PRESENT: Mayor Mike Potter, Councilmembers Duane Berning,
Albert Barthel, John Vetsch and Sharon Anderson, City Attorney Mike
Couri, City Clerk Linda Houghton
Mayor Potter called the closed meeting to discuss the
assessment appeals filed by 50th Street residents.
Attorney Couri reported there is a scheduling conference
coming up the toward the end of February. The trial is scheduled
for late in May. The attorneys have agreed to limit discovery to
depositions of our appraiser and their appraiser. Couri estimates
that the trial will last 1-2 days.
Couri recommends that the Council consider some sort of
settlement discussion after the plaintiff's appraisal comes in.
Couri would prefer to have two Councilmembers appointed to a
committee to discuss any settlement proposals in an attempt to
speed up the process. The committee would make a recommendation
to the entire Council.
Potter made a motion to appoint Councilmembers Berning and
Vetsch to the committee to consider settlement offers and prepare
their recommendation for the entire Council to consider. Barthel
seconded the motion. All voted aye.
Barthel made a motion to adjourn at 8:45 PM. Berning seconded
the motion. All voted aye.
