COUNCIL MINUTES
NOVEMBER 13, 1989
The regular meeting of the Albertville C1 ty Cotmc11 was called to order
by Mayor Gary Schwenzfeier Members present Included Bob Braun, Ibn Cornelius.
Ibnatus Vetsch and and J 1.In Krystosek Others present included Maureen Andrews,
Lorie Villareal, Bob M11ler, Bob Sullentrop and Ken Lmdsay
The agenda for the evening's meetJ.1'lg was rev1ewed by the Cotmc11 A
mot10n was made by Ibn Cornelius and seconded by Bob Braun to approve the
agenda All were In favor and the motion carr1ed
The minutes of the OJtober 16th meeting and the OJtober 25th special
meeting were reviewed by the Cotmcil There were no corrections or additions
so J1.In Krystosek made a mot10n to approve the minutes of OJtober 16th and
25th Ibn Cornel1us seconded the motion All were in favor and the motion
carried
Ibnatus Vetsch made a motion to open the Public Hearing for Savi tski ' s
Sunr1se Commerc1a1 Addition Special Assessments. Bob Braun seconded the
motion All were in favor and the motion carr1ed The Notice of Public Hearing
was not read because of its length
Bob Sullentrop reviewed with the Cotmc11 the assessment numbers, noting
how the proJect expenses were broken down on a lot bases The cost of the
1988-7 improvement project was $120,020 f20 and Included the installation of
water, sewer, storm sewer and gravel based streets Additional cost
assoc1ated with the project included $31,386 21 for the developer's share of
the 1n6tallation of the sewer interceptor line which had been completed under
the G 0 Sewer and Water Revenue Bond of 1988 The total amount to be
assessed is $151,386 21
Bob next reviewed with the Cotmc11 the proposed assessment role I t was
noted that since this was commercial property the assessments were figured on

a per acre basis mstead of on a per lot basJ.s, as typically done with
resJ.dential subdivisJ.ons The Council was shown how the breakdown was
prepared, based on the percentage of land area to the total cost The
assessment roles are as follows

It was noted that the assessments can be certified to the County but they
will not appear on the tax roles until 1991 because of a new State
certifJ.cation requirement regarding when County tax statement must be sent
out It was noted that the City would be required to levy the fJ.rst year of
bond payments, noting that J. t would be recouped once the sPeCJ.al assessments
go on the tax role
A motJ.on was made by I:bn Cornelius and seconded by J1.m Krystosek to close
the Public Hearing All were in favor and the motion carried
A motion to approve the RESOLUTION AJXIPI'IID ASSESSMENT FOR WATER,
SANITARY SEWER, STREET AND STORM SEWER IMPROVEMENT NO 1988-7 m the amount of
$151.386 21 for Savitskirs SunrJ.se Commercial Addition and for certJ.ficatJ.on
to the County for the 1991 tax collection at 8 5% interest was made by I:bn
CornelJ.us and seconded by I:bnatus Vetsch All were m favor and the motion
carried
Jim Krystosek made the motion to open the Public Hearmg for Delmquent
Sewer Accounts I:bnatus Vetsch seconded the motJ.on All were in favor and the
motJ.on carrJ.ed
It was explained to the Council that the delinquent sewer assessments
were through the second quarter of 1989 There was no comment from the
Council
A motion was made by I:bn Cornelius and seconded by J1.m Krystosek to close
the PublJ.c Hearing for the Delinquent Sewer Accounts All were m favor and
the motion carried
I:bn Cornelius made the motion approve the RESOLUTION AJXIPI'IID AND
CONFIRMIID ASSESSMENTS FOR DELIliQUENT SEWER SERVICE CHABGES ('rHROIJJH SECOND
QUARTER 1989) Assessments will appear on the 1991 tax roles and interest
will be set at the 8% rate for collectJ.on I:bnatus Vetsch seconded the motion
All were in favor and the motion carried

The Council next heard from Bob Miller on the legal 1SSUes for the City
The Council was informed that if the City plans on undertak:mg the
stormwater drainage project m 1990 that it would be helpful to bring the
appraiser on board for the proJect now so that he would have an opp:>rtuni ty to
see the property prior to winter cond1 tions setting m Bob noted that he had
the name of an appraiser from St Cloud who spec1a11zes m the area of storm
water drainage appraisals
After some addi t10nal discussion a motion to have Bob M1ller obtam the
services of an appraiser to do the appra1sals for the storm water drainage
project was made by Don Cornelius and seconded by J1ln Krystosek All were in
favor and the mot10n carried
The Counc1l heard a Joint Powers update next
Don reported to the Council that Joint Powers had elim1nated one of the
water hydrants in Berningwood Also, that the delinquent water b1lls had been
assessed to the County tax. roles
Other 1tems discussed included a special meeting that Joint Powers held
to discuss the Marksmen Metals project and where the water pipes would be
runn:mg and how the new school was going to be assessed back for water
It appears that sloppy maintenance is being done W1th mamtaining the
water system Individual City members are not up on what 1S going on and
therefore there 1S negligence in proper maintenance of the system
Ken mquired whether or not something could be done about not flush:mg
the water hydrants so late in the season. Numerous problems are caused when
the flush:mg 1S done so late There was no comment from the Council
The Maintenance Department was heard from next
Ken reported to the Council that 50th Street has been bladed two times
smce the last meeting and is now in halfway decent shape
Ken said that he has talked to Otsego Township' s mamtenance man about
blading the ponds road. He would hke to see someth:mg worked out for next
year Perhaps a meeting can be set up to f1gUre out some kind of schedule for
blad:mg the road
The street sweeping is being worked on and the excess 1S being PJ,t down
at the lift station The sweeping looks pretty good and should be fin1shed
shortly
The hockey rink repairs are almost finished - one board needs to replaced
yet and then it will be ready for flooding

