ALBERTVILLE CITY COUNCIL October 18, 2010 MINUTES ALBERTVILLE CITY HALL CALL TO ORDER — PLEDGE OF ALLEGIANCE 7:00 PM The Mayor called the regular bi-monthly meeting of the Albertville City Council to order followed by the pledge. ROLL CALL PRESENT: Mayor Ron Klecker, Council members Dan Wagner, John Vetsch, Tom Fay, and Larry Sorensen STAFF MEMEBERS PRESENT: City Engineer Adam Nafstad, City Clerk Bridget Miller, Finance Director Tina Lannes, and Assistant City Attorney Sarah Schwarzhoff ABSENT: City Administrator Larry Kruse, City Attorney Mike Couri, and City Planner Alan Brixius RECOGNITIONS — PRESENTATIONS — INTRODUCTIONS none CITIZENS FORUM none AMENDMENTS TO THE AGENDA The Monday, October 18, 2010 agenda was amended as follows: Council member Vetsch wanted to add an item under City Council to discuss the possibility of WPublic Data\City Council\Council Minutes\2010 Minutes\M 10-18-10 approved.doc City of Albertville City Council Minutes October 4, 2010 Page 2 of 8 passing an ordinance or ruling to look at collecting some form of a Transportation Dedication fee in the remaining Commercial and or Industrial areas versus collecting the Park Dedication fee. CMs Fay/Vetsch motioned to approve the Monday, October 18, 2010 agenda as amended; to include discussion on the Transportation Dedication fee. Motion carried unanimously. APPROVE RESOLUTION NO.2010-025 RELATING TO THE ALBERTVILLE MEADOWS APARTMENTS Ben Johnson with Kennedy and Graven noted the Bond Counsel has prepared a Resolution for Council's review, which is the last step to complete the process of the issuance of the Bonds and the Notes that the Council preliminarily approved in May 2010 for the Albertville Meadows Development. In order to issue the Bonds and the Notes, the City must receive an allocation from the Office of Minnesota Management and Budget and such an allocation that was received on September 27, 2010. Johnson briefly went over some of the background of how the process began. The Albertville Meadows Development - Albertville Meadows Apartment Project is selling the project to Albertville Leased Housing Associates III, LP. The sale and purchase of the Project will allow for the new owner to provide for approximately $1,360,000 of improvements to the Project. The purchase price of the Project will be approximately $6,750,000 so the Borrower will be making improvements to the Project that will be equal to approximately 20% of the purchase price of the Project. Under the documents relating to the Bonds and the Notes (and the low-income tax credits associated with the Project) the Borrower will maintain 40% of the units in the Project for individuals and families that make no more than 60% of the area median income (adjusted for family size). These income restrictions on the Project are similar to the restrictions that have been in place for many years under the current ownership. The Project will continue to be managed by the same management company, Dominium Management. Council member Vetsch brought up the topic of Section 8 Housing, which there was no comment included in the resolution. According to State Statute, Assistant City Attorney Schwarzhoff reported stipulation language restricting Section 8 Housing cannot be included in the resolution. CMs Wagner/Sorensen motioned to approve Resolution No. 2010-025 entitled a Resolution Authorizing the Issuance, Sale, and Delivery of Revenue Bonds and Subordinate Notes Relating to the Albertville Meadows Apartments Project; and Approving the form of And Authorizing the Execution and Delivery of Certain Documents Relating to the Revenue Bonds and Subordinate Notes as presented; the signed copy will be scanned and retained as the official City record. FINANCE DEPARTMENT Authorize the Monday, October 18, 2010 Payment of Claims (bills) for check numbers 028949 to 029002 as presented Council member Wagner questioned check number 028955 made payable to Brothers Fire Protection in the amount of $350.00 for annual inspection and testing of the sprinkler systems within the Public Works Facility and the Fire Hall. Wagner wanted an explanation why the Public Works and Fire Hall need these inspections. Finance Director Lannes explained the Albertville City Hall would require an annual inspection of the sprinkler systems as the facility is rented out throughout the year, which the City is encouraged to make sure the systems are working appropriately; however, with the other buildings Lannes was not sure if it was a state requirement to get them tested because they are public facilities. Lannes concluded with the comment that she would check with staff to verify the need to have the other buildings sprinkler system tested. CMs Wagner/Fay motioned to authorize the Monday, October 18, 2010 Payment of Claims for check numbers 028949 to 029002 in the amount of $164,861.29 as presented, that will be scanned with supporting documents; the electronically scanned version will be kept on file in the office of the Finance Director that will serve as the City's official record. Motion carried unanimously. CITY CLERK Approve October 1, 2010 special City Council minutes CMs Fay/Sorensen motioned to approve the Friday, October 1, 2010 special Council minutes as presented; the signed copy will be scanned and retained as the official City record. Approve Resolution No. 2010-026 appointing 2010 General Election Judges Mayor Klecker commented there is a Resolution before the Council to approve appointing Election Judges to serve at the Albertville Precinct for the 2010 General Election taking place at City Hall. CMs Vetsch/Fay motioned to approve Resolution No. 2010-026 entitled a Resolution Appointing Election Judges for the 2010 General Elections held within the Albertville city limits, that will serve at the Albertville Precinct located at 5959 Main Avenue NE on November 2, 2010 as presented; the signed Resolution will be scanned and retained as the official City record. Motion carried unanimously. CITY COUNCIL Recycling Contract Recommendation Mayor Klecker reported that back on September 2, 2010 the Council authorized proposals for recycling services. At the same time appointed Council members John Vetsch and Larry Sorensen to coordinate with staff on evaluating proposals and bring a recommendation back to City Council. The City sent out seven (7) Requests for Proposals (RFPs) that included ACE Solid Waste. The City received four (4) proposals for consideration, which ACE Solid Waste did not participate. Recycling Committee reviewed the questionnaire from the four (4) participants to clarify a number of issues. Council members Vetsch, Sorensen, and City Administrator Kruse conducted interviews with each company to provide an opportunity for them to market their services and to discuss questions. The proposals were evaluated based on the cost of service; innovation to increase both the number of people recycling and the amount they recycle; innovation related to recycling education; evaluation of supplemental written questions and lastly the responsiveness of the Company during the RFP process. Committee member Sorensen invited the remaining members of the Council for their input on what option they would prefer. Committee member Vetsch commented on Option 2, since the Council encourages staff to support local vendors he would like to see the City go with Randy's Sanitation located in Delano. M:APublic Data\City Council\Council Minutes\2010 Minutes\M 10-18-10 approved.doc City of Albertville City Council Minutes October 4, 2010 Page 5 of 8 Council member Wagner agreed with Vetsch on the thought of keeping the business close to Albertville; however, Allied Waste appears to be a better deal as residents have been asking for single -sort versus dual -sort. Wagner regretted to admit that citizens are busier these days and single -sort would be easier to accommodate the lifestyle compared to sorting out items. Jim Wollschlager, Director of Operations for Randy's Sanitation shared the recycling cart they provide encourage the homeowner to place the higher volume of recycling in the main part of the cart and the lower volume would be placed in the bin. Offering this type of recycling would `recycle' the bins that are in place today by drilling a couple of holes and placing `S' hooks in them. With little effort the materials are slightly pre-sorted when the truck stopped by. One of the garbage employees would step out of the truck; lift the lid to remove the bin with the lesser amount of recyclables. At the same time the bin is removed the garbage hauler glances at the remaining items in the cart to ensure it is all recyclable. If there are some items that are non - recyclable, the hauler would leave a note or tag the garbage container bringing it to the homeowner's attention of the violation. Rich Hirstein with Allied Waste Services commented that the single -sort works well in other communities. The garbage truck does not compact the recyclables, instead a lever moves them forward or backward out of the way for the next load. As the garbage cart is being dumped into the truck the driver has the ability to glance at the material or items being disposed of. If there is an issue or concern, the garbage cart would be tagged letting the homeowner know of the items not acceptable for recycling. Mark Meehan of Albertville wanted to know if Recycling Committee or staff checked with other communities on how they are disposing of the recyclables. Meehan also wanted to know if the public had an opportunity to express or share their comments on recycling. In other words, Meehan encouraged the Council to conduct a Public Hearing to take public comment. In response to Meehan's comments, Council member Sorensen reported he did research on the internet relating to recycling where single -sort was preferred over mutli-sort. Sorensen asked a resident from Maple Grove who had single -sort that works out great for the family. Mark Stoltman with Randy's Environmental Services confirmed the main purpose is to encourage the community to recycle. Stoltman commented on the current recycling program and stated it is rather overwhelming with the directions on how to dispose of your materials. Reducing down to even a dual -sort cart would be an accomplishment if the residents increase the amount of recycling. CMs Sorensen/Wagner motioned to approve Option No. 1 to select Allied Waste for single stream (single sort) recycling, direct the City Attorney to draft a contract, and bring back to the next meeting. Further to pass this monthly charge unto the utility bill and direct staff to maintain a separate accounting of these funds. Council members Sorensen and Wagner voted aye. Mayor Klecker, Council members Fay, and Vetsch voted nay. Motion dies. Mayor KleckerNetsch motioned to set Wednesday, November 3, 2010 to hold a public hearing to take public comment on the two (2) options being considered for recycling; the two (2) options are going with Allied Waste for single -sort recycling or Randy's Sanitation to go with a dual -sort system. Following public comment the Council hopes to have sufficient response to make a consecutive decision. Mayor Klecker, Council members Fay and Vetsch voted aye. Council member Wagner was okay with holding the public hearing. Council member Sorensen voted nay. Motion carried. Transportation Incentive Fee Council member Vetsch began with the comment that it appears the majority of the parks have been updated and are complete. There is still land within Albertville to be developed, which a limited amount in residential districts. Vetsch felt it would be in the City's best interest to consider amending the Code to collect funds when the Industrial or Commercial land is developed to assist with the transportation (street) maintenance. Council acknowledged the recommendation Council member Vetsch made. Staff reported the need to have some type of formula or table similar to Park Dedication Fees to justify the collection of the fee. There will be the need to justify the fee that would be collected up front with the paperwork to accomplish the legality to move forward and implement the proposal. In summary, the Council directed the Finance Director to have the City Administrator and Finance Director check with other communities that have implemented the collection of a transportation fee when Industrial or Commercial property is developed. Staff would report back at a future meeting. Assistant City Attorney Schwarzhoff commented when the site was initially developed it was proposed for commercial. About two (2) years ago the Council received a request from Horizon Church to allow Parkside Commercial 2°a to hold Sunday morning worship services within a portion of the building. Council reviewed the option and approved the worship services to take place with a number of stipulations. Since then the Horizon Church has grown and are looking at the possibility of expanding. The church has contacted staff with the potential, which they will come back to the Council at a later date with a written request to occupy more space on the site.
