ADOPT AGENDA MOTION BY Council member Vetsch, seconded by Council member Fay to approve the agenda as amended: Adding: 8.H.2. Silt Fences 8.H.3. Update on the Railroad Property and meeting with Deb Holm, owner of 152 Club 8.H.4. Wright County Sheriff 8.H.5. Albertville Historical Committee Open House Removing: 7.A. Motion carried unanimously. MOTION BY Council member Wagner, seconded by Council member Berning to approve the Monday, April 2, 2007 regular City Council minutes was amended to include the following: Mayor Klecker wanted it noted in the minutes thanking Assistant City Engineer Adam Nafstad for attending the meetings in St. Michael, and assisting with the negotiations on the Stormwater Pond issue at the St. Michael Council meetings, and on file in the office of the City Clerk. Motion carried unanimously. Motion carried unanimously. CITIZEN FORUM Mayor Klecker asked if there was anyone present that wanted to speak to the Council regarding an issue that was not on the agenda. The residents that were present during the Citizen Forum did not have any issue or concern to discuss with the Council. MOTION BY Council member Berning, seconded by Mayor Klecker to approve check number 024136 to Bobcat of West Metro in the amount of $142.44 for general maintenance on the Bobcat. Motion carried unanimously. PUBLIC HEARING Resolution No. 2006-69 Vacation of MacKenzie Avenue NE that lies North of 52nd Street NE and South of the Burlington Northern Railroad within the City of Albertville (tabled at the March 5, 2007 and April 2, 2007 meetings) Assistant City Attorney Hartnett asked that Resolution No. 2006-xx be tabled until a future date, which is unknown at this time. DEPARTMENT BUSINESS PUBLIC WORKS DEPARTMENT Set Monday, May 7, 2007 at 6:00 p.m. as a Public Works Committee meeting MOTION BY Council member Berning, seconded by Mayor Klecker to set Monday, May 7, 2007 at 6:00 p.m. as a Public Works Committee meeting. Motion carried unanimously. BUILDING DEPARTMENT 2006 Year-end Building Permit Activity Report - January 2007 Building Permit Activity - February 2007 Building Permit Activity - March 2007 Building Permit Activity Council member Berning requested for a second time that the Building Official prepare an estimate of Building Permit Revenue for the year 2007. City Administrator Kruse reported that the Finance Director does prepare a quarterly budget report for the Council. FINANCE DEPARTMENT There was nothing additional to report on from the Finance Department. M:\Public Data\City Council\Council Minutes\2007 Minutes\M 04-16-07 Final.doc City of Albertville City Council Minutes April 16, 2007 Page 4 of 7 City Clerk Monticello -Big Lake Community Hospital would like to present the 2006 Community Report to the Albertville City Council at a future meeting Mayor Klecker informed the Council and staff members that Albertville should thank the Monticello -Big Lake Community Hospital for the opportunity to hear about the 2006 Community Report, but did not see a need for the Monticello -Big Lake staff to conduct a presentation. Other Council members instructed staff to invite the Monticello -Big Lake Hospital staff to present the 2006 Community Report at a future meeting when the agenda appears to be light. PLANNING AND ZONING Council member Vetsch inquired about the possibility of organizing a Housing and Redevelopment Authority. The HRA would be a pro -active approach to fixing up the homes along Main Avenue NE. City Planner Brixius reported that there are other communities that are built out and are looking towards re -development. Brixius informed the Council that staff would report on the potential of an HRA committee at a future meeting. ENGINEERING The Assistant City Engineer Nafstad did not have items to report on during the meeting. LEGAL Approve STMA Pond Construction Agreement Between City of Albertville and Independent School District 885 City Attorney Couri reported that the agreement is contingent on a couple of issues, which is that ISD 885 has previously granted Albertville an option to purchase an easement or fee interest in a parcel of land intended to be used for Stormwater ponding. The school wants to give the property to the City, rather than have an easement. The school has informed staff that the school anticipates completion of the elementary school and grading should be completed by early July 2007, which was brought to staffs attention just this morning. MAPublic Data\City Council\Council Minutes\2007 Minutes\M 04-16-07 Final.doc City of Albertville City Council Minutes April 16, 2007 Page 5 of 7 Another section that is in negotiation is Part 4. of the agreement that deals with the payment: if the alternate bid is accepted, Albertville agrees to reimburse ISD 885 for all fees, costs and expenses charged by the contractor and incurred by ISD 885 associated with the work performed to construct the Pond pursuant to the alternate bid. The other item in the agreement that is under review is Part 5. Payment of Additional ISD 885 Expenses, which stated that Albertville shall reimburse ISD 885 for all reasonable expenses it incurs in reviewing Albertville Pond plans, modifying its engineering plans and specifications to accommodate Albertville's Pond, any additional engineering, inspection and staking