2005-03-21 CC Minutes ClosedA�Ibcrtvillc snm.,�U n City of Albertville City Council Closed Session Minutes March 21, 2005 Albertville City Hall 9:45 PM PRESENT: Mayor Don Peterson, Council members Tom Fay, Ron Klecker, LeRoy Berning and John Vetsch, Assistant City Engineer Bob Moberg, City Attorney Mike Couri, City Administrator Larry Kruse, and City Clerk Bridget Miller City Administrator Kruse briefed the Council on the history of Kenco, Pilot Land and Woodside Communities. City Administrator Kruse stated City Attorney Couri had drafted up a Settlement Agreement for the Council's review. City Attorney Couri informed the Council that Pilot Land's Attorney has drafted up a Settlement Agreement of which Kent Roessler wanted to be something very simple or basic. City Attorney Couri noted the Settlement Agreement from Pilot Land's Attorney is not as tight as he would like to have it. City Attorney Couri brought to the Council's attention Pilot Land Development came up with an agreement including a specified pay-off amount. City Attorney Couri went on to state contingent of this; the City would like Pilot Land Development to provide us with a document noting Kenco has been assigned to Pilot Land Development. City Attorney Couri explained with past development we have agreed to reimburse for the access fees. City Attorney Couri stated the City could continue through mediation in which we could get more. But it would involve more Attorneys' fees. City Attorney Couri recommended proceeding with the settlement with the exception the City obtains the documentation assigning Pilot Land Development from Kenco. Mayor Peterson directed staff to proceed with the settlement only IF the City gets the assignment document in regards to Kenco. Council members Klecker, Berning, Vetsch, and Fay were in agreement with Mayor Peterson to proceed under the conditions of the assignment document.
