CALL TO ORDER - PLEDGE OF ALLEGIANCE Mayor Hendrickson called the meeting to order at 7:00 p.m. 2. ROLL CALL 7:00 PM Present: Mayor Hendrickson and Council members Cocking, Hudson, Olson, and Vetsch Absent: None Staff Present: City Administrator -PWD Adam Nafstad, City Planner Al Brixius, Fire Chief Eric Bullen, Finance Director Tina Lannes, Public Works Supervisor Tim Guimont, and City Clerk Kimberly Olson Others Present: Sergeant Ben Schaap 3. RECOGNITIONS — PRESENTATIONS — INTRODUCTIONS - None 4. PUBLIC FORUM — (time reserved 5 minutes) There was no one present for the forum. 5. AMENDMENTS TO THE AGENDA Motioned by Olson, seconded by Hudson, to approve the Agenda as presented. Ayes: Hendrickson, Cocking, Hudson, Olson and Vetsch. Nays: None. Absent: None. MOTION DECLARED CARRIED. 6. CONSENT AGENDA All items under the Consent Agenda are considered to be routine by the City staff and will be enacted by one motion. In the event an item is pulled, it will be discussed in the order it is listed on the Consent agenda following the approval of the remaining Consent items. These items will be approved by a separate motion. A. Approve the May 1, 2017 Local Board of Appeals and Equalization as presented B. Approve the May 1, 2017 regular City Council meeting minutes as presented C. Authorize the Monday, May 15, 2017 payment of claims as presented, except bills specifically pulled which are passed by separate motion. The claims listing has been Page 1 provided to City Council as a separate document and is available for public view at City Hall upon request D. Approve a Temporary On -Sale Intoxicating Liquor License for the Foxtailers Snowmobile Club on Saturday, June 10, 2017 during the 2017 Albertville Friendly City Days festival held in Central Park E. Approve the Church of St. Albert Lawful Gambling Exempt Permit Application for the annual Parish Festival that will be held on September 17, 2017 at the St. Albert Parish Center Motioned by Cocking, seconded by Hudson, to approve the Consent Agenda as presented. Ayes: Hendrickson, Cocking, Hudson, Olson and Vetsch. Nays: None. Absent: None. MOTION DECLARED CARRIED. 7. PUBLIC HEARINGS — None 8. DEPARTMENT BUSINESS A. City Council 1). Committee Updates (JWPB, FYCC, Fire, Planning, Ice Arena, Parks, etc Joint Powers Water Board Hendrickson confirmed the domain name is owned by a third party, but a formal decision has not been made on whether the Board will purchase the domain name from the third party. Planning Commission Hudson reported the May Planning Commission meeting was cancelled. The Verizon CUP request will be coming back to Planning in August/September. The applicant needed more time to research alternative locations. STMA Ice Arena Board Hudson reported that the Board has released the Kraft Hockeyville funds to the STMA School District. B. Planning/Zoning 1). Central Park Master Plan -Presentation at Meeting Brixius reported that some changes were made to the original concept plan for Central Park. He stated the master plan must accommodate the needs of Albertville Friendly City Days, the farmers market, car shows, and musical events. The master plan incorporates a central corridor, parking along Mh Street NE, spaces for food trucks and carnival rides, and a service lane to the depot. Brixius also showed potential locations for a splash pad. Hendrickson felt the splash pad(s) should be located closer to the depot and farmers market location. Brixius reported the entrance to Central Park was changed to center on Main Avenue NE rather than angled towards CSAH 37 to the north. Hendrickson stated she liked the original concept better. Cocking also preferred the angled entrance and suggested they could have two angled entrances; one to the north and one to the south. City Council Meeting Minutes Page 2 Regular Meeting of May 15, 2017 Nafstad explained the service lane to the depot is not intended for traffic and parking; rather it is a glorified sidewalk to provide access for events at the depot. Brixius stated he will incorporate Council's ideas as well as the Albertville Lions' ideas into the park plan. He explained they will need a specific schedule for the improvements so they do not interfere with Albertville Friendly City Days or the farmers market. C. Public Works/Engineering 1). Tennis Court Regulations Nafstad reported the City has received requests to reserve tennis courts at Albertville parks for an extended period of time. He explained the City has three parks that have tennis courts and these courts have historically been used on a first come, first serve basis. The STMA School District does have reserveable tennis courts and City staff has directed groups to them. Tennis court rules are posted at all tennis courts. The purpose of the ordinance is to allow for enforcement of the general rules should it become needed. Nafstad explained the school district courts are better designed for organized lessons or camps. Motioned by Cocking, seconded by Vetsch, to adopt Ordinance 2017-02 establishing regulations for tennis courts in all city parks. Ayes: Hendrickson, Cocking, Hudson, Olson, and Vetsch. Nays: None. Drainage and Utility Easement Encroachment Agreements — Discussion Nafstad reported they have received numerous requests from residents to place sheds in backyard drainage and utility easements. He stated that residents