The Subject Property's value and resulting assessment are greater than can lawfully or
constitutionally be established or impossd; the value and assessment were determined
and imposed in an arbitrary and unreasonable manner and are excessive, unfair,
discriminatory, illegal, and invalid; and the real property tax fevied as of the above-

captioned assessment date against the Subject Property is iliegal. Petitioner alleges the
error(s) in the assessment stated in Table Three and requests from the court a judgment
correcting said error(s).

1. The Court determine the validity of the petitioner's claims, defenses and
objections with respect to the valuation and assessment of the Subject Property
for real property tax purposes.
2. The Court reduce the estimated market value for the Subject Property from the
value placed upon it by the assessor.
3. The real property tax assessment be reduced to a legal amount.
4. The court grant judgment to petitioner herein for such other and further relief as
is just and equitable.

That the foregoing valuation of said real estate is excessive and greater than its real or actual
value, and discriminates against the real estate in favor of comparable properties. To the extent that the
total market value assigned to said real estate exceeds actual market value or discriminates against said
real estate, said real estate has been partially, unfairly, unequally valued for the said year in violation of
M.S.A. § 273.11 and in violation of Article X, section 1, of the Constitution of the State of Minnesota;
and that the tax levied against the same is illegal in whole or in part, within the meaning and
contemplation of M.S.A. § 278.01, et. seq. To the extent that the tax levied against said real estate is
based on a total market value which exceeds actual market value or discriminates against said real estate,
the real estate will be taken without due process of law, in violation of Article I, section 7 of said
Constitution.

That the limitations on relief set forth in M.S.A. § 278.05 subd. 4(d) unconstitutionally violate the
prohibitions against (i) denial of due process, (ii) denial of equal protection of the laws, (iii) lack of
uniformity in ta�cation, (iv) denial of redress of injuries or wrongs, and (v) exercise by the legislature of
powers properly belonging to the judiciary, contained in the state and federal constitutions.

That for purposes of real estate taxation, the real estate is improperly classified.
WHEREFORE, the Petitioner prays that the Court determine and adjudicate the validity of its
claim and objections as above set forth; that it determine the fair and proper valuation of said real
property for tax purposes as of January 2, 2011; that it award costs, disbursements and interest to
Petitioner; that it declare the limitation of relief contained in M.S.A. § 278.Q5 subd. 4(d)
unconstitutional; that it classify the property in accordance with the law; and that it award such other
relief as the court deems just and equitable.

1. Alshouse Properties LLC, hereinafter "Petitioner", is the owner of a parcel of real
estate situated in the City of Albertville, County of Wright, State of Minnesota, the address, property
identification number and legal description as set forth on the attached e�ibit, all of wluch are
hereby incorporated herein as though recited at length.
2. Petitioner claims said real estate was unfairly and unequally assessed and wrongfully
classified for the purposes of real estate taYes payable in 2012, and was assessed at a valuation
greater than its real or actual value, and that consequently the real estate ta��es payable in 2012 are
excessive and unreasonable for the reasons, among others, herein alleged.
3. The real estate value assessed for the above described property in 2011 for which real
estate taxes are payable in 2012 have been arbitrarily assessed, are partial, and have no economic
relation to the market value of the described property, and as a result, said real estate taxes have
worked on an economic hardship upon the owners of the property.
4. Petitioner further claims that said unfair and unequal assessment of real esta.te t�es
pursuant to Minnesota Statutes Chapter 278.05, Subd. 4(d), is a denial of due process to Petitioner in
violation of Article 1, 7 of the Minnesota Constitution and the Sth and 14th Amendments of the
United States Constitution, and that said statute is illegal, unconstitutional, and without force of law.
WHEREFORE, the Petitioner respectfully prays to the Court for an Order, Judgment and
Decree as follows:
1. The market value of the real property described herein be reduced, and that the
assessed value be adjusted accordingly.
2. The taxes upon said real property payable in 2012 be reduced in accordance with such
proper deternunations of value as requested herein.
3. That Minnesota Statutes Chapter 278.05, Subd. 4, be declared unconstitutional to the
extent it denies Petitioner relief from the first 5% of the difference between the assessment/sales ratio
and the median ratio of the class of property of the subject property.
4. The Wright County Auditor and the Wright County Treasurer be directed to correct
the tax list and assessment rolls pursuant to Minnesota Statutes in accordance with such proper
determinations of market value and assessed value as is requested herein and that corrected tax
statements reflecting such change in value as requested herein be issued by the Wright County
Treasurer.
5. There be no penalties, costs or interest on such correct assessment of taxes.
6. Petitioner recover its costs and disbursements therein, together with interest on any
overpayment.

