developer - s Agreement for the Pheasant
Ridge Apartments had been -prepared and reviewed by staff and the developer and
that we are just wa1. ting for some adch tional mformation regarding the surety

It was recommended that the Council approve the agreement pending the City

Attorney receivrng the necessary information from the bondrng company
A motion was made by Donatus Vetsch and seconded by Bob Braun to approve
the I:/l9veloper' s Asreement. pending the Attorney' 6 approval. All were in favor
and the motion carried.
The last item on the agenda was an update on the street maintenance
contract The Council was informed that there might need to be an increase in
the amotmt materials used for the sealcoat~ because of the fact that the
