COUNCIL MINUTES
DECEMBER 18, 1989
The regular meeting of the Albertville C1ty council was called to
order by Mayor Gary Schwenzfeier Members present included Bob Braun, Don
Cornelius, Donatus Vetsch and J1m Krystosek Others present included
Maureen Andrews, Lorie Villareal, Bob M11ler, Thore Meyer, Bob Sullentrop,
Ken L1ndsay and Steve Klitzka
The agenda of the evening's meeting was rev1ewed by the Council Don
Cornel1us made the mot10n and Donatus Vetsch seconded it to approve the
agenda All were 1n favor and the motion carried
The minutes of the December 4th meet1ng were rev1ewed by the Council
Ken L1ndsay pointed out that there was one correction to the minutes On
page one, last paragraph, should read snow blower not snow plow
. There were no other corrections or add1tions so a mot10n was made by
ITim Krystosek and seconded by Bob Braun to approve the minutes of December
4th. All were 1n favor and the mot10n carried
The Counc11 first dealt with the public hearing for the Fraser Steel
Company's Industr1al Development Revenue Bonds
A motion to open the Public Hearing was made by Don Cornel1us Donatus
Vetsch seconded the motion All were in favor and the motion carried
The Notice of the Public Hear1ng was not read because of its length
It was noted that the Notice had been prepared by Briggs and Morgan per
statutory requirements
Maureen Andrews gave a progress report on how the project was coming
together and noted that at the time of the hear1ng there was a possib111ty
that Fra5er Steel would be turning back their allocation of Industrial
Development Revenue Bonds because the bonds had not been sold and it
appeared that there would be problems closing on them before the December
22nd federal deadline The Council was 1nformed that 1t had been dec1ded
that the hearing should st111 be held in the event that the bonds could be
sold 1n a weeks time or 1n the event that additional allocation would be
requested in 1990,
After a review of the documents. a motion was made to close the public
hear1ng. The motion was made by Bob Braun and seconded by Don Cornel1us
~ll were in favor and the mot10n carried
Steve Kl1tzka of the Park Board was present to g1ve a Park Board
update The Park Board had sponsored a Christmas raffle for which the
.drawing was held on December 15th The Counc11 was 1nformed that the Board
had Just broke even and it has been determined that the tim1ng of the
raffle may have been the reason
Steve provided the Counc11 w1th the 11st of W1nner-s wh1ch 1ncluded

Steve next commented that he would like to see the playground and
p1cn1C area of the Four Season's Park open by mid June As far as the
blacktopp1ng goes, he is requesting to see it included 1n any street
1mprovement proJect done 1n 1990 He noted that he felt that it was
crit1cal to get the walk1ng paths completed as soon as possible followed by
the Parking lot The tennis courts will likely wait unt11 a later date
because of the expense assoc1ated with building courts
It was p01nted out that Paul He1nen, J111 Merges, Ken. Ray and Steve
would be tak1ng turns volunteering their t1me to patrol the skat1ng r1nks
dur1ng the hours they are available for fam1ly open skat1ng on the
weekends
A comment was made by Steve that he was under the impress10n that "NO
ALCOHOL" s1gns needed to be posted in the park To this Bob Miller
commented that the C1ty has an ordinance in effect that states "NO GLASS
CONTAINERS". but nothing pertaining to alcohol It was noted that 1f the
City wants an ord1nance pertaining to alcohol in the park during the w1nter
or Just pertaining to the warm1ng house that the ordinance would have be
amended to state "NO ALCOHOL IN WARMING HOUSE" It was noted that once the
ord1nance was amended that the s1gns can be posted

At th~s po~nt brought up the Rules for Ice Use to be rev~ewed by the
Council He stated that these were rules that have been established
. throughout the years but that they had never been brought before the
Council for rev~ew or enforcement
Ken stated that he had gone over the rules with representatives of the
broomball teams and Hockey Assoc~ation and that they d~d not have any
problems with the contents of the rules It was noted that extra cop~es had
been requested so that all the managers would have cop~es of them
A motion was made by Donatus Vetsch and seconded by Jim Krystosek to
approve the Rule for Ice Use All were in favor and the motion carried.
The Council next reviewed the bids for the sale of the old pickup and
plow There were three b~ds to be open which ~ncluded

