2001-08-27 JPWB Minutes JOINT POWERS WATER BOARD MINUTES Regular Meeting of August 27, 2001 7:00 PM JPWT Plant Board Room Present Olson, Kessler, PaullIn, Kottke, Vetsch, Hagerty The meetmg was called to order at 7 00 PM Kessler added dIScussIon on changeover of meters and pnvate wells to the agenda Braunwarth added corrected claIm lIst MOTION BY KESSLER, SECONDED BY KOTTKE TO APPROVE CHANGED AGENDA MOTION CARRIED UNANIMOUSLY No one present for the CItizen Forum MOTION BY PAULLIN, SECONDED BY HAGERTY TO APPROVE MINUTES MOTION CARRIED UNANIMOUSLY MOTION BY KOTTKE, SECONDED BY PAULLIN TO APPROVE THE CONSENT AGENDA MOTION CARRIED UNANIMOUSLY Larry L Page was present to request that the penalty for spnnkhng VIOlation be rescmded, as he was laymg sod and was unaware of the emergency restnctIOns After some dIscussIOn a motIOn was made to affect the three customers presented m person and by letter MOTION BY PAULLIN, SECONDED BY VETSCH TO RECIND THE PENALTY FOR WINTER, GOEPFERT, AND PAGE WHEN PROOF OF WHEN SOD WAS LAID IS RECEIVED MOTION CARRIED UNANIMOUSLY Jensen letter was revIewed It was the consensus of the Board to take no actIOn MOTION BY KESSLER, SECONDED BY HAGERTY TO APPROVE REQUEST BY CITY OF HANOVER TO TEMPORARILY STORE THEIR PORTABLE GENERATOR UNTIL THEIR NEW FACILITY IS READY MOTION CARRIED UNANIMOUSLY Greg Stonehouse, standmg m for Catltn, stated that he spoke With MunsterteIger and they agreed to a couple of hne Item changes to be made The first was a spellIng error where Thrrd Avenue should be ThIrd AddItion In Item number 10 the amount should be $7500 00 mstead of $800000 There also needs to be a QUIt ClaIm for lots 2,3, and 4 by the developer to the Board and there needs to be a QUIt ClaIm from the Board to the developer for the rest of the lots mvolved m order to get the parcel plat approved After some dIScussIon over the exchangmg of qUIt claIm deeds and assurances that none of the changes mentIOned would take place wIthout the Board's attorney overseemg them, a motIon was made MOTION BY VETSCH, SECONDED BY HAGERTY TO AUTHORIZE THE THREE MAYORS SIGNING THE AGREEMENT IF THE CHANGES AND QUIT CLAIM DEEDS ARE AUTHORIZED AND APPROVED BY THE BOARD'S ATTORNEY MOTION CARRIED UNANIMOUSLY MOTION BY HAGERTY, SECONDED BY VETSCH TO AUTHORIZE OLSON AND BRAUNW ARTH TO SIGN THE PLAT DOCUMENTS AFTER BOARD'S ATTORNEY HAS GIVEN ASSURANCE THAT THE OTHER DOCUMENTS ARE IN ORDER AND HAVE BEEN ACTED UPON BY ST MICHAEL CITY COUNCIL MOTION CARRIED UNANIMOUSL Y MOTION BY KESSLER, SECONDED BY PAULLIN TO APPROVE CBI PAY REQUEST #1 MOTION CARRIED UNANIMOUSLY Braunwarth explamed that there have been some requests from publIc for telephone numbers and addresses of Board members Braunwarth stated she had gIVen out the names of Board members and whIch CIty they were representmg and had left It up to the mdIvIdual CIty to honor or reject any further request for personal mformatIOn The consensus of the Board was that the Jomt Powers Water Board staff contmues to handle these requests as they have been Kessler asked If the meter replacmg process was underway or If any of the new meters were m yet Brownmg stated that they are now bemg mstalled by the buIlders She explamed that there was some delay due to the InItIal delIvery of new meters bemg shIpped late and not bemg programmed when they were receIved By the tIme the meter guy straIghtened some of that out we were m the busy season He IS stIll waItmg for an mstrument needed to program some of the meters Kessler stated there was a request from Coldwater Creek to dIg therr own well for spnnkhng Jomt Powers Water Board has an ordmance m place that would not allow them to dIg therr own well There was some dIScussIon as to when wells were dug at some of the other developments Brownmg and Stonehouse both stated that they dId not know of any other CIties where they would allow a new well to be dug after CIty water IS avaIlable The matter was tabled WIth further dIScussIon after mdIvIdual CIties get the OpInIOn oftherr CouncIl, BrownIng presents WIth a report showmg revenues from spnnklmg accounts, and any thoughts from the Board's attorney are gathered MOTION BY KESSLER, SECONDED BY HAGERTY TO APPROVE THE CHANGED LIST OF CLAIMS MOTION CARRIED UNANIMOUSLY MOTION BY PAULLIN, SECONDED BY KESSLER TO ADJOURN THE MEETING AT 7 45 P M MOTION CARRIED UNANIMOUSLY o~J: j/&a~~,~ Recordmg Secretary
