ALBERTVILLE CITY COUNCIL
SPECIAL MEETING
May 30, 1991

PRESENT: Mayor Jim Walsh, Councilmen Donatus Vetsch, Mark
Barthel, and Duane Berning (arrived at 9:00 PM), City Clerk Linda
Houghton, Attorney Bill Radzwill, Engineer Thore Meyer
Mayor Walsh called the special meeting to order. The purpose
of the special meeting is to discuss the following four projects:
(1) Westwind Phase II
(2) Beaudry property
(3) Fraser Steel
(4) Savitski Sunrise Commercial Park assessments
Attorney Radzwill explained that the City prefers that
improvements in the Westwind Phase II development be done under the
429 statutes. A final decision on whether the improvements will
be assessed under these statutes must be made before the
Developer's Agreement can be completed.
The developers have requested that the Ci ty decrease the
surety amount provided through a Letter of Credit from 30% to 15%
of the project costs. Radzwill explained that this can be
negotiated with the Council before the Developer's Agreement is
finalized.
The developer must also provide the clerk with the covenants
proposed for Phase II to allow the Council to review them at the
June 3 Council meeting.
The temporary 20' easement to the park area will be released
at the completion of a dedicated street into the park.
John Darkenwald requested that the Council order a Feasibility
Study for the Westwind Phase II improvements with the developer
responsible for payment of all costs associated with the study.
Barthel made a motion directing the City Engineer to prepare
a Feasibility Study for Westwind Phase II, with all costs to be
borne by John George, Inc. It is the Council's understanding that
drainage into County Ditches 9 and 21 has been approved by Wright
County. Vetsch seconded the motion. All voted aye.
Radzwill explained that a new deed has been prepared on the
Beaudry property. There still are nine more years of assessments
on the parcel, which wi 11 be di vided between the Ci ty and the
Steffens. Before the deed can be recorded, all taxes must be paid.
Attorney Mike Corey reviewed the series of events involved in
the Fraser Steel project. Up to now, the signed promissory note

has not been located. A complete written report on the entire
project will be prepared for the Council to review.
Attorney Mike Corey reviewed his findings on the charged
assessed to the Sunrise Commercial Parks lots and the bond used to
finance the pro ject . Corey wi 11 be research the bond and the
actual charges that should be assessed to Andy Savitski and will
provide a complete report on his findings. It appears that the
assessments levied on the lots may be more than the actual costs
of the project and the figures may need to be adjusted.
Barthel made a motion to adjourn at IO:35 PM. Vetsch seconded
the motion. All voted aye.
