1989-10-16 CC Minutes . . . COUNCIL MINUTES OCTOBER 16, 1989 The regular meeting of the Albertville City Council was called to order by Mayor Gary Schwenzfeier Members present included Bob Braun, D::>n Cornelius, Ihnatus Vetsch and Jim Krystosek others present mcluded Maureen Andrews, Lorie Villareal, Bob Miller and Bob Sullentrop The agenda for the evening's meetJ.Dg was rev1.ewed by the Council A motion was made by D::>n Cornelius and seconded by Bob Braun to approve the agenda All were in favor and the motion carr1.ed The minutes of the Cbtober 2nd meeting were reviewed by the Council Before making a motion to approve the minutes, D::>natus asked whether or not a meeting with the utility companies was going to be set up Maureen explamed the S1. tuation and how the City was gOJ.Dg to handle it D::>natus Vetsch then made a motion to approve the minutes of Cbtober 2nd D::>n Cornelius seconded the motion All were in favor and the motion carried. The Council first heard from the Maintenance Department Since Ken was not present at the meeting, d1.scuss1.on on the Wastewater Treatment Facility was tabled until the next meeting However, a couple of other 1.ssues were d1.scussed Maureen received a call from a resident on 50th Street who was wondering what can be done about the condition of the road The road 1.S in very bad drivJ.Dg condition with lots of dust and pot holes where the black magic has worn away Something will have to be done about th1.s prevailing problem as the traffic flow is fairly heavy on 50th Street now and with the new school the road will see an mcrease in traffic There was some discussion about the continued use of black magic Supposedly, we cannot use black magic anymore However, Ihn Cornelius thinks that black magic is legal and we should see if we can get it . . . A conment was also made that black magic cannot be moved becauce it is an oil based product. Someone else conmented that 1. t could be moved with a grader 1.f there was a good sharp blade to lift the black magic And the rubber tire compaction should be all right The general feeling of the Council was to not do anythmg maJor to the road - just enough to get through the winter Bob Sullentrop will check W1. th MNJDQT on the black magic and Ken will talk to Frankfort Township Street sweeping needs to be done agam for the second time after sealcoatmg Ken would like to see the sweeping done in the next few weeks and 1.S askmg for approval of the work order Jim Krystosek made the motion and lhn Cornelius seconded it to approve the street sweepmg for the first of November or shortly thereafter All were m favor and the motion carried The Council next heard from Engineering Bob Sullentrop gave an update on construction projects The second lift of sealcoatmg was put down m Psyk' s Add1. t1.on on Fr1.day Black dirt was put down last week and sod will be next The contractors will be usmg a dormant seed for the lots that are not to receive sod It was noted that these materials cost less and because of the timmg of the project. will better suit the winter weather conditions It was noted that the contractor will be responsible for guaranteeing the materials because 1. t is part of the project restoration Gary asked Bob about the ponds How are the discharges going and will there be time to shoot the bottoms of the three ponds? Bob stated that Ken 1.S ready for the second discharge and the third d1.scharge will be done within a month At that rate. there will be time to shoot the bottoms of all three ponds Adoption of the Yard and Street Maintenance Ordinance was d1.sCU6sed Bob Miller rev1.ewed with the Council the policy issue regarding how this type of an ordinance will pertain to new developments as well as eX1.stmg property It was noted that there are two major issues pertaining to yard mamtenance issue. the first being the type of vegetation being installed and secondly what type of financial guarantee will be required for new development It was pomted out that as part of the current Developer's Agreements the developer is responsible for soddmg the 11 5 feet of easement once construction has been completed Bob pointed out that if the Council chose to adopt the new policy that it could be incorporated into the Development Agreement by reference -2- . . . It was also noted that the new ordmance would prov1de the City with the standards for houses that are built in the older subdivisions which are not under the cr1 teria of the development agreements by requiring some type of fast vegetation to eliminate soil erosion and washouts into the City storm sewer system The next issue discussed as Part of the ordinance was the matter of fmancial guarantee that the City would requ1re to protect against violation of the ordinance There was discuss10n regarding how much it would cost to seed the boulevard area It was noted that typically $l,f2B2I ~ covers the expense of seedJ.ng of an acre of land (excludJ.ng tops011) but the City's InaJor concern focuses on the property that 1S adjacent to the street, noting that typically this would amount to about 20 square feet NotJ.ng that the amount of the surety needs to be large enough to provide for some b1 te to assure that the developer will meet the requirements of the ordinance rot not to make it so cost prohib1 ted that 1 t would harm development in Albertv111e It was suggested that the dollar amount should fall in between the $5021 to $803 range to assure that there is adequate funds ava11able in the event that the City should have to step in and do the work After some additional discuss10n, fun Cornelius then made a motion to approve the adoption of the Yard and Street Maintenance Ordinance W1 th the changes stipulated in the policy And that the guarantee fee should be established at $750 ~ an acre Jim Krystosek seconded the motion All were in favor and the mot10n carried Bob told the Counc11 that an appraisal is bemg done on the piece of land set aside for the Fraser Steel proJect The State wants the appraisal done as Part of the grant application It was noted that the County has had no sale ill