Don Cornelius made a mot~on and Donatus Vetsch seconded it to accept
the bid from Garrard Zachman for $806 00 for the sale of the old pickup and
plow Before the motion carried ~t was brought to the Counc~l"s attention

Don then amended h~s motion to exclude the w~nch from the bid or the
bid would be be reJected Donatus Vetsch seconded the amendment All were
in favor and the motion carried
The Council was next ~nformed that the City had been contacted
regard~ng the Lakes & Prairies Program It appears that ~n order to hire
the maintenance employee that the City w~ll need to pay a $99 00
administrative fee to cover the expenses assoc~ated with the program
There was some d~scussion regarding how many hours the person would be
working and the Council was ~nformed that they would be working about 5 5
hours per day up to a maximum of 500 hours
Hear~ng no other discussion a motion was made to approve the $99 00
admin~strative fee The mot~on was made by Don Cornelius and seconded by
Bob Braun All were ~n favor and the motion carr~ed
Bob Sullentrop next reviewed w~th the Counc~l a pay request for LaTour
Construct~on The Council was ~nformed the request was for the work done on
the ~nstallat~on of the storm sewer pipe in Barthel"s Industrial Park It
was noted that this request excludes bids C and D, because none of th~s
work was done The amount of the request was $63,345 53 and included a 5%
retainage

It was noted that both the Sunday On-Sale and the Off-Sale
Intoxicating Liquor licenses were already as h1gh as State Statute would
allow so no change had been made to these two licenses
Hear1ng no other comment, a motion was made to approve Ordinance No
1989-20 ent1tled, AN ORDINANCE ESTABLISHING LICENSE FEES FOR RETAIL SALE OF
ALCOHOLIC BEVERAGES The motion was made by Jim Krystosek and seconded by
Bob Braun All were in favor and the motion carried
The Council next reviewed an ordinance regard1ng Charitable Gambl1ng
It was noted that the C1ty can collect $100 00 per appl1cation for
adm1nistrat1ve charges and requ1re that 10% of the net prof1t (m1nus
expenses) be used on designated City projects After some add1tional
d1scussion 1t was agreed to table this ordinance unt11 such t1me that the
Counc11 has an opportun1ty to discuss the issue with the different
organizat10ns

The Counc11 next reviewed the Income Received and B11ls to be Pa1d It
was noted that the Council would 11ke to see mileage checks turned 1n on a
more regular basis, it was agreed that they would be done more often, There
was also some questions regard1ng the the bU1lding perm1t fees Hear1ng no
other quest10ns the Council approved income and bills
A mot10n was made by Donatus Vetsch and seconded by Don Cornelius to
approve check numbers 10074 through 10108 All were 1n favor and the mot10n
carried
The Personal Policy discussion was tabled until a later date
A motion was made by Don Cornelius and seconded by Bob Braun to change

was made by Bob Braun and seconded by Jim Krystosek All were 1n
favor and the motion carried
Sunday Liquor L1cense for the Albertville Bar ($200 00) -- The motion
was made by Jim Krystosek and seconded by Don Cornelius All were
1n favor and the motion carr1ed
The Counc1l was 1nformed that the City's Insurance Po11cy had been
prepared and w1ll be ava1lable soon It was noted that the Council should
make a mot1on to continue the coverage as it is currently held A mot1on
was made by Jim Krystosek and seconded by Donatus Vetsch All were in favor

The 1990 Sheriff's contract was approved on a mot1on by Donatus Vetsch
and seconded by Bob Braun All were 1n favor and the mot1on carr1ed The
m1nutes should note that the contract pr1ce increased by $ 25 an hour