costs related to the pond should it be constructed, and any additional costs it incurs as a result of including the alternate pond bid in its bid packet. Assistant City Engineer Nafstad reported that the City is dealing with two plans; one is the high school, the other is the elementary school. The sooner Albertville receives their approvals from St. Michael, the better Albertville will be able to proceed with the ponding. The school district is encouraging both cities to obtain the approvals and the ability to proceed, so the school can proceed with the construction of the schools. Additional discussion ensued on the pond construction agreement between the City of Albertville and the STMA School District. Council had concerns with the cost associated with the construction of the ponding. Council suggested putting a cost not to exceed value on the pond construction in the agreement. City Administrator Kruse reported that staff will work through the issues and or concerns regarding the construction date and the cost not to exceed value. Council asked if Albertville could receive detailed invoices from the School regarding the costs associated with the ponding project. Kruse re -assured the Council that staff will do their best to monitor the construction of the pond project and the costs associated. Assistant City Engineer Nafstad will conduct inspections and updates. MOTION BY Council member Berning, seconded by Council member Fay to approve the STMA Pond Construction Agreement between the City of Albertville and Independent School District 885. MAPublic Data\City Council\Council Minutes\2007 Minutes\M 04-16-07 Final.doc City of Albertville City Council Minutes April 16, 2007 Page 6 of 7 ADMINISTRATION Set a Public Hearing for Fraser Steel Tax Increment Financing District (TIF 13) to be held on Monday, June 4, 2007 beginning at 7:00 p.m. or soon thereafter, which will be held at the Albertville City Hall located at 5959 Main Avenue NE City Administrator Kruse reported that staff anticipates approval of the Fraser Steel TIF; therefore, staff is looking for approval to set a public hearing to be held on Monday, June 4, 2007 for 7:00 p.m. or soon thereafter to be held at the Albertville City Hall. MOTION BY Council member Vetsch, seconded by Mayor Klecker to set a Public Hearing for Fraser Steel Tax Increment Financing District (TIF 13) to be held on Monday, June 4, 2007 beginning at 7:00 p.m. or soon thereafter, which will be held at the Albertville City Hall located at 5959 Main Avenue NE. Motion carried unanimously. SILT FENCE BEHIND THE PARKSIDE COMMERCIAL DEVELOPMENT Mayor Klecker inquired about silt fencing that abuts up against the residential property with the Parkside Commercial Development. It appears that the construction is complete and the silt fencing could be removed. If it is not removed, then the developer should be notified to repair and maintain the silt fence until it is completely developed. Nafstad reported that staff will notify the developer regarding the appearance of the silt fencing and encourage the developer to remove and place appropriate landscaping, which will be maintained by the property owner. RAILROAD PROPERTY Council member Berning inquired about the status or progress on the recent purchase of the Railroad Property. City Administrator Kruse reported that City Planner Brixius and myself met with Deb Holm, the 152 Club owner, to discuss and negotiate the land trade or purchase of the City's Railroad Property to get her site in compliance. There was additional discussion between the Council and staff on the platting process of the new City Hall, which will include the recent purchase of the Railroad Property. Council member Vetsch brought up a consideration of selling some of the Railroad Property to the properties that are located along 60th Street NE that abut up to the Railroad Property. The discussion went back to the negotiation with Ms. Holm and consideration to other property owners along 57th Street NE east of Main Avenue NE, where the rear lots abut up to the Railroad Property. Council would like to set up a work session with the deputies to discuss "what are some of their concerns that they see or experience". Council suggested forming or setting up a Police Commission or Police Committee. Council recommended holding a workshop once or twice a year to review Police Protection and expectations. HISTORICAL COMMITTEE — OPEN HOUSE Council member Berning brought to the Council's attention the fact that a date has been set for an Albertville Historical Committee open house. The open house will be held on Saturday, April 28, 2007 at the Albertville City Hall from 10:00 a.m. to 2:00 p.m. The committee is inviting all those residents that may have some historical facts or photos they would like to share about the City of Albertville. All council members are more than welcome to attend. The committee would like to serve some beverages and cookies. Council member Fay recommended putting it in the 2008 Budget the funds to purchase appropriate frames or display cases for the Historical Society exhibits. WIRELESS COMMITTEE Mayor Klecker briefly reported that he has a couple of residents that are interested in participating in a wireless committee. No date has been set for a meeting yet.