the Industrial Park in five years and with Pat's "66" selling for 50 a square foot, 1t is not a good representation of the going prices ill the Industrial Park The income received and the bills to be paid were reviewed by the Council Hearing no questions, I:bn Cornelius made the motion to approve the income received and the bills to be paid funatus Vetsch seconded the motion All were in favor and checks 9921 through 9948 were pa1d The Albertville Area Jaycees are requestrng approval of the1r gambling license renewal applicat10n and waiver of the thirty day not1ce waitmg period Bob Braun made the motion and fun Cornelius seconded it to approve the gambling license renewal application for the Jaycees and to waive the thirty day notice waiting period All were in favor and the motion carried -3- . . . Maureen gave an update on the Wright County Economic Development meeting which was a three hour mini session held up in Buffalo An all day session l.S bel.ng planned for sometime in January This meeting was about how involved should the County be m economl.C development It was an educational process with favorable comments Arlyn Nelson COlI'IDented that part of the reason was because of the Cl. ty' s letter to her regarding economic development and in response to her comments in the local newspaper There was some discussion about being involved in economic development and how everyone should be aware of l.t The Council meeting date of November 6th needs to be rescheduled because of l. ts conflict with deer hunting opener A motion was made by fun Cornell.us and seconded by Bob Braun to reschedule the Council meetl.ng for November 13th All were in favor and the motion carried A reminder that the school bond election wl.ll be held November 7th Polls will be open at both the Albertville and St Ml.chael City Hall's from 7 00 a m until 8 00 p m Ibn Cornell.us made a motion and Bob Braun seconded l. t to approve a specl.al meetl.ng to be held on CCtober 25th at 7 00 p m to approve bids for the ditch work for the Fraser Steel proJect All were m favor and the motion carrl.ed A remmder that a meeting will be held at 6 30 p m on CCtober 23rd for special assessments on the Savitski Project and for delinquent sewer bills that need to be assessed to the County tax roles Maureen reported to the Council an update on the Fraser Steel project The State dl.d not receive the turn back of Industrl.al Revenue Bond allocatl.on as expected 60 there was no money available for the drawing on CCtober 23rd so none was held In the event that monies would become aval.lable prl.or to the next drawing date the appll.cation would stl.ll be available It was also noted that l.f no additional drawings are held thl.s fall that Fraser would be able to reapply in December for the first drawing in January The purchase agreement between Fraser Steel and Barthel Constructl.on for the purchase of the land in the Industrial Park has been signed and l.S being finall.zed A representative of the STMA Cl.tl.Zen6' Task Force for the promotl.on of the new school l.S requestl.ng a donatl.on from the City of Albertville to help defray the campaigning expenses Maureen commented that Frankfort Township gave a donation but St Michael did not and either did Joint Powers Bob Ml.ller sal.d that he had never seen this done and l. t could cause -4- . problems They do not appear to be stipulating exactly what the donated. ftmds are being used for If they are a private organizat10n, this 1S not the proper expenditure for public purposes There was discussion about how this money is going to be spent It was noted that the money was being used by the Task Force to help inform the public of how the financing of the new school would be undertaken It was the general consensus of the Council that 1f Bob Miller was uncomfortable about donating funds for this type of purpose that it would be best to let the matter pass Therefore, they agreed not to donate any money to this endeavor tonatus Vetsch voiced his concern about whether or not a fuildrng Chmmi ttee was gorng to be formed to establish our bluldrng plans He felt it should be done before February of 1990 otherwise drop 1t The Council dJ.scussed the fact of deciding who would be good candidates to be on this comm1ttee. Then these people should be contacted. and asked to express their feelings about being on the committee as some may be undecided Five members was felt to be a comfortable group The five people decided on are tonatus Vetsch, Bob Braun, Kevm Mealhouse, Greg Bernl.ng and Howard Larson . The Council then acknowledged the request for proposal to do the needs assessment for the new bu1lding A schedule will be set for the comm1ttee to go and look at some different buildings No further action was taken A question was asked if anYthing has been done on the hockey rink yet Ken is just now starting to do some of the make ready for the rink The Fire Department was called out on a fire call to the second apartment building at the Westwind Apartments on Saturday night When the firemen prepared to tie into the internal water stands, they found that the connection was not on the stand pipe - it was just capped off Almost 2eK2J feet of hose had to therefore be pulled out to the other side of the bu1ldrng Fortunately, the alarm was false and there were no problems, but the connect10n needs to be on the stand as soon as 1 t can be repa1red The firemen talked to Ray Varner, who is the manager of the Westwind Apartments, and he w111 talk to Westwind r s plumbers and have the problem taken care of right away Maureen will also talk to Loren Kohnen There 1S no reason that this should not have been caught by the building inspector in the final mspection . ton Cornelius commended the Rescue Squad for their very prompt response and knowledge when he needed them on Sunday morning He expressed his thanks and said that the City should mdeed be proud of the1r rescue squad There was no other business so a motion to adjourn the meeting was made by ton Cornelius and seconded by Bob Braun All were in favor and the meetrng adj<Xlrnffi ~ ~ -5-