Petitioner presents this Petition to the Court pursuant to the provisions of Minnesota
Statutes Chapter 278 and alleges as follows:
I.
That at all material times Petitioner had an estate, right, title or interest in the parcels of
real property in the City of Albertville, County of Wright and State of Minnesota, Property
Identification No. R101-109-001010.
II.
That said property was valued and assessed for real estate taxes payable in 2012 at a
valuation greater than its real or actual value.
III.
That said property was partially, unfairly and unequally assessed for real esta.te taxes
payable in 2012 in comparison with other properties in said County.
IV.
That the tax levied against said property is illegal in part.
V.
That other property in said County and State and in the pertinent school district and
locale was arbitrarily, systematically or intentionally undervalued and underassessed for real
estate taxes payable in 2012.
VL
That said property was fully or partially improperly classified.
VII.
That the limitation on relief contained in Minn. Stat. § 278.05 subd. 4(d) violates among
other provisions, the state and federal constitutional prohibitions against the denial of due
process, the denial of equal protection of the laws, the lack of uniformity in taxation, the denial
of redress of injuries or wrongs, and the exercise by the legislature of powers properly belonging
to the judiciary.
VIII.
That the valuation and assessment determined by the Assessor for said property and the
resultant tax imposed on said property is contrary to and in violation of Chapters 272, 273 and
278 of Minnesota Statutes (including, but not limited to, any applicable exemption under Section
272.02); Article X, Section 1 of the Constitution of the State of Minnesota; and the Fourteenth
Amendment to the Constitution of the United States.
WHEREFORE, Petitioner prays for judgment of the Court: (1) determining the validity
of the claims and objections of Petitioner with respect to the valuation and assessment of said
property for real estate taxes payable in 2012; (2) that the estimated market value for said
property be reduced from the value placed upon it by the Assessor; (3) that the assessed valuation
and real estate talces payable on said property be reduced consistent with the reduction in the
estimated market value; (4) that Petitioner receive its costs and disbursements and reasonable

attorneys' fees incurred herein; and (S} for such other and further relief as the Court deems
appropriate.

Presentation by the Wright County Assessor(s)
Wright County Assessor Peterson began by explaining the purpose of Local Board of Review
and Equalization is to review the assessment of property. This Local Board of Review and
Equalization is being held for the 2012 assessment for t�es due and payable in 2013. The Board
does not have the authority to change any prior year's assessments. The Local Board does not
have the authority to grant an exemption or to order property to be removed from the tax rolls. A
quorum must be present and at least one of the members must be `Training Certified' under
Minnesota State Statutes Section 274A14. Peterson acknowledged that there are two (2)
members that have completed the training and are certified. State law requires the assessor to be
at 100% of market value; however, the Statutes allow the Assessor to be within a range of 90 to
105 percent of market value. The sales ratio study time frame is from October 1, 2010 thru
September 30, 201 l. The sales date gathered from this ratio period is used to appraise property
as of the January 2, 2012 assessment date. The formula for calculating `Green Acre' taxable
value is statutorily determined by the Department of Revenue as required by the 2008 legislative
changes. The current assessment meets or exceeds standards for uniform assessment in all
jurisdictions established by the International Association of Assessment Officers.
Peterson reported there were 30 qualified sales during the period of October l, 2010 and
September 30, 201 L The median sales ratio is 109.61%, with the median sale price of $136,300.
Peterson continued with the unqualified or foreclosure/bank sales in the quantity of 56. The
median sales ratio for the unqualified sales is 127.69% and the median sale price was $139,900.
Assessor reported that after review and analysis, market based reductions were made on most

properties throughout Albertville. The final sales ratio came in at 101.41%. The State of
Minnesota requires this ratio (estimated market value/sale price) to be between 90-105%.
Peterson stated there are currently six (6) qualified sales to be used for 2013 valuations. Those
sales have a ratio of 90.65% with a median sale price of $167,900.
County Assessor Rasmussen gave a report on the Commercial properties acknowledging the fact
that there is a definite sign of economic times with a fair amount of empty buildings. Wright
County focused on vacant and or empty land throughout the County, which staff had a tight
range to work with. It was a challenge to factor in the cost associated for the commercial sales in
arriving at a fair market value for the shell of a building that is sitting empty or unfinished.
The Assessor's Department realizes that commercial owners have been doing everything
possible to keep the business going, in which some have even gone to more of a Contract for
Deed.
Rasmussen reported that there is still a decline in the market and with the drop in residential
values there might be a shift to commercial, industrial and agriculture.
Board member Hendrickson asked how Wright County is doing compared to other metro
counties.
Rasmussen reported that with fuel costs and foreclosures that the metro counties are starting to
turn faster, but slowly Wright County will get better once the supply declines. The foreclosure
has hit the commercial market. Rental rates for properties also declined due to the market where
it is ranging from $18-$22 per square foot, which is a large decrease from the boom time. Some
of the issues commercial properties face now are financing and the economy.
Peterson reported there was one (1) Albertville property owner that contacted Wright County,
and presented a letter sent by the property owner to the board. The letter was a request to review
the values placed on parcels 101-500-364301, 364302 and 364311. These paxcels are the Old
Albertville Creamery located on Large Avenue NE within Albertville.
County Assessor Rasmussen confirmed that the land that the billboard is constructed on is being
valued at fair market price. Rasmussen took the billboard and compared it to other billboards
within Wright County located on the I-94 corridor. The land has a billboard and that is taken
into account with the calculation assuming the property owner is taking in or receiving revenue
from the billboard company; therefore, rental of the land. Rasmussen stated the value is based
on the land and it's best use and he feels it is a fair value.
With that comment, the Board made the following motion:
Board Members Wagner/Vetsch motioned not to make changes in the values for parcels 101-
500-364301, 364302 and 36431 l. Motion carried.
