ALBERTVILLE CITY COURCIL SPECIAL ~IRG Rov~er 30, 1995 Albertville City Hall 7:00 PM PRESENT: Mayor Mike Potter, Councilmembers Duane Berning, John Vetsch, Curt Muyres, and Sharon Anderson, City Administrator Garrison Hale, City Clerk-Treasurer Linda Houghton, and City Attorney Mike Couri Mayor Potter called the special meeting of the Albertville city Council to order. Anderson made a motion to approve the agenda as presented. Muyres seconded the motion. All voted aye. Mayor Potter reviewed the ordinance detaining the city administrator's job description with the Council. Councilmember Muyres suggested that the evaluation process be a team-building approach with the Council identifying the employee's strengths and weaknesses. Muyres recommended that the administrator rate himself on each item of the Performance Evaluation Sheet followed by each Councilmember discussing his/her rating of the administrator on the same item. Muyres al so suggested that when the evaluation of the administrator is concluded, the administrator give the Council feedback on its performance and recommend ways teamwork can be improved. The Council agreed with Muyres' recommendations on the procedure for the evaluation. The administrator/Council evaluations were conducted. City Attorney Couri reviewed with the Council a chart on Consolidation Proceedings. The Minnesota Municipal Board (MMB) has ini tiated proceedings for the consol idation of Albertvi 11 e and otsego in accordance with M.S. 414.04. Each City is required to submit a list of 10 individuals to the MMB for consideration as candidates for the Consolidation Commission. Further, each City must submit a list of three individuals, none of whom can be residents of Albertville or otsego but who must be residents of Wright County, to be considered as the chair. The Consolidation Commission holds hearings and issues a report within two years. Following receipt of the report, the MMB hol ds a consol idation hearing, considers the Consolidation Committee's recommendation, takes additional testimony, and then makes an order. If the MMB orders no consol idation, the process ends. I f the MMB orders consolidation, each City Council considers the order and votes to approve or disapprove by resolution. If the Councils approve, a . . . ALBERTVILLE CITY COUNCIL November 30, 1995 Page 2 of 3 referendum election is held to determine if consolidation should take place. If the Councils disapprove, 10% of the voters in the last general election may petition for a referendum election to decide if a consolidation should occur. In either situation, the voting public makes the final decision to consolidate or not. Attorney Couri advised the Council that he is unable to represent Albertville in the consolidation proceedings because his firm serves as legal counsel to both Albertville and otsego. He advised the Counci I to seek outside counsel to represent its interests and recommended an attorney from Northfield, Peter Schmitz, who has worked on several consolidation proceedings. The Council discussed the pros and cons of the consolidation proceedings. Counci lmember Muyres suggested that the Counci I conduct an executive meeting with an attorney to discuss options. Mayor Potter advised the Council that the MMB has extended the date on which the list of candidates must be submitted to January 9, 1996. The Council directed staff to place an ad in the Crow Ri ver News asking for vol unteers interested in serving on the consolidation committee. Potter made a motion to appoint Councilmembers Berning and Vetsch to the Frankfort Drainage Committee. Anderson seconded the motion. All voted aye. City Administrator Hale bri~fed the Council on the status of various projects. Anderson made a motion to adjourn at 10: 05 PM. seconded the motion. All voted aye.