don't realize how large the easements sometimes are in the rear yards and when they come to apply for a building permit for a shed, City staff informs them sheds are not allowed in easements. Nafstad reported that best practice is to not allow any type of structure within these easements, but residents who have requested these sheds are very frustrated. Nafstad reviewed a drainage and utility scenario and described how small sheds or structures sometimes could be placed in easement areas without causing issues. Nafstad explained he is seeking Council direction if staff should continue to simply deny requests for sheds and small structures in drainage and utility easements or if the Council would be open to an encroachment agreement if the request was reasonable and would not cause a problem. Nafstad explained the agreement would require the shed or structure to be moved if and when the City or private utility companies need to access or work in the easement. Nafstad would not want to see any permanent structures such as pools allowed in the easements; but rather temporary structures or sheds without permanent foundations. Hudson wanted to be sure future purchasers of properties that have entered into an encroachment agreement be made aware of the agreement. Nafstad replied the agreement would be recorded on the property and Brixius added a mortgage company would be aware of the recorded document. Nafstad explained that eventually any utility or drainage Swale will need to be worked or replaced which needs to be considered when reviewing whether to allow something to be placed in a rear yard easement. It is also difficult to determine what properties should be able to enter into an agreement and where to draw the line. He presented a diagram that showed this type of trickle-down effect where one neighbor is allowed the temporary structure in their easement and another is not. City Council Meeting Minutes Page 3 Regular Meeting of May 15, 2017 Cocking inquired if all sheds need a building permit. Nafstad replied that anything under 120 square feet does not, but a shed over 120 square feet does and a shed over 150 square feet requires a conditional use permit. Vetsch inquired, if a shed in an easement needed to be removed by the city or private utility, how would the city be reimbursed. Nafstad replied that there would need to be language in the encroachment agreement addressing that specifically. Council directed Nafstad to work with the residents and consider the encroachment requests on a case-by-case basis. Nafstad noted that if staff felt an encroachment request was reasonable, the request and draft agreement would be presented to the Council for approval. D. Fire —None E. Finance — None F. City Clerk — None G. Building —None H. Legal —None I. Administration 1). Crop Lease Agreement Nafstad reported that 17 acres north of the wastewater treatment facility has been used by the Beaudry family for hay/alfalfa for several years. He informed Council that since the land was not tilled or used with row crops, taxes were not payable for the parcel. This year Brian Beaudry and family have requested to plant a row crop which would require taxes to be paid on the parcel. The crop lease agreement would require Beaudry to pay those taxes. Nafstad reported that Public Works does not need to maintain and mow the parcel, so it works well for the City. Hudson stated the Beaudry's are not only providing the City a service, they are paying to provide that service. Cocking mentioned the new 50 foot buffer requirement that is now law and who would have to put that buffer in. Nafstad replied the City can work with the Beaudry's on the buffer. Motioned by Cocking, seconded by Hudson, to approve crop lease agreement between the City of Albertville and Brian Beaudry. Ayes: Hendrickson, Cocking, Hudson, Olson, and Vetsch. Nays: None. Absent: None. MOTION DECLARED CARRIED. 2). City Administrator's Update Nafstad reported they had three interviews for the FYCC Coordinator position. Nafstad reminded Council of the social hour planned for June 9 during Albertville Friendly City Days. Invites will be sent this week. Sunday liquor sales will go into effect on July 2, 2017 and staff is seeking direction from Council if an ordinance matching the new state regulations should be drafted. Cocking would like to see the City's ordinance match the new state language. Staff will bring an ordinance to the next Council meeting. City Council Meeting Minutes Page 4 Regular Meeting of May 15, 2017 Nafstad reported the new pads for the Main Avenue NE railroad tracks will be placed on May 22 and 23 and Main will be opened the week of June 5. Nafstad invited the Council to the I-94 West Chamber's First Responders Luncheon on Tuesday, May 23 at 11:30 a.m. Nafstad also reported that there may be some changes coming to WCAT due to ongoing issues with the Trailblazer Board; however, he stated that transportation numbers in Albertville were good. Sergeant Ben Schaap was present at the meeting. He introduced himself as the new sergeant for the Albertville area, replacing Sergeant Josh Hinton. He will oversee District 3 which includes Albertville, St. Michael and Buffalo Township. He works primarily the evening shift. He reported they will have at least 3 patrol cars to visit the parks during Friday's Explore Your Parks Night. 9.
