JOINT POWERS WATER BOARD MINUTES
Regular Meetmg of
January 28, 2002
7:00 PM JPWT Plant Board Room
Present Olson, Kessler, Paullm, Kottke, Hagerty, Vetsch
The meetmg was called to order at 7 00 PM
Appomtment of ChaIrperson, VIce ChaIrperson, and Treasurer was added under New Busmess
JIm Mahler arrIved and was added to the CItizen Forum MOTION BY KOTTKE, SECONDED
BY HAGERTY TO ADOPT AGENDA AS CHANGED MOTION CARRIED
UNANIMOUSLY
Mr Mahler explamed how hIS mother had splIt her property, there was an assessment that wasn't
paId, and a hen was put on the property WIthout any notification The day before hIS closmg hIS
banker called and told hIm he owed $10,000 00 more than he thought His mam concern was
that he felt there should have been some notification that there had been a hen put on the
property He wants to be sure this doesn't happen to someone else He was able to contact all the
other buyers m this spht as they were relatives, but someone else may not have It that easy Mr
Mahler stated It was qUIte a shock that he had to come up WIth that amount of money by the next
day Kessler asked If they were all filed now Browmng answered that the last batch was done
tomght The County had requested that we do them m batches as there were so many They
should now all appear m any title search WIth the County Mrs Mahler asked Ifthere couldn't be
notificatIOn to each of the property owners Kessler asked If that was a procedure the County dId
when they put hens on or not Browmng dIdn't thInk so Her understandmg was that the PublIc
Heanng Process and the Objection Hearmgs served that purpose, as those charges all get
affirmed m that process and then It'S just a matter of recordmg them WIth the County Vetsch
asked Ifthese charges wouldn't show on the property tax statements from the County They wIll
all show now on the 2002 property statements There was some dISCUSSIon regardmg the amount
paId by Mr Mahler for the entrre EDA charge, not just hIS portIon of the spht It was determmed
that It was clear that the entrre charge was to be paId when It was splIt Vetsch questIOned
whether another property had paId m full Browmng stated that that was still bemg worked on
by the attorneys as It had taken place prevIously Paulhn questIOned whether thIS rule was
conSIstent for everyone Browmng stated that It was and that was the reason everythmg was now
certIfied to the county, so It wIll turn up m any title search The Board then thanked Mr Mahler
for hIS mput
MOTION BY KESSLER, SECONDED BY PAULLIN, TO APPROVE THE MINUTES OF
THE DECEMBER 26, 2001, REGULAR BOARD MEETING AS PRESENTED MOTION
CARRIED UNANIMOUSLY
MOTION BY HAGERTY, SECONDED BY KOTTKE, TO APPROVE THE CONSENT
AGENDA AS PRESENTED MOTION CARRIED UNANIMOUSLY

CHAIRPERSON KESSLER, PAULLIN, KOTTKE, HAGERTY, AND VETSCH VOTED
AYE OLSON ABSTAINED FROM VOTING MOTION PASSED
MOTION BY PAULLIN, SECONDED BY HAGERTY, TO APPOINT WAYNE KESSLER
AS VICE CHAIRPERSON MOTION CARRIED UNANIMOUSLY
MOTION BY KESSLER, SECONDED BY HAGERTY, TO APPOINT JOYCE PAULLIN AS
TREASURER MOTION CARRIED UNANIMOUSLY
CatlIn respectfully requests approval of new rates Howard R Green has been operatmg under
the ongmal rates of 1997 that were approved the begmnmg of 1998 Old, new, and standard
rates were revIewed and dIscussed Olson requested that an mdustry standard be presented along
wIth any future mcrease requests MOTION BY HAGERTY, SECONDED BY KOTTKE, TO
APPROVE THE RATES AS REQUESTED MOTION CARRIED UNANIMOUSLY
CatlIn states that plans and specifications for the watermam are completed Catlm requests
permISSIon to advertIse for bIds to connect the watermam to the tower and the raw watermam to
the treatment plant ThIS Job IS bemg coordmated WIth Leuer/MunsterteIger to put water through
theIr development by the eXIstmg tower so the bId date Isn't exact, but probably early March
MOTION BY PAULLIN, SECONDED BY KESSLER, TO APPROVE ADVERTISING FOR
BIDS MOTION CARRIED UNANIMOUSLY
MOTION BY PAULLIN, SECONDED BY HAGERTY, TO APPROVE THE LIST OF
CLAIMS MOTION CARRIED UNANIMOUSLY
Browmng asked for clarIfication that the Board was leamng toward allowmg prIvate wells wIth
the stipulation that It be a planned umt development or a homeowners assocIation, ect Hagerty
and Kessler brought up the fact that the CIty of St MIchaelIs m favor of allowmg It, but would
need a polIcy m place for Jomt Powers Water Board before movmg forward Browmng wIll
have a polIcy together for the lfflgatIon wells for the next meetmg It was deCIded that thIS Issue
warranted further dIScussIon and the Board wIll not rush to a decIsIOn, but wIll look mto all
aspects before adoptmg any polIcy
