Acting Mayor Berning called the regular Meeting of the
Albertville City Council to order.

Hearing and the Pebruary 6, 1995, regular City Council meeting (as
amended). Muyres seconded. the motion. All voted aye.
VetSch made a motion to approve pa~nt of Check I's 9136-
9163 as presented. Murres seconded the motion. All voted aye~
Acting Mayor Berning asked if there was anyone in the audience
who wished to address the Council. 110 one addressed the Council.
Anderson made a motion recognizing receipt of "thank you" note
from Jerome Perraul t. Vetsch .econded the motion. All voted aye.
Anderson made a motion to accept a $300 donation from the st.
Michael-Albertville Women of TOday for use in the parks. Vetsch
seconded the motion. All voted aye.
Anderson made a motion to accept a $3500 donation \ from the
Albertville Jaycees for the purchase of barricades, chairs, and a
generator and fora $2000 dotlation to the Albertville Priendl y
Days. Vetseh seconded the motion. All voted aye.
Anderson made a motion to accept a $2700 donation from the
Albertville Jaycees for the purchase of lumber, sound board, labor

and hardware for soundproofing the Park Shelter. Vetsch seconded
the motion. All voted aye.
Anderson made a motion to accept a $900 donation from the
Albertville Jaycees for the purchase of trash containers and gutter
for the Park Shelter. Vetsch seconded the motion~ All voted aye.
Anderson made a motion to approve the 3. 2 Bon-Intoxicating
Liquor Licen.. for the Albertville Jaycees on March 4, 1995, from.
6:00 PM to ~daight. Vetsch seconded the motion. All voted aye.
Anderson ...de a aotion to approve the Pollow-Op Sheet from the
February 6, 1995, "!lting as presented. Vetsch seconded the
motion. All voted aye.
Anderson made a motion to approve the Pinancial statement for
the period January 31 - Pebruary 15 as pres.nted. V.tsch second.d
the motion. All voted aye.
Anderson made a motion to set the 1994 Board of Review meeting
for Tuesday, April 18, 1995, at 7:00 PM. V.tschseconded the
motion. All voted aye.

Anderson made a motion to accept receipt of the 1994 franchise
fee payment from Jones Int.rcable inth. amount of $3,227.45.
Vetsch seconded the aotion. All voted a7e.
City Engine.r Pete carlson revi.wed his letter dated Pebruary
13, 1995, regarding the ownership and responsibility of the Joint
Powers Water System. Carlson i.concerned that the Joint Powers
System does not have a comprehensive water plan to properly plan
major improvem.nts to the system. Carl son feel s that . the Joint
Powers Board should retain ownership and responsibility for major
capital improvem.nts and maintenance costs; however, he also feels
that the ownerShip and maintenance of the .local distribution system
should remain with the local cOl1llluni ty, rather than the Joint
Powers Board. After discussion of the absence of a Comprehensive
Water Plan, Anderson made a motion to have P.te attend, along with
the two City representatives, the Pebruary 27th Joint Powers Board
meeting to discus the City's concerns. Vetsch seconded the
motion. All voted aye.

The Council revi.wed the letter fraa the Joint Powers Board
expl aining the recnt!lst to approve the Deba1er Agreement.
Councilmember Vetsoh. r.c~nded that the Council approve the
revised agreement. After much discussion regarding the. agreement,
Anderson made a motion to table a decision on the agreement until
the City's JointPoll.rs r.pre..ntatives can get further
clarification on the agr....nt. Muyres seconded the motion. All
voted aye.

Muyres suggested that both Mike Potter and the city attorney
review the agreement and mate a recoanendation to the Council.
Councilmember Vetsch reported ont he otsego Creek Authority
meeting. The City ofots89o haa requested that Ali:>ertville submit
information regarding the run-off to be expected from the
Albertville portion of the wateraheddraining into Otsego Creek
once it is developed. Cit}' EDgineerrete Carlson explained that
the run-off rate will be no greater after the area ia developed
than it is undeveloped. The total volume of ..ter will be 9reater
but the run-off fate wi 11 r...in the .... through tbe use of
detention ponds on site. Linda was directed to send a letter
expressing that opinion, as well as a copy of the drainave amounts
previously calculated, to the CIty of otsego.
Muyres made. moti()n to table discussion of Mike Rutkowski's
employment status indefinitely. Ander.on seconded the motion. All
voted aye. ! "
Anderson made a motion to appointCounci 1 member Vetsch as
Assistant Need Inspector and to have him attend the W.ed Inspector
Annual Meeting on March 13, 1995. Muyres seconded the motion.
Anderson, Muyres, and Berning voted aye. Vetsch abstained from
voting. The motion carried.
city Clerk Linda Boughton stated that oney one sealed bid was
received for the purchase of the single phase generator advertised
offered for sale by the City. That bid was from DennisPehn in the
amount of $1,050. Anderson made. BIOtion to accept the bid from
Pehn and sell the genera\or to him at the cost of $1,050. Vetsch
seconded the motion. All voted aye.

... Donatus Vetsch w.. presnt to discuss the former water tower
lot maintenance. . Vetscll ...lained to the Council that he has aow.d
and taken care of the laWllon the water tower site for the past 22
years with no coMpensation. 80w that the tower has been removed
and the City may sell the lot, Vetsch is requesting that he be
compensated for the maintenance by being9iven a 10 foot strip on
the west side of the water tower lot or reimbursed in the amount
of $2,600 ($6/mowing X 20 mowings per year X 22 years). The
Council pointed out that Vetsch has had use of the property for
garden space for those 22 ,ears. I
Anderson made a motion to table further discussion of the
question until after the appraisal on the lot has been completed.

Anderson made a motion to set Saturday, May 13,1 995, as
Community Pride Day. The Council and any citizens who wish to
participate will plant shrubs, flowers, etc. around City Hall from
9:00 AM to 1:00 PM. Vetsch seconded the motion. All voted aye.

Vetsch made a motion to appoint Counci I member Anderson to
Chair the Community Pride Day. Huy~es seconded the motion. All
voted aye.
Counci I m4tmber Anderson reported she has been approached by the
Albertville Lionesses about the possibility of removing the voting
booths in. the old ai ty hall bui lding. The Lionesses agreed to
provide the labor... .. The Council concurred that the booths could be
removed but the ..intenance department will be responsible for the
removal.

The Council discUHed Ordinance 11995-7. This ordinance
defines the processes the Council will follow in its meetings and
in passing its ordinanc.. and resolutions. Anderson made a motion

amended by deleting the second paragraph and amending the third
paragraph to read as follows: "Whereas, the City Council is