The C1 ty received 10 to 20 more trees from M1dwest Landscaping There
were some shade and some pine trees in the 'bt.mch The trees will be planted by
the parking lot, along the property owners boundary line and used to fill in
the vacant spots in the Four Seasons Park
Ken mformed the Council that the lift stat10n at the ponds blew up The
motor on the pump proved to have failed so a new pump was put in There was a
25% warranty left on the old pump. These current problems appear to be related
to the problems the plant had ex;perienced when it first went on line with
power surges
Also, the transfer pump went out at about the same t1ll'le and is being
fixed In the meantime, a transfer pump was rented at a cost of $500 0?l a
week This is a hydraul1c pump and is being used while the City' s pump lS
being repaired
It was suggested that surge protection might be needed and we should
think about investing in a surge protector
The ponds are down to 1 to 2 inches and Ken hopes to have 1 t down to zero
soon
At this point, Ken suggested that 1t might be a good idea for the City to
invest in a portable generator The cost could be added to future projects No
action was taken by the Counc1l
Ken would also like to b.ly a subnersible pump He does not have any costs
available at this time This too, could be added to a future proJect
Ken let the Council know that he had been informed of three snow plow
trucks that were available for $6,020 0?l each They are 1977 Fords with a 391
rebuilt engine, a 5/6 yard dump and a 10 foot plow There is no wing on the
trucks He wondered what the Counc1l felt about looking into this further
Don commented that 1f the trucks are that old they will show the wear m
1 to 2 years He felt that we should hold on for awh1le yet and see if we can
get a new one No other action was taken
Ken then asked the Counc1l what they wanted to do with the old truck and
plow He has had some inqu1r1es about whether or not we were g01ng to sell it
After some minor discussion, it was the general consensus of the Counc1l
to sell the t:ro.ck and plow through the classif1ed section via sealed bid
with the minlll'D..lm bid being $500 ~ Sealed bids will be opened December 4th or
at a date to be determined
Ken's overtime was the next lssue discussed by the Council

Ken told the CouncJ.l that he has tried to keep the overtime down but t"he
Maintenance Department has been too busy for him to take time off Right now
he has 32 days of vacatJ.on and. 79 25 hours of overtime He noted that he and
Ray have both donated a lot of their time to the planting of the trees in the
park mstead of charging the CJ. ty for them
He asked the Council whether or not they want to pay him the overtime
hours down to 25 hours and. what the vacation polJ.CY was for carrying over
vacatJ.on days
It was pointed out that the City's Personnel Policy states that not more
than. 20 vacatJ.on dayS can. be carrJ.ed over mto the next year
The Council decided that Ken's overtime should be paJ.d off down to zero
hours and. that he should try to take his vacation hours down to 20 days by the
first of the year The Council will decide at that time what to do WJ. th the
days that are unused
A motion was made by IOnatus Vetsch and seconded by IOn CornelJ.us to pay
Ken's overtime down to zero hours and. for him to take what vacation time he
can. between now and the first of the year All were m favor and the motion
carried.
It was noted that Ray'S overtime was used to balance out what was owing
on his family coverage msurance and Lorie' s overtime J.S belllg kept down
IOnatus COIMlented that he would like to see the City purchase a good
camera so that we would have one available when we needed to use one for City
purposes
At this suggestion, Loren Kohnen. who J.S the CJ.ty's fuildlllg Inspector
and who was present at a portion of the meeting. volunteered to donate a
camera to the City of Albertville The City appreciates this donation
The Council next heard from the Engineering Department
Bob informed the Council that the balance of the work on Psyk' s Project
will be done tomorrow and. that some of the rP...storation will be done in the
spring
It should be noted that at this point IOn CornelJ.us commented that in the
previous minutes Psyk' s 4th Addi tJ.on was not seal coated - it was blacktoPPed
No other comments were made
Bob presented a pay request from fuffalo BJ. tuminous for partJ.al paYment
#3 on Psyk's 4th AddJ.tion Streets in the amount of $29.326 27 This request is
for the second lJ.ft of blacktop and. some restoration
There was some discussion about the 1% retainer It was felt that we
should take a 2% retainer instead of 1%

