2003-09-22 JPWB Minutes JOINT POWERS WATER BOARD MINUTES Regular Meeting of September 22, 2003 7:00 PM JPWT Plant Board Room Present PaullIn, Kessler, Peterson, Kottke, Fay, Drew Scherber - Alternate Absent Hagerty The meetmg was called to order at 7 00 PM No one present for the CItIzen forum MOTION BY KESSLER, SECONDED BY FAY TO APPROVE THE MINUTES OF THE DECEMBER, 2002 REGULAR MEETING MOTION CARRIED UNANIMOUSLY MOTION BY PETERSON, SECONDED BY KOTTKE, TO APPROVE THE CONSENT AGENDA AS PRESENTED MOTION CARRIED UNANIMOUSLY Browmng stated that Steve Bot, CIty of St Michael Engmeer, suggested that the boards that have been placed around the CItIes be changed to read when the restnctIOns wIll end Peterson saId he'd lIke the boards removed Brownmg added that she too thought It would be unproductIve to change the boards Peterson stated that AlbertvIlle has an ordmance to remove them after 30 days and Scherber stated that St MIchael has a 90 days ordmance, but It doesn't apply to publIc use Peterson dIdn't know If theIr ordmance had that exception or not Kessler asked Ifusage of down enough to lIft the restnctlons and Browmng stated that It was Browmng commented on the fact that we've tned the restnctlons many dIfferent ways and there's always someone who IS unhappy WIth them She states that she'll do more research and try to come up WIth somethmg that IS SImpler and more effectIve, ahead of time, for next year Kessler asked how many fines were Issued Browmng/Braunwarth dIdn't know exact numbers, but saId that many warnIng letters had been sent out Braunwarth stated that many of the VIOlations were turned mto warmng letters nght after the last meetmg She also stated that a few calls were receIved from reSIdents who stated that they wouldn't bother callmg and reportmg anyone agam because we don't seem to be domg anythmg to enforce the rules It was the consensus of the Board to leave the current restnctIons m place untIl September 30th, when all restnctIOns would be lIfted The boards placed around town wIll be removed Drew Scherber was concerned about he spnnklIng ban on new sod, explaInIng that he'd laId sod at 9 a m and found that he couldn't water It untIl 10 p m He states that sod wIll dry out qUIckly, espeCIally If temperatures are high He also stated that most CItIes have a reqUIrement that you must have your sod laId Within 6 months of your move In day and SInce he moved In In January and he waIted, he was now at the very end of the tIme requIrement Scherber also wondered how a person WIth new sod and WIthout a spnnkler system was supposed to water JOINT POWERS WATER BOARD MINUTES Regular Meeting of September 22, 2003 7:00 PM JPWT Plant Board Room between the hours of lOp m and lOa m Browmng stated that It had not come up as a huge Issue Scherber felt the reason for that was that most people "Just water" Peterson commented that he thought you could water sod at any time dunng the first 60 days Brownmg stated that If anyone would have saId somethmg about It earher she would have brought It up She also stated that she would try to come up wIth some better alternatives over the wmter Browmng presented the 2004 Proposed Budget & Agreement Renewal She explamed that nght now we're at the end ofthe last renewal, wrnch was for 3 years She explamed that although trns agreement IS for 5 years, It'S an agreement, not a contract that The Board IS tied to She went on to state that under the term section, there's an "out" m the case that The Board IS unhappy WIth US Filter and It can't seem to be resolved MOTION BY SCHERBER, SECONDED BY PETERSON, TO APPOINT HAGERTY MEET WITH BROWNING AND REVIEW THE PROPOSAL MOTION CARRIED UNANIMOUSLY MOTION BY PETERSON, SECONDED BY FAY TO ADOPT THE BUDGET AS PRESENTED MOTION CARRIED UNANIMOUSLY Catlm recommended payment of pay request #4 to J R Ferche, m the amount of $72,798 13 MOTION BY PETERSON, SECONDED BY KESSLER, TO APPROVE THE RECOMMENDED PAYMENT TO J R FERCHE MOTION CARRIED UNANIMOUSLY Catlm recommended payment of pay request #4 and pay request #5 to Traut Wells, m the amount of$11,221 33 Tills amount reflects a $2,000 00 retamage to ensure the well IS properly dlsmfected pnor to final payment MOTION BY KESSLER, SECONDED BY KOTTKE, TO APPROVE THE RECOMMENDED PAYMENT TO TRAUT WELLS MOTION CARRIED UNANIMOUSLY MOTION BY KOTTKE, SECONDED BY KESSLER TO ADJOURN THE MEETING AT 7 40 P M MOTION CARRIED UNANIMOUSLY Recordmg Secretary