Ihn Cornelius made a motion to change the retainer to 2% and pay partial
pay request #3 to fuffalo Bituminous m the new amount of $28,573 20 Bob
Braun seconded the motion All were in favor and the motion carried
Bob noted that the Drainage DJ. tch Project would be started on Wednesday
of this week
The income received and the bills to be paid were reviewed by the
Council There were a few questions which were clearly answered Ken asked
that the Otsego Township bJ.II not be paid until after a meetmg J.S held with
them to talk about the cost of blading the ponds road The Council agreed
that the bill should be paid now and an agreement for the future can be
negotJ.ated
A motion was then made by Ihn Cornelius and seconded by Jim Krystosek to
approve the mcome received and the bills to be paid All were m favor and
checks 9949 through. ~ were paid
LeRoy Berning J representing the AlbertvJ.lle Jaycees J was present to talk
about the bulbs for the Christmas decorations The bulbs were originally
OOught through Display Center and they are now clal.mmg that the bulbs are not
theirs Because of this J they have agreed to sell us the bulbs at $1 02J a
piece instead of $2 40 a piece This will be 1/4 the original cost
What the Jaycees are requesting is that the CJ. ty pJ.ck up the cost of
replacing the bulbs and do the ongoing mamtenance The Jaycees will donate
the labor to PJ,t up and take down the decorations Keith Franklin will again
donate the b:x:l!D truck as long as we pay for the operator' s labor and fuel for
the truck
Ihn Cornelius made a motion to replace all the bulbs and the CJ. ty will
pJ.ck up the cost of the bulbs and do the ongomg mamtenance of the IJ.ghts
Jim Krystosek seconded the motion All were in favor and the motJ.on carried
The Council reviewed the addendum to the Conditional Use Permit --
Plarmed Unit Development for Fraser Steel The p.rrpose of the conditional use
permit was to allow for certain design flexibilJ. ty from the strict standards
of the Ordinance The changes included
1. To allow for the final building to exceed the maximum lot coverage of
30% by WX
2 To reduce the number of requJ.red parkmg spaces for the size building
being constructed, based on the Justification that the employee load
will not demand the full number of parking spaces required
3 To allow for more than one principal buJ.lding on the site for a
period of 5 years and not to exceed 10 years
4 To allow for the construction of a temporary pole-type construction
storage building for cold storage

The Council was informed that the Plarming Commission was concerned about
the length of time that the temPorary storage wilding would be allowed to
remain on site The original report from Northwest Associated Consultants
Inc suggested that the wilding be allowed to remain on site for 10 years wt
that Plarming Commission noted that they would be more comfortable with
approving a conditional use permit for period of five years with the
possibility of a 5 year extension without an additional Public Hearing

The Council was Informed that the Plarml1lg Commiss~on had made a motion
to recommend to the Council that they move the adopt~on of the Condi t~onal Use
Permit for the Plarmed Unit Development with the cr~ teria establ~shed In the
document
A motion was made by Jim Krystosek to adopt the Condit~onal Use Permit --
PUn for Fraser Steel with the criteria established In the document funatus
Vetsch seconded the motion All were in favor and the motion carried

The Cooncil was also informed that the Plarming Commission had also held
a public hearl1lg for F&M Properties to the construction of 15 garages ~tead
of 30 for two 30 unit apartment wildings being proposed In the Westwind
Subdiv~s~on It was noted that the proposal was the same for the second two
wildings as ~t was for the wildings on lots 1 and 2 of Westwind It was
also noted that there has not been any problem with on-street parking and that
the w~ldings have been managed well to assure that no violation occurs
The Plarming Commission made the recommendation to the Council to approve
a deviation to the zoning ordinance for a PUn for F&M Propert~es (Westwind
Apartments)
Bob Braun made a motion and fun Cornel~us seconded it to approve a
Deviation to the Zoning Ordinance for a PUn for F&M Propert~es (Westwind
Apartments) for the wildings 3 and 4 All were in favor and the motion
carried
The Council next heard an update on the fuilding Committee
Part of the cormni ttee met and discussed a lease/purchase agreement If
the City went with this, bonds would have to be issued in January The
committee agreed to explore some other opt~ons as the lease/purchase agreement
left the cormni ttee somewhat unsettled
Maureen informed the Council that there would be a League of Mmnesota
C~ t~es policy cormni ttee meeting at the Hotel Sof~ tel on November 16th This
. would be an all day seminar

The Council was reminded that work meetings are needed and would be
scheduled
There will be a meeting in fuffalo on Wednesday, November 22nd at 7 p m
on the Opt1C scan voting equiIment for those that are mterested in attending
It was noted that a meeting with Frankfort Townsh1p is needed to discuss
50th Street and the water situation under the freeway
The Park Board mmutes were included m the packet for the Council's
review
The Sheriff's Report for September was included m the packet for the
Council's review
There was no further rosiness so a motion was made by fun Cornelius and
seconded by funatus Vetsch to adjourn the meeting All were in favor and the
meetrng adjourned